    The Food and Drug Administration (FDA) is issuing a final rule amending the final monograph (FM) for over-the-counter (OTC) dandruff, seborrheic dermatitis, and psoriasis drug products to include the combination of 1.8 percent coal tar solution and 1.5 percent menthol in a shampoo drug product to control dandruff. FDA did not receive any comments or data in response to its previously proposed rule to include this combination. This final rule is part of FDA's ongoing review of OTC drug products.

    Loan Guarantees for Projects that Employ Innovative Technologies: On October 23, 2007, the Department of Energy published a final rule establishing regulations for the loan guarantee program authorized by Section 1703 of Title XVII of the Energy Policy Act of 2005. Section 1703 of Title XVII authorizes the Secretary of Energy to make loan guarantees for projects that “avoid, reduce, or sequester air pollutants or anthropogenic emissions of greenhouse gases; and employ new or significantly improved technologies as compared to commercial technologies in service in the United States at the time the guarantee is issued.”

    This is the Final Safety Analysis Report (FSAR) Amendment 82 for incorporation into the Fast Flux Test Facility (FFTF) FSAR set assigned to you. This page change amendment incorporates changes previously approved by the U.S. Department of Energy, Richland Operations Office. This amendment provides updates to the FSAR to facilitate FFTF shutdown and deactivation. Among the changes are the following: Chapter 11 is updated to describe upgrades to the Solid Waste Cask. Additional fuel handling accidents are added to Chapter 15. Appendix G is revised to clearly identify systems and their safety functions. Appendix H is revised to remove the discussion of material that has been removed from the Interim Storage Area. Appendix I is revised to provide a general description of liquid metal removal from FFTF. Other changes include minor technical updates from the FSAR annual review and editorial and procedure references.

    The Department has issued a Final Rule revising the existing contractor regulations covering contractor legal management requirements at 10 C.F.R. 719 (Federal Register May 3, 2013; http://www.gpo.gov/fdsys/pkg/FR-2013-05-03/pdf/2013-10485.pdf). One unusual aspect of the Final Rule is that it requires Contracting Officers to attempt to execute bilateral modifications to existing affected contracts to apply the Final Rule's revisions to those contracts. We will issue an Acquisition Letter shortly with suggested contract modification language. (The Final Rule's revisions "… are designed to clarify and streamline existing requirements, improve efficiency of contractor legal management, and facilitate oversight over the expenditure of taxpayer dollars." The contract modifications will state the revisions will only apply to costs incurred from date the bilateral modifications are executed forward. The revisions are administrative in nature. Regarding costs contractors have not yet incurred, the revisions could have been communicated to contractors without using a Final Rule to incorporate them into current contracts. Consequently, the modifications do not require equitable adjustments.)

    Since the last reactor operation of FFTF in March of 1992, the FFTF has either been in a programmatic status of Standby or Shutdown. The facility hazards have decreased markedly. Rather than making extensive Final Safety Analysis Report (FSAR) changes, Appendix G was prepared to reflect the design and operation during Standby or Shutdown. Appendix G describes the application of the entire FSAR for the current configuration, accounting for the natural reduction in hazards and new system configurations associated with Standby/Shutdown. This Final Safety Analysis Report (FSAR) is submitted per the requirements of Paragraph 014, Energy Research and Development Administration (ERDA) Manual Chapter 0540, ''Safety of ERDA-Owned Reactors.'' This FSAR and its supporting documentation provide a complete description and safety evaluation of the site, plant design, normal and emergency operations, potential accidents and predicted consequences of such accidents, and the means that will prevent such accidents and/or reduce their consequences to an acceptable level.

    Cooperative Power`s Coal Creek Station (CCS) the North Dakota Industrial Commission, and the US Department of Energy provided funds for a research project at the Energy and Environmental Research Center. The goals of the project were (1) to determine conditions for the conversion of scrubber sludge to gypsum simulating an ex situ process on the laboratory scale; (2) to determine the feasibility of scaleup of the process; (3) if warranted, to demonstrate the ex situ process for conversion on the pilot scale; and (4) to evaluate the quality and handling characteristics of the gypsum produced on the pilot scale. The process development and demonstration phases of this project were successfully completed focusing on ex situ oxidation using air at low pH. The potential to produce a high-purity gypsum on a commercial scale is excellent. The results of this project demonstrate the feasibility of converting CCS scrubber sludge to gypsum exhibiting characteristics appropriate for agricultural application as soil amendment as well as for use in gypsum wallboard production. Gypsum of a purity of over 98% containing acceptable levels of potentially problematic constituents was produced in the laboratory and in a pilot-scale demonstration.

    Hungry Horse and Libby dams have profoundly affected the aquatic ecosystems in two major tributaries of the Columbia River by altering habitat and water quality, and by imposing barriers to fish migration. In 1980, the U.S. Congress passed the Pacific Northwest Electric Power Planning and Conservation Act, designed in part to balance hydropower development with other natural resources in the Columbia System. The Act formed the Northwest Power Planning Council (Council) who developed a program to protect, mitigate and enhance fish and wildlife on the Columbia River and its tributaries. Pursuant to the Council`s Fish and Wildlife Program for the Columbia River System (1987), we constructed computer models to simulate the trophic dynamics of the reservoir biota as related to dam operation. Results were used to develop strategies to minimize impacts and enhance the reservoir and riverine fisheries, following program measures 903(a)(1-4) and 903(b)(1-5). Two FORTRAN simulation models were developed for Hungry Horse and Libby reservoirs located in northwestern Montana. The models were designed to generate accurate, short-term predictions specific to two reservoirs and are not directly applicable to other waters. The modeling strategy, however, is portable to other reservoir systems where sufficient data are available. Reservoir operation guidelines were developed to balance fisheries concerns in the headwaters with anadromous species recovery actions in the lower Columbia (Biological Rule Curves). These BRCs were then integrated with power production and flood control to reduce the economic impact of basin-wide fisheries recovery actions. These Integrated Rule Curves (IRCs) were developed simultaneously in the Columbia Basin System Operation Review (SOR), the Council`s phase IV amendment process and recovery actions associated with endangered Columbia Basin fish species.

    The Love Canal (93rd Street) site is an inactive hazardous waste site located in Niagara Falls, New York. The 19-acre 93rd Street School site, one of several operable units for the Love Canal Superfund site, is the focus of the Record of Decision (ROD). The fill material is reported to contain fly ash and BHC (a pesticide) waste. The ROD amends the 1988 ROD, and addresses final remediation of onsite contaminated soil through excavation and offsite disposal. The primary contaminants of concern affecting the soil are VOCs including toluene and xylenes; other organics including PAHs and pesticides; and metals including arsenic, chromium, and lead.

    This is a draft final technical report on Task 1 of a contract to synthesize 6-Methyl-9-propyldibenzothiophene-4-ol, as amended to 9- isopropyl-6-methyldibenzothiophene-4-ol. This report is a compilation of data presented in earlier reports. The first annual report dealt with an attempted synthesis of 4-methoxy-6-methyl-9- propyldibenzothiophene (the original target compound), the successful synthesis and delivery of 200 grams of the sulfide 1,4-diethyl-2- [(2{prime}-methoxyphenyl)-thio]benzene, and initial work on a new synthesis route for the preparation of the new target compound 9- isopropyl-6-methyldibenzothiophene-4-ol. The change to the new target compound and the new synthesis route became necessary when it was learned that the sulfide mixture could not be cyclized to the substituted dibenzothiophene mixture. The second annual report described the successful preparation of 45 g of the new target compound using the new synthesis route. Subsequently funds were provided to synthesize an additional 45 g of the new target using the same reaction scheme. This task was recently completed.

    This report presents the schedules and methods required to comply with the newly promulgated Underground Storage Tank (UST) Regulations Title 40 Code of Federal Regulations (CFR) 280 and 281. These rules were promulgated by the US Environmental Protection Agency (EPA) on September 23, 1988, and became effective December 22, 1988. These regulations are required by Subtitle I of the Resource Conservation and Recovery Act of 1976. Their purpose is to protect the groundwater supplies of the United States in the following ways: Closing old tanks; detecting and remediating tank leaks and spills; establishing stringent standards for new tanks; and upgrade of existing tanks to new-tank standards. 3 refs., 5 tabs.

    Preparation of the final Decommissioning Rule by the Nuclear Regulatory Commission (NRC) staff has been assisted by Pacific Northwest Laboratory (PNL) staff familiar with decommissioning matters. These efforts have included updating previous cost estimates developed during the series of studies of conceptually decommissioning reference licensed nuclear facilities for inclusion in the Final Generic Environmental Impact Statement (FGEIS) on decommissioning; documenting the cost updates; evaluating the cost and dose impacts of post-TMI-2 backfits on decommissioning; developing a revised scaling formula for estimating decommissioning costs for reactor plants different in size from the reference boiling water reactor (BWR) described in the earlier study; and defining a formula for adjusting current cost estimates to reflect future escalation in labor, materials, and waste disposal costs. This report presents the results of recent PNL studies to provide supporting information in three areas concerning decommissioning of the reference BWR: updating the previous cost estimates to January 1986 dollars; assessing the cost and dose impacts of post-TMI-2 backfits; and developing a scaling formula for plants different in size than the reference plant and an escalation formula for adjusting current cost estimates for future escalation.

    The 7-acre Whitehouse Waste Oil Pits site was used by Allied Petroleum Products (Allied) to dispose of acidic waste oil sludges from its oil reclamation process in Whitehouse, Duval County, Florida. A cypress swamp system and residential area are immediately adjacent to the site. The acid sludge produced in the first step and clay used to decolorize the oil were dumped into the unlined pits at the site. A 1985 ROD addressed source control as a containment remedy consisting of a slurry wall construction, soil cap, and a ground water recovery and treatment system; however, EPA has re-evaluated the 1985 ROD selection and determined that the containment remedy failed to meet the requirements of SARA. As a result, the ROD Amendment focuses on an alternative for treating Whitehouse wastes by eliminating direct contact risk associated with pit soil/sludge wastes and preventing contaminated ground water in the surficial aquifer from migrating laterally. The primary contaminants of concern that affect the soil, sediment, surface water, and ground water are VOCs, including benzene, toluene, and xylenes; organics, including PCBs and phenols; and metals, including arsenic, chromium, and lead. The amended remedial action for the site are included.

    The 11-acre Coleman-Evans Wood Preserving site is a former wood treatment facility, which was operated from 1954 to the late 1980s, in the community of Whitehouse, Duval County, Florida. Prior to 1970, wastewater from the facility was precipated and discharged to the onsite drainage ditch. The precipitated sludge was deposited into two unlined pits until 1970, when the sludge was stored in tanks. The wastewater treatment process was also enhanced in 1970 with lime precipitation and chlorination. In 1980, onsite ground water contamination was detected and activated charcoal filters were added to the treatment process to remove organics. The primary contaminant in onsite soil and ground water has been identified as pentachlorophenol (PCP). The highest areas of PCP concentration were in the vicinity of onsite chemical tanks and the unlined pit areas. In 1985, EPA conducted an emergency response, which included excavating and disposing of pit material offsite and filling excavated areas with clean fill. The Record of Decision (ROD) amends a 1986 ROD, which documented the selection of incineration for an estimated 9,000 cubic yards of contaminated soil. Since that time, additional studies during the remedial design phase indicated that there are approximately 27,000 cubic yards of contaminated soil. Based on the excessive volume of soil and the high cost of incineration, treatability studies were conducted and an alternative source control treatment was selected. The primary contaminants of concern affecting the soil, sediment, and ground water are organics including PCP and metals.

    With the issuance of the final Decommissioning Rule (July 27, 1998), owners and operators of licensed nuclear power plants are required to prepare, and submit to the US Nuclear Regulatory Commission (NRC) for review, decommissioning plans and cost estimates. The NRC staff is in need of bases documentation that will assist them in assessing the adequacy of the licensee submittals, from the viewpoint of both the planned actions, including occupational radiation exposure, and the probable costs. The purpose of this reevaluation study is to provide some of the needed bases documentation. This report contains the results of a review and reevaluation of the 1978 PNL decommissioning study of the Trojan nuclear power plant (NUREG/CR-0130), including all identifiable factors and cost assumptions which contribute significantly to the total cost of decommissioning the nuclear power plant for the DECON, SAFSTOR, and ENTOMB decommissioning alternatives. These alternatives now include an initial 5--7 year period during which time the spent fuel is stored in the spent fuel pool, prior to beginning major disassembly or extended safe storage of the plant. Included for information (but not presently part of the license termination cost) is an estimate of the cost to demolish the decontaminated and clean structures on the site and to restore the site to a ``green field`` condition. This report also includes consideration of the NRC requirement that decontamination and decommissioning activities leading to termination of the nuclear license be completed within 60 years of final reactor shutdown, consideration of packaging and disposal requirements for materials whose radionuclide concentrations exceed the limits for Class C low-level waste (i.e., Greater-Than-Class C), and reflects 1993 costs for labor, materials, transport, and disposal activities.

    Northern States Power Company, (NSP), a Minnesota investor owned utility has applied to the Office of Fossil Energy, United States Department of Energy, to amend Presidential Permit PP-63 to allow for alterations to the 500 kV transmission line and as sedated facilities currently regulated by this permit. The alterations proposed for the 500 kV line owned by NSP are part of a long term effort sponsored by NSP to upgrade the existing NSP transmission system to allow for increased exchange of electricity with the Manitoba Hydro-Electric Board. Presidential Permit PP-63 authorized NSP to construct, connect, operate and maintain a 500 kV line at the United States/Canadian border approximately seven-and-a-half miles west of Warroad in Roseau County, Minnesota. This line connects with a 500 kV line owned and operated by the Manitoba Hydro-Electric Board (MHEB), which extends from Dorsey, Manitoba, Canada to the United States/Canadian border. NSP proposes to increase the electricity transfer capability of this transmission facility by constructing a new 80-acre substation on the existing 500 kV line in Roseau County, Minnesota, and upgrading the existing substation at Forbes, Minnesota. The proposed Roseau substation would contain two 41.5 ohm series capacitor banks. In addition, static VAR compensators are to be installed at the existing Forbes Substation. Approximately 5 acres would be added to the 30-acre Forbes site to house the additional equipment. No new lines would enter or exit the facility. NSP proposes to place the new Roseau Substation in service in May 1993 and to complete the upgrading of the Forbes Substation in March 1994. The primary, initial purpose of these modifications is to enable NSP to import 400 megawatts of electric power from MHEB during the summer months to meet peak electrical demand in the Minneapolis-St. Paul area. It is expected that this power transfer would begin in 1993.

    The U.S. Environmental Protection Agency (EPA) and state air quality control agencies are in the midst of developing regulations and programs to meet the ambitious goals of the Clean Air Act Amendment (CAAA) of 1990. The CAAA--which call for stricter air quality standards, a greater number of pollutants and sources to be regulated, new operating permits, and more stringent enforcement of air quality violations--are expected to have a significant impact on virtually every facility in the country. An important deadline in the implementation of the CAAA is November 1993. That is when individual states must submit their proposed operating permit programs to the EPA, as mandated by Title 5 of the Amendments. The EPA then has one year after receiving a state program to accept or reject it. Once a state's program is accepted, all major sources of air pollution in that state have one year to apply for an operating air permit. Although the initial deadlines for business and industry are up to two years away, sufficient information is now available to take the first steps toward compliance with the new air quality regulations. Even while the details of the new rules are being hammered out, plant engineering can and should begin laying the groundwork for their own permit applications. Time and effort spent preparing now for the provisions of the CAAA will pay off in the long run.

    The Clean Air Act Amendments of 1990 established a rigorous timetable for EPA to develop and implement an unprecedented number of regulatory and policy initiatives. EPA has made great progress in meeting these mandates; however, much remains to be done if the Act`s health and environmental goals are to be achieved. EPA must issue dozens of additional regulations, guidance documents, and studies and reports over the next several years. The largest group of remaining rulemakings will be those controlling air toxics emissions. Other significant actions will include final rulemakings on emission standards for non-road engines, emissions standards for municipal and medical waste combustion, enhanced emissions monitoring, Federal operating permits, and newsource review simplification. EPA also must accelerate and expand a host of activities to ensure that the Agency and the States are implementing and enforcing the Act effectively. For example, EPA must assess hundreds of SIP revisions, as well as 120 State and local permit programs, and provide technical assistance to States and sources. Ms. Nichols will present EPA`s will present EPA`s plans for implementing these activities over the next several years. She will present a summary of the Agency`s current achievements under the 1990 amendments and EPA`s framework for completing the challenging tasks that lie ahead.

    The Risk Management Program (RMP) rule, Section 112(r) of the Clean Air Act (CAA), was signed on May 24 and finalized on June 20. RMP is one of the most comprehensive, technically based regulatory programs for preventing, detecting and responding to accidental hazardous materials releases to have been issued in recent times. Although facilities have three years to comply, EPA estimates that the rule will affect an estimated 66,000 facilities that store highly hazardous or acutely toxic materials. The 1990 CAA Amendments are designed to prevent accidental releases of highly hazardous chemicals from stationary sources. Two significant regulatory programs that have emerged from the revised CAA are the Process Safety Management (PSM) standard and RMP. PSM is designed to protect employees and regulated by the Occupational Safety and Health Administration. RMP`s purpose is to protect the public and the environment from highly hazardous chemicals. It authorizes EPA to create a list of substances (distinct from the list generated under PSM) known to cause serious adverse effects and to implement a program for accidental chemical release prevention.

    The NRC staff is in need of decommissioning bases documentation that will assist them in assessing the adequacy of the licensee submittals, from the viewpoint of both the planned actions, including occupational radiation exposure, and the probable costs. The purpose of this reevaluation study is to update the needed bases documentation. This report presents the results of a review and reevaluation of the PNL 1980 decommissioning study of the Washington Public Power Supply System`s Washington Nuclear Plant Two (WNP-2) located at Richland, Washington, including all identifiable factors and cost assumptions which contribute significantly to the total cost of decommissioning the plant for the DECON, SAFSTOR, and ENTOMB decommissioning alternatives. These alternatives now include an initial 5-7 year period during which time the spent fuel is stored in the spent fuel pool prior to beginning major disassembly or extended safe storage of the plant. Included for information (but not presently part of the license termination cost) is an estimate of the cost to demolish the decontaminated and clear structures on the site and to restore the site to a {open_quotes}green field{close_quotes} condition. This report also includes consideration of the NRC requirement that decontamination and decommissioning activities leading to termination of the nuclear license be completed within 60 years of final reactor shutdown, consideration of packaging and disposal requirements for materials whose radionuclide concentrations exceed the limits for Class C low-level waste (i.e., Greater-Than-Class C), and reflects 1993 costs for labor, materials, transport, and disposal activities. Sensitivity of the total license termination cost to the disposal costs at different low-level radioactive waste disposal sites, to different depths of contaminated concrete surface removal within the facilities, and to different transport distances is also examined.

    The Clean Air Act Amendments of 1990 represents a bold step in application of environmental regulation. By setting up a national free market in sulfur dioxide emission allowances, Congress has adopted the position that environmental protection and good economics are not necessarily in opposition. In fact, by carefully crafting legislation these two goals may work in aide of each other. Title IV is intended to achieve a significant reduction in the incidence of acid rain at minimal cost for the nation as a whole. On the other hand, states have traditionally had the greater responsibility for direct regulation of electric utility operations. A national free market in pollution is not welcomed by many state regulatory agencies. Some states are concerned about losing in-state markets for coal; others are unwilling to {open_quotes}import{close_quotes} pollution through the purchase of allowances. A number of states have reacted by passing regulations which limit utilities` choices in developing compliance plans. The Illinois Coal Act, for example, specifically requires two of the largest Illinois coal-fired power plants to install scrubbers and prohibits any plant from reducing its use of Illinois-mined coal by more than 10 percent per year. In December of 1993 the U.S. District Court for the Northern District of Illinois ruled, in the case of Alliance for Clean Coal v. Craig, that the Illinois Coal Act violates the Commerce Clause of the U.S. Constitution and permanently enjoined the Illinois Commerce Commission from enforcing it. The state appealed that decision but in January of 1995 the U.S. Court of Appeals for the Seventh Circuit upheld the District Court`s opinion. This paper will show that the argument that should be of particular interest from an economics perspective. Finally, the paper will attempt to draw conclusions regarding how state regulators may legitimately integrate the trading of emission allowances into their current regulatory schemes.

  14. The limits on combining recursive horn rules with description logics

    Horn rule languages have formed the basis for many Artificial Intelligence application languages, but are not expressive enough to model domains with a rich hierarchical structure. Description logics have been designed especially to model rich hierarchies. Several applications would significantly benefit from combining the expressive power of both formalisms. This paper focuses on combining recursive function-free Horn rules with the expressive description logic ALCNR, and shows exactly when a hybrid language with decidable inference can be obtained. First, we show that several of the core constructors of description logics lead by themselves to undecidability of inference when combined with recursive function-free Horn rules. We then show that without these constructors we obtain a maximal subset of ALCNRR that yields a decidable hybrid language. Finally, we describe a restriction on the Horn rules that guarantees decidable inference when combined with all of ALCNR, and covers many of the common usages of recursive rules.

    In a somewhat surprising move, the U.S. Department of Labor has decided not to appeal a court decision essentially dropping regulations established by the Occupational Safety and Health Administration (OSHA) for about 400 hazardous substances. The decision leaves unregulated or subject to reduced standards substances that range from carbon monoxide to perchloroethylene. The Labor Department had until March 22, 1993, to appeal the court decision. On July 8, 1992, the U.S. Court of Appeals for the 11th Circuit overturned OSHA's final Air Contaminants Standard, which was promulgated in 1989. The standard established permissible exposure limits (PELs) for 428 toxic substances. In AFL-CIO vs. OSHA, the Court ruled that OSHA failed to make a separate scientific case for evaluating health risks of each chemical. Because of the decision not to appeal, PELs for more than half of the substances regulated by OSHA now are removed from the books or revert to the voluntary industry standards adopted by OSHA in 1970 and in force prior to the 1989 final rule.

    Title III, Section 112(r) of the Clean Air Act (CAA) Amendments of 1990 requires the Environmental Protection Agency (EPA) to promulgate regulations to prevent accidental releases of regulated substances and to reduce the severity of those releases that do occur. The final EPA rule for Risk Management Programs under Section 112(r)(7) of the CAA, promulgated June 20, 1996, applies to all stationary sources with processes that contain more than a threshold quantity of any of 139 regulated substances listed under 40 CFR 68.130. All affected sources will be required to prepare a risk management plan which must be submitted to EPA and be made available to state and local governments and to the public. This paper will provide details of initiatives underway at US Department of Energy (DOE) Oak Ridge Reservation (ORR) Facilities for implementation of the Prevention of Accidental Release Rule. The ORR encompasses three DOE Facilities: the Y-12 Plant, Oak Ridge National Laboratory (ORNL), and the K-25 Site. The Y-12 Plant manufactures component parts for the national nuclear weapons program; the ORNL is responsible for research and development activities including nuclear engineering, engineering technologies, and the environmental sciences; and the K-25 Site conducts a variety of research and development activities and is the home of a mixed waste incinerator. ORR activities underway and soon to be undertaken toward implementation of the Prevention of Accidental Release Rule include: compilation of inventories of regulated substances at all processes at each of the three ORR Facilities for determination of affected processes and facilities; plans for inventory reduction to levels below threshold quantities, where necessary and feasible; determination of the overlap of processes subject to the OSHA PSM Standard and determination of parallel requirements; preparation of Risk Management Plans and Programs for affected processes and facilities including detailed requirements
