    Plaintiff Rocky Mountain Oil and Gas Association, a non-profit trade association, brought suit against the Secretary of the Interior, challenging land management policies of the Department of the Interior which plaintiff contended have effectively prohibited oil and gas exploration in areas proposed as wilderness under the Federal Land Policy Management Act of 1976 (FLPMA). The principal issue at trial was Interior's interpretation of the wilderness study provisions contained in Section 603 of the Act, which directed that activities on oil and gas leases in proposed wilderness areas be managed so as to prevent impairment of wilderness values. The United States Court for the District of Wyoming, Kerr, J., held that strict application of the non-impairment standard of Section 603, FLPMA, by the Department of the Interior virtually halted oil and gas exploration in proposed wilderness areas, and is therefore statutorily erroneous, clearly contrary to Congressional intent, and counter-productive to public interest. The Trial Court's decision is being appealed to the Tenth Circuit Court of Appeals under the title Rocky Mountain Oil and Gas Association v. Watt. 91 references.

    DOE has canceled this EIS, which was to evaluate the environmental impacts of the designation, under Section 368(b) of the Energy Policy Act of 2005, of energy corridors on federal lands in 39 nonwestern states. The corridors, which were to be jointly identified by the Secretaries of Agriculture, Commerce, Defense, Energy, and the Interior, might have been used for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities.

    Much of the environmental and technical data useful to the oil and gas industry and regulatory agencies is now contained in disparate state and federal databases. Delays in coordinating permit approvals between federal and state agencies translate into increased operational costs and stresses for the oil and gas industry. Making federal lease stipulation and area restriction data available on state agency Web sites will streamline a potential lessors review of available leases, encourage more active bidding on unleased federal lands, and give third-party operators independent access to data who otherwise may not have access to lease restrictions and other environmental data. As a requirement of the Energy Policy Conservation Act (EPCA), the Bureau of Land Management (BLM) is in the process of inventorying oil and natural gas resources beneath onshore federal lands and the extent and nature of any stipulation, restrictions, or impediments to the development of these resources. The EPCA Phase 1 Inventory resulted in a collection of GIS coverage files organized according to numerous lease stipulation reference codes. Meanwhile, state agencies also collect millions of data elements concerning oil and gas operations. Much of the oil and gas data nationwide is catalogued in the Ground Water Protection Council's (GWPC's) successfully completed Risk Based Data Management System (RBDMS). The GWPC and the states of Colorado, New Mexico, Utah, and Montana are implementing a pilot project where BLM lease stipulation data and RBDMS data will be displayed in a GIS format on the Internet. This increased access to data will increase bid activity, help expedite permitting, and encourage exploration on federal lands. Linking environmental, lease stipulation and resource inventory assessment data and making a GIS interface for the data available to industry and other agencies via the internet represents an important step in the GWPC strategy for all oil and gas regulatory e

    1997-06-01

    In order to evaluate the transfer of certain Federal lands at Los Alamos National Laboratory (LANL), the US Department of Energy (DOE) determined that the proposed action had the potential to result in environmental impacts and required the preparation of an Environmental Assessment under the National Environmental Policy Act (NEPA). The specific proposed action evaluated by DOE with support from LANL was the transfer of approximately 28 contiguous acres of underutilized Federal land to the County. This tract was locally referred to as the DP Road tract. Although the land was underutilized, it functioned as part of a larger buffer area between potentially hazardous operations at LANL and the general public. The tract was covered with scrub vegetation. There were no government buildings located on the site. The tract of land had two Resource Conservation and Recovery Act (RCRA) Solid Waste Management Units (SWMUs) located within the tract boundary as well as a buried but active liquid radioactive waste pipeline that crossed the site. The tract of land was adjacent to several other DOE SWMUs as well as a public road. In addition, there were ownership issues pertaining to the transfer of the land to persons and agencies other than the County. This particular tract of land was being considered for transfer to the County at the same time DOE and LANL began evaluating another large Federal land tract for lease to the County to be developed as a private research park.

    On August 8, 2005, the President signed the Energy Policy Act of 2005 (EPAct) into law. In Subtitle F of EPAct, Congress set forth various provisions that would change the way certain federal agencies (Agencies) coordinate to authorize the use of land for a variety of energy-related purposes. As part of Subtitle F of EPAct, Section 368 addresses the issue of energy transportation corridors on federal land for oil, gas, and hydrogen pipelines, as well as electricity transmission and distribution facilities. Because of the critical importance of improving the nation's electrical transmission grid, Congress recognized that electricity transmission issues should receive added attention when the Agencies address corridor location and analysis issues. In Section 368, Congress specifically directed the Agencies to consider the need for upgraded and new facilities to deliver electricity: In carrying out [Section 368], the Secretaries shall take into account the need for upgraded and new electricity transmission and distribution facilities to (1) improve reliability; (2) relieve congestion; and (3) enhance capability of the national grid to deliver electricity. Section 368 does not require the Agencies to consider or approve specific projects, applications for rights-of-way (ROWs), or other permits within designated energy corridors. Importantly, Section 368 does not direct, license, or otherwise permit any on-the-ground activity of any sort. If an applicant is interested in obtaining an authorization to develop a project within any corridor designated under Section 368, the applicant would have to apply for a ROW authorization and applicable permits. The Agencies would consider each application by applying appropriate project-specific reviews under requirements of laws and related regulations, including, but not limited to, the National Environmental Policy Act (NEPA), the Clean Water Act, the Clean Air Act, Section 7 of the Endangered Species Act (ESA), and Section 106 of

    This volume contains the appendices for the ''Impact of Geothermal Technology Improvements on Royalty Collections on Federal Lands, Final Report, Volume I.'' The material in this volume supports the conclusions presented in Volume I and details each Known Geothermal Resource Area's (KGRA's) royalty estimation. Appendix A details the physical characteristics of each KGRA considered in Volume I. Appendix B supplies summary narratives on each state which has a KGRA. The information presented in Appendix C shows the geothermal power plant area proxies chosen for each KGRA considered within the report. It also provides data ranges which fit into the IMGEO model for electric energy cost estimates. Appendix D provides detailed cost information from the IMGEO model if no Geothermal Program RandD goals were completed beyond 1987 and if all the RandD goals were completed by the year 2000. This appendix gives an overall electric cost and major system costs, which add up to the overall electric cost. Appendix E supplies information for avoided cost projections for each state involved in the study that were used in the IMGEO model run to determine at what cost/kWh a 50 MWe plant could come on line. Appendix F supplies the code used in the determination of royalty income, as well as, tabled results of the royalty runs (detailed in Appendix G). The tabled results show royalty incomes, assuming a 10% discount rate, with and without RandD and with and without a $0.01/kWh transmission cost. Individual data sheets for each KGRA royalty income run are presented in Appendix G.

    Texas State Lands oil and gas resources are estimated at 1.6 BSTB of remaining mobile oil, 2.1 BSTB, or residual oil, and nearly 10 Tcf of remaining gas. An integrated, detailed geologic and engineering characterization of Texas State Lands has created quantitative descriptions of the oil and gas reservoirs, resulting in delineation of untapped, bypassed compartments and zones of remaining oil and gas. On Texas State Lands, the knowledge gained from such interpretative, quantitative reservoir descriptions has been the basis for designing optimized recovery strategies, including well deepening, recompletions, workovers, targeted infill drilling, injection profile modification, and waterflood optimization. The State of Texas Advanced Resource Recovery program is currently evaluating oil and gas fields along the Gulf Coast (South Copano Bay and Umbrella Point fields) and in the Permian Basin (Keystone East, Ozona, Geraldine Ford and Ford West fields). The program is grounded in advanced reservoir characterization techniques that define the residence of unrecovered oil and gas remaining in select State Land reservoirs. Integral to the program is collaboration with operators in order to deploy advanced reservoir exploitation and management plans. These plans are made on the basis of a thorough understanding of internal reservoir architecture and its controls on remaining oil and gas distribution. Continued accurate, detailed Texas State Lands reservoir description and characterization will ensure deployment of the most current and economically viable recovery technologies and strategies available.

    The long-term U.S. natural gas resource base (1300 + TCF) exists. The challenge is the timely conversion of that resource base to proved, deliverable reserves. Tax credits stimulate the transfer of the natural gas resource base to deliverable proved reserves by effective price enhancement and through the discovery, application, and dissemination of technology. Tax incentives act as net price increases to gas producers as long as all companies have roughly the same tax rate and all are able to utilize the credit. Tax incentives can thus be merged with gas price for statistical purposes. This paper demonstrates how the existence of the 29 credits stimulated drilling, increased relatively clean burning gas reserves, resulted in new technological advances and possibly increased federal tax receipts with no upward pressure on gas prices. New tax-stimulus mechanisms are introduced that will help ensure that tax credits both stimulate drilling and increase tax revenue.

    About 6% of the total coa resource was selected for assessment in the Gulf of Mexico Coastal Plain region of the NCRA project underlies federally proclaimed management areas. Of the approximately 11 billion short tons of coal in this category, approximately 37 percent are estimated to be federally owned. Much of the coal in these categories may not be available for mining, and much of it is probably not economically recoverable. The dispersed nature of Federal holdings, the complicated nature of surface and mineral estate ownership, and the existence of various legal and technological restrictions may remove a significant portion of this coal resource from consideration for development. Continuing work by USGS scientists suggests that potentially viable energy resources of coal-bed methane are present within both Federal and non-Federal areas of the Gulf of Mexico Coastal Plain coal-bearing region. 3 refs., 3 figs.

    Carbon dioxide (CO{sub 2}) and methane (CH{sub 4}) gases are the main contributors to the greenhouse effect that consequently results in global warming. This paper examines the sources and sinks of these gases from/to forest, land use and biomass burning and their likely contribution to climate change using IPCC/OECD methodology. Emissions have been calculated in mass units of carbon and nitrogen Emissions and uptake have been summed for each gas and the emissions converted to full molecular weights. Mismanagement of forests and land misuse have contributed much to greenhouse gas emissions in Tanzania. For example, cultivation methods, forest clearing, burning of savannah grass and indiscriminate logging (non-sustainable logging) have contributed significantly to greenhouse gas emissions. These categories contribute more than 90% of total CO{sub 2} emissions. However, the study shows that shifting cultivation, savannah burning and forest clearing for conversion to permanent crop land and pasture are the main contributors.

    Suits in the last 4-5 years jeopardize the title of thousands of mining claims and mineral leases. The cases presenting the most striking examples are National Wildlife Federation v. Burford, Connor v. Burford, Sierra Club V. Watt, and Bob Marshall Alliance v. Watt. From the claimants' and lessees' point of view, these decisions granted environmental groups sweeping, though somewhat ill-defined, relief. The challenges by environmental groups are based on statutes designed to bring environmental considerations before federal decision makers. The claimants and lessees are caught in the middle of the exchange between environmentalists and federal agencies. Lawsuits that indirectly challenge leases and claims are unlike environmental challenges to fixed projects such as highways or dams. Those affected often times do not know exactly what is at stake. When the challenge is indirect, unexplored, or partially explored, proper ties have only speculative value and the claimants and lessees are often unwilling or unable to engage in a fight with well-heeled environmental public interest law firms. While the federal government has defended the suits, their interests and those of the claimants and lessees may diverge. In the context of the four cases mentioned above, this paper addresses the rights and remedies of claimants and lessees before, during, and after environmental procedural suits that indirectly challenge federal mining claims and mineral leases.

    Utility regulators increasingly take responsibility for the [open quotes]extemalities[close quotes] associated with their decisions, meaning the economic and social costs related to rate decisions or other kinds of authorizations. Yet, when Congress adopted the National Environmental Policy Act of 1969 (NEPA), it intervened to ensure protection of the natural environment, not from abuses by the citizenry but from the activities of the federal government itself. Comprised of action forcing procedures, NEPA was designed to infuse the decisional processes of federal agencies with a broad awareness of the environmental consequences of their actions. NEPA encourages decisionmakers to counterbalance the organic statutory and political missions of their departments or agencies with a sensitivity to the ecological consequences of their directives and authorizations. This paper examines how the requirements of NEPA have fared in the environment of classical public utility regulation at the Federal Energy Regulatory Commission. Commission proceedings did not evidence any widely held opinion that economic regulation of the gas industry is hostile to the NEPA process.

    New flue gas desulfurization (FGD) scrubbing technologies create a dry, solid by-product material consisting of excess sorbent, reaction product that contains sulfate and sulfite, and coal fly ash. Generally, dry FGD by-products are treated as solid wastes and disposed in landfills. However, landfill sites are becoming scarce and tipping fees are constantly increasing. Provided the environmental impacts are socially and scientifically acceptable, beneficial uses via recycling can provide economic benefits to both the producer and the end user of the FGD. A study titled ''Land Application Uses for Dry Flue Gas Desulfurization By-Products'' was initiated in December, 1990 to develop and demonstrate large volume, beneficial uses of FGD by-products. Phase 1 and Phase 2 reports have been published by the Electric Power Research Institute (EPRI), Palo Alto, CA. Phase 3 objectives were to demonstrate, using field studies, the beneficial uses of FGD by-products (1) as an amendment material on agricultural lands and on abandoned surface coal mine land, (2) as an engineering material for soil stabilization and raid repair, and (3) to assess the environmental and economic impacts of such beneficial uses. Application of dry FGD by-product to three soils in place of agricultural limestone increased alfalfa (Medicago sativa L.) and corn (Zea may L.) yields. No detrimental effects on soil and plant quality were observed.

    The Department of Energy`s Advanced Turbine Systems (ATS) program is aimed at fostering the development of a new generation of land-based gas turbine systems with overall efficiencies significantly beyond those of current state-of-the-art machines, as well as greatly increased times between inspection and refurbishment, improved environmental impact, and decreased cost. The proposed duty cycle of ATS machines will emphasize different criteria in the selection of materials for the critical components. In particular, thermal barrier coatings (TBCS) will be an essential feature of the hot gas path components in these machines. In fact, the goals of the ATS will require significant improvements in TBC technology, since these turbines will be totally reliant on TBCs, which will be required to function on critical components such as the first stage vanes and blades for times considerably in excess of those experienced in current applications. Issues that assume increased importance are the mechanical and chemical stability of the ceramic layer and of the metallic bond coat; the thermal expansion characteristics and compliance of the ceramic layer; and the thermal conductivity across the thickness of the ceramic layer. Obviously, the ATS program provides a very challenging opportunity for TBCs, and involves some significant opportunities to extend this technology.     This report provides estimates of the amount of land required by past and future energy development in the United States and examines major federal legislation that regulates the impact of energy facilities on land use. An example of one land use issue associated with energy development - the potential conflict between surface mining and agriculture - is illustrated by describing the actual and projected changes in land use caused by coal mining in western Indiana. Energy activities addressed in the report include extraction of coal, oil, natural gas, uranium, oil shale, and geothermal steam; uranium processing; preparation of synfuels from coal; oil refineries; fossil-fuel, nuclear, and hydro-electric power plants; biomass energy farms; and disposal of solid wastes generated during combustion of fossil fuels. Approximately 1.1 to 3.3 x 10/sup 6/ acres were devoted to these activities in the United States in 1975. As much as 1.8 to 2.0 x 10/sup 6/ additional acres could be required by 1990 for new, nonbiomass energy development. The production of grain for fuel ethanol could require an additional 16.9 to 55.7 x 10/sup 6/ acres by 1990. Federal laws that directly or indirectly regulate the land-use impacts of energy facilities include the National Environmental Protection Act, Clean Air Act, Federal Water Pollution Control Act, Surface Mining Control and Reclamation Act, and Coastal Zone Management Act. The major provisions of these acts, other relevant federal regulations, and similar state and local regulatons are described in this report. Federal legislation relating to air quality, water quality, and the management of public lands has the greatest potential to influence the location and timing of future energy development in the United States.

    The extensive network of geodetic leveling lines in the Houston-Galveston, Texas, area, where at least 110 oil and gas fields have been developed, provides the most comprehensive opportunity in the Gulf Coast to search for the occurrence of land subsidence caused by withdrawal of oil and gas. Although the evaluation is complicated by regional subsidence caused by a decline of ground-water level in aquifers beneath the area, subsidence caused by oil and gas withdrawal can be examined by searching for local increases of subsidence at oil and gas fields crossed by leveling lines. Twenty-nine fields are crossed by lines with repeated leveling surveys. Subsidence profiles across these fields indicate local increases of subsidence at six fields-Alco-Mag, Chocolate Bayou, Goose Creek, Hastings, Mykawa, and South Houston. Although ground-water withdrawal is undoubtedly the most important factor contributing to the total subsidence at each field, oil and gas withdrawal may be partly responsible for the local increases. Except for Chocolate Bayou, the volume of petroleum production at each field was sufficient to account for the increase. The volume of petroleum production, however, in general is not a reliable index for predicting the local increase because land within many fields with significant production did not show local increases of subsidence. With the exception of the 1 m subsidence caused by petroleum withdrawal at Goose Creek (1917-1925), local increases of subsidence were less than 0.3 m.

    Use of ethanol as a transportation fuel in the United States has grown from 76 dam{sup 3} in 1980 to over 40.1 hm{sup 3} in 2009 - and virtually all of it has been produced from corn. It has been debated whether using corn ethanol results in any energy and greenhouse gas benefits. This issue has been especially critical in the past several years, when indirect effects, such as indirect land use changes, associated with U.S. corn ethanol production are considered in evaluation. In the past three years, modeling of direct and indirect land use changes related to the production of corn ethanol has advanced significantly. Meanwhile, technology improvements in key stages of the ethanol life cycle (such as corn farming and ethanol production) have been made. With updated simulation results of direct and indirect land use changes and observed technology improvements in the past several years, we conducted a life-cycle analysis of ethanol and show that at present and in the near future, using corn ethanol reduces greenhouse gas emission by more than 20%, relative to those of petroleum gasoline. On the other hand, second-generation ethanol could achieve much higher reductions in greenhouse gas emissions. In a broader sense, sound evaluation of U.S. biofuel policies should account for both unanticipated consequences and technology potentials. We maintain that the usefulness of such evaluations is to provide insight into how to prevent unanticipated consequences and how to promote efficient technologies with policy intervention.

    This paper provides an overview of recent initiatives of the United States which promote greater use of natural gas and unconventional gas as one part of this nations`s larger response to the global warming threat. Measurable increases in greenhouse gas concentrations since the beginning of the industrial revolution have led to the belief in the existence of a global warming problem. The international community has responded to the global warming threat with the United Nations Framework Convention on Climate Change which is directed toward the stabilization of greenhouse gases in the atmosphere. The Climate Change Action Plan is the Clinton Administration`s detailed response to the global warming threat. It is designed to return United States emissions of greenhouse gases to their 1990 levels by the year 2000. The Action Plan targets all greenhouse gases and emphasizes energy efficiency. Significant regulatory reformation designed to increase the efficiency of the natural gas industry has already occurred and will be continued. Recovery of methane emissions from landfills will be encouraged through indentification of suitable sites and use of existing technology and development of new technology. Recovery of methane from coal mining operations will be promoted by targeting 50 of the gassiest mines in the United States. Even if the Action Plan is fully implemented. legitimate questions arise as to whether its goals will be achieved as a result of funding shortfalls.

    As has been noted in many reports and publications, acquiring new or expanded rights-of-way for transmission is a challenging process, because numerous land use and land ownership constraints must be overcome to develop pathways suitable for energy transmission infrastructure. In the eastern U.S., more than twenty federally protected national trails (some of which are thousands of miles long, and cross many states) pose a potential obstacle to the development of new or expanded electricity transmission capacity. However, the scope of this potential problem is not well-documented, and there is no baseline information available that could allow all stakeholders to study routing scenarios that could mitigate impacts on national trails. This report, Electricity Transmission, Pipelines, and National Trails: An Analysis of Current and Potential Intersections on Federal Lands in the Eastern United States, was prepared by the Environmental Science Division of Argonne National Laboratory (Argonne). Argonne was tasked by DOE to analyze the “footprint” of the current network of National Historic and Scenic Trails and the electricity transmission system in the 37 eastern contiguous states, Alaska, and Hawaii; assess the extent to which national trails are affected by electrical transmission; and investigate the extent to which national trails and other sensitive land use types may be affected in the near future by planned transmission lines. Pipelines are secondary to transmission lines for analysis, but are also within the analysis scope in connection with the overall directives of Section 368 of the Energy Policy Act of 2005, and because of the potential for electrical transmission lines being collocated with pipelines. Based on Platts electrical transmission line data, a total of 101 existing intersections with national trails on federal land were found, and 20 proposed intersections.     Proposed climate mitigation measures do not account for direct biophysical climate impacts of land-use change (LUC), nor do the stabilization targets modeled for the 5th Climate Model Intercomparison Project (CMIP5) Representative Concentration Pathways (RCPs). To examine the significance of such effects on global and regional patterns of climate change, a baseline and alternative scenario of future anthropogenic activity are simulated within the Integrated Earth System Model, which couples the Global Change Assessment Model, Global Land-use Model, and Community Earth System Model. The alternative scenario has high biofuel utilization and approximately 50% less global forest cover compared to the baseline, standard RCP4.5 scenario. Both scenarios stabilize radiative forcing from atmospheric constituents at 4.5 W/m2 by 2100. Thus, differences between their climate predictions quantify the biophysical effects of LUC. Offline radiative transfer and land model simulations are also utilized to identify forcing and feedback mechanisms driving the coupled response. Boreal deforestation is found to strongly influence climate due to increased albedo coupled with a regional-scale water vapor feedback. Globally, the alternative scenario yields a 21st century warming trend that is 0.5 °C cooler than baseline, driven by a 1 W/m2 mean decrease in radiative forcing that is distributed unevenly around the globe. Some regions are cooler in the alternative scenario than in 2005. These results demonstrate that neither climate change nor actual radiative forcing are uniquely related to atmospheric forcing targets such as those found in the RCP’s, but rather depend on particulars of the socioeconomic pathways followed to meet each target.

    This report provides an overview of the regulatory frameworks governing natural gas supply chain infrastructure siting, construction, operation, and maintenance. Information was drawn from a number of sources, including published analyses, government reports, in addition to relevant statutes, court decisions and regulatory language, as needed. The scope includes all onshore facilities that contribute to methane emissions from the natural gas sector, focusing on three areas of state and federal regulations: (1) natural gas pipeline infrastructure siting and transportation service (including gathering, transmission, and distribution pipelines), (2) natural gas pipeline safety, and (3) air emissions associated with the natural gas supply chain. In addition, the report identifies the incentives under current regulatory frameworks to invest in measures to reduce leakage, as well as the barriers facing investment in infrastructure improvement to reduce leakage. Policy recommendations regarding how federal or state authorities could regulate methane emissions are not provided; rather, existing frameworks are identified and some of the options for modifying existing regulations or adopting new regulations to reduce methane leakage are discussed.

    This analysis was updated for Annual Energy Outlook 2009 (AEO): Impact of Limitations on Access to Oil and Natural Gas Resources in the Federal Outer Continental Shelf (OCS). The OCS is estimated to contain substantial resources of crude oil and natural gas; however, some areas of the OCS are subject to drilling restrictions. With energy prices rising over the past several years, there has been increased interest in the development of more domestic oil and natural gas supply, including OCS resources. In the past, federal efforts to encourage exploration and development activities in the deep waters of the OCS have been limited primarily to regulations that would reduce royalty payments by lease holders. More recently, the states of Alaska and Virginia have asked the federal government to consider leasing in areas off their coastlines that are off limits as a result of actions by the President or Congress. In response, the Minerals Management Service (MMS) of the U.S. Department of the Interior has included in its proposed 5-year leasing plan for 2007-2012 sales of one lease in the Mid-Atlantic area off the coastline of Virginia and two leases in the North Aleutian Basin area of Alaska. Development in both areas still would require lifting of the current ban on drilling.

  13. Implications of High Renewable Electricity Penetration in the U.S. for Water Use, Greenhouse Gas Emissions, Land-Use, and Materials Supply

    Recent work found that renewable energy could supply 80% of electricity demand in the contiguous United States in 2050 at the hourly level. This paper explores some of the implications of achieving such high levels of renewable electricity for supply chains and the environment in scenarios with renewable supply up to such levels. Transitioning to high renewable electricity supply would lead to significant reductions in greenhouse gas emissions and water use, with only modest land-use implications. While renewable energy expansion implies moderate growth of the renewable electricity supply chains, no insurmountable long-term constraints to renewable electricity technology manufacturing capacity or materials supply are identified.

    Taking seriously the overall panel question, {open_quotes}Will Light Regulation Promote the Public Interest in Market-Driven Utility Industries?,{close_quotes} the answer depends on (1) the reality of the last phrase, {open_quotes}market-driven utility industries,{close_quotes} and (2) timing. My answer is, {open_quotes}Possibly, but it is by no means certain.{close_quotes} This article centers on what needs to happen in various consumer protection activities to enhance the chances of a satisfactory outcome as we {open_quotes}let down our guard{close_quotes} from more traditional public utility regulation. The topics that I will briefly treat are (1) the worsened information asymmetry, (2) where substitute help might be found for consumer protection, (3) the reemergence of the diversification phenomenon, (4) the opportunities/problems of a dual system of regulation (federal/state) in the current context, and (5) the needed theoretical contributions that I hope our economics profession can make in advancing our knowledge of how oligopolistic markets really work.
