    When foreigners are injured or killed in offshore oil operations in foreign jurisdictional waters, US laws do not always apply as they would if the plaintiffs are American or resident aliens. The courts must first consider whether the Jones Act, Death on the High Seas Act, general maritime law, or a combination of laws applies and whether the court should assume jurisdiction or use the doctrine of forum non conveniens. Cases involving foreign offshore workers are used to illustrate the factors involved in each application and to consider the foreign-policy implication when foreign nationals assume that American laws and morality accompany multinational business. Congress has yet to resolve the issues, although a bill was proposed in 1980. 75 references. (DCK)

    In a world with water resources severely impacted bytechnology, science must actively contribute to water law. To this end,this paper is an earth scientist s attempt to comprehend essentialelements of water law, and to examine their connections to science.Science and law share a common logical framework of starting with apriori prescribed tenets, and drawing consistent inferences. In science,observationally established physical laws constitute the tenets, while inlaw, they stem from social values. The foundations of modern water law inEurope and the New World were formulated nearly two thousand years ago byRoman jurists who were inspired by Greek philosophy of reason.Recognizing that vital natural elements such as water, air, and the seawere governed by immutable natural laws, they reasoned that theseelements belonged to all humans, and therefore cannot be owned as privateproperty. Legally, such public property was to be governed by jusgentium, the law of all people or the law of all nations. In contrast,jus civile or civil law governed private property. Remarkably, jusgentium continues to be relevant in our contemporary society in whichscience plays a pivotal role in exploiting vital resources common to all.This paper examines the historical roots of modern water law, followstheir evolution through the centuries, and examines how the spirit ofscience inherent in jus gentium is profoundly influencing evolving waterand environmental laws in Europe, the United States and elsewhere. In atechnological world, scientific knowledge has to lie at the core of waterlaw. Yet, science cannot formulate law. It is hoped that a philosophicalunderstanding of the relationships between science and law willcontribute to their constructively coming together in the service ofsociety.

    We analyze the temperature relaxation phenomena of systems in contact with a thermal reservoir that undergoes a non-Markovian diffusion process. From a generalized Langevin equation, we show that the temperature is governed by a law of cooling of the Newton’s law type in which the relaxation time depends on the velocity autocorrelation and is then characterized by the memory function. The analysis of the temperature decay reveals the existence of an anomalous cooling in which the temperature may oscillate. Despite this anomalous behavior, we show that the variation of entropy remains always positive in accordance with the second law of thermodynamics.

    This report provides background information to the report Energy Company Competitiveness: Little to Do With Subsidies (DOE 1994). The main body of this publication consists of data uncovered during the course of research on this DOE report. This data pertains to major government energy policies in each country studied. This report also provides a summary of the DOE report. In October 1993, the Office of Energy Intelligence, US Department of Energy (formerly the Office of Foreign Intelligence), requested that Pacific Northwest Laboratory prepare a report addressing policies and actions used by foreign governments to enhance the competitiveness of their energy firms. Pacific Northwest Laboratory prepared the report Energy Company Competitiveness Little to Do With Subsidies (DOE 1994), which provided the analysis requested by DOE. An appendix was also prepared, which provided extensive background documentation to the analysis. Because of the length of the appendix, Pacific Northwest Laboratory decided to publish this information separately, as contained in this report.

    The hearing was called regarding the responsibilities of the state and Federal government in administering the Federal Surface Mining Control and Reclamation Act of 1977. With mining taking place in 27 states under a variety of conditions and practices, the Act encourages the states to assume primacy responsibility for regulating coal mining. Once a state's plan is approved, the Federal role becomes one of oversight. This hearing examines Pennsylvania's programs and what happens when there is a disagreement between state and Federal authorities.     The US has a non-proliferation policy to receive foreign and domestic research reactor returns of spent fuel materials of US origin. These spent fuel materials are returned to the Department of Energy (DOE) and placed in storage in the L-area spent fuel basin at the Savannah River Site (SRS). The foreign research reactor returns fall subject to the 123 agreements for peaceful cooperation. These “123 agreements” are named after section 123 of the Atomic Energy Act of 1954 and govern the conditions of nuclear cooperation with foreign partners. The SRS management of these foreign obligations while planning material disposition paths can be a challenge.

    The Global Threat Reduction Initiative's (GTRI) Off-Site Source Recovery Project (OSRP), which is administered by the Los Alamos National Laboratory (LANL), removes excess, unwanted, abandoned, or orphan radioactive sealed sources that pose a potential threat to national security, public health, and safety. In total, GTRI/OSRP has been able to recover more than 25,000 excess and unwanted sealed sources from over 825 sites. In addition to transuranic sources, the GTRI/OSRP mission now includes recovery of beta/gamma emitting sources, which are of concern to both the U.S. government and the International Atomic Energy Agency (IAEA). This paper provides a synopsis of cooperative efforts in foreign countries to remove excess and unwanted sealed sources by discussing three topical areas: (1) The Regional Partnership with the International Atomic Energy Agency; (2) Challenges in repatriating sealed sources; and (3) Options for repatriating sealed sources.

    The current international energy trade governance system is fragmented and multi-layered. Streamlining it for greater legal cohesiveness and international political and economic cooperation would promote global energy security. The current article explores three levels of energy trade governance: multilateral, regional and bilateral. Most energy-rich countries are part of the multilateral trading system, which is institutionalized by the World Trade Organization (WTO). The article analyzes the multilateral energy trade governance system by focusing on the WTO and energy transportation issues. Regionally, the article focuses on five major regional agreements and their energy-related aspects and examines the various causes that explain the proliferation of regional trade agreements, their compatibility with WTO law, and then provides several examples of regional energy trade governance throughout the world. When it comes to bilateral energy trade governance, this article only addresses the European Union’s (EU) bilateral energy trade relations. The article explores ways in which gaps could be filled and overlaps eliminated whilst remaining true to the high-level normative framework, concentrating on those measures that would enhance EU energy security.

In various fields a conservation law requires that a set of fluctuating variables be non-negative and (if appropriately normalized) sum to one. As a result, any stochastic differential equation model to be realizable must not produce events outside of the allowed sample space. We develop a set of constraints on the drift and diffusion terms of such stochastic models to ensure that both the non-negativity and the unit-sum conservation law constraint are satisfied as the variables evolve in time. We investigate the consequences of the developed constraints on the Fokker-Planck equation, the associated system of stochastic differential equations, and the evolution equations of the first four moments of the probability density function. We show that random variables, satisfying a conservation law constraint, represented by stochastic diffusion processes, must have diffusion terms that are coupled and nonlinear. The set of constraints developed enables the development of statistical representations of fluctuating variables satisfying a conservation law. We exemplify the results with the bivariate beta process and the multivariate Wright-Fisher, Dirichlet, and Lochner’s generalized Dirichlet processes.

    Some US renewable energy industries are now looking abroad, especially to the rapidly developing Asia-Pacific region, in order to increase sales and expand markets. The developing world appears in principle to be an important market for renewable energy technologies. These international markets have proven extremely difficult to penetrate, and the US competitive position is threatened by strong, well-organized, government-supported competition from Japan and Western Europe. For example, US photovoltaic manufacturers held 80% of the world PV market in 1980; today their market share is down to 35%. Less developed countries (LDCs) present a potentially significant but highly elusive market for renewable energy technologies. This market may develop for three major reasons; the shortage of electricity supply and the high cost of grid extension to rural areas, the high cost of oil imports and the scarcity of light oil products, and the gradual replacement of traditional fuels with modern ones. The focus of this report is on the policies and attitudes of national and regional governments in India and Pakistan towards renewable energy technology and how these policies and attitudes affect the potential for penetration of these markets by US industry. We have attempted to provide some useful insight into the actual market environment in India and Pakistan rather than just report on official laws, regulations, and policies. The report also examines the economics of technologies in comparison with more traditional sources of energy. It concentrates primarily on technologies, such as photovoltaics and wind electric systems, that would benefit from foreign participation, but also identifies potential market opportunities for advanced solar desalination and other renewable energy technologies. 31 refs.

    The pollution prevention program operated by the Health Department of Boulder County is called Business Partners for a Clean Environment (Business Partners). It is a cooperative effort among local businesses, the City of Boulder, Boulder County, and the Boulder Chamber of Commerce. This nonregulatory, incentive-based program provides industry with pollution prevention information and technical assistance necessary to reduce and/or eliminate environmental waste. This paper provides an overview of the program development, creation of partnerships and trust, and some of the results from implementation of the program. Following the first 18 months of the program, 35 businesses were recognized as Business Partners. The Business Partners program has also received an achievement award from the National Association of Counties for promoting {open_quotes}responsible, responsive, and effective government{close_quotes} and two governor`s awards from the State of Colorado.     As endovascular therapies increase in frequency, the incidence of lost or embolized foreign bodies is increasing. The presence of an intravascular foreign body (IFB) is well recognized to have the potential to cause serious complications. IFB can embolize and impact critical sites such as the heart, with subsequent significant morbidity or mortality. Intravascular foreign bodies most commonly result from embolized central line fragments, but they can originate from many sources, both iatrogenic and noniatrogenic. The percutaneous approach in removing an IFB is widely perceived as the best way to retrieve endovascular foreign bodies. This minimally invasive approach has a high success rate with a low associated morbidity, and it avoids the complications related to open surgical approaches. We examined the characteristics, causes, and incidence of endovascular embolizations and reviewed the various described techniques that have been used to facilitate subsequent explantation of such materials.

    The Office of National Security Policy has produced this Directory of Financing Sources for Foreign Energy Projects. The Directory reviews programs that offer financing from US government agencies, multilateral organizations, public, private, and quasi-private investment funds, and local commercial and state development banks. The main US government agencies covered are the US Agency for International Development (USAID), the Export-Import Bank of the US (EXIM Bank), Overseas Private Investment Corporation (OPIC), US Department of Energy, US Department of Defense, and the US Trade and Development Agency (TDA). Other US Government Sources includes market funds that have been in part capitalized using US government agency funds. Multilateral organizations include the World Bank, International Finance Corporation (IFC), Asian Development Bank (ADB), European Bank for Reconstruction and Development (EBRD), and various organizations of the United Nations. The Directory lists available public, private, and quasi-private sources of financing in key emerging markets in the Newly Independent States and other developing countries of strategic interest to the US Department of Energy. The sources of financing listed in this directory should be considered indicative rather than inclusive of all potential sources of financing. Initial focus is on the Russian Federation, Ukraine, india, China, and Pakistan. Separate self-contained sections have been developed for each of the countries to enable the user to readily access market-specific information and to support country-specific Departmental initiatives. For each country, the directory is organized to follow the project life cycle--from prefeasibility, feasibility, project finance, cofinancing, and trade finance, through to technical assistance and training. Programs on investment and export insurance are excluded.

    The Hanford Site was established in 1943 as one of the three original Manhattan Project locations involved in the development of atomic weapons. It continued as a defense production center until 1988, when its mission changed to environmental restoration and remediation. The Hanford Site is changing its business strategy and in doing so, is reinventing government. This new development has been significantly influenced by a number of external sources. These include: the change in mission, reduced security requirements, new found partnerships, fiscal budgets, the Tri-Party agreement and stakeholder involvement. Tight budgets and the high cost of cleanup require that the site develop and implement innovative cost saving approaches to its mission. Costeffective progress is necessary to help assure continued funding by Congress.

The legal guidelines are far from clear and are evolving. However, as regulated entities find themselves in an ever more competitive environment, it becomes necessary for their legal counsel to monitor closely the developments in the law concerning immunities from the antitrust laws by virtue of regulation imposed by government. The author hopes that this article will provide a useful starting point for that analysis.

    In his analysis of the oil industry-government relationship, the author examines the question of whether Big Oil is really bad and, if so, whether the government should leave it alone because it is unmanageable or regulate it for that reason. Responding to Robert Sherrill's The Oil Follies of 1970-1980 and its emphasis on conspiracy and betrayal, he focuses on the replacement of the Rule of Capture, which promoted the production of natural resources, with regulations restricting oil and gas production. He concludes that Big Government has not managed Big Oil well, but proposes an approach based on a series of workable projects instead of antitrust review. These initiatives could include efforts for horizontal and vertical divestiture, restrictions on tax divestiture, regulating cross-ownership, and a reworking of banking and tax laws.

    The US Army Corps of Engineers has retained Idaho National Laboratory (INL) to conduct a study of past INL experiences and complete a report that identifies the processes that are needed for the development of renewable energy projects on government properties. The INL has always maintained expertise in power systems and applied engineering and INL’s renewable energy experiences date back to the 1980’s when our engineers began performing US Air Force wind energy feasibility studies and development projects. Over the last 20+ years of working with Department of Defense and other government agencies to study, design, and build government renewable projects, INL has experienced the do’s and don’ts for being successful with a project. These compiled guidelines for government renewable energy projects could include wind, hydro, geothermal, solar, biomass, or a variety of hybrid systems; however, for the purpose of narrowing the focus of this report, wind projects are the main topic discussed throughout this report. It is our thought that a lot of what is discussed could be applied, possibly with some modifications, to other areas of renewable energy. It is also important to note that individual projects (regardless the type) vary to some degree depending on location, size, and need but in general these concepts and directions can be carried over to the majority of government renewable energy projects. This report focuses on the initial development that needs to occur for any project to be a successful government renewable energy project.

    It is asserted that oil companies claim to be generally receptive to gas development proposals; however, the lack of potential markets for gas, problems of foreign exchange convertibility, and lack of a legal framework often hinders their engagement. Governments, on the other hand, need to secure domestic energy supply and, if possible, gain some export earnings or royalties. An extensive discussion on the principles of pricing and fiscal regimes, potential points of disagreement is provided. A course of action is outlined from the managerial point of view to circumvent the most common pitfalls in planning and financing a gas project. Eight very detailed case studies are presented for Argentina, Egypt, Malaysia, Nigeria, Pakistan, Tanzania, Tunisia and Thailand.

    A detailed description is given of the laws and programs of the State of Nebraska governing the regulation of public energy utilities, the siting of energy generating and transmission facilities, the municipal franchising of public energy utilities, and the prescription of rates to be charged by utilities including attendant problems of cost allocations, rate base and operating expense determinations, and rate of return allowances. These laws and programs are analyzed to identify impediments which they may present to the implementation of Integrated Community Energy Systems (ICES). This report is one of fifty-one separate volumes which describe such regulatory programs at the Federal level and in each state as background to the report entitiled ''Community Energy Systems and the Law of Public Utilities--Volume One: An Overview.''     We investigate the validity of the generalized second law of thermodynamics in a universe governed by Ho?ava-Lifshitz gravity. Under the equilibrium assumption, that is in the late-time cosmological regime, we calculate separately the entropy time-variation for the matter fluid and, using the modified entropy relation, that of the apparent horizon itself. We find that under detailed balance the generalized second law is generally valid for flat and closed geometry and it is conditionally valid for an open universe, while beyond detailed balance it is only conditionally valid for all curvatures. Furthermore, we also follow the effective approach showing that it can lead to misleading results. The non-complete validity of the generalized second law could either provide a suggestion for its different application, or act as an additional problematic feature of Ho?ava-Lifshitz gravity.

    Eisenhower's Atoms for Peace speech in 1953 is remembered for engaging the world, and the Soviet Union in particular, in a dialogue about arms control and the formulation of a nuclear regime in which national and international security concerns growing from this unprecedented emerging and frightening new weapons capability would be addressed while tapping the civilian promise of nuclear applications for the good of mankind. Out of it came a series of initiatives, leading fifteen years later to the NPT, intended to allow the growth and spread of the beneficial uses of nuclear know-how while constraining the incentives and capabilities for nuclear weapons. The last 50 years has seen a gradual spread in nations with nuclear weapons, other nations with nuclear knowledge and capabilities, and still others with nuclear weapon intentions. Still most nations of the world have forgone weapon development, most have signed and abided by the NPT, and some that have had programs or even weapons, have turned these capabilities off. Yet despite this experience, and despite a relatively successful record up to a few years ago, there is today a clear and generally recognized crisis in nuclear governance, a crisis that affects the future of all the cross-cutting civilian/security issues we have cited. The crux of this crisis is a lack of consensus among the major powers whose support of international efforts is necessary for effective governance of nuclear activities. The lack of consensus focuses on three challenges: what to do about non-compliance, what to do about non-adherence, and what to do about the possible leakage of nuclear materials and technologies to terrorist groups. Short of regaining consensus on the priority to be given to nuclear material and technology controls, it is unlikely that any international regime to control nuclear materials and technologies, let alone oversee a growth in the nuclear power sector, will be successful in the tough cases where it needs to

    The State and Local Government Partnership project has built relationships between the Department of Energy (DOE), regional states, and municipalities. CCAT implemented this project using a structure that included leadership by the DOE. Outreach was undertaken through collaborative meetings, workshops, and briefings; the development of technical models and local energy plans; support for state stakeholder groups; and implementation of strategies to facilitate the deployment of hydrogen and fuel cell technologies. The final guidance documents provided to stakeholders consisted of individual strategic state “Roadmaps” to serve as development plans. These “Roadmaps” confirm economic impacts, identify deployment targets, and compare policies and incentives for facility development in each of the regional states. The partnerships developed through this project have improved the exchange of knowledge between state and local government stakeholders and is expected to increase the deployment of hydrogen and fuel cell technologies in early market applications, consistent with the DOE’s market transformation efforts. Technically accurate and objective information was, and continues to be, provided to improve public and stakeholder perceptions regarding the use of hydrogen and fuel cell technologies. Based on the “Roadmaps” and studies conducted for this project, there is the potential to generate approximately 10.75 million megawatt hours (MWh) of electricity annually from hydrogen and fuel cell technologies at potential host sites in the Northeast regional states, through the development of 1,364 to 1,818 megawatts (MW) of fuel cell electric generation capacity. Currently, the region has approximately 1,180 companies that are part of the growing hydrogen and fuel cell industry supply chain in the region. These companies are estimated to have over $1 billion in annual revenue and investment, contribute more than $51 million in annual state and local tax revenue

    On their seaward migration, juvenile salmonids commonly pass hydroelectric dams. Fish passing by the turbine blade may experience rapid decompression, the severity of which can be highly variable and may result in a number of barotraumas. The mechanisms of these injuries can be due to expansion of existing bubbles or gases coming out of solution; governed by Boyle’s Law and Henry’s Law, respectively. This paper combines re-analysis of published data with new experiments to gain a better understanding of the mechanisms of injury and mortality for fish experiencing rapid decompression associated with hydroturbine passage. From these data it appears that the majority of decompression related injuries are due to the expansion of existing bubbles in the fish, particularly the expansion and rupture of the swim bladder. This information is particularly useful for fisheries managers and turbine manufacturers, demonstrating that reducing the rate of swim bladder ruptures by reducing the frequency of occurrence and severity of rapid decompression during hydroturbine passage could reduce the rates of injury and mortality for hydroturbine passed juvenile salmonids.

    The rapid development of natural gas and condensate reserves in the Middle East results from a simple motivation: the desire of governments to earn revenues. For the past decade, Middle East governments have run budget deficits, which they funded by drawing down foreign assets and issuing debt. Now in the process of structural economic reform, they have begun to use an under-utilized resource--natural gas, of which Middle East governments own about one third of the world`s reserves. Governments receive revenues from several sources in natural gas developments, which makes the projects very attractive. Revenue comes from the sale of the natural gas in the domestic market and, if exported, the international market; the sale of associated condensates; the additional exports of crude oil or refined products if natural gas is substituted for refined products in domestic markets; the increased sale of crude oil if natural gas is injected into reservoirs to maintain pressure; and the sale of petrochemicals where natural gas is used as feedstock. Large projects under way in the Middle East highlight the consequences of multiple revenue sources and interlinked costs of natural gas and condensate development. Other countries in the region are undertaking similar projects, so examples cited represent only a portion of what is occurring. The paper describes Abu Dhabi, Qatar, Saudi Arabia, and Iran.
