    A preliminary exploration is given of the legal and economic considerations surrounding the formation and operation of some form of utility-sponsored collective buying arrangement for heliostats. Particular attention is focused on considerations of federal antitrust law surrounding collective buying and other joint operations by electric utilities. Attention is also given to considerations suggested by the economic theory of monopsony (markets with a single buyer) and oligopsony (markets with a small number of buyers). The advantages and disadvantages of such arrangements are examined from the viewpoints of the buyer and the seller. (LEW)

    An antitrust suit against 90 Georgia electric utilities, charging that their monopoly of retail electricity sales should not preclude cogenerators and small power producers from selling surplus power to utilities elsewhere on the network, could set a national precedent allowing cogenerators to shop around for the best buy-back rate. Greensboro Lumber Co. charges that the utilities' refusal to wheel cogenerated power to potential purchasers represents a restraint of trade. The lumber company contends that cogenerators should sell to the wholesale market, where utilities have no state-granted monopoly. Attorneys for the two sides are unsure of the immediate outcome, but predict that antitrust action or threatened action could give cogenerators unfair leverage.

    Understanding the diverse PHEV purchase behaviors among prospective new car buyers is key for designing efficient and effective policies for promoting new energy vehicle technologies. The ORNL MA3T model developed for the U.S. Department of Energy is described and used to project PHEV purchase probabilities by different consumers. MA3T disaggregates the U.S. household vehicle market into 1458 consumer segments based on region, residential area, driver type, technology attitude, home charging availability and work charging availability and is calibrated to the EIA s Annual Energy Outlook. Simulation results from MA3T are used to identify the more likely PHEV buyers and provide explanations. It is observed that consumers who have home charging, drive more frequently and live in urban area are more likely to buy a PHEV. Early adopters are projected to be more likely PHEV buyers in the early market, but the PHEV purchase probability by the late majority consumer can increase over time when PHEV gradually becomes a familiar product.     The business of buying and selling producing oil and gas properties has been active over the past decade. On frequently encountered difficulty is that many producing properties are subject to operating agreements containing `preferential right of purchase` PRP provisions, also referred to as rights of first refusal or preemptive rights. Under a PRP clause, a party wanting to sell its interest must first provide notice to other parties to the operating agreement and an opportunity to acquire the sellers rights and interests in the property. Determining if a PRP clause applies to a particular transaction and the extent of such application is not always easy. In addition if the PRP clause does apply and the holder elects to purchase the property, the deal for which the buyer and seller have bargained may be frustrated. Topics covered in this article include the following: scope of `sales` covered by the PRP clause; exclusion from preferential right; events triggering the PRP provision.

    Federal agency leaders are expressing growing interest in using innovative fuel cell combined heat and power (CHP) technology at their sites, motivated by both executive branch sustainability targets and a desire to lead by example in the transition to a clean energy economy. Fuel cell CHP can deliver reliable electricity and heat with 70% to 85% efficiency. Implementing this technology can be a high efficiency, clean energy solution for agencies striving to meet ambitious sustainability requirements with limited budgets. Fuel cell CHP systems can use natural gas or renewable fuels, such as biogas. Procuring Stationary Fuel Cells for CHP: A Guide for Federal Facility Decision Makers presents an overview of the process for planning and implementing a fuel cell CHP project in a concise, step-by-step format. This guide is designed to help agency leaders turn their interest in fuel cell technology into successful installations. This guide concentrates on larger (100 kW and greater) fuel cell CHP systems and does not consider other fuel cell applications such as cars, forklifts, backup power supplies or small generators (<100 kW). Because fuel cell technologies are rapidly evolving and have high up front costs, their deployment poses unique challenges. The electrical and thermal output of the CHP system must be integrated with the building s energy systems. Innovative financing mechanisms allow agencies to make a make versus buy decision to maximize savings. This guide outlines methods that federal agencies may use to procure fuel cell CHP systems with little or no capital investment. Each agency and division, however, has its own set of procurement procedures. This guide was written as a starting point, and it defers to the reader s set of rules if differences exist. The fuel cell industry is maturing, and project developers are gaining experience in working with federal agencies. Technology improvements, cost reductions, and experienced project developers are making fuel cell projects easier to put into service. In this environment, federal decision makers can focus on being smart buyers of fuel cell energy instead of attempting to become experts in fuel cell technology. For agencies that want to pursue a fuel cell CHP this guide presents a four step process for a successful project. 1. Perform a preliminary screening of the energy needs energy costs and incentives. 2. Compare a detailed project plan. 3. Make a financing and contracting decision. 4. Execute the project plan including financing, installation, and operation. The simplest procurement method is designated funding for the outright purchase of the fuel cell CHP system, although this is usually not the most cost-effective option. This guide describes the following financing options: Power purchase agreement Energy savings performance contract Utility energy services contract Enhanced use lease Fuel cell CHP technology can help federal facility managers comply with agency objectives for reducing energy consumption and air pollution emissions. Fuel cells do not generate particulate pollutants, unburned hydrocarbons or the gases that produce acid rain. Fuel cells emit less carbon dioxide (CO2) than other, less efficient technologies and use of renewable fuels can make them carbon neutral. Fuel cell CHP technology can deliver reliable electricity and heat with high efficiency (70% to 85%) in a small physical footprint with little noise, making it a cost-effective option for federal facilities.

    The US has signed an Agreement with the Russian Federation for the purchase of 500 metric tons of highly enriched uranium (HEU) derived from dismantled Russian nuclear weapons. The BEU will be blended down to low-enriched uranium (LEU) in Russia and will be transported to the US to be used by fuel Fabricators to make fuel for commercial nuclear power plants. Both the United States and Russia have been preparing to institute transparency measures to provide confidence that the nonproliferation, physical protection, and material control and accounting requirements specified in the Agreement are met. This paper provides a background on the Agreement and subsequent on-going negotiations to develop transparency measures suited to the facilities and processes which are expected to be involved.

Blum of the Independent Gasoline Marketers Council, Attorney General William J. Brown of Ohio, and William F. Baxter of the Justice Department's Antitrust Division. It addressed the financial, logistical, and legal questions relevant to implementing a PPA, but we do not examine the technical details?those can be discussed later with the developer/contractor. This fact sheet is written to support decision makers in U.S. state and local governments who are aware of solar PPAs and may have a cursory knowledge of their structure but they still require further information before committing to a particular project.

    A large solar thermal system installed at the Phoenix Federal Correctional Institution (FCI) in 1998 heats water for the prison and costs less than buying electricity to heat that water. This renewable energy system provides 70% of the facility's annual hot water needs. The Federal Bureau of Prisons did not incur the up-front cost of this system because it was financed through an Energy Savings Performance Contract (ESPC). The ESPC payments are 10% less than the energy savings so that the prison saves an average of $6,700 per year, providing an immediate payback. The solar hot water system produces up to 50,000 gallons of hot water daily, enough to meet the needs of 1,250 inmates and staff who use the kitchen, shower, and laundry facilities. This publication details specifications of the parabolic trough solar system and highlights 5 years of measured performance data.

The resulting product is a search engine called Needle, an open-source-based tool that the INL uses internally for researching across a wide variety of information repositories. Needle has a flexible search interface that allows end users to point at any available data source.     Federal fleets are a frequent subject of legislative and executive efforts to lead a national transition to alternative fuels and advanced vehicle technologies. Section 701 of the Energy Policy Act of 2005 requires that all dual-fueled alternative fuel vehicles in the federal fleet be operated on alternative fuel 100% of the time when they have access to it. However, in Fiscal Year (FY) 2012, drivers of federal flex fuel vehicles (FFV) leased through the General Services Administration refueled with E85 24% of the time when it was available--falling well short of the mandate. The U.S. Department of Energy's National Renewable Energy Laboratory completed a 2-year Laboratory Directed Research and Development project to identify the factors that influence the refueling behavior of federal FFV drivers. The project began with two primary hypotheses. First, information scarcity increases the tendency to miss opportunities to purchase E85. Second, even with perfect information, there are limits to how far drivers will go out of their way to purchase E85. This paper discusses the results of the project, which included a June 2012 survey of federal fleet drivers and an empirical analysis of actual refueling behavior from FY 2009 to 2012. This research will aid in the design and implementation of intervention programs aimed at increasing alternative fuel use and reducing petroleum consumption.

    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    The FHFA regulates Fannie Mae, Freddie Mac, and the 12 Federal Home Loan Banks (the government-sponsored enterprises - GSEs). On June 18, 2009, James B. Lockhart III, then Director of FHFA, released a letter expressing concern about the negative impact of energy loan tax assessment programs (ELTAPs) - also known as Property Assessed Clean Energy (PACE) programs - on both the housing finance system and homeowner program participants. Subsequently, a number of PACE proponents responded to the concerns laid out in the FHFA letter. In early Fall 2009, word circulated that FHFA was planning to follow its June letter with guidance to other agencies, possibly including Fannie Mae and Freddie Mac, discouraging them from buying loans on properties subject to PACE-type assessment liens. This triggered a second round of stakeholder letters, several of which were addressed to President Obama. On October 18, 2009, the White House, in what some believe was an attempt to obviate the need for FHFA guidance, released a Policy Framework for PACE Financing Programs that outlined best practices guidance for homeowner and lender protection. As of February 2010, FHFA and the GSEs have agreed to monitor PACE programs and work with stakeholders and the Administration to consider additional guidance beyond the Policy Framework and to collect more information on PACE program efficacy and risks. A summary of the communications timeline and highlights of the communications are provided.

    With organizations and individuals increasingly interested in accounting for their carbon emissions, greater attention is being placed on how to account for the benefits of various carbon mitigation actions available to consumers and businesses. Generally, organizations can address their own carbon emissions through energy efficiency, fuel switching, on-site renewable energy systems, renewable energy purchased from utilities or in the form of renewable energy certificates (RECs), and carbon offsets. This paper explores the role of green power and carbon offsets in carbon footprinting and the distinctions between the two products. It reviews how leading greenhouse gas (GHG) reporting programs treat green power purchases and discusses key issues regarding how to account for the carbon benefits of renewable energy. It also discusses potential double counting if renewable energy generation is used in multiple markets.

    Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    The (SRS) Federal Facility Agreement (FFA) was made effective by the US. Environmental Protection Agency Region IV (EPA) on August 16, 1993. To meet the reporting requirements in Section XXV of the Agreement, the FFA Progress Report was developed. The FFA Progress Report is the first of a series of quarterly progress reports to be prepared by the SRS. As such this report describes the information and action taken to September 30, 1993 on the SRS units identified for investigation and remediation in the Agreement. This includes; rubble pits, runoff basins, retention basin, seepage basin, burning pits, H-Area Tank 16, and spill areas.
