    Federal agencies have had performance contracting authority since 1985, when Congress first authorized agencies to enter into shared energy savings agreements with Public Law 99-272, the Consolidated Omnibus Budget Reconciliation Act. By the end of FY 2001, agencies had used energy savings performance contracts (ESPCs) to attract private-sector investment of over $1 billion to improve the energy efficiency of federal buildings. Executive Order 13123 directs agencies to maximize their use of alternative financing contracting mechanisms such as ESPCs when life-cycle cost effective to reduce energy use and cost in their facilities and operations. Continuing support for ESPCs at the Administration and Congressional levels is evident in the pending comprehensive national energy legislation, which repeals the sunset provision on ESPC authority and extends ESPC authority to water savings projects. Despite the Congressional and Presidential directives to use ESPCs, some agencies have been reluctant to do so. Decision makers in these agencies see no reason to enter into long-term obligations to pay interest on borrowed money out of their own operating budgets if instead Congress will grant them appropriations to pay for the improvements up front. Questions frequently arise about whether pricing in ESPCs, which are negotiated for best value, is as favorable as prices obtained through competitive sourcing, and whether ESPC as a means of implementing energy conservation projects is as life-cycle cost effective as the standard practice of funding these projects through appropriations. The lack of any quantitative analysis to address these issues was the impetus for this study. ESPCs are by definition cost-effective because of their ''pay-from-savings'' requirement and guarantee, but do their interest costs and negotiated pricing extract an unreasonably high price? Appropriations seem to be the least-cost option, because the U.S. Treasury can borrow money at lower interest rates

    An ESPC is a working relationship between a Federal agency and an energy service company (ESCO). The ESCO conducts a comprehensive energy audit for the Federal facility and identifies improvements to save energy. In consultation with the Federal agency, the ESCO designs and constructs a project that meets the agency’s needs and arranges the necessary funding. The ESCO guarantees the improvements will generate energy cost savings sufficient to pay for the project over the term of the contract. After the contract ends, all additional cost savings accrue to the agency.

    The Energy Savings Performance Contract (ESPC) ENABLE program, a new project funding approach, allows small Federal facilities to realize energy and water savings in six months or less. ESPC ENABLE provides a standardized and streamlined process to install targeted energy conservation measures (ECMs) such as lighting, water, and controls with measurement and verification (M&V) appropriate for the size and scope of the project. This allows Federal facilities smaller than 200,000 square feet to make progress towards important energy efficiency and water conservation requirements.

    Pending or recently enacted greenhouse gas regulations and mandates are leading to the need for current and feasible GHG reduction solutions including combined heat and power (CHP). Distributed generation using advanced reciprocating engines, gas turbines, microturbines and fuel cells has been shown to reduce greenhouse gases (GHG) compared to the U.S. electrical generation mix due to the use of natural gas and high electrical generation efficiencies of these prime movers. Many of these prime movers are also well suited for use in CHP systems which recover heat generated during combustion or energy conversion. CHP increases the total efficiency of the prime mover by recovering waste heat for generating electricity, replacing process steam, hot water for buildings or even cooling via absorption chilling. The increased efficiency of CHP systems further reduces GHG emissions compared to systems which do not recover waste thermal energy. Current GHG mandates within the U.S Federal sector and looming GHG legislation for states puts an emphasis on understanding the GHG reduction potential of such systems. This study compares the GHG savings from various state-of-the- art prime movers. GHG reductions from commercially available prime movers in the 1-5 MW class including, various industrial fuel cells, large and small gas turbines, micro turbines and reciprocating gas engines with and without CHP are compared to centralized electricity generation including the U.S. mix and the best available technology with natural gas combined cycle power plants. The findings show significant GHG saving potential with the use of CHP. Also provided is an exploration of the accounting methodology for GHG reductions with CHP and the sensitivity of such analyses to electrical generation efficiency, emissions factors and most importantly recoverable heat and thermal recovery efficiency from the CHP system.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services

    This paper discusses the use of a Shared Energy Savings (SES) contract as the procurement vehicle to provide, install, and maintain closed-loop ground-coupled heat pumps (CLGCHP`s) for 4,003 family-housing units at Fort Polk, Louisiana. In addition to the requirement relative to heat pumps, the contract allows the energy service company (ESCO) to propose additional projects needed to take full advantage of energy cost-saving opportunities that may exist at Fort Polk. The paper traces the development of the SES contract from feasibility study through development of the request for proposal (RFP) to contract award and implementation. In tracing this development, technical aspects of the project are set forth and various benefits inherent in SES contracting are indicated. The paper concludes that, due to the positive motivation inherent in the shared-savings, as well as partnering aspects of SES contracts, SES contracting is well suited to use as a procurement vehicle.

    In order to provide a sound basis and foundation for integrated Project and Contract change management, it is imperative to ensure the alignment of the Negotiated Contract Costs (NCC) with the Contract Budget Base (CBB), where CBB is defined as the Performance Measurement Baseline (PMB) plus Management Reserve (MR). The achievement of this alignment assures customer and contractor agreement on scope, requirements, quantities, schedule and cost, which facilitates the identification of change conditions and ultimate agreement on the value of changes to the NCC and the CBB. Delays in contract/CBB true up/reconciliation can negatively effect measurement of project progress, limiting owner understanding of liability, and may result in increased contract disagreements and potential claims. The Department of Energy Oak Ridge Office of Environmental Management (OR-EM) and URS - CH2M Oak Ridge LLC (UCOR) achieved alignment of the NCC with the CBB within 10 months of UCOR taking over work on the East Tennessee Technology Park (ETTP) cleanup contract by: 1. The model developed for this report estimates the magnitude of CHP that could be implemented under various performance and economic assumptions associated with different applications. This model may be useful for other energy technologies. It can be adapted to estimate the market potential in federal buildings for any energy system based on the cost and performance parameters that a user desires to assess. The model already incorporates a standard set of parameters based on available data for federal buildings including total building space, building type, energy use intensity, fuel costs, and the performance of many prime movers commonly used in CHP applications.     Implementing solar energy projects at federal facilities is a process. The project planning phase of the process includes determining goals, building a team, determining site feasibility and selecting the appropriate project funding tool. This fact sheet gives practical guidance to assist decision-makers with understanding and selecting the funding tool that would best address their site goals. Because project funding tools are complex, federal agencies should seek project assistance before making final decisions. High capital requirements combined with limits on federal agency energy contracts create challenges for funding solar projects. Solar developers typically require long-term contracts (15-20) years to spread out the initial investment and to enable payments similar to conventional utility bill payments. In the private sector, 20-year contracts have been developed, vetted, and accepted, but the General Services Administration (GSA) contract authority (federal acquisition regulation [FAR] part 41) typically limits contract terms to 10 years. Payments on shorter-term contracts make solar economically unattractive compared with conventional generation. However, in several instances, the federal sector has utilized innovative funding tools that allow long-term contracts or has created a project package that is economically attractive within a shorter contract term.

    Juvenile rainbow trout (Oncorhynchus mykiss) were fed either 5 or 20 {micro}g, 2,2{prime},4,4{prime},5,5{prime}-hexachlorobiphenyl (245-HxCB)/g diet (wet wt.) for 4,8, or 12 weeks. Hepatic xenobiotic-metabolizing enzyme activities and dietary 245-HxCB accumulation in liver, muscle, and remaining carcass were determined. Liver-to-body weight ratios were not altered by either of the two 245-HxCB concentrations. Relative growth rate increased with time but was not altered by 245-HxCB concentration. Bioaccumulation of 245-HxCB was dose and time dependent in all tissues without reaching apparent stayed state. Hepatic arylhydrocarbon hydroxylase (AHH) activities increased with 245-HxCB dose and with time. Ethoxyresorufin-O-deethylase (EROD) activities also increased in fish fed 20 {micro}g 245-HxCB/g diet. No 245-HxCB-induced changes in uridine diphosphoglucuronosyl transferase (UDP-DT) or NADPH-dytochrome-c reductase (NCCR) activities were determined. High-resolution GC-MS analysis of the 245-HxCB standard revealed trace (0.4--0.5%) contamination by two mono-ortho pentachlorobiphenyls (PnCBs): 2,3,3{prime},4,4{prime}-PnCB and 2,3,4,4{prime},5-PnCB. Total liver accumulation of these contaminants was inversely related with corresponding EROD and AHH activities and estimated to contribute minimally to their induction. Results from this study suggested that long-term dietary 245-HxCB exposure induced cytochrome P4501A activities in rainbow trout liver.

    This report documents the results of the ORNL investigation into prime movers that would be desirable for the construction of a power system suitable for the United States Marine Corps (USMC) expeditionary forces under Operational Maneuvers From The Sea (OMFTS) doctrine. Discrete power levels of {approx}1, 5, 15, and 30 kW are considered. The only requirement is that the prime mover consumes diesel fuel. A brief description is given for the prime movers to describe their basic scientific foundations and relative advantages and disadvantages. A list of key attributes developed by ORNL has been weighted by the USMC to indicate the level of importance. A total of 14 different prime movers were scored by ORNL personnel in four size ranges (1,5, 15, & 30 kW) for their relative strength in each attribute area. The resulting weighted analysis was used to indicate which prime movers are likely to be suitable for USMC needs. No single engine or prime mover emerged as the clear-cut favorite but several engines scored as well or better than the diesel engine. At the higher load levels (15 & 30 kW), the results indicate that the open Brayton (gas turbine) is a relatively mature technology and likely a suitable choice to meet USMC needs. At the lower power levels, the situation is more difficult and the market alone is not likely to provide an optimum solution in the time frame desired (2010). Several prime movers should be considered for future developments and may be satisfactory; specifically, the Atkinson cycle, the open Brayton cycle (gas turbine), the 2-stroke diesel. The rotary diesel and the solid oxide fuel cell should be backup candidates. Of all these prime movers, the Atkinson cycle may well be the most suitable for this application but is an immature technology. Additional demonstrations of this engine will be conducted at ORNL. If this analysis is positive, then the performance of a generator set using this engine, the open Brayton and the 2-stroke diesel should

    This updated market assessment for capturing water conservation opportunities in the Federal sector is based on a new analytical approach that utilizes newly available data and technologies. The new approach fine-tunes the original assessment by using actual Federal water use, which is now tracked by DOE (as compared to using estimated water use). Federal building inventory data is also used to disseminate water use by end-use technology in the Federal sector. In addition, this analysis also examines the current issues and obstacles that face performance contracting of water efficiency projects at Federal sites.
