    The purpose of this study is to satisfy the requirements of Section 152 of the Energy Policy Act of 1992 (EPAct 92), which directs the Secretary of Energy to ``evaluate the potential use of the purchasing power of the Federal government to promote the development and commercialization of energy efficient products`` (US Congress 1992). Here, purchasing power implies a market presence by the Federal government that is large enough to influence decisions by manufacturers and suppliers about new-product introduction. In recent years, as energy use has become more efficient in the United States in both the public and private sectors, a major contributor to this transition has been the development of innovative technologies and products that reduce the use of energy and/or that use renewable forms of energy. Although the Nation`s efforts toward greater efficiency have been impressive, there are still many opportunities for the widespread introduction of even more energy-saving innovations. This report outlines the actions that DOE can take, in partnership with other Federal agencies, to address the barriers and realize the opportunities from commercializing new technologies.

    Although the government sector represents only 10 to 15 percent of the economy in most countries, carefully targeted public procurement can play a significant role in market transformation through its influence on both buyers and suppliers. Government leadership in energy-efficient purchasing can set an example for other buyers, while creating opportunities for leading manufacturers and distributors to increase their sales and market share by offering energy-efficient products at competitive prices. Under proper circumstances, a highly visible government purchasing policy can have a disproportionately large influence on the market for efficient products. In the United States, President Bush signed an Executive Order in 2001 directing all federal agencies to buy products with low standby power (1 watt or less where possible). This represents a deliberate choice to use government purchasing - rather than regulations or incentives - as a market-based strategy to encourage energy savings. It also builds upon existing efforts to encourage Federal purchase of energy-efficient products (Energy Star products and others in the top 25th percentile of efficiency). This paper summarizes the Federal Energy Management Program s first 18 months of experience in implementing this Executive Order, including analysis of data on standby power, interactions with manufacturers and industry groups, and the relationship between these efforts and other federal programs concerning product labelling, testing, rating, and efficiency standards. After five years of implementing low-standby power purchasing, we estimate energy savings for federal agencies alone at about 230 GWh/year (worth US$14 million), with spillover effects on the broader market that will save all US consumers nearly 4000 GWh/year (US$300 million).

    Federal, state, and local governments could save at least $139 million annually by reducing energy waste through the purchase and use of energy-efficient products. Reducing this waste would reduce annual greenhouse gas emissions by 4.1 million metric tons of carbon (MMTCs) by the year 2010; the equivalent of planting an area of trees the size of Yellowstone National Park. In addition, with $50-70 billion in purchasing power for energy-related products, specifying energy efficiency could significantly shift the market for these products. The Federal government recently launched the ENERGY STAR® Purchasing Initiative to channel the purchasing power of state and local governments -and its environmental impact- in the direction of energy-efficient products to capture significant environmental benefits and increase the demand in the marketplace. Part of this effort studied why governments don’t currently procure the most efficient products, and attempted to identify the changes that would be necessary to allow many governments to do so. Some of the initial barriers to energy-efficient procurement that were found are: • Lack of information about the availability of energy-efficient products; • Split incentives, where the agency purchasing the products do not pay for the utility bills directly and, therefore, have little interest, or incentive, to save energy; • Misinformation about the benefits of energy efficiency; • Energy efficiency not seen as a value-added aspect of procurement; • Budget constraints; and • Lowest first-cost bias. This paper will present the results of this study and describe the mechanisms that will be put into place to address each of these barriers.

    An antitrust suit against 90 Georgia electric utilities, charging that their monopoly of retail electricity sales should not preclude cogenerators and small power producers from selling surplus power to utilities elsewhere on the network, could set a national precedent allowing cogenerators to shop around for the best buy-back rate. Greensboro Lumber Co. charges that the utilities' refusal to wheel cogenerated power to potential purchasers represents a restraint of trade. The lumber company contends that cogenerators should sell to the wholesale market, where utilities have no state-granted monopoly. Attorneys for the two sides are unsure of the immediate outcome, but predict that antitrust action or threatened action could give cogenerators unfair leverage.

    A preliminary exploration is given of the legal and economic considerations surrounding the formation and operation of some form of utility-sponsored collective buying arrangement for heliostats. Particular attention is focused on considerations of federal antitrust law surrounding collective buying and other joint operations by electric utilities. Attention is also given to considerations suggested by the economic theory of monopsony (markets with a single buyer) and oligopsony (markets with a small number of buyers).     Understanding the diverse PHEV purchase behaviors among prospective new car buyers is key for designing efficient and effective policies for promoting new energy vehicle technologies. The ORNL MA3T model developed for the U.S. Department of Energy is described and used to project PHEV purchase probabilities by different consumers. MA3T disaggregates the U.S. household vehicle market into 1458 consumer segments based on region, residential area, driver type, technology attitude, home charging availability and work charging availability and is calibrated to the EIA s Annual Energy Outlook. Simulation results from MA3T are used to identify the more likely PHEV buyers and provide explanations. It is observed that consumers who have home charging, drive more frequently and live in urban area are more likely to buy a PHEV. Early adopters are projected to be more likely PHEV buyers in the early market, but the PHEV purchase probability by the late majority consumer can increase over time when PHEV gradually becomes a familiar product.     Public Works and Government Services Canada (PWGSC) is the equivalent to the U.S. General Services Administration (GSA). The Central Procurement Agency purchases all goods and services for the federal public sector-$1.5 billion per annum expenditure for information technology. The personal computer (PC) group buys about 300 million PCs per annum. All requirements are fulfilled through a competitive process, which involves a Request for Proposal. The lowest compliant bidder always wins. All requirements are computed under GATT and NAFTA. PWGSC and GSA purchase the same office technology. PWGSC has a standing offer method of supply, much like a GSA schedule. Only the least expensive vendors are allowed on the standing offer after a Request for Standing Offer. The price is determined by a mean plus one standard deviation, so 68% of the bidders make it on to the standing offer. Multiple vendors offer multiple platforms, and a wide variety are from the United States and the Canadian Pacific Rim. New PC technology introduced through categories is where the `green` issue comes in. Those categories reflect new PC technology, usually models with Intel CPUs. A green PC category was created in parallel with other nongreen categories. All the testing - not necessarily green testing - was done by the Philadelphia based National Software Testing Laboratory. Again, the lowest compliant bidder is always used. This laboratory does a good job of performance, usability, and compatibility studies. The green category, one category out of a possible six, specifies Energy Star. All the suppliers to the Canadian Government also supply to the U.S. Government. Canadian PC manufacturers essentially repackage Taiwanese or U.S. components, and through the insight of GSA, it is very easy for a vendor to become an Energy Star partner. An in-house test methodology with a watt meter was developed.

    The business of buying and selling producing oil and gas properties has been active over the past decade. On frequently encountered difficulty is that many producing properties are subject to operating agreements containing `preferential right of purchase` PRP provisions, also referred to as rights of first refusal or preemptive rights. Under a PRP clause, a party wanting to sell its interest must first provide notice to other parties to the operating agreement and an opportunity to acquire the sellers rights and interests in the property. Determining if a PRP clause applies to a particular transaction and the extent of such application is not always easy. In addition if the PRP clause does apply and the holder elects to purchase the property, the deal for which the buyer and seller have bargained may be frustrated. Topics covered in this article include the following: scope of `sales` covered by the PRP clause; exclusion from preferential right; events triggering the PRP provision.

    Three Sites win EPA Federal Green Challenge Awards DOE's National Renewable Energy Laboratory (NREL), Brookhaven National Laboratory (BNL), and East Tennessee Technology Park (ETTP) were all recognized by EPA's Federal Green Challenge for their 2012 accomplishments.     Federal agency leaders are expressing growing interest in using innovative fuel cell combined heat and power (CHP) technology at their sites, motivated by both executive branch sustainability targets and a desire to lead by example in the transition to a clean energy economy. Fuel cell CHP can deliver reliable electricity and heat with 70% to 85% efficiency. Implementing this technology can be a high efficiency, clean energy solution for agencies striving to meet ambitious sustainability requirements with limited budgets. Fuel cell CHP systems can use natural gas or renewable fuels, such as biogas. Procuring Stationary Fuel Cells for CHP: A Guide for Federal Facility Decision Makers presents an overview of the process for planning and implementing a fuel cell CHP project in a concise, step-by-step format. This guide is designed to help agency leaders turn their interest in fuel cell technology into successful installations. This guide concentrates on larger (100 kW and greater) fuel cell CHP systems and does not consider other fuel cell applications such as cars, forklifts, backup power supplies or small generators (<100 kW). Because fuel cell technologies are rapidly evolving and have high up front costs, their deployment poses unique challenges. The electrical and thermal output of the CHP system must be integrated with the building s energy systems. Innovative financing mechanisms allow agencies to make a make versus buy decision to maximize savings.     The Federal Fleet Conversion Task Force was created by Executive Order 12844, signed by President Clinton on April 21, 1993. In the Order, the President directed that purchases of alternative fueled vehicles by the Federal Government be substantially increased beyond the levels required by current law. The President charged the Task Force with developing recommendations for carrying out the Executive Order, with special emphasis on setting a course that will lead to the widespread use of alternative fueled vehicles by Federal, State, and local government fleets, by private fleets and, ultimately, by individuals. The chief recommendation of the Task Force is the establishment of a Presidential Clean Cities Initiative. To support creation of the Presidential Initiative, the Task Force identified 38 cities and regions, prioritized into three tiers, for concentrating the Initiative`s efforts in Fiscal Years 1994 through 1996. This concentration of effort is key to the effectiveness of the Initiative. The 38 cities and regions would receive priority funding for Federal vehicle purchases and for infrastructure development. In addition, the Task Force has made specific recommendations for overcoming numerous regulatory, economic, and technical barriers that have slowed the introduction of alternative fueled vehicles into general use.

    The US has signed an Agreement with the Russian Federation for the purchase of 500 metric tons of highly enriched uranium (HEU) derived from dismantled Russian nuclear weapons. The BEU will be blended down to low-enriched uranium (LEU) in Russia and will be transported to the US to be used by fuel Fabricators to make fuel for commercial nuclear power plants. Both the United States and Russia have been preparing to institute transparency measures to provide confidence that the nonproliferation, physical protection, and material control and accounting requirements specified in the Agreement are met. This paper provides a background on the Agreement and subsequent on-going negotiations to develop transparency measures suited to the facilities and processes which are expected to be involved.

The solar hot water system produces up to 50,000 gallons of hot water daily, enough to meet the needs of 1,250 inmates and staff who use the kitchen, shower, and laundry facilities.     Federal fleets are a frequent subject of legislative and executive efforts to lead a national transition to alternative fuels and advanced vehicle technologies. Section 701 of the Energy Policy Act of 2005 requires that all dual-fueled alternative fuel vehicles in the federal fleet be operated on alternative fuel 100% of the time when they have access to it. However, in Fiscal Year (FY) 2012, drivers of federal flex fuel vehicles (FFV) leased through the General Services Administration refueled with E85 24% of the time when it was available--falling well short of the mandate. The U.S. Department of Energy's National Renewable Energy Laboratory completed a 2-year Laboratory Directed Research and Development project to identify the factors that influence the refueling behavior of federal FFV drivers. The project began with two primary hypotheses. First, information scarcity increases the tendency to miss opportunities to purchase E85. Second, even with perfect information, there are limits to how far drivers will go out of their way to purchase E85. This paper discusses the results of the project, which included a June 2012 survey of federal fleet drivers and an empirical analysis of actual refueling behavior from FY 2009 to 2012. This research will aid in the design and implementation of intervention programs aimed at increasing alternative fuel use and reducing petroleum consumption.

    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    The FHFA regulates Fannie Mae, Freddie Mac, and the 12 Federal Home Loan Banks (the government-sponsored enterprises - GSEs). On June 18, 2009, James B. Lockhart III, then Director of FHFA, released a letter expressing concern about the negative impact of energy loan tax assessment programs (ELTAPs) - also known as Property Assessed Clean Energy (PACE) programs - on both the housing finance system and homeowner program participants. Subsequently, a number of PACE proponents responded to the concerns laid out in the FHFA letter. In early Fall 2009, word circulated that FHFA was planning to follow its June letter with guidance to other agencies, possibly including Fannie Mae and Freddie Mac, discouraging them from buying loans on properties subject to PACE-type assessment liens. This triggered a second round of stakeholder letters, several of which were addressed to President Obama. On October 18, 2009, the White House, in what some believe was an attempt to obviate the need for FHFA guidance, released a Policy Framework for PACE Financing Programs that outlined best practices guidance for homeowner and lender protection. As of February 2010, FHFA and the GSEs have agreed to monitor PACE programs and work with stakeholders and the Administration to consider additional guidance beyond the Policy Framework and to collect more information on PACE program efficacy and risks. A summary of the communications timeline and highlights of the communications are provided.

    The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.
