    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    The theme for the 1998 workshop was Standards Management -- A World of Change and Opportunities. The workshop`s goal was to further the implementation of the National Technology Transfer and Advancement Act of 1995 (Public Law 104-113) through the sharing of standards management success stories, lessons learned, and emerging initiatives within the Executive Branch of the Federal Government. The target audience for this workshop included agency/department and contractor personnel and representatives of standards developing organizations that either used technical standards in their work for the Federal Government of participated in standards writing/management activities in support of the missions and programs of Federal agencies/departments. As with previous standards workshops sponsored by the DOE, views on the technical subject areas under the workshop theme were solicited from and provided by agency Standards Executives and standards program managers, voluntary standards organizations, and the private sector.     The hearing was called regarding the responsibilities of the state and Federal government in administering the Federal Surface Mining Control and Reclamation Act of 1977. With mining taking place in 27 states under a variety of conditions and practices, the Act encourages the states to assume primacy responsibility for regulating coal mining. Once a state's plan is approved, the Federal role becomes one of oversight. This hearing examines Pennsylvania's programs and what happens when there is a disagreement between state and Federal authorities.     The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances. To this end,this paper is an earth scientist s attempt to comprehend essentialelements of water law, and to examine their connections to science.Science and law share a common logical framework of starting with apriori prescribed tenets, and drawing consistent inferences. In science,observationally established physical laws constitute the tenets, while inlaw, they stem from social values. The foundations of modern water law inEurope and the New World were formulated nearly two thousand years ago byRoman jurists who were inspired by Greek philosophy of reason.Recognizing that vital natural elements such as water, air, and the seawere governed by immutable natural laws, they reasoned that theseelements belonged to all humans, and therefore cannot be owned as privateproperty. Legally, such public property was to be governed by jusgentium, the law of all people or the law of all nations. In contrast,jus civile or civil law governed private property. Remarkably, jusgentium continues to be relevant in our contemporary society in whichscience plays a pivotal role in exploiting vital resources common to all.This paper examines the historical roots of modern water law, followstheir evolution through the centuries, and examines how the spirit ofscience inherent in jus gentium is profoundly influencing evolving waterand environmental laws in Europe, the United States and elsewhere. In atechnological world, scientific knowledge has to lie at the core of waterlaw. Yet, science cannot formulate law. It is hoped that a philosophicalunderstanding of the relationships between science and law willcontribute to their constructively coming together in the service ofsociety.

    We analyze the temperature relaxation phenomena of systems in contact with a thermal reservoir that undergoes a non-Markovian diffusion process. From a generalized Langevin equation, we show that the temperature is governed by a law of cooling of the Newton’s law type in which the relaxation time depends on the velocity autocorrelation and is then characterized by the memory function. The analysis of the temperature decay reveals the existence of an anomalous cooling in which the temperature may oscillate. Despite this anomalous behavior, we show that the variation of entropy remains always positive in accordance with the second law of thermodynamics.

    The Atomic Energy Act of 1954 established, and later Congressional amendments have confirmed, that except in areas which have been explicitly granted to the states, the federal government possesses preemptive authority to regulate radiation hazards associated with the development and use of atomic energy. Since the passage of the original Act, numerous decisions by the courts have reaffirmed the legitimacy of federal preemption, and have defined and redefined its scope. In this study, the aim is to explore the underlying issues involved in federal preemption of radiation-hazard regulation, and to recommend actions that the Department of Energy and other agencies and groups should consider undertaking in the near term to protect the preemption principle. Appropriate roles of the states are discussed, as well as recent state-level activities and their rationale, and several current arenas in which state-federal conflicts about regulation of hazards are being played out. The emphasis here is on four particular arenas that are now important arenas of conflict, but the issues discussed are far broader in scope. These four arenas are: state-level moratorium activity; emergency planning for reactors; conflicts arising from state financial regulation; and inroads in federal preemption through litigation under state law.

    Federal and state law enforcement authorities have amassed large collections of DNA samples and the identifying profiles derived from them. These databases help to identify the guilty and to exonerate the innocent, but as the databanks grow, so do fears about civil liberties. The research reported here discusses three legal and social policy issues that have been raised in regard to these biobanks—the choice of loci to type for identifying individuals, the indefinite retention of DNA samples, and the use of the DNA samples or the identifying profiles for research purposes. It also considers the possible value of the databases for research into the genetics of human behavior and the ethics of using them for this purpose. It rejects the broad claim that such research is inherently unethical but proposes procedures for ensuring that the value of the proposed research justifies any psychosocial or other risks to the subjects of the research.

Section 246(a) of EISA directs Federal agencies to install at least one renewable fuel pump at each Federal fleet fueling center under their jurisdiction by January 1, 2010.     On December 19, 2007, the Energy Independence and Security Act of 2007 (EISA) was signed into law as Public Law 110-140. Section 246(a) of EISA directs Federal agencies to install at least one renewable fuel pump at each Federal fleet fueling center under their jurisdiction by January 1, 2010. Section 246(b) requires the President to submit an annual report to Congress on Federal agency progress in meeting this renewable fuel pump installation mandate. This guidance document provides guidelines to help agencies understand these requirements and how to comply with EISA Section 246.

The resulting product is a search engine called Needle, an open-source-based tool that the INL uses internally for researching across a wide variety of information repositories. Needle has a flexible search interface that allows end users to point at any available data source. A user can select multiple sources such as commercialmore » databases (Web of Science, Engineering Index), external resources (WorldCat, Google Scholar), and internal corporate resources (email, document management system, library collections) in a single interface with one search query.     This paper reports on tanker owners which face a growing dilemma on the issue of oil spill liability. The U.S. Oil Pollution Act, passed last year in the wake of the March 1989 Exxon Valdez oil spill, was intended to reduce risk of and damage from such accidents. However, in addition to phasing in double hulls on most tankers operating in U.S. waters, the law substantially increases shipowner's liability for spills. And the federal law does not preempt state liability laws, which in most cases amount to unlimited liability for spill cleanup. Rather than face potentially unlimited liability in the event of a spill, tanker owners worldwide are exercising a number of options to shield themselves. Some of those options could increase the potential for oil spills, industry officials warn. The act also threatens to shatter the international alliance among shippers. A report by Drewry Shipping Consultants Ltd., London, says the law could have a devastating effect on operating practices. Tanker owners and operators have voiced the most opposition to the new spill law and the shackles it places on them. Now the industry that insures tankers has spoken up about is increased liability, and it too may launch a boycott.

    The goal of the U.S. Department of Energy's (DOE) Loaner Program is to increase the awareness, deployment, and use of electric vehicles (EVs) in Federal fleets. The Loaner Program accomplishes this by providing free EVs to Federal fleets on a loaner basis, generally for 1 or 2 months. The Program partners DOE with six electric utilities, with DOE providing financial support and some leads on Federal fleets interested in obtaining EVs. The utilities obtain the vehicles, identify candidate loaner fleets, loan the vehicles, provide temporary charging infrastructure, provide overall support to participating Federal fleets, and support fleets with their leasing decisions. While the utilities have not had the success initially envisioned by themselves, DOE, the Edison Electric Institute, and the Electric Vehicle Association of the Americas, the utilities can not be faulted for their efforts, as they are not the entity that makes the ultimate lease or no-lease decision. Some external groups have suggested to DOE that they direct other federal agencies to change their processes to make loaning vehicles easier; this is simply not within the power of DOE. By law, a certain percentage of all new vehicle acquisitions are supposed to be alternative fuel vehicles (AFV); however, with no enforcement, the federal agencies are not compelled to lease AFVs such as electric vehicles.

    The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.

The passage of a new energy crop rule in Idaho, effective as of March 20, 2014, follows an increased interest in growing, possessing, and transporting energy crops comprised of invasive plant species that are regulated under Idaho’s Invasive Species Act.     The idea to do this research was suggested by the efforts of some consumer groups and others to seek passage of a law in the United States to exempt investor-owned electric utilities from federal income taxes. The goal of the consumer groups is to reduce the charges to utility customers (which is measured in this study by the amount of the operating revenues of the utilities) while not causing any harm to the utilities. The population of interest consisted of all investor-owned electric utilities included on a current Compustat utility tape. In the analysis of the data, the changes in cash flow, operating revenue, and net income were summarized by the 89 utilities as a total group and by the division of the utilities into smaller groups or combinations which used the same accounting methods during the test period. The results of this research suggest the following conclusions concerning the change to a situation in which electric utilities are not subject to federal income taxes: (1) as a group, the decrease in cash flow would be significant, (2) as a group, the decrease in operating revenue (charges to customers) would not be significant, (3) as a group, the increase in net income would be significant, and (4) in analyzing the effects of any financial adjustments or changes on electric utilities, the accounting policies used to the utilities are an important factor.
