    The findings and conclusions of the analysis of the various issues involved in the federal preemption of state regulations for the DOE no standard rule on covered appliances are summarized. The covered products are: refrigerators, refrigerator-freezers, freezers, clothes dryers, kitchen ranges and ovens, water heaters (excluding heat pump water heaters), room air conditioners, central air conditioners (excluding heat pumps), and furnaces. A detailed discussion of the rationale for the positions of groups offering comment for the record is presneted. The pertinent categories of state and local regulations and programs are explained, then detailed analysis is conducted on the covered products and regulations. Issues relating to the timing of preemption of state regulations are discussed, as well as issues relating to burden of proof, contents of petitions for exemptions from preemption, criteria for evaluating petitions, and procedural and other issues.     With the realignment and closure of Federal facilities, especially Department of Defense installations, Federal agencies have been presented with a unique opportunity: the chance to create and dispose of air emission reduction credits (ERCs). This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances. This paper will discuss ERCs, why the disposal of ERCs by Federal agencies is a pressing issue, and how Federal agencies can dispose of ERCs under existing Federal property laws and regulations.

    In 2005, the Environmental Protection Agency (EPA) finalized two regulations, the Clean Air Interstate Rule (CAIR) and the Clean Air Mercury Rule CAMR, that would reduce emissions from coal-fired power plants in the United States. Both CAIR and CAMR are included in the Annual Energy Outlook 2006 reference case. The EPA has received 11 petitions for reconsideration of CAIR and has provided an opportunity for public comment on reconsidering certain aspects of CAIR. Public comments were accepted until January 13, 2006. The EPA has also received 14 petitions for reconsideration of CAMR and is willing to reconsider certain aspects of the rule. Public comments were accepted for 45 days after publication of the reconsideration notice in the Federal Register. Several states and organizations have filed lawsuits against CAMR. The ultimate decision of the courts will have a significant impact on the implementation of CAMR.

    The Risk Management Program (RMP) rule, Section 112(r) of the Clean Air Act (CAA), was signed on May 24 and finalized on June 20. RMP is one of the most comprehensive, technically based regulatory programs for preventing, detecting and responding to accidental hazardous materials releases to have been issued in recent times. Although facilities have three years to comply, EPA estimates that the rule will affect an estimated 66,000 facilities that store highly hazardous or acutely toxic materials. The 1990 CAA Amendments are designed to prevent accidental releases of highly hazardous chemicals from stationary sources. Two significant regulatory programs that have emerged from the revised CAA are the Process Safety Management (PSM) standard and RMP. PSM is designed to protect employees and regulated by the Occupational Safety and Health Administration. RMP`s purpose is to protect the public and the environment from highly hazardous chemicals. It authorizes EPA to create a list of substances (distinct from the list generated under PSM) known to cause serious adverse effects and to implement a program for accidental chemical release prevention.

This Interim Phase I report presents the findings of the impacts of proposed RCRA and related federal regulations on the utility sector fossil fuel-fired facilities. Subsequent phases involve parallel engineering studies on the industrial sector as well as economic evaluations. This paper describes analyses that assess the likelihood that TRU waste in shallow land burial can meet the 40 CFR 191 standards for a geologic repository. The simulated probability of the cumulative release exceeding 1 and 10 times the 40 CFR 191.13 containment requirements is estimated to be 0.009 and less than 0.0001, respectively. The cumulative release is most sensitive to the number of groundwater withdrawal wells drilled through the disposal trench. The mean total effective dose equivalent for a member of the public is estimated to reach a maximum of 0.014 milliSievert (mSv) at 10,000 years, or approximately 10 percent of the 0.15 mSv 40 CFR 191.15 individual protection requirement. The dose is predominantly from inhalation of short-lived Rn-222 progeny in air produced by low-level waste disposed in the same trench. The transuranic radionuclide released in greatest amounts, Pu-239, contributes only 0.4 percent of the dose. The member of public dose is most sensitive to the U-234 inventory and the radon emanation coefficient. Reasonable assurance of compliance with the Subpart C groundwater protection standard is provided by site characterization data and hydrologic processes modeling which support a conclusion of no groundwater pathway within 10,000 years.     In 1986, 21 m{sup 3} of transuranic (TRU) waste was inadvertently buried in a shallow land burial trench at the Area 5 Radioactive Waste Management Site on the Nevada Test Site (NTS). The U.S. Department of Energy, National Nuclear Security Administration Nevada Site Office is considered five options for management of the buried TRU waste.     Implementing solar energy projects at federal facilities is a process. The project planning phase of the process includes determining goals, building a team, determining site feasibility and selecting the appropriate project funding tool. This fact sheet gives practical guidance to assist decision-makers with understanding and selecting the funding tool that would best address their site goals. Because project funding tools are complex, federal agencies should seek project assistance before making final decisions. High capital requirements combined with limits on federal agency energy contracts create challenges for funding solar projects. Solar developers typically require long-term contracts (15-20) years to spread out the initial investment and to enable payments similar to conventional utility bill payments. In the private sector, 20-year contracts have been developed, vetted, and accepted, but the General Services Administration (GSA) contract authority (federal acquisition regulation [FAR] part 41) typically limits contract terms to 10 years. Payments on shorter-term contracts make solar economically unattractive compared with conventional generation. However, in several instances, the federal sector has utilized innovative funding tools that allow long-term contracts or has created a project package that is economically attractive within a shorter contract term.

    The Savannah River Site (SRS) is a 310-square-mile United States Department of Energy (US DOE) nuclear facility located along the Savannah River near Aiken, South Carolina that contains six primary stream/river systems. The Lower Three Runs Stream (LTR) is one of the primary streams within the site that is located in the southeast portion of the Savannah River Site and is a large black water stream system that originates in the northeast portion of SRS and follows a southerly direction before it enters the Savannah River. During reactor operations, secondary reactor cooling water, storm sewer discharges, and miscellaneous wastewater was discharged and contaminated a 36 kilometer stretch of Lower Three Runs Stream that narrows providing a limited buffer of US DOE property along the stream and flood plain. Based on data collected during 2009 and 2010 under Recover Act Funding, the stream was determined to be contaminated with cesium-137 at levels that exceeded acceptable risk based limits. As efficiencies were realized within the SRS Recovery Act Program, funding was made available to design, permit and execute remediation of the LTR. This accelerated Project allowed for the remediation of 36 kilometers of LTR in only nine months from inception to completion, contributing significantly to the Foot Print Reduction of SRS. The scope consisted of excavation and disposal of more than 2064 cubic meters of contaminated soil, and installing 11 kilometers of fence and 2,000 signs at 1000 locations. Confirmatory sampling and analysis, and radiological surveying were performed demonstrating that soil concentrations met the cleanup goals. The project completed with a very good safety record considering the harsh conditions including, excessive rain in the early stages of the project, high summer temperatures, swampy terrain, snakes, wild boar, insects and dense vegetation. The regulatory approval process was compressed by over 75% and required significant efforts from SRS's stakeholders including the regulators, U. S. Environmental Protection Agency (US EPA) and the South Carolina Department of Health and Environmental Control (SCDHEC), and the public including local property owners and the SRS Citizens Advisory Board. Stakeholder buy-in was critical in the up-front planning in order to achieve this challenging cleanup. (authors)

    In this work, we present a form of extremum seeking (ES) in which the unknown function being minimized enters the system’s dynamics as the argument of a cosine or sine term, thereby guaranteeing known bounds on update rates and control efforts. We present general n-dimensional optimization and stabilization results as well as 2D vehicle control, with bounded velocity and control efforts. For application to autonomous vehicles, tracking a source in a GPS denied environment with unknown orientation, this ES approach allows for smooth heading angle actuation, with constant velocity, and in application to a unicycle-type vehicle results in control ability as if the vehicle is fully actuated. Our stability analysis is made possible by the classic results of Kurzweil, Jarnik, Sussmann, and Liu, regarding systems with highly oscillatory terms. In our stability analysis, we combine the averaging results with a semi-global practical stability result under small parametric perturbations developed by Moreau and Aeyels.

  14. Attributes of the Federal Energy Management Program's Federal Site Building Characteristics Database

    Typically, the Federal building stock is referred to as a group of about one-half million buildings throughout the United States. Additional information beyond this level is generally limited to distribution of that total by agency and maybe distribution of the total by state. However, additional characterization of the Federal building stock is required as the Federal sector seeks ways to implement efficiency projects to reduce energy and water use intensity as mandated by legislation and Executive Order. Using a Federal facility database that was assembled for use in a geographic information system tool, additional characterization of the Federal building stock is provided including information regarding the geographical distribution of sites, building counts and percentage of total by agency, distribution of sites and building totals by agency, distribution of building count and floor space by Federal building type classification by agency, and rank ordering of sites, buildings, and floor space by state. A case study is provided regarding how the building stock has changed for the Department of Energy from 2000 through 2008.

  16. Determining Price Reasonableness in Federal ESPCs

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services obtained through conventional procurements. While claims of excessive prices are largely unsubstantiated and based on anecdotal evidence, the perception that there is a problem is shared by many in the ESPC community and has been noted by auditors and oversight organizations. The Price Reasonableness Working Group determined that a more formal emphasis on FAR 15.404-1 in the ESPC process could remove much of the doubt about price reasonableness determinations. The working group's recommended consensus policy on price reasonableness stresses the price analysis techniques described in the FAR that are applicable to ESPCs and includes guidance for agencies use of these techniques in determining price reasonableness for their ESPC delivery orders. The recommended policy and guidance, if communicated to federal ESPC stakeholders, can ensure that agencies will comply with the FAR in awarding ESPCs, obtain fair and reasonable prices and best value for the government, and follow procedures that provide auditable documentation of due diligence in price reasonableness determinations.

    President Carter issued Executive Order 12044 (3/28/78) that required all Federal agencies to distinguish between significant and insignificant regulations, and to determine whether a regulation will result in major impacts. This study gathered information on the impact of the order and the guidelines on the Office of Conservation and Solar Energy (CS) regulatory practices, investigated problems encountered by the CS staff when implementing the order and guidelines, and recommended solutions to resolve these problems. Major tasks accomplished and discussed are: (1) legislation, Executive Orders, and DOE Memoranda concerning Federal administrative procedures relevant to the development and analysis of regulations within CS reviewed; (2) relevant DOE Orders and Memoranda analyzed and key DOE and CS staff interviewed in order to accurately describe the current CS regulatory process; (3) DOE staff from the Office of the General Counsel, the Office of Policy and Evaluation, the Office of the Environment, and the Office of the Secretary interviewed to explore issues and problems encountered with current CS regulatory practices; (4) the regulatory processes at five other Federal agencies reviewed in order to see how other agencies have approached the regulatory process, dealt with specific regulatory problems, and responded to the Executive Order; and (5) based on the results of the preceding four tasks, recommendations for potential solutions to the CS regulatory problems developed.     The Department of Energy`s (DOE) Federal Relighting Initiative (FRI), under the Federal Energy Management Program (FEMP), has developed a comprehensive process to assist federal agencies in meeting the nation`s energy mandate. This mandate states that federal facilities must use 20% less energy by the year 2000, based on 1985 consumption levels. Because lighting accounts for about 40% of total federal electricity consumption, the FRI was conceived to help reduce energy use in this important area while improving lighting quality and increasing productivity through relighting. Selected federal rules and regulations provide guidance on the types of energy efficiency techniques required, life-cycle costing methods and lighting levels that should be employed to achieve the federal mandate. Although the central focus of this paper is on the environment, this paper takes the perspective that the energy efficiency gains achieved through the FRI would produce both environmental and economic benefits for the United States. For example, improvements in energy efficiency would reduce electricity demand, and would consequently reduce the emissions associated with fossil fuel combustion for power production. These reduced emissions include carbon dioxide, which is associated with the potential for global climate change, and heavy metals, which pose a potential health threat to humans and aquatic ecosystems. Economic benefits of the FRI would include reduced federal expenditures on energy or, possibly, avoiding new power plant construction.This paper begins with a brief overview of the FRI process. Next, current lighting energy use in federal buildings is evaluated and the potential future energy savings achievable through full implementation of the FRI are estimated. The paper then translates these energy savings into avoided emissions of carbon dioxide and heavy metals and into avoided fuel expenditures.

    Utility financing of energy efficient measures becomes easier to accomplish with the two new alternative financing guidance memoranda, released April 17, 1998, that address the use of utility incentives for Federal facilities. The memoranda have been approved by the Alternative Financing Guidance Committee on the Interagency Energy Management Task Force. The memoranda include: (1) Policy Statement No. 001: Authority to Sole Source Utility Service Contracts as Referenced in Section 152 of the Energy Policy Act (EPACT) of 1992; and (2) Policy Statement No. 002: Congressional Notification for Utility Projects Under the Authority of Section 152 of the Energy Policy Act (EPACT) of 1992. The purpose for developing the financing memoranda was to address specific issues within current Federal procurement regulations that require clarification or guidance. This new guidance will allow for increased use of utility incentives as a means of financing energy efficient and life cycle cost-effective projects in Federal facilities.

    The paragraphs for general licenses for fissile material and exemptions (often termed exceptions in the international community) for fissile material have long been a part of the US Code of Federal Regulations (CFR) 10 CFR Part 71, Packaging and Transportation of Radioactive Material. More recently, the Nuclear Regulatory Commission (NRC) issued a final rule on Part 71 via emergency rule-making procedures in order to address an identified deficiency related to one of the fissile exemptions. To address the specified deficiency in a general fashion, the emergency rule adopted the approach of the 1996 Edition of the IAEA: Regulations for the Safe Transport of Radioactive Material (IAEA 1996), which places restrictions on certain moderating materials and limits the quantity of fissile material in a consignment. The public comments received by the NRC indicated general agreement with the need for restrictions on certain moderators (beryllium, deuterium, and graphite). The comments indicated concern relative to both the degree of restriction imposed (not more than 0.1% of fissile material mass) and the need to limit the fissile material mass of the consignment, particularly in light of the subsequent NRC staff position that the true intent was to provide control for limiting the fissile mass of the conveyance. The purpose of the review is to identify potential deficiencies that might be adverse to maintaining adequate subcriticality under normal conditions of transport and hypothetical accident conditions. In addition, ORNL has been asked to identify changes that would address any identified safety issues, enable inherently safe packages to continue to be unencumbered in transport, and seek to minimize the impact on current safe practices.

    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    In a ''green roof,'' a layer of vegetation (e.g., a roof garden) covers the surface of a roof to provide shade, cooler indoor and outdoor temperatures, and effective storm-water management to reduce runoff. The main components are waterproofing, soil, and plants. There are two basic kinds: intensive and extensive. An intensive green roof often features large shrubs and trees, and it can be expensive to install and maintain. An extensive green roof features shallow soil and low-growing, horizontally spreading plants that can thrive in the alpine conditions of many rooftops. These plants do not require a lot of water or soil, and they can tolerate a significant amount of exposure to the sun and wind. This Federal Technology Alert focuses on the benefits, design, and implementation of extensive green roofs and includes criteria for their use on federal facilities.

    The U.S. Nuclear Regulatory Commission (NRC) was formed in 1975 to regulate the various commercial and institutional uses of nuclear energy, including nuclear power plants. The agency succeeded the Atomic Energy Commission, which previously had responsibility for both developing and regulating nuclear activities. Federal research and development work for all energy sources, as well as nuclear weapons production, is now conducted by the U.S. Department of Energy. Under its responsibility to protect public health and safety, the NRC has three principal regulatory functions: (1) establish standards and regulations, (2) issue licenses for nuclear facilities and users of nuclear materials, and (3) inspect facilities and users of nuclear materials to ensure compliance with the requirements. These regulatory functions relate to both nuclear power plants and to other uses of nuclear materials - like nuclear medicine programs at hospitals, academic activities at educational institutions, research work, and such industrial applications as gauges and testing equipment. The NRC places a high priority on keeping the public informed of its work. The agency recognizes the interest of citizens in what it does through such activities as maintaining public document rooms across the country and holding public hearings, public meetings in local areas, and discussions with individuals and organizations.

    This paper seeks to briefly characterize the evolving role of power sector regulation. Given current global dynamics, regulation of the power sector is undergoing dramatic changes. This transformation is being driven by various factors including technological advances and cost reductions in renewable energy, energy efficiency, and demand management; increasing air pollution and climate change concerns; and persistent pressure for ensuring sustainable economic development and increased access to energy services by the poor. These issues add to the already complex task of power sector regulation, of which the fundamental remit remains to objectively and transparently ensure least-cost service delivery at high quality. While no single regulatory task is trivial to undertake, it is the prioritization and harmonization of a multitude of objectives that exemplifies the essential challenge of power sector regulation. Evolving regulatory roles can be understood through the concept of existing objectives and an additional layer of emerging objectives. Following this categorization, we describe seven existing objectives of power sector regulators and nine emerging objectives, highlighting key challenges and outlining interdependencies. This essay serves as a preliminary installment in the Clean Energy Regulatory Initiative (CERI) series, and aims to lay the groundwork for subsequent reports and case studies that will explore these topics in more depth.

    Environmental regulations can have a significant impact on product use, disposal, and recycling. This report summarizes the basic aspects of current federal, state and international regulations which apply to end-of-life photovoltaic (PV) modules and PV manufacturing scrap destined for disposal or recycling. It also discusses proposed regulations for electronics that may set the ground of what is to be expected in this area in the near future. In the US, several states have started programs to support the recycling of electronic equipment, and materials destined for recycling often are excepted from solid waste regulations during the collection, transfer, storage and processing stages. California regulations are described separately because they are different from those of most other states. International agreements on the movement of waste between different countries may pose barriers to cross-border shipments. Currently waste moves freely among country members of the Organization of Economic Cooperation and Development (OECD), and between the US and the four countries with which the US has bilateral agreements. However, it is expected, that the US will adopt the rules of the Basel Convention (an agreement which currently applies to 128 countries but not the US) and that the Convection's waste classification system will influence the current OECD waste-handling system. Some countries adopting the Basel Convention consider end-of-life electronics to be hazardous waste, whereas the OECD countries consider them to be non-hazardous. Also, waste management regulations potentially affecting electronics in Germany and Japan are mentioned in this report.

    Under contract to the Office of Leasing Policy Development (LPDO), Jack Faucett Associates is currently undertaking the description and analysis of the Outer Continental Shelf (OCS) regulatory process to determine the nature of time delays that affect OCS production of oil and gas. This report represents the results of the first phase of research under this contract, the description and analysis of regulatory activity associated with exploration activities on the Federal OCS. Volume 1 contains the following three sections: (1) study results; (2) Federal regulatory activities during exploration of Federal OCS leases which involved the US Geological Survey, Environmental Protection Agency, US Coast Guard, Corps of Engineers, and National Ocean and Atmospheric Administration; and (3) state regulatory activities during exploration of Federal OCS leases of Alaska, California, Louisiana, Massachusetts, New Jersey, North Carolina, and Texas. Volume II contains appendices of US Geological Survey, Environmental Protection Agency, Coast Guard, Corps of Engineers, the Coastal Zone Management Act, and Alaska. The major causes of delay in the regulatory process governing exploration was summarized in four broad categories: (1) the long and tedious process associated with the Environmental Protection Agency's implementation of the National Pollutant Discharge Elimination System Permit; (2) the lack of mandated time periods for the completion of individual activities in the permitting process; (3) the lack of overall coordination of OCS exploratory regulation; and (4) the inexperience of states, the Federal government and industry relating to the appropriate level of regulation for first-time lease sale areas.

    This paper examines the factors that threaten the future of the Russian Federation (RF). The observations are based on a study that focused on eight republics: Mordova, Udmurtia, Tatarstan, Mari El, Bashkortostan, Kabardino-Balkaria, Buryatia, and Altay Republic. These republics were selected for their geographic and economic significance to the RF. Tatarstan, Bashkortostan, Udmurtia, and Mari El are located on important supply routes, such as the Volga River and the trans-Siberian railroad. Some of these republics are relatively wealthy, with natural resources such as oil (e.g., Tatarstan and Bashkortostan), and all eight republics play significant roles in the military-industrial complex. The importance of these republics to the RF contrasts to the relative insignificance of the independence-minded Northern Caucasus area. The author chose not to examine the Northern Caucasus region (except Kabardino-Balkaria) because these republics may have only a minor impact on the rest of the RF if they secede. Their impact would be minimized because they lie on the frontiers of the RF. Many Russians believe that {open_quotes}it might be best to let such a troublesome area secede.{close_quotes}

    The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

    The Federal Demonstration Project is a cooperative effort between a number of universities, a private research institute, and several federal agencies to increase research productivity by eliminating unnecessary administrative procedures and by streamlining and standardizing needed controls. The Project aims to locate responsibility for decision-making as close as possible to principal investigators while maintaining necessary institutional and agency oversight to ensure accountability. By freeing researchers from some of their paperwork burden, more efficient research administration systems will enable investigators to spend more of their time doing science and engineering. The Federal Demonstration Project is an outgrowth of an earlier activity sponsored by five major federal R D agencies at the Florida State University System and the University of Miami. In Florida, the focus was on standardizing and streamlining procedures for administering research grants after the grants had been awarded to the universities. (See Attachment 1 for descriptions of the demonstrations carried out under the Florida Demonstration Project). In May 1988, the most successful of the demonstrated procedures were approved by the US Office of Management and Budget for use in grants awarded by any federal agency to any research organization. The new procedures give agencies authority to waive requirements that grantees obtain federal approval prior to taking a number of administrative actions with respect to grant management. The FDP institutions together with the participating federal agencies are designing and demonstrating innovative research administration procedures and are assessing the impact of those new procedures.

The two main drivers for the energy efficiency upgrades within the Federal sector are Executive Orders (E.O.) from the Executive branch and the legislative requirements passed by the legislative branch and then signed into law by the Executive branch of the U.S. Federal Government. The concept of regulatory climate and how the financial community has developed a system of ranking regulatory climate in the various State jurisdictions are explained. The existing evidence on the hypothesis that the cost of capital to a utility increases and its availability is reduced as regulatory climate grows more unfavorable from an investor's point of view is analyzed. The implications of this cost of capital effect on the electric utilities and collaterally on national energy policy and electric ratepayers are explained. Finally various State, regional and Federal regulatory responses to problems associated with PUC regulation are examined.

    We digitally implement an extremum seeking (ES) algorithm, which optimizes the rise time of the output voltage of a high voltage converter modulator (HVCM) at the Los Alamos Neutron Science Center (LANSCE) HVCM test stand by iteratively, simultaneously tuning the first 8 switching edges of each of the three phase drive waveforms (24 variables total). We achieve a 50 ?s rise time, which is reduction in half compared to the 100 ?s achieved at the Spallation Neutron Source (SNS) at Oak Ridge National Laboratory. Considering that HVCMs typically operate with an output voltage of 100 kV, with a 60Hz repetition rate, the 50 ?s rise time reduction will result in very significant energy savings. The ES algorithm will prove successful, despite the noisy measurements and cost calculations, confirming the theoretical results that the algorithm is not affected by noise whose frequency components are independent of the perturbing frequencies.

    The theme for the 1998 workshop was Standards Management -- A World of Change and Opportunities. The workshop`s goal was to further the implementation of the National Technology Transfer and Advancement Act of 1995 (Public Law 104-113) through the sharing of standards management success stories, lessons learned, and emerging initiatives within the Executive Branch of the Federal Government. The target audience for this workshop included agency/department and contractor personnel and representatives of standards developing organizations that either used technical standards in their work for the Federal Government of participated in standards writing/management activities in support of the missions and programs of Federal agencies/departments. As with previous standards workshops sponsored by the DOE, views on the technical subject areas under the workshop theme were solicited from and provided by agency Standards Executives and standards program managers, voluntary standards organizations, and the private sector.     Geographic information systems (GIS) technology was applied to analyze federal energy demand across the contiguous US. Several federal energy clusters were previously identified, including Hampton Roads, Virginia, which was subsequently studied in detail. This study provides an analysis of three additional diverse federal energy clusters. The analysis shows that there are potential sites in various federal energy clusters that could be evaluated further for placement of an integral pressurized-water reactor (iPWR) to support meeting federal clean energy goals.
