  6. Using the National Environmental Policy Act to facilitate the transfer of federal lands for economic development

    In order to evaluate the transfer of certain Federal lands at Los Alamos National Laboratory (LANL), the US Department of Energy (DOE) determined that the proposed action had the potential to result in environmental impacts and required the preparation of an Environmental Assessment under the National Environmental Policy Act (NEPA). The specific proposed action evaluated by DOE with support from LANL was the transfer of approximately 28 contiguous acres of underutilized Federal land to the County. This tract was locally referred to as the DP Road tract. Although the land was underutilized, it functioned as part of a larger buffer area between potentially hazardous operations at LANL and the general public. The tract was covered with scrub vegetation. There were no government buildings located on the site. The tract of land had two Resource Conservation and Recovery Act (RCRA) Solid Waste Management Units (SWMUs) located within the tract boundary as well as a buried but active liquid radioactive waste pipeline that crossed the site. The tract of land was adjacent to several other DOE SWMUs as well as a public road. In addition, there were ownership issues pertaining to the transfer of the land to persons and agencies other than the County. This particular tract of land was being considered for transfer to the County at the same time DOE and LANL began evaluating another large Federal land tract for lease to the County to be developed as a private research park.

    On August 8, 2005, the President signed the Energy Policy Act of 2005 (EPAct) into law. In Subtitle F of EPAct, Congress set forth various provisions that would change the way certain federal agencies (Agencies) coordinate to authorize the use of land for a variety of energy-related purposes. As part of Subtitle F of EPAct, Section 368 addresses the issue of energy transportation corridors on federal land for oil, gas, and hydrogen pipelines, as well as electricity transmission and distribution facilities. Because of the critical importance of improving the nation's electrical transmission grid, Congress recognized that electricity transmission issues should receive added attention when the Agencies address corridor location and analysis issues. In Section 368, Congress specifically directed the Agencies to consider the need for upgraded and new facilities to deliver electricity: In carrying out [Section 368], the Secretaries shall take into account the need for upgraded and new electricity transmission and distribution facilities to (1) improve reliability; (2) relieve congestion; and (3) enhance capability of the national grid to deliver electricity. Section 368 does not require the Agencies to consider or approve specific projects, applications for rights-of-way (ROWs), or other permits within designated energy corridors. Importantly, Section 368 does not direct, license, or otherwise permit any on-the-ground activity of any sort. If an applicant is interested in obtaining an authorization to develop a project within any corridor designated under Section 368, the applicant would have to apply for a ROW authorization and applicable permits. The Agencies would consider each application by applying appropriate project-specific reviews under requirements of laws and related regulations, including, but not limited to, the National Environmental Policy Act (NEPA), the Clean Water Act, the Clean Air Act, Section 7 of the Endangered Species Act (ESA), and Section 106 of

    Protection of low-income consumers remains an important public policy concern in a restructuring electricity industry. Policies are needed to ensure that low-income households have enough affordable electricity to protect their health and safety, and that they are not victimized by unscrupulous suppliers. In this paper, the author presents three broad federal roles in setting low-income electricity policy, and discuss three more specific policy areas: universal service, electricity assistance, and health and safety. He discusses the key policy issues that arise when considering these potential federal initiatives and draw upon reviews of proposed low-income policies from restructuring proposals in eight states--California, Massachusetts, New Hampshire, New York, Pennsylvania, Rhode Island, Vermont, and Wisconsin.

    Plaintiff Rocky Mountain Oil and Gas Association, a non-profit trade association, brought suit against the Secretary of the Interior, challenging land management policies of the Department of the Interior which plaintiff contended have effectively prohibited oil and gas exploration in areas proposed as wilderness under the Federal Land Policy Management Act of 1976 (FLPMA). The principal issue at trial was Interior's interpretation of the wilderness study provisions contained in Section 603 of the Act, which directed that activities on oil and gas leases in proposed wilderness areas be managed so as to prevent impairment of wilderness values. The United States Court for the District of Wyoming, Kerr, J., held that strict application of the non-impairment standard of Section 603, FLPMA, by the Department of the Interior virtually halted oil and gas exploration in proposed wilderness areas, and is therefore statutorily erroneous, clearly contrary to Congressional intent, and counter-productive to public interest. The Trial Court's decision is being appealed to the Tenth Circuit Court of Appeals under the title Rocky Mountain Oil and Gas Association v. Watt. 91 references.

  19. Environmental assessment of spatial plan policies through land use scenarios

    This paper presents a method based on scenario analysis to compare the environmental effects of different spatial plan policies in a range of possible futures. The study aimed at contributing to overcome two limitations encountered in Strategic Environmental Assessment (SEA) for spatial planning: poor exploration of how the future might unfold, and poor consideration of alternative plan policies. Scenarios were developed through what-if functions and spatial modeling in a Geographical Information System (GIS), and consisted in maps that represent future land uses under different assumptions on key driving forces. The use of land use scenarios provided a representation of how the different policies will look like on the ground. This allowed gaining a better understanding of the policies' implications on the environment, which could be measured through a set of indicators. The research undertook a case-study approach by developing and assessing land use scenarios for the future growth of Caia, a strategically-located and fast-developing town in rural Mozambique. The effects of alternative spatial plan policies were assessed against a set of environmental performance indicators, including deforestation, loss of agricultural land, encroachment of flood-prone areas and wetlands and access to water sources. In this way, critical environmental effects related to the implementation of each policy were identified and discussed, suggesting possible strategies to address them. - Graphical abstract: Display Omitted Research Highlights: Black-Right-Pointing-Pointer The method contributes to two critical issues in SEA: exploration of the future and consideration of alternatives.     Much of the environmental and technical data useful to the oil and gas industry and regulatory agencies is now contained in disparate state and federal databases. Delays in coordinating permit approvals between federal and state agencies translate into increased operational costs and stresses for the oil and gas industry. Making federal lease stipulation and area restriction data available on state agency Web sites will streamline a potential lessors review of available leases, encourage more active bidding on unleased federal lands, and give third-party operators independent access to data who otherwise may not have access to lease restrictions and other environmental data. As a requirement of the Energy Policy Conservation Act (EPCA), the Bureau of Land Management (BLM) is in the process of inventorying oil and natural gas resources beneath onshore federal lands and the extent and nature of any stipulation, restrictions, or impediments to the development of these resources. The EPCA Phase 1 Inventory resulted in a collection of GIS coverage files organized according to numerous lease stipulation reference codes. Meanwhile, state agencies also collect millions of data elements concerning oil and gas operations. Much of the oil and gas data nationwide is catalogued in the Ground Water Protection Council's (GWPC's) successfully completed Risk Based Data Management System (RBDMS). The GWPC and the states of Colorado, New Mexico, Utah, and Montana are implementing a pilot project where BLM lease stipulation data and RBDMS data will be displayed in a GIS format on the Internet. This increased access to data will increase bid activity, help expedite permitting, and encourage exploration on federal lands. Linking environmental, lease stipulation and resource inventory assessment data and making a GIS interface for the data available to industry and other agencies via the internet represents an important step in the GWPC strategy for all oil and gas regulatory e

    Policies aimed at limiting anthropogenic climate change would result in significant transformations of the energy and land-use systems. However, increasing the demand for bioenergy could have a tremendous impact on land use, and can result in land clearing and deforestation. Wise et al. (2009a,b) analyzed an idealized policy to limit the indirect land use change emissions from bioenergy. The policy, while effective, would be difficult, if not impossible, to implement in the real world. In this paper, we consider several different land use policies that deviate from this first-best, using the Joint Global Change Research Institute’s Global Change Assessment Model (GCAM). Specifically, these new frameworks are (1) a policy that focuses on just the above-ground or vegetative terrestrial carbon rather than the total carbon, (2) policies that focus exclusively on incentivizing and protecting forestland, and (3) policies that apply an economic penalty on the use of biomass as a proxy to limit indirect land use change emissions. For each policy, we examine its impact on land use, land-use change emissions, atmospheric CO2 concentrations, agricultural supply, and food prices.

    Many papers have shown that bioenergy and land-use are potentially important elements in a strategy to limit anthropogenic climate change. But, significant expansion of bioenergy production can have a large terrestrial footprint. In this paper, we test the implications for land use, the global energy system, carbon cycle, and carbon prices of meeting a specific climate target, using a single fossil fuel and industrial sector policy instrument—the carbon tax, but with five alternative bioenergy and land-use policy architectures. We find that the policies we examined have differing effects on the different segments of the economy. Comprehensive land policies can reduce land-use change emissions, increasing allowable emissions in the energy system, but have implications for the cost of food. Bioenergy taxes and constraints, on the other hand, have little effect on food prices, but can result in increased carbon and energy prices.

  16. Fifty years of federal radioactive waste management: Policies and practices

    This report provides a chronological history of policies and practices relating to the management of radioactive waste for which the US Atomic Energy Commission and its successor agencies, the Energy Research and Development Administration and the Department of Energy, have been responsible since the enactment of the Atomic Energy Act in 1946. The defense programs and capabilities that the Commission inherited in 1947 are briefly described. The Commission undertook a dramatic expansion nationwide of its physical facilities and program capabilities over the five years beginning in 1947. While the nuclear defense activities continued to be a major portion of the Atomic Energy Commission`s program, there was added in 1955 the Atoms for Peace program that spawned a multiplicity of peaceful use applications for nuclear energy, e.g., the civilian nuclear power program and its associated nuclear fuel cycle; a variety of industrial applications; and medical research, diagnostic, and therapeutic applications. All of these nuclear programs and activities generated large volumes of radioactive waste that had to be managed in a manner that was safe for the workers, the public, and the environment. The management of these materials, which varied significantly in their physical, chemical, and radiological characteristics, involved to varying degrees the following phases of the waste management system life cycle: waste characterization, storage, treatment, and disposal, with appropriate transportation linkages. One of the benefits of reviewing the history of the waste management program policies and practices if the opportunity it provides for identifying the lessons learned over the years. Examples are summarized at the end of the report and are listed in no particular order of importance.

  17. Using federal technology policy to strength the US microelectronics industry

    A review of US and Japanese experiences with using microelectronics consortia as a tool for strengthening their respective industries reveals major differences. Japan has established catch-up consortia with focused goals. These consortia have a finite life targeted from the beginning, and emphasis is on work that supports or leads to product and process-improvement-driven commercialization. Japan`s government has played a key role in facilitating the development of consortia and has used consortia promote domestic competition. US consortia, on the other hand, have often emphasized long-range research with considerably less focus than those in Japan. The US consortia have searched for and often made revolutionary technology advancements. However, technology transfer to their members has been difficult. Only SEMATECH has assisted its members with continuous improvements, compressing product cycles, establishing relationships, and strengthening core competencies. The US government has not been a catalyst nor provided leadership in consortia creation and operation. We propose that in order to regain world leadership in areas where US companies lag foreign competition, the US should create industry-wide, horizontal-vertical, catch-up consortia or continue existing consortia in the six areas where the US lags behind Japan -- optoelectronics, displays, memories, materials, packaging, and manufacturing equipment. In addition, we recommend that consortia be established for special government microelectronics and microelectronics research integration and application. We advocate that these consortia be managed by an industry-led Microelectronics Alliance, whose establishment would be coordinated by the Department of Commerce. We further recommend that the Semiconductor Research Corporation, the National Science Foundation Engineering Research Centers, and relevant elements of other federal programs be integrated into this consortia complex.

    A conceptual framework is presented for describing selected urban and community impacts of Federal energy policies. The framework depends on a simple causal model. The outputs of the model are impacts, changes in the state of the world of particular interest to policymakers. At any given time, a set of determinants account for the state of the world with respect to an impact category. Application of the model to a particular impact category requires: establishing a definition and measure for the impact category and identifying the determinants of these impacts. Analysis of the impact of a particular policy requires the following: identifying the policy and its effects (as estimated by others), isolating any effects that themselves constitute an urban and community impact, identifying any effects that change the value of determinants, and describing the impact with reference to the new values of determinants. This report provides a framework for these steps. Three impacts addressed are: neighborhood stability, housing availability, and quality and availability of public services. In each chapter, a definition and measure for the impact are specified; its principal determinants are identified; how the causal model can be used to estimate impacts by applying it to three illustrative Federal policies (domestic oil price decontrol, building energy performance standards, and increased Federal aid for mass transit) is demonstrated.   20. Expanding the Pool of Federal Policy Options to Promote Industrial Energy Efficiency

    Improving the energy efficiency of industry is essential for maintaining the viability of domestic manufacturing, especially in a world economy where production is shifting to low-cost, less regulated developing countries. Numerous studies have shown the potential for significant cost-effective energy-savings in U.S. industries, but the realization of this potential is hindered by regulatory, information, workforce, and financial obstacles. This report evaluates seven federal policy options aimed at improving the energy efficiency of industry, grounded in an understanding of industrial decision-making and the barriers to efficiency improvements. Detailed analysis employs the Georgia Institute of Technology's version of the National Energy Modeling System and spreadsheet calculations, generating a series of benefit/cost metrics spanning private and public costs and energy bill savings, as well as air pollution benefits and the social cost of carbon. Two of the policies would address regulatory hurdles (Output-Based Emissions Standards and a federal Energy Portfolio Standard with Combined Heat and Power); three would help to fill information gaps and workforce training needs (the Superior Energy Performance program, Implementation Support Services, and a Small Firm Energy Management program); and two would tackle financial barriers (Tax Lien Financing and Energy-Efficient Industrial Motor Rebates). The social benefit-cost ratios of these policies appear to be highly favorable based on a range of plausible assumptions. Each of the seven policy options has an appropriate federal role, broad applicability across industries, utilizes readily available technologies, and all are administratively feasible.

  1. Evaluation of tools for renewable energy policy analysis: The ten federal region model

    The Energy Policy Act of 1992 establishes a program to support development of renewable energy technologies including a production incentive to public power utilities. Because there is a wide range of possible policy actions that could be taken to increase electric market share for renewables, modeling tools are needed to help make informed decisions regarding future policy. Previous energy modeling tools did not contain the region or infrastructure focus necessary to examine renewable technologies. As a result, the Department of Energy Office of Utility Technologies (OUT) supported the development of tools for renewable energy policy analysis. Three models were developed: The Renewable Energy Penetration (REP) model, which is a spreadsheet model for determining first-order estimates of policy effects for each of the ten federal regions; the Ten Federal Region Model (TFRM), which employs utility capacity expansion and dispatching decision; and the Region Electric Policy Analysis Model (REPAM), which was constructed to allow detailed insight into interactions between policy and technology within an individual region. These Models were developed to provide a suite of fast, personal-computer based policy analysis tools; as one moves from the REP model to the TFRM to the REPAM the level of detail (and complexity) increases. In 1993 a panel was formed to identify model strengths, weaknesses (including any potential biases) and to suggest potential improvements. The panel met in January 1994 to discuss model simulations and to deliberate regarding evaluation outcomes. This report is largely a result of this meeting. This report is organized as follows. It provides a description of the TFRM and summarizes the panel`s findings. Individual chapters examine various aspects of the model: demand and load, capacity expansion, dispatching and production costing, reliability, renewables, storage, financial and regulatory concerns, and environmental effects.

    The US Department of Energy (DOE) has recognized the opportunity to achieve energy, economic, and environmental benefits by promoting energy-efficient lighting through federal policies, including lighting standards, financial incentives, and information programs. To assist in this process, the Office of Conservation and Renewable Energy`s Office of Codes and Standards invited Lawrence Berkeley Laboratory to assess prospective national impacts for a variety of policy options. Some progress has already been made in developing lighting policies at both the federal and state levels. The US DOE`s Office of Building Technologies has evaluated lighting efficiency incentives as part of its analysis for the National Energy Strategy. Fluorescent and incandescent lamp standards are included in the national Energy Policy Act of 1992 (P.L. 102-486, October 24, 1992). A few states have analyzed or implemented lamp and luminaire standards. Many policy-related issues merit further investigation. For example, there is considerable debate over issues such as mandatory or voluntary standards versus component labeling and other education-oriented strategies. Several different technologies are involved that interact with each other-lamps (incandescent, compact fluorescent, and HID), ballasts (for fluorescent and HID lamps), and fixtures with reflectors and lenses. Control systems and operation patterns must also be considered (timers, automated dimming, or occupancy sensors). Lighting applications are diverse, ranging from offices, restaurants, hallways, hospital operating rooms, to exterior lights.     The US Department of Energy (DOE) has recognized the opportunity to achieve energy, economic, and environmental benefits by promoting energy-efficient lighting through federal policies, including lighting standards, financial incentives, and information programs. To assist in this process, the Office of Conservation and Renewable Energy's Office of Codes and Standards invited Lawrence Berkeley Laboratory to assess prospective national impacts for a variety of policy options. Some progress has already been made in developing lighting policies at both the federal and state levels. The US DOE's Office of Building Technologies has evaluated lighting efficiency incentives as part of its analysis for the National Energy Strategy. Fluorescent and incandescent lamp standards are included in the national Energy Policy Act of 1992 (P.L. 102-486, October 24, 1992). A few states have analyzed or implemented lamp and luminaire standards. Many policy-related issues merit further investigation. For example, there is considerable debate over issues such as mandatory or voluntary standards versus component labeling and other education-oriented strategies. Several different technologies are involved that interact with each other-lamps (incandescent, compact fluorescent, and HID), ballasts (for fluorescent and HID lamps), and fixtures with reflectors and lenses. Control systems and operation patterns must also be considered (timers, automated dimming, or occupancy sensors). Lighting applications are diverse, ranging from offices, restaurants, hallways, hospital operating rooms, to exterior lights. Responses to the review comments by the Jet Propulsion Laboratory, preparer of the Congressional report, are also included in this supplement.     Utility regulators increasingly take responsibility for the [open quotes]extemalities[close quotes] associated with their decisions, meaning the economic and social costs related to rate decisions or other kinds of authorizations. Yet, when Congress adopted the National Environmental Policy Act of 1969 (NEPA), it intervened to ensure protection of the natural environment, not from abuses by the citizenry but from the activities of the federal government itself. Comprised of action forcing procedures, NEPA was designed to infuse the decisional processes of federal agencies with a broad awareness of the environmental consequences of their actions. NEPA encourages decisionmakers to counterbalance the organic statutory and political missions of their departments or agencies with a sensitivity to the ecological consequences of their directives and authorizations. This paper examines how the requirements of NEPA have fared in the environment of classical public utility regulation at the Federal Energy Regulatory Commission. Commission proceedings did not evidence any widely held opinion that economic regulation of the gas industry is hostile to the NEPA process.

    This volume contains the appendices for the ''Impact of Geothermal Technology Improvements on Royalty Collections on Federal Lands, Final Report, Volume I.'' The material in this volume supports the conclusions presented in Volume I and details each Known Geothermal Resource Area's (KGRA's) royalty estimation. Appendix A details the physical characteristics of each KGRA considered in Volume I. Appendix B supplies summary narratives on each state which has a KGRA. The information presented in Appendix C shows the geothermal power plant area proxies chosen for each KGRA considered within the report. It also provides data ranges which fit into the IMGEO model for electric energy cost estimates. Appendix D provides detailed cost information from the IMGEO model if no Geothermal Program RandD goals were completed beyond 1987 and if all the RandD goals were completed by the year 2000. This appendix gives an overall electric cost and major system costs, which add up to the overall electric cost. Appendix E supplies information for avoided cost projections for each state involved in the study that were used in the IMGEO model run to determine at what cost/kWh a 50 MWe plant could come on line. Appendix F supplies the code used in the determination of royalty income, as well as, tabled results of the royalty runs (detailed in Appendix G). The tabled results show royalty incomes, assuming a 10% discount rate, with and without RandD and with and without a $0.01/kWh transmission cost. Individual data sheets for each KGRA royalty income run are presented in Appendix G.

    As has been noted in many reports and publications, acquiring new or expanded rights-of-way for transmission is a challenging process, because numerous land use and land ownership constraints must be overcome to develop pathways suitable for energy transmission infrastructure. In the eastern U.S., more than twenty federally protected national trails (some of which are thousands of miles long, and cross many states) pose a potential obstacle to the development of new or expanded electricity transmission capacity. However, the scope of this potential problem is not well-documented, and there is no baseline information available that could allow all stakeholders to study routing scenarios that could mitigate impacts on national trails. This report, Electricity Transmission, Pipelines, and National Trails: An Analysis of Current and Potential Intersections on Federal Lands in the Eastern United States, was prepared by the Environmental Science Division of Argonne National Laboratory (Argonne). Argonne was tasked by DOE to analyze the “footprint” of the current network of National Historic and Scenic Trails and the electricity transmission system in the 37 eastern contiguous states, Alaska, and Hawaii; assess the extent to which national trails are affected by electrical transmission; and investigate the extent to which national trails and other sensitive land use types may be affected in the near future by planned transmission lines. Pipelines are secondary to transmission lines for analysis, but are also within the analysis scope in connection with the overall directives of Section 368 of the Energy Policy Act of 2005, and because of the potential for electrical transmission lines being collocated with pipelines. Based on Platts electrical transmission line data, a total of 101 existing intersections with national trails on federal land were found, and 20 proposed intersections.     During the years 1916 to 1924, the United States was subjected to both real and feared energy shortages. Those years of coal strikes, transportation breakdowns, perceived oil scarcity, and world war compelled the Federal government to assume an unprecedented role in fuel-resource management. The Arab oil embargo of 1973 to 1974 precipitated another period of real and perceived energy shortages and intensified Federal intervention in energy-policy formulation. This paper compares Federal policies adopted or considered during these two crises toward production controls, price setting, distribution, and allocation. Attention is focused on the adversarial relationships of such special-interest groups as the major integrated oil companies and the so-called independents; the disputed need for Federal regulation to achieve equity in the distribution and allocation of scarce resources; and the unresolved debate concerning the impact of price and other controls on energy supply.

    About 6% of the total coa resource was selected for assessment in the Gulf of Mexico Coastal Plain region of the NCRA project underlies federally proclaimed management areas. Of the approximately 11 billion short tons of coal in this category, approximately 37 percent are estimated to be federally owned. Much of the coal in these categories may not be available for mining, and much of it is probably not economically recoverable. The dispersed nature of Federal holdings, the complicated nature of surface and mineral estate ownership, and the existence of various legal and technological restrictions may remove a significant portion of this coal resource from consideration for development. Continuing work by USGS scientists suggests that potentially viable energy resources of coal-bed methane are present within both Federal and non-Federal areas of the Gulf of Mexico Coastal Plain coal-bearing region. 3 refs., 3 figs.

  1. Defending mining claims and mineral leases in environmental suits against federal land managers

    Suits in the last 4-5 years jeopardize the title of thousands of mining claims and mineral leases. The cases presenting the most striking examples are National Wildlife Federation v. Burford, Connor v. Burford, Sierra Club V. Watt, and Bob Marshall Alliance v. Watt. From the claimants' and lessees' point of view, these decisions granted environmental groups sweeping, though somewhat ill-defined, relief. The challenges by environmental groups are based on statutes designed to bring environmental considerations before federal decision makers. The claimants and lessees are caught in the middle of the exchange between environmentalists and federal agencies. Lawsuits that indirectly challenge leases and claims are unlike environmental challenges to fixed projects such as highways or dams. Those affected often times do not know exactly what is at stake. When the challenge is indirect, unexplored, or partially explored, proper ties have only speculative value and the claimants and lessees are often unwilling or unable to engage in a fight with well-heeled environmental public interest law firms. While the federal government has defended the suits, their interests and those of the claimants and lessees may diverge. In the context of the four cases mentioned above, this paper addresses the rights and remedies of claimants and lessees before, during, and after environmental procedural suits that indirectly challenge federal mining claims and mineral leases.

    The goal of this 3-year project was to facilitate a more productive dynamic matching between resource providers and resource consumers in Grid environments by explicitly specifying policies. There were broadly two problems being addressed by this project. First, there was a lack of an Open Grid Services Architecture (OGSA)-compliant mechanism for expressing, storing and retrieving user policies and Virtual Organization (VO) policies. Second, there was a lack of tools to resolve and enforce policies in the Open Services Grid Architecture. To address these problems, our overall approach in this project was to make all policies explicit (e.g., virtual organization policies, resource provider policies, resource consumer policies), thereby facilitating policy matching and policy negotiation. Policies defined on a per-user basis were created, held, and updated in MyPolMan, thereby providing a Grid user to centralize (where appropriate) and manage his/her policies. Organizationally, the corresponding service was VOPolMan, in which the policies of the Virtual Organization are expressed, managed, and dynamically consulted. Overall, we successfully defined, prototyped, and evaluated policy-based resource management and access control for OGSA-based Grids. This DOE project partially supported 17 peer-reviewed publications on a number of different topics: General security for Grids, credential management, Web services/OGSA/OGSI, policy-based grid authorization (for remote execution and for access to information), policy-directed Grid data movement/placement, policies for large-scale virtual organizations, and large-scale policy-aware grid architectures. In addition to supporting the PI, this project partially supported the training of 5 PhD students.

    Proposed climate mitigation measures do not account for direct biophysical climate impacts of land-use change (LUC), nor do the stabilization targets modeled for the 5th Climate Model Intercomparison Project (CMIP5) Representative Concentration Pathways (RCPs). To examine the significance of such effects on global and regional patterns of climate change, a baseline and alternative scenario of future anthropogenic activity are simulated within the Integrated Earth System Model, which couples the Global Change Assessment Model, Global Land-use Model, and Community Earth System Model. The alternative scenario has high biofuel utilization and approximately 50% less global forest cover compared to the baseline, standard RCP4.5 scenario. Both scenarios stabilize radiative forcing from atmospheric constituents at 4.5 W/m2 by 2100. Thus, differences between their climate predictions quantify the biophysical effects of LUC. Offline radiative transfer and land model simulations are also utilized to identify forcing and feedback mechanisms driving the coupled response. Boreal deforestation is found to strongly influence climate due to increased albedo coupled with a regional-scale water vapor feedback. Globally, the alternative scenario yields a 21st century warming trend that is 0.5 °C cooler than baseline, driven by a 1 W/m2 mean decrease in radiative forcing that is distributed unevenly around the globe. Some regions are cooler in the alternative scenario than in 2005. These results demonstrate that neither climate change nor actual radiative forcing are uniquely related to atmospheric forcing targets such as those found in the RCP’s, but rather depend on particulars of the socioeconomic pathways followed to meet each target.

    Focusing on the American Southwest, the authors review physical explanations of subsidence, then offer an explanation for the evolving doctrines of responsibility, laws of support, tort liability, and ground water management. Still in its infancy, the effort to develop effective measures to prevent subsidence or compensate for damages will become increasingly clear. They note the societal cost of not dealing directly and rationally with the problem and the subsequent loss of initiatives and options. Ground water withdrawal is a relatively new cause of land subsidence. Dealing with sub-surface support and the avoidance of subsidence damage is a geo-political problem calling for rational planning and management. 50 references.

    Utah is rich in oil shale and oil sands resources. Chief among the challenges facing prospective unconventional fuel developers is the ability to access these resources. Access is heavily dependent upon land ownership and applicable management requirements. Understanding constraints on resource access and the prospect of consolidating resource holdings across a fragmented management landscape is critical to understanding the role Utah’s unconventional fuel resources may play in our nation’s energy policy. This Topical Report explains the historic roots of the “crazy quilt” of western land ownership, how current controversies over management of federal public land with wilderness character could impact access to unconventional fuels resources, and how land exchanges could improve management efficiency. Upon admission to the Union, the State of Utah received the right to title to more than one-ninth of all land within the newly formed state. This land is held in trust to support public schools and institutions, and is managed to generate revenue for trust beneficiaries. State trust lands are scattered across the state in mostly discontinuous 640-acre parcels, many of which are surrounded by federal land and too small to develop on their own. Where state trust lands are developable but surrounded by federal land, federal land management objectives can complicate state trust land development. The difficulty generating revenue from state trust lands can frustrate state and local government officials as well as citizens advocating for economic development. Likewise, the prospect of industrial development of inholdings within prized conservation landscapes creates management challenges for federal agencies. One major tension involves whether certain federal public lands possess wilderness character, and if so, whether management of those lands should emphasize wilderness values over other uses.     Reclamation has long been recognized as an essential action necessary to mitigate the degradation of land caused by mining activities. But, it is only within the past several decades that reclamation has become an integral component of the mineral extraction process. While the Metallic Mining Reclamation Act (MMRA) was passed in 1973, Wisconsin is yet to enact comprehensive state-wide reclamation requirements for mining other than metallic minerals and the code for metallic mining has yet to establish procedures and standards for reclamation success, specifically revegetation and postmining land use. This study integrates several interdisciplinary methodologies including a history of reclamation; an inventory and status report of mined lands; a critique and comparison of existing reclamation policy with previous state and current federal reclamation policies; in-field case studies of revegetation parameters, procedures, and performance standards; and an economic analysis of reclamation technology. This study makes three major recommendations: (1) The metallic mining code should be amended to establish vegetation parameters, measuring methods, and performance standards for revegetation success similar to those contained in the federal Surface Mining Control and Reclamation Act (SMCRA); (2) The metallic mining code should be amended to resolve semantic loopholes by clearly defining the endpoints of terms such as restoration, reclamation, and rehabilitation and by utilizing the reclamation continuum as a planning tool for determining acceptable postmining land use alternatives; and (3) Mandatory statewide nonmetallic legislation should be enacted to strengthen the mineral resource management program in Wisconsin by systematically and uniformly regulating the mining and reclamation of nonmetallic minerals, the state's most important mineral resource.

    Abandoned Mined Lands (AML) are lands that were mined prior to implementation of the federal Surface Mining Control and Reclamation Act (SMCRA) in 1977, but were inadequately reclaimed. Re-mining of AML is being conducted on a routine basis by coal-mining operations in eastern states such as Virginia. Re-mining is a potentially important means of reclaiming AML. However, under current policies, re-mining operations often fail to permit and reclaim priority 1, 2, and 3 AML, especially those areas which present the most severe environmental problems. This paper describes policy issues which affect the potential for AML reclamation by re-mining operations in mountainous mining areas, such as Virginia; efforts underway in Virginia which seek to resolve those issues; and progress achieved to date under that initiative.

    Leakage occurs whenever actions to mitigate greenhouse gas emissions in one part of the world unleash countervailing forces elsewhere in the world so that reductions in global emissions are less than emissions mitigation in the mitigating region. While many researchers have examined the concept of industrial leakage, land-use policies can also result in leakage. We show that land-use leakage is potentially as large as or larger than industrial leakage. We identify two potential land-use leakage drivers, land-use policies and bioenergy. We distinguish between these two pathways and run numerical experiments for each. We also show that the land-use policy environment exerts a powerful influence on leakage and that under some policy designs leakage can be negative. International offsets are a potential mechanism to communicate emissions mitigation beyond the borders of emissions mitigating regions, but in a stabilization regime designed to limit radiative forcing to 3.7 2/m2, this also implies greater emissions mitigation commitments on the part of mitigating regions.

    The Arid Lands Ecology (ALE) facility is a 312-sq-km tract of land that lies on the western side of the Hanford Site in southcentral Washington. The US Atomic Energy Commission officially set aside this land area in 1967 to preserve shrub-steppe habitat and vegetation. The ALE facility is managed by Pacific Northwest Laboratory (PNL) for the US Department of Energy (DOE) for ecological research and education purposes. In 1971, the ALE facility was designated the Rattlesnake Hills Research Natural Area (RNA) as a result of an interagency federal cooperative agreement, and remains the largest RNA in Washington. it is also one of the few remaining large tracts of shrub-steppe vegetation in the state retaining a predominant preeuropean settlement character. This management plan provides policy and implementation methods for management of the ALE facilities consistent with both US Department of Energy Headquarters and the Richland Field Office decision (US Congress 1977) to designate and manage ALE lands as an RNA and as a component of the DOE National Environmental Research Park System.

    This report provides estimates of the amount of land required by past and future energy development in the United States and examines major federal legislation that regulates the impact of energy facilities on land use. An example of one land use issue associated with energy development - the potential conflict between surface mining and agriculture - is illustrated by describing the actual and projected changes in land use caused by coal mining in western Indiana. Energy activities addressed in the report include extraction of coal, oil, natural gas, uranium, oil shale, and geothermal steam; uranium processing; preparation of synfuels from coal; oil refineries; fossil-fuel, nuclear, and hydro-electric power plants; biomass energy farms; and disposal of solid wastes generated during combustion of fossil fuels. Approximately 1.1 to 3.3 x 10/sup 6/ acres were devoted to these activities in the United States in 1975. As much as 1.8 to 2.0 x 10/sup 6/ additional acres could be required by 1990 for new, nonbiomass energy development. The production of grain for fuel ethanol could require an additional 16.9 to 55.7 x 10/sup 6/ acres by 1990. Federal laws that directly or indirectly regulate the land-use impacts of energy facilities include the National Environmental Protection Act, Clean Air Act, Federal Water Pollution Control Act, Surface Mining Control and Reclamation Act, and Coastal Zone Management Act. The major provisions of these acts, other relevant federal regulations, and similar state and local regulatons are described in this report. Federal legislation relating to air quality, water quality, and the management of public lands has the greatest potential to influence the location and timing of future energy development in the United States.

    Forestry programs are frequently invoked as having potential for mitigation of greenhouse gas emissions. Most studies have attempted to quantify the potential impact of forest programs on carbon uptake and the potential costs of such programs. In this paper, we will attempt instead to focus on the institutional issues of the implementation of forestry programs for carbon sequestration. In particular, we explore the challenges for implementing forest programs that are: of increasing technological complexity; and in settings that depart significantly from the idealized conditions of economic models. We start in Section 1 by examining a suite of instruments that are commonly employed to implement a given policy. Section 2 examines a relatively simple case -- a tree-planting program in the US -- and demonstrates that there are significant difficulties involved in implementing a carbon sequestration program, even in a well-developed market economy. Section 3 focuses on other technologies in the US and why the choice of policy instruments and program design is more difficult than for the simple tree-planting case. Section 4 considers implementation of forestry policies in other countries where the economies may bear less resemblance to the ideal market economy than the US. In those settings, the choice of policy instruments may be very sensitive to non-market considerations that are often missed in conventional policy and cost analysis.

    This report addresses the land use impacts of past and future energy development and summarizes the major federal and state legislation which influences the potential land use impacts of energy facilities and can thus influence the locations and timing of energy development. In addition, this report describes and presents the data which are used to measure, and in some cases, predict the potential conflicts between energy development and alternative uses of the nation's land resources. The topics section of this report is divided into three parts. The first part describes the myriad of federal, state and local legislation which have a direct or indirect impact upon the use of land for energy development. The second part addresses the potential land use impacts associated with the extraction, conversion and combustion of energy resources, as well as the disposal of wastes generated by these processes. The third part discusses the conflicts that might arise between agriculture and energy development as projected under a number of DOE mid-term (1990) energy supply and demand scenarios.

    As the nation moves into the 1980s, development of our domestic energy resources must surely be the number one priority of energy policy. Important natural resources are owned by the Federal government and must be dedicated to development in the public interest. This includes a government leasing program which fosters competitive and efficient development of these resources by private companies. Through its antitrust review of individual leases and its general advocacy of competition in the leasing program, the Department of Justice seeks to bring the prospect of a sound national energy policy closer to reality. Examples of how this review functions are drawn from the Outer Continental Shelf Land Acts Amendments of 1978 and the Federal Coal Leasing Amendments Act of 1975. 32 references.

    The purpose for agency action is to preclude surface entry and the location of new mining claims, subject to valid existing rights, within and surrounding the Caliente rail corridor as described in the Yucca Mountain FEIS (DOE 2002). This protective measure is needed to enhance the safe, efficient, and uninterrupted evaluation of land areas for potential rail alignments within the Caliente rail corridor. The evaluation will assist the DOE in determining, through the Rail Alignment environmental impact statement (EIS) process, whether to construct a branch rail line, and to provide support to the BLM in deciding whether or not to reserve a ROW for the rail line under the Federal Land Policy and Management Act (FLPMA). The BLM participated as a cooperating agency in preparing this EA because it is the responsible land manager and BLM staff could contribute resource specific expertise.

    Geothermal electricity production capacity has grown over time because of multiple factors, including its renewable, baseload, and domestic attributes; volatile and high prices for competing technologies; and policy intervention. Overarching federal policies, namely the Public Utilities Regulatory Policies Act (PURPA), provided certainty to project investors in the 1980s, leading to a boom in geothermal development. In addition to market expansion through PURPA, research and development policies provided an investment of public dollars toward developing technologies and reducing costs over time to increase the market competitiveness of geothermal electricity. Together, these efforts are cited as the primary policy drivers for the currently installed capacity. Informing policy decisions depends on the combined impacts of policies at the federal and state level on geothermal development. Identifying high-impact suites of policies for different contexts, and the government levels best equipped to implement them, would provide a wealth of information to both policy makers and project developers.
