Three experimental OTEC facilities in Hawaii are described, and the many regulations that must be observed and permits needed are described.     The findings and conclusions of the analysis of the various issues involved in the federal preemption of state regulations for the DOE no standard rule on covered appliances are summarized. The covered products are: refrigerators, refrigerator-freezers, freezers, clothes dryers, kitchen ranges and ovens, water heaters (excluding heat pump water heaters), room air conditioners, central air conditioners (excluding heat pumps), and furnaces. A detailed discussion of the rationale for the positions of groups offering comment for the record is presneted. The pertinent categories of state and local regulations and programs are explained, then detailed analysis is conducted on the covered products and regulations. Issues relating to the timing of preemption of state regulations are discussed, as well as issues relating to burden of proof, contents of petitions for exemptions from preemption, criteria for evaluating petitions, and procedural and other issues.     With the realignment and closure of Federal facilities, especially Department of Defense installations, Federal agencies have been presented with a unique opportunity: the chance to create and dispose of air emission reduction credits (ERCs). This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances. This paper will discuss ERCs, why the disposal of ERCs by Federal agencies is a pressing issue, and how Federal agencies can dispose of ERCs under existing Federal property laws and regulations.

    In 2005, the Environmental Protection Agency (EPA) finalized two regulations, the Clean Air Interstate Rule (CAIR) and the Clean Air Mercury Rule CAMR, that would reduce emissions from coal-fired power plants in the United States. Both CAIR and CAMR are included in the Annual Energy Outlook 2006 reference case. The EPA has received 11 petitions for reconsideration of CAIR and has provided an opportunity for public comment on reconsidering certain aspects of CAIR. Public comments were accepted until January 13, 2006. The EPA has also received 14 petitions for reconsideration of CAMR and is willing to reconsider certain aspects of the rule. Public comments were accepted for 45 days after publication of the reconsideration notice in the Federal Register. Several states and organizations have filed lawsuits against CAMR. The ultimate decision of the courts will have a significant impact on the implementation of CAMR.

    The Risk Management Program (RMP) rule, Section 112(r) of the Clean Air Act (CAA), was signed on May 24 and finalized on June 20. RMP is one of the most comprehensive, technically based regulatory programs for preventing, detecting and responding to accidental hazardous materials releases to have been issued in recent times. Although facilities have three years to comply, EPA estimates that the rule will affect an estimated 66,000 facilities that store highly hazardous or acutely toxic materials. The 1990 CAA Amendments are designed to prevent accidental releases of highly hazardous chemicals from stationary sources. Two significant regulatory programs that have emerged from the revised CAA are the Process Safety Management (PSM) standard and RMP. PSM is designed to protect employees and regulated by the Occupational Safety and Health Administration. RMP`s purpose is to protect the public and the environment from highly hazardous chemicals. It authorizes EPA to create a list of substances (distinct from the list generated under PSM) known to cause serious adverse effects and to implement a program for accidental chemical release prevention.

    Utility regulators increasingly take responsibility for the [open quotes]extemalities[close quotes] associated with their decisions, meaning the economic and social costs related to rate decisions or other kinds of authorizations. Yet, when Congress adopted the National Environmental Policy Act of 1969 (NEPA), it intervened to ensure protection of the natural environment, not from abuses by the citizenry but from the activities of the federal government itself. Comprised of action forcing procedures, NEPA was designed to infuse the decisional processes of federal agencies with a broad awareness of the environmental consequences of their actions. NEPA encourages decisionmakers to counterbalance the organic statutory and political missions of their departments or agencies with a sensitivity to the ecological consequences of their directives and authorizations. This paper examines how the requirements of NEPA have fared in the environment of classical public utility regulation at the Federal Energy Regulatory Commission. Commission proceedings did not evidence any widely held opinion that economic regulation of the gas industry is hostile to the NEPA process.

    This report presents the schedules and methods required to comply with the newly promulgated Underground Storage Tank (UST) Regulations Title 40 Code of Federal Regulations (CFR) 280 and 281. These rules were promulgated by the US Environmental Protection Agency (EPA) on September 23, 1988, and became effective December 22, 1988. These regulations are required by Subtitle I of the Resource Conservation and Recovery Act of 1976. Their purpose is to protect the groundwater supplies of the United States in the following ways: Closing old tanks; detecting and remediating tank leaks and spills; establishing stringent standards for new tanks; and upgrade of existing tanks to new-tank standards. 3 refs., 5 tabs.

    This research focuses on the regulatory politics of mountaintop removal mining for coal within the Appalachian states of West Virginia and Kentucky. Based on Administrative Presidency concepts suggesting that chief executives seek more control and influence over agency program decisions, this article analyzes President George W. Bush's efforts to promote the development of coal resources within these states despite statutory constraints posed by federal environmental laws. The analysis demonstrates that President Bush effectively achieved his energy production goals by combining the use of discretionary authority with staff controls, executive orders, and regulatory initiatives to lessen industry compliance costs with environmental regulatory requirements.

  10. A Title 40 Code of Federal Regulations Part 191 Evaluation of Buried Transuranic Waste at the Nevada Test Site

    In 1986, 21 m{sup 3} of transuranic (TRU) waste was inadvertently buried in a shallow land burial trench at the Area 5 Radioactive Waste Management Site on the Nevada Test Site (NTS). The U.S. Department of Energy, National Nuclear Security Administration Nevada Site Office is considered five options for management of the buried TRU waste. One option is to leave the waste in-place if the disposal can meet the requirements of Title 40 Code of Federal Regulations (CFR) Part 191, 'Environmental Radiation Protection Standard for Management and Disposal of Spent Nuclear Fuel, High-Level, and Transuranic Radioactive Wastes'. This paper describes analyses that assess the likelihood that TRU waste in shallow land burial can meet the 40 CFR 191 standards for a geologic repository. The simulated probability of the cumulative release exceeding 1 and 10 times the 40 CFR 191.13 containment requirements is estimated to be 0.009 and less than 0.0001, respectively. The cumulative release is most sensitive to the number of groundwater withdrawal wells drilled through the disposal trench. The mean total effective dose equivalent for a member of the public is estimated to reach a maximum of 0.014 milliSievert (mSv) at 10,000 years, or approximately 10 percent of the 0.15 mSv 40 CFR 191.15 individual protection requirement. The dose is predominantly from inhalation of short-lived Rn-222 progeny in air produced by low-level waste disposed in the same trench. The transuranic radionuclide released in greatest amounts, Pu-239, contributes only 0.4 percent of the dose. The member of public dose is most sensitive to the U-234 inventory and the radon emanation coefficient. Reasonable assurance of compliance with the Subpart C groundwater protection standard is provided by site characterization data and hydrologic processes modeling which support a conclusion of no groundwater pathway within 10,000 years. Limited quantities of transuranic waste in a shallow land burial trench at the NTS can meet the requirements of 40 CFR 191.

    This compilation includes in the first two sections the reporting and recordkeeping requirements applicable to US Nuclear Regulatory Commission (NRC) licensees and applicants and to members of the public. It includes those requirements codified in Title 10 of the code of Federal Regulations, Chapter 1, on December 31, 1993. It also includes, in a separate section, any of those requirements that were superseded or discontinued between January 1992 and December 1993. Finally, the appendix lists mailing and delivery addresses for NRC Headquarters and Regional Offices mentioned in the compilation. The Office of Information Resources Management staff compiled this listing of reporting and recordkeeping requirements to briefly describe each in a single document primarily to help licensees readily identify the requirements. The compilation is not a substitute for the regulations, and is not intended to impose any new requirements or technical positions. It is part of NRC`s continuing efforts to comply with the Paperwork Reduction Act of 1980 and the Office of Management and Budget regulations that mandate effective and efficient Federal information resources management programs.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services obtained through conventional procurements. While claims of excessive prices are largely unsubstantiated and based on anecdotal evidence, the perception that there is a problem is shared by many in the ESPC community and has been noted by auditors and oversight organizations. The Price Reasonableness Working Group determined that a more formal emphasis on FAR 15.404-1 in the ESPC process could remove much of the doubt about price reasonableness determinations. The working group's recommended consensus policy on price reasonableness stresses the price analysis techniques described in the FAR that are applicable to ESPCs and includes guidance for agencies use of these techniques in determining price reasonableness for their ESPC delivery orders. The recommended policy and guidance, if communicated to federal ESPC stakeholders, can ensure that agencies will comply with the FAR in awarding ESPCs, obtain fair and reasonable prices and best value for the government, and follow procedures that provide auditable documentation of due diligence in price reasonableness determinations.

    The most important indicator of a well-managed site cleanup effort may no longer be funding or scientific expertise. While support for federal facility cleanup has included appropriations of more than $10 billion annually, these expenditures alone are unlikely to assure progress toward environmental remediation. {open_quotes}Trust{close_quotes} is now overwhelmingly mentioned as a prerequisite for progress with site cleanup in DOE`s weapons complex. In part, federal budget deficits are forcing participants to focus on factors that build consensus and lead to cost-effective cleanup actions. In some cases, the stakeholders at cleanup sites are making efforts to work cooperatively with federal agencies. A report by 40 representatives of federal agencies, tribal and state governments, associations, and others developed recommendations to create a {open_quotes}new era of trust and consensus-building that allows all parties to get on with the job of cleaning up federal facilities in a manner that reflects the priorities and concerns of all stakeholders.{close_quotes} Changes are underway affecting how federal agencies work with federal and state regulators reflecting this concept of shared responsibility for conducting cleanup. This paper addresses these changes and provides examples of the successes and failures underway.

The resulting product is a search engine called Needle, an open-source-based tool that the INL uses internally for researching across a wide variety of information repositories. Needle has a flexible search interface that allows end users to point at any available data source.     The tandem gene clusters orfR-ombB-omaB-omcB and orfS-ombC-omaC-omcC of the metal-reducing bacterium Geobacter sulfurreducens PCA are responsible for trans-outer membrane electron transfer during extracellular reduction of Fe(III)-citrate and ferrihydrite [a poorly crystalline Fe(III) oxide]. Each gene cluster encodes a putative transcriptional factor (OrfR/OrfS), a porin-like outer-membrane protein (OmbB/OmbC), a periplasmic c-type cytochrome (c-Cyt, OmaB/OmaC) and an outer-membrane c-Cyt (OmcB/OmcC). The individual roles of OmbB, OmaB and OmcB in extracellular reduction of Fe(III), however, have remained either uninvestigated or controversial. Here, we showed that replacements of ombB, omaB, omcB and ombB-omaB with an antibiotic gene in the presence of ombC-omaC-omcC had no impact on reduction of Fe(III)-citrate by G. sulfurreducens PCA. Disruption of ombB, omaB, omcB and ombB-omaB in the absence of ombC-omaC-omcC, however, severely impaired the bacterial ability to reduce Fe(III)-citrate as well as ferrihydrite. These results unequivocally demonstrate an overlapping role of ombB-omaB-omcB and ombC-omaC-omcC in extracellular Fe(III) reduction by G. sulfurreducens PCA. Involvement of both ombB-omaB-omcB and ombC-omaC-omcC in extracellular Fe(III) reduction reflects the importance of these trans-outer membrane protein complexes in the physiology of this bacterium. Moreover, the kinetics of Fe(III)-citrate and ferrihydrite reduction by these mutants in the absence of ombC-omaC-omcC were nearly identical, which clearly show that OmbB, OmaB and OmcB contribute equally to extracellular Fe(III) reduction. Finally, orfS was found to have a negative impact on the extracellular reduction of Fe(III)-citrate and ferrihydrite in G. sulfurreducens PCA probably by serving as a transcriptional repressor.

This mandate states that federal facilities must use 20% less energy by the year 2000, based on 1985 consumption levels. Because lighting accounts for about 40% of total federal electricity consumption, the FRI was conceived to help reduce energy use in this important area while improving lighting quality and increasing productivity through relighting. Selected federal rules and regulations provide guidance on the types of energy efficiency techniques required, life-cycle costing methods and lighting levels that should be employed to achieve the federal mandate. Although the central focus of this paper is on the environment, this paper takes the perspective that the energy efficiency gains achieved through the FRI would produce both environmental and economic benefits for the United States. For example, improvements in energy efficiency would reduce electricity demand, and would consequently reduce the emissions associated with fossil fuel combustion for power production. These reduced emissions include carbon dioxide, which is associated with the potential for global climate change, and heavy metals, which pose a potential health threat to humans and aquatic ecosystems. Economic benefits of the FRI would include reduced federal expenditures on energy or, possibly, avoiding new power plant construction.This paper begins with a brief overview of the FRI process. Next, current lighting energy use in federal buildings is evaluated and the potential future energy savings achievable through full implementation of the FRI are estimated. The paper then translates these energy savings into avoided emissions of carbon dioxide and heavy metals and into avoided fuel expenditures.

    Pacific Northwest National Laboratory (PNNL) conducted in-depth research of state-level rainwater harvesting regulations for the Federal Energy Management Program (FEMP) to help federal agencies strategically identify locations conducive to rainwater harvesting projects. Currently, rainwater harvesting is not regulated by the federal government but rather it is up to individual states to regulate the collection and use of rainwater. There is no centralized information on state-level regulations on rainwater harvesting maintained by a federal agency or outside organization. To fill this information gap, PNNL performed detailed internet searches for each state, which included state agencies, universities, Cooperative Extension Offices, city governments, and related organizations. The state-by-state information on rainwater harvesting regulations was compiled and assembled into an interactive map that is color coded by state regulations. The map provides a visual representation of the general types of rainwater harvesting policies across the country as well as general information on the state programs if applicable. The map allows the user to quickly discern where rainwater harvesting is supported and regulated by the state. This map will be available on the FEMP website by September 2015.

    Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    The Clean Air Act Amendments of 1990 established a rigorous timetable for EPA to develop and implement an unprecedented number of regulatory and policy initiatives. EPA has made great progress in meeting these mandates; however, much remains to be done if the Act`s health and environmental goals are to be achieved. EPA must issue dozens of additional regulations, guidance documents, and studies and reports over the next several years. The largest group of remaining rulemakings will be those controlling air toxics emissions. Other significant actions will include final rulemakings on emission standards for non-road engines, emissions standards for municipal and medical waste combustion, enhanced emissions monitoring, Federal operating permits, and newsource review simplification. EPA also must accelerate and expand a host of activities to ensure that the Agency and the States are implementing and enforcing the Act effectively. For example, EPA must assess hundreds of SIP revisions, as well as 120 State and local permit programs, and provide technical assistance to States and sources. Ms. Nichols will present EPA`s will present EPA`s plans for implementing these activities over the next several years. She will present a summary of the Agency`s current achievements under the 1990 amendments and EPA`s framework for completing the challenging tasks that lie ahead.

    This paper examines the factors that threaten the future of the Russian Federation (RF). The observations are based on a study that focused on eight republics: Mordova, Udmurtia, Tatarstan, Mari El, Bashkortostan, Kabardino-Balkaria, Buryatia, and Altay Republic. These republics were selected for their geographic and economic significance to the RF. Tatarstan, Bashkortostan, Udmurtia, and Mari El are located on important supply routes, such as the Volga River and the trans-Siberian railroad. Some of these republics are relatively wealthy, with natural resources such as oil (e.g., Tatarstan and Bashkortostan), and all eight republics play significant roles in the military-industrial complex. The importance of these republics to the RF contrasts to the relative insignificance of the independence-minded Northern Caucasus area. The author chose not to examine the Northern Caucasus region (except Kabardino-Balkaria) because these republics may have only a minor impact on the rest of the RF if they secede. Their impact would be minimized because they lie on the frontiers of the RF. Many Russians believe that {open_quotes}it might be best to let such a troublesome area secede.{close_quotes}

    As far as we know, naturally occurring radioactive material (NORM) has surrounded humankind since the beginning of time. However, recent data demonstrating that certain activities concentrate NORM have increased concern regarding its proper handling and disposal and precipitated the development of new NORM-related regulations. The regulation of NORM affects the management of government facilities as well as a broad range of industrial processes. Recognizing that NORM regulation at the federal level is extremely limited, Argonne National Laboratory (ANL) conducted a 50-state survey to determine the extent to which states have assumed the responsibility for regulating NORM as well as the NORM standards that are currently being applied at the state level. Though the survey indicates that NORM regulation comprises a broad spectrum of controls from full licensing requirements to virtually no regulation at afl, a trend is emerging toward recognition of the need for increased regulation of potential NORM hazards, particularly in the absence of federal standards.

    The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

    Under contract to the Office of Leasing Policy Development (LPDO), Jack Faucett Associates is currently undertaking the description and analysis of the Outer Continental Shelf (OCS) regulatory process to determine the nature of time delays that affect OCS production of oil and gas. This report represents the results of the first phase of research under this contract, the description and analysis of regulatory activity associated with exploration activities on the Federal OCS. Volume 1 contains the following three sections: (1) study results; (2) Federal regulatory activities during exploration of Federal OCS leases which involved the US Geological Survey, Environmental Protection Agency, US Coast Guard, Corps of Engineers, and National Ocean and Atmospheric Administration; and (3) state regulatory activities during exploration of Federal OCS leases of Alaska, California, Louisiana, Massachusetts, New Jersey, North Carolina, and Texas. Volume II contains appendices of US Geological Survey, Environmental Protection Agency, Coast Guard, Corps of Engineers, the Coastal Zone Management Act, and Alaska. The major causes of delay in the regulatory process governing exploration was summarized in four broad categories: (1) the long and tedious process associated with the Environmental Protection Agency's implementation of the National Pollutant Discharge Elimination System Permit; (2) the lack of mandated time periods for the completion of individual activities in the permitting process; (3) the lack of overall coordination of OCS exploratory regulation; and (4) the inexperience of states, the Federal government and industry relating to the appropriate level of regulation for first-time lease sale areas.
