    Suits in the last 4-5 years jeopardize the title of thousands of mining claims and mineral leases. The cases presenting the most striking examples are National Wildlife Federation v. Burford, Connor v. Burford, Sierra Club V. Watt, and Bob Marshall Alliance v. Watt. From the claimants' and lessees' point of view, these decisions granted environmental groups sweeping, though somewhat ill-defined, relief. The challenges by environmental groups are based on statutes designed to bring environmental considerations before federal decision makers. The claimants and lessees are caught in the middle of the exchange between environmentalists and federal agencies. Lawsuits that indirectly challenge leases and claims are unlike environmental challenges to fixed projects such as highways or dams. Those affected often times do not know exactly what is at stake. When the challenge is indirect, unexplored, or partially explored, proper ties have only speculative value and the claimants and lessees are often unwilling or unable to engage in a fight with well-heeled environmental public interest law firms. While the federal government has defended the suits, their interests and those of the claimants and lessees may diverge. In the context of the four cases mentioned above, this paper addresses the rights and remedies of claimants and lessees before, during, and after environmental procedural suits that indirectly challenge federal mining claims and mineral leases.

    The statistics in this update of the Outer Continental Shelf Statistics publication document what has happened since federal leasing began on the Outer Continental Shelf (OCS) in 1954. Highlights note that of the 29.8 million acres actually leased from 175.6 million acres offered for leasing, 20.1% were in frontier areas. Total revenues for the 1954-1982 period were $58.9 billion with about 13% received in 1982. The book is divided into six parts covering highlights, leasing, exploration and development, production and revenue, reserves and undiscovered recoverable resources, and pollution problems from well and tanker accidents. 5 figures, 59 tables.

The publication updates and augments the first Federal Offshore Statistics, published in December 1983. It also extends a statistical series published annually from 1969 until 1981 by the US Geological Survey (USGS) under the title Outer Continental Shelf Statistics. The USGS collected royalties and supervised operation and production of minerals on the Outer Continental Shelf (OCS) until the Minerals Management Service (MMS) took over these functions in 1982. Statistics are presented under the following topics: (1) highlights, (2) leasing, (3) exploration and development, (4) production and revenue, (5) federal offshore production by ranking operator, 1983, (6) reserves and undiscovered recoverable resources, and (7) oil pollution in the world's oceans.

The publication updates and augments the first Federal Offshore Statistics, published in December 1983. It also extends a statistical series published annually from 1969 until 1981 by the US Geological Survey (USGS) under the title Outer Continental Shelf Statistics. The USGS collected royalties and supervised operation and production of minerals on the Outer Continental Shelf (OCS) until the Minerals Management Service (MMS) took over these functions in 1982. Some of the highlights are: of the 329.5 million acres offered for leasing, 37.1 million acres were actually leased; total revenues for the 1954 to 1983 period were $68,173,112,563 and for 1983 $9,161,435,540; a total of 22,095 wells were drilled in federal waters and 10,145 wells were drilled in state waters; from 1954 through 1983, federal offshore areas produced 6.4 billion barrels of oil and condensate, and 62.1 trillion cubic feet of natural gas; in 1983 alone production was 340.7 million barrels of oil and condensate, and 3.9 trillion cubic feet of gas; and for the second straight year, no oil was lost in 1983 as a result of blowouts in federal waters. 8 figures, 66 tables.

    A draft environmental impact statement (EPA No. 850428D) assesses the impacts of proposed offtract disposal of waste materials associated with an open pit mine on a prototype oil shale lease tract. The offtract lease would include facilities for retorting, upgrading, power generation, and product storage. Offtract disposal and plant siting would make the mining cite more viable and cost effective. The project would require rerouting of two major country roads, and would eliminate an airport and other facilities. The site would become more isolated, which could affect future development in the area. The Federal Land Policy and Management Act of 1976 mandates the impact study.

    Plaintiff Rocky Mountain Oil and Gas Association, a non-profit trade association, brought suit against the Secretary of the Interior, challenging land management policies of the Department of the Interior which plaintiff contended have effectively prohibited oil and gas exploration in areas proposed as wilderness under the Federal Land Policy Management Act of 1976 (FLPMA). The principal issue at trial was Interior's interpretation of the wilderness study provisions contained in Section 603 of the Act, which directed that activities on oil and gas leases in proposed wilderness areas be managed so as to prevent impairment of wilderness values. The United States Court for the District of Wyoming, Kerr, J., held that strict application of the non-impairment standard of Section 603, FLPMA, by the Department of the Interior virtually halted oil and gas exploration in proposed wilderness areas, and is therefore statutorily erroneous, clearly contrary to Congressional intent, and counter-productive to public interest. The Trial Court's decision is being appealed to the Tenth Circuit Court of Appeals under the title Rocky Mountain Oil and Gas Association v. Watt. 91 references.

    Much of the environmental and technical data useful to the oil and gas industry and regulatory agencies is now contained in disparate state and federal databases. Delays in coordinating permit approvals between federal and state agencies translate into increased operational costs and stresses for the oil and gas industry. Making federal lease stipulation and area restriction data available on state agency Web sites will streamline a potential lessors review of available leases, encourage more active bidding on unleased federal lands, and give third-party operators independent access to data who otherwise may not have access to lease restrictions and other environmental data. As a requirement of the Energy Policy Conservation Act (EPCA), the Bureau of Land Management (BLM) is in the process of inventorying oil and natural gas resources beneath onshore federal lands and the extent and nature of any stipulation, restrictions, or impediments to the development of these resources. The EPCA Phase 1 Inventory resulted in a collection of GIS coverage files organized according to numerous lease stipulation reference codes. Meanwhile, state agencies also collect millions of data elements concerning oil and gas operations. Much of the oil and gas data nationwide is catalogued in the Ground Water Protection Council's (GWPC's) successfully completed Risk Based Data Management System (RBDMS). The GWPC and the states of Colorado, New Mexico, Utah, and Montana are implementing a pilot project where BLM lease stipulation data and RBDMS data will be displayed in a GIS format on the Internet. This increased access to data will increase bid activity, help expedite permitting, and encourage exploration on federal lands. Linking environmental, lease stipulation and resource inventory assessment data and making a GIS interface for the data available to industry and other agencies via the internet represents an important step in the GWPC strategy for all oil and gas regulatory e-commerce. The next step beyond mere data sharing for facilitating the permitting process is to make it possible for industry to file those permit applications electronically. This process will involve the use of common XML schemas.

This report represents the results of the first phase of research under this contract, the description and analysis of regulatory activity associated with exploration activities on the Federal OCS. Volume 1 contains the following three sections: (1) study results; (2) Federal regulatory activities during exploration of Federal OCS leases which involved the US Geological Survey, Environmental Protection Agency, US Coast Guard, Corps of Engineers, and National Ocean and Atmospheric Administration; and (3) state regulatory activities during exploration of Federal OCS leases of Alaska, California, Louisiana, Massachusetts, New Jersey, North Carolina, and Texas.     In order to evaluate the transfer of certain Federal lands at Los Alamos National Laboratory (LANL), the US Department of Energy (DOE) determined that the proposed action had the potential to result in environmental impacts and required the preparation of an Environmental Assessment under the National Environmental Policy Act (NEPA). The specific proposed action evaluated by DOE with support from LANL was the transfer of approximately 28 contiguous acres of underutilized Federal land to the County. This tract was locally referred to as the DP Road tract. Although the land was underutilized, it functioned as part of a larger buffer area between potentially hazardous operations at LANL and the general public. The tract was covered with scrub vegetation. There were no government buildings located on the site. The tract of land had two Resource Conservation and Recovery Act (RCRA) Solid Waste Management Units (SWMUs) located within the tract boundary as well as a buried but active liquid radioactive waste pipeline that crossed the site. The tract of land was adjacent to several other DOE SWMUs as well as a public road. In addition, there were ownership issues pertaining to the transfer of the land to persons and agencies other than the County. This particular tract of land was being considered for transfer to the County at the same time DOE and LANL began evaluating another large Federal land tract for lease to the County to be developed as a private research park.

    As part of its initiative to fulfill its responsibilities to provide support for the incorporated County of Los Alamos (the County) as an Atomic Energy Community, while simultaneously fulfilling its obligations to enhance the self-sufficiency of the County under authority of the Atomic Energy Community Act of 1955 and the Defense Authorization Act, the U.S. Department of Energy (DOE) proposes to lease undeveloped land in Los Alamos, New Mexico, to the County for private sector use as a research park. The Proposed Action is intended to accelerate economic development activities within the County by creating regional employment opportunities through offering federal land for private sector lease and use. As a result of the proposed land lease, any government expenditures for providing infrastructure to the property would be somewhat supplemented by tenant purchase of Los Alamos National Laboratory (LANL) expertise in research and development activities. The presence of a research park within LANL boundaries is expected to allow private sector tenants of the park to be able to quickly and efficiently call upon LANL scientific expertise and facility and equipment capabilities as part of their own research operations and LANL research personnel, in turn, would be challenged in areas complementary to their federally funded research. In this way a symbiotic relationship would be enjoyed by both parties while simultaneously promoting economic development for the County through new job opportunities at the Research Park and at LANL, new indirect support opportunities for the community at large, and through payment of the basic building space leases. A ''sliding-scale'' approach (DOE 1993) is the basis for the analysis of effects in this Environmental Assessment (EA). That is, certain aspects of the Proposed Action have a greater potential for creating adverse environmental effects than others; therefore, they are discussed in greater detail in this EA than those aspects of the action that have little potential for effect. The Proposed Action would result in an increase of as many as 1,500 new direct jobs and, as many as 2,565 indirect jobs could be created from the development of a research park. Lease of the tract would not reduce the size of LANL or change its site boundary. However, approximately 30 ac (12 ha) of a 60-ac (24-ha) tract would be changed from an undeveloped to a developed status. Under the No Action Alternative, no transfer or lease of Federal lands would occur. LANL would not have the benefit of its research personnel working on a variety of complementary research efforts beyond their federally funded responsibilities. No new jobs would be created from proposed development activities. Undeveloped lands would remain in their current condition. Two hypothetical accidents were analyzed that evaluated a potential chemical release and radiological doses to the public from hypothetical accidents at the proposed Research Park. Neither accident scenario resulted in potentially serious health effects for workers or the public at the proposed Research Park. The cumulative effects of the Proposed Action as well as reasonably foreseeable related actions could result in potential adverse health effects. Environmental effects would be limited to the loss of a small amount of wildlife habitat. Additional economic development would be expected to occur.

    The United States (U.S.) Department of Energy (DOE) proposes to lease approximately 3 acres of land at the Los Alamos National Laboratory (LANL) on the southeast tip of Technical Area (TA) 54 for the siting, construction and operation of an AM radio broadcasting antenna. This Environmental Assessment (EA) has been developed in order to assess the environmental effects of the Proposed Action and No Action alternative. The Proposed Action includes the lease of land for the siting, construction and operation of an AM radio broadcasting antenna in TA-54, just north of Pajarito Road and State Highway 4. The No Action Alternative was also considered. Under the No Action Alternative, DOE would not lease land on LANL property for the siting and operation of an AM radio broadcasting antenna; the DOE would not have a local station for emergency response use; and the land would continue to be covered in native vegetation and serve as a health and safety buffer zone for TA-54 waste management activities. Other potential sites on LANL property were evaluated but dismissed for reasons such as interference with sensitive laboratory experiments. Potential visual, health, and environmental effects are anticipated to be minimal for the Proposed Action. The radio broadcasting antenna would be visible against the skyline from some public areas, but would be consistent with other man-made objects in the vicinity that partially obstruct viewsheds (e.g. meteorological tower, power lines). Therefore, the net result would be a modest change of the existing view. Electromagnetic field (EMF) emissions from the antenna would be orders or magnitude less than permissible limits. The proposed antenna construction would not affect known cultural sites, but is located in close proximity to two archaeological sites. Construction would be monitored to ensure that the associated road and utility corridor would avoid cultural sites.

The Domestic Uranium Program regulation, codified at Title 10, Part 760.1, of the US Code of Federal Regulations (CFR), gives DOE the flexibility to continue leasing these lands under the Uranium Lease Management Program (ULMP) if the agency determines that it is in its best interest to do so. A key element in determining what is in DOE`s ``best interest`` is the assessment of the environmental impacts that may be attributable to lease tract operations and associated activities. On the basis of the information and analyses presented in the EA for the ULMP, DOE has determined that the proposed action does not constitute a major Federal action significantly affecting the quality of the human environment, as defined in the National Environmental Policy Act (NEPA) of 1969 (42 United States Code 4321 et seq.), as amended.Therefore, preparation of an environmental impact statement is not required for the ULMP,and DOE is issuing this Finding, of No Significant Impact (FONSI).

    The Committee on Interior and Insular Affairs recommends passage of H.R.1531 as amended by the committee. The purpose of H.R.1531 is to facilitate the development of interstate coal slurry pipelines within the framework of state water law and interstate water allocations. The amendment establishes a procedure through which the Secretary of the Interior may grant the federal power of eminent domain to obtain rights-of-way over private lands to coal pipelines determined to be in the national interest. The Secretary may also grant certified pipelines rights-of-way over federal lands. The pipelines must first obtain any water use permits from the necessary states. The amendment also includes pipelines that would use another media in place of water, such as carbon dioxide. The major issues discussed in this report are certification, employment, state water rights, environment, eminent domain, access over Federal land, and antitrust review.

    Washington State's geothermal potential is wide spread. Hot springs and five strato volcanoes existing throughout the Cascade Range, limited hot spring activity on the Olympic Peninsula, and broad reaching, low temperature geothermal resources found in the Columbia Basin comprise the extent of Washington's known geothermal resources. Determination of resource ownership is the first step in proceeding with geothermal exploration and development activities. The federal and state processes are examined from pre-lease activity through leasing and post-lease development concerns. Plans, permits, licenses, and other requirements are addressed for the federal, state, and local level. Lease, permit, and other forms for a number of geothermal exploration and development activities are included. A map of public lands and another displaying the measured geothermal resources throughout the state are provided.

    This volume contains the appendices for the ''Impact of Geothermal Technology Improvements on Royalty Collections on Federal Lands, Final Report, Volume I.'' The material in this volume supports the conclusions presented in Volume I and details each Known Geothermal Resource Area's (KGRA's) royalty estimation. Appendix A details the physical characteristics of each KGRA considered in Volume I. Appendix B supplies summary narratives on each state which has a KGRA. The information presented in Appendix C shows the geothermal power plant area proxies chosen for each KGRA considered within the report. It also provides data ranges which fit into the IMGEO model for electric energy cost estimates. Appendix D provides detailed cost information from the IMGEO model if no Geothermal Program RandD goals were completed beyond 1987 and if all the RandD goals were completed by the year 2000. This appendix gives an overall electric cost and major system costs, which add up to the overall electric cost. Appendix E supplies information for avoided cost projections for each state involved in the study that were used in the IMGEO model run to determine at what cost/kWh a 50 MWe plant could come on line. Appendix F supplies the code used in the determination of royalty income, as well as, tabled results of the royalty runs (detailed in Appendix G). The tabled results show royalty incomes, assuming a 10% discount rate, with and without RandD and with and without a $0.01/kWh transmission cost. Individual data sheets for each KGRA royalty income run are presented in Appendix G.

    About 6% of the total coa resource was selected for assessment in the Gulf of Mexico Coastal Plain region of the NCRA project underlies federally proclaimed management areas. Of the approximately 11 billion short tons of coal in this category, approximately 37 percent are estimated to be federally owned. Much of the coal in these categories may not be available for mining, and much of it is probably not economically recoverable. The dispersed nature of Federal holdings, the complicated nature of surface and mineral estate ownership, and the existence of various legal and technological restrictions may remove a significant portion of this coal resource from consideration for development. Continuing work by USGS scientists suggests that potentially viable energy resources of coal-bed methane are present within both Federal and non-Federal areas of the Gulf of Mexico Coastal Plain coal-bearing region. 3 refs., 3 figs.

    Federal regulations require that onshore oil and gas leases that are subsequently determined to overlie a known geologic structure are to have their rental rates increased. The Bureau of Land Management does not have internal controls that ensure that such rental increases are processed consistently and in a timely manner. Although BLM'S state offices in Colorado and Wyoming generally increased rental rates for leases determined to overlie known geologic structures, these increases were not made in a timely manner during calendar years 1984 and 1985. These delays resulted in lost revenue of $552,614. There were also a few instances in the two states in which the rental rates had not been increased at all, causing an additional revenue loss of at least $15,123.

    On August 8, 2005, the President signed the Energy Policy Act of 2005 (EPAct) into law. In Subtitle F of EPAct, Congress set forth various provisions that would change the way certain federal agencies (Agencies) coordinate to authorize the use of land for a variety of energy-related purposes. As part of Subtitle F of EPAct, Section 368 addresses the issue of energy transportation corridors on federal land for oil, gas, and hydrogen pipelines, as well as electricity transmission and distribution facilities. Because of the critical importance of improving the nation's electrical transmission grid, Congress recognized that electricity transmission issues should receive added attention when the Agencies address corridor location and analysis issues. In Section 368, Congress specifically directed the Agencies to consider the need for upgraded and new facilities to deliver electricity: In carrying out [Section 368], the Secretaries shall take into account the need for upgraded and new electricity transmission and distribution facilities to (1) improve reliability; (2) relieve congestion; and (3) enhance capability of the national grid to deliver electricity. Section 368 does not require the Agencies to consider or approve specific projects, applications for rights-of-way (ROWs), or other permits within designated energy corridors. Importantly, Section 368 does not direct, license, or otherwise permit any on-the-ground activity of any sort. If an applicant is interested in obtaining an authorization to develop a project within any corridor designated under Section 368, the applicant would have to apply for a ROW authorization and applicable permits. The Agencies would consider each application by applying appropriate project-specific reviews under requirements of laws and related regulations, including, but not limited to, the National Environmental Policy Act (NEPA), the Clean Water Act, the Clean Air Act, Section 7 of the Endangered Species Act (ESA), and Section 106 of the National Historic Preservation Act (NHPA). Under Section 368, Congress divided the United States into two groups of states: the 11 contiguous western states and the remaining states. Direction for energy transportation corridor analysis and selection in the 11 western states was addressed in Section 368(a) of EPAct, while direction for energy transportation corridor analysis and selection in all other states was addressed under Section 368(b) of EPAct. It was clearly the priority of Congress to conduct corridor location studies and designation first on federal lands in the western states. Under Section 368(a), the Agencies produced a programmatic environmental impact statement (EIS), Designation of Energy Corridors on Federal Land in the 11 Western States (DOE and DOI 2008), that was used in part as the basis for designating more than 6,000 mi (9,656 km) of energy transportation corridors on federal land in 11 western states. Under Section 368(a) of EPAct, Congress clearly stated the Agencies needed to (1) designate energy transportation corridors on federal land, (2) conduct the necessary environmental review of the designated corridors, and (3) incorporate the designated corridors into the appropriate land use plans. Congressional direction under Section 368(b) of EPAct differs from that provided under Section 368(a). Specifically, Section 368(b) requires the secretaries of the Agencies, in consultation with the Federal Energy Regulatory Commission (FERC), affected utility industries, and other interested persons, to jointly: (1) Identify corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on federal land in states other than the 11 western states identified under Section 368(a) of EPAct, and (2) Schedule prompt action to identify, designate, and incorporate the corridors into the applicable land use plans. While Section 368(a) clearly directs designation as a necessary first step for energy transportation corridors in the 11 western states, Section 368(b) directs the Agencies to first identify corridors and then schedule prompt action to identify, designate, and incorporate the corridors into applicable land use plans. To comply with the congressional direction provided in Section 368(b), the Agencies investigated corridor identification issues in the Section 368(b) states; this report to Congress provides information that could be relevant to possible future designation of energy corridors. Future designations, if appropriate and necessary, would occur when the Agencies undertake revisions and/or updates to land use plans that guide management decisions on lands located within individual administrative units, such as specific National Forests, National Parks, or Wildlife Refuges. At this time, the Agencies are not proposing any actions or decisions related directly or indirectly to designating energy corridors on federal land under Section 368(b) of EPAct.

    In recognition of our nation's increasing energy needs, the George W. Bush Administration's National Energy Policy Development Group report (May 2001) suggested that one way to increase domestic on-shore production of oil and gas is to increase access to undiscovered resources on federal lands. Also recognized is the need to protect and conserve natural resources, which often are located on and around federal lands. The National Environmental Policy Act (NEPA) was designed to create and maintain conditions under which man and nature can exist in productive harmony. NEPA requires that federal agencies prepare an environmental impact statement (EIS) prior to the approval of any development activities. The NEPA scope is broad, with the process applicable to many situations from the building of highways, barge facilities and water outtake facilities, bridges, and watersheds to other less significant projects. The process often involves cooperation among multiple federal agencies, industry, scientists and consultants, and the surrounding community. The objective of the project, titled Compilation and Presentation of Existing Data on Oil and Gas Leasing and Development in a Manner Useful to the NEPA Process, is to facilitate faster and more comprehensive access to current oil and gas data by land management agencies and operators. This will enable key stakeholders in the NEPA process to make decisions that support access to federal resources while at the same time achieving a legitimate balance between environmental protection and appropriate levels of development.

    DOE has issued the Draft Uranium Leasing Program Programmatic Environmental Impact Statement (ULP PEIS)(DOE/EIS-0472D) for public review and comment. The public comment period ends May 16, 2013. Under the Uranium Leasing Program, the DOE Office of Legacy Management administers 31 tracts of land in Mesa, Montrose, and San Miguel counties that are leased to private entities to mine uranium and vanadium. The program covers an area of approximately 25,000 acres. No mining operations are active on the ULP lands at this time. A computerized data base on the non-competitive leasing program is described here. The required data were obtained from the files of the BLM State Offices where the lease applications are received and from Forest Service Regional Offices responsible for that agency's consultation. The states covered include: Arizona, California, Colorado, Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington, and Wyoming.     As has been noted in many reports and publications, acquiring new or expanded rights-of-way for transmission is a challenging process, because numerous land use and land ownership constraints must be overcome to develop pathways suitable for energy transmission infrastructure. In the eastern U.S., more than twenty federally protected national trails (some of which are thousands of miles long, and cross many states) pose a potential obstacle to the development of new or expanded electricity transmission capacity. However, the scope of this potential problem is not well-documented, and there is no baseline information available that could allow all stakeholders to study routing scenarios that could mitigate impacts on national trails. This report, Electricity Transmission, Pipelines, and National Trails: An Analysis of Current and Potential Intersections on Federal Lands in the Eastern United States, was prepared by the Environmental Science Division of Argonne National Laboratory (Argonne). Argonne was tasked by DOE to analyze the “footprint” of the current network of National Historic and Scenic Trails and the electricity transmission system in the 37 eastern contiguous states, Alaska, and Hawaii; assess the extent to which national trails are affected by electrical transmission; and investigate the extent to which national trails and other sensitive land use types may be affected in the near future by planned transmission lines. Pipelines are secondary to transmission lines for analysis, but are also within the analysis scope in connection with the overall directives of Section 368 of the Energy Policy Act of 2005, and because of the potential for electrical transmission lines being collocated with pipelines. Based on Platts electrical transmission line data, a total of 101 existing intersections with national trails on federal land were found, and 20 proposed intersections. Transmission lines and pipelines are proposed in Alaska; however there are no locations that intersect national trails. Source data did not indicate any planned transmission lines or pipelines in Hawaii. A map atlas provides more detailed mapping of the topics investigated in this study, and the accompanying GIS database provides the baseline information for further investigating locations of interest. In many cases the locations of proposed transmission lines are not accurately mapped (or a specific route may not yet be determined), and accordingly the specific crossing locations are speculative. However since both national trails and electrical transmission lines are long linear systems, the characteristics of the crossings reported in this study are expected to be similar to both observed characteristics of the existing infrastructure provided in this report, and of the new infrastructure if these proposed projects are built. More focused study of these siting challenges is expected to mitigate some of potential impacts by choosing routes that minimize or eliminate them. The current study primarily addresses a set of screening-level characterizations that provide insights into how the National Trail System may influence the siting of energy transport facilities in the states identified under Section 368(b) of the Energy Policy Act of 2005. As such, it initializes gathering and beginning analysis of the primary environmental and energy data, and maps the contextual relationships between an important national environmental asset and how this asset intersects with energy planning activities. Thus the current study sets the stage for more in-depth analyses and data development activities that begin to solve key transmission siting constraints. Our recommendations for future work incorporate two major areas: (1) database development and analytics and (2) modeling and scenario analysis for energy planning. These recommendations provide a path forward to address key issues originally developed under the Energy Policy Act of 2005 that are now being carried forward under the President’s Climate Action Plan.

    The goal of the U.S. Department of Energy's (DOE) Loaner Program is to increase the awareness, deployment, and use of electric vehicles (EVs) in Federal fleets. The Loaner Program accomplishes this by providing free EVs to Federal fleets on a loaner basis, generally for 1 or 2 months. The Program partners DOE with six electric utilities, with DOE providing financial support and some leads on Federal fleets interested in obtaining EVs. The utilities obtain the vehicles, identify candidate loaner fleets, loan the vehicles, provide temporary charging infrastructure, provide overall support to participating Federal fleets, and support fleets with their leasing decisions. While the utilities have not had the success initially envisioned by themselves, DOE, the Edison Electric Institute, and the Electric Vehicle Association of the Americas, the utilities can not be faulted for their efforts, as they are not the entity that makes the ultimate lease or no-lease decision. Some external groups have suggested to DOE that they direct other federal agencies to change their processes to make loaning vehicles easier; this is simply not within the power of DOE. By law, a certain percentage of all new vehicle acquisitions are supposed to be alternative fuel vehicles (AFV); however, with no enforcement, the federal agencies are not compelled to lease AFVs such as electric vehicles.

    The US Department of Energy (DOE) proposes to lease the Strategic Petroleum Reserve`s (SPR) St. James Terminal to private industry. The St. James Terminal consists of six storage tanks, a pumping station, two maine docks and ancillary facilities. DOE believes that the St. James Terminal presents an opportunity to establish a government- industry arrangement that could more effectively use this asset to serve the nations`s oil distribution needs, reduce the operational cost of the SPR, and provide a source of revenue for the Government. DOE solicited interest in leasing its distribution facilities in a notice published March 16, 1994. In response, industry has expressed interest in leasing the St. James Terminal, as well as several DOE pipelines, to enhance the operation of its own facilities or to avoid having to construct new ones. Under such a lease, industry use would be subordinate to DOE use in the event of a national energy emergency. This Environmental Assessment describes the proposed leasing operation, its alternatives, and potential environmental impacts. Based on this analyses, DOE has determined that the proposed action is not a major Federal action significantly affecting the quality of the human environment within the meaning of the National Environmental Policy Act (NEPA) OF 1969 and has issued the Finding of No Significant Impact (FONSI).

    The magnitude and complexity of permit processes raises a question as to their impact on the rate and scope of industrial development activity. One particular area where this issue is of concern is in new energy extraction and development activities. The initiation of new energy projects has been a national priority for several years. But, energy projects, because of their potential for creating land disturbances, are subject to many environmental and other regulations. Because of this, the permitting required of energy resource developers is extensive. Within the energy field, a major portion of development activities occurs on federal lands. This is particularly true in the Rocky Mountain states and Alaska where the principal landholder is the federal government. The permitting requirements for federal lands' development differ from those for private lands. This report assesses the impact of permitting processes for energy resource development on federal lands. The permitting processes covered include all of the major environmental, land-use, and safety permits required by agencies of federal and state governments. The lands covered include all federal lands, with emphasis on eight states with major development activities.

    In October, 1986, the US Bureau of Land Management, White River Resource Area, issued the Final Environmental Impact Statement concerning Rio Blanco Oil Shale Company's request to lease an offtract site for disposal of overburden and spent shale from Tract C-a. A major issue which pitted Rio Blanco Oil Shale Company against many other members of the oil shale community was the covering up of oil shale resources on 84 Mesa. The oil shale resource under 84 Mesa may contain as much oil in place as Tract C-a itself. Some of the significant points concerning this issue are discussed. A summary of environmental consequences is given. 5 figures.

    This report addresses the land use impacts of past and future energy development and summarizes the major federal and state legislation which influences the potential land use impacts of energy facilities and can thus influence the locations and timing of energy development. In addition, this report describes and presents the data which are used to measure, and in some cases, predict the potential conflicts between energy development and alternative uses of the nation's land resources. The topics section of this report is divided into three parts. The first part describes the myriad of federal, state and local legislation which have a direct or indirect impact upon the use of land for energy development. The second part addresses the potential land use impacts associated with the extraction, conversion and combustion of energy resources, as well as the disposal of wastes generated by these processes. The third part discusses the conflicts that might arise between agriculture and energy development as projected under a number of DOE mid-term (1990) energy supply and demand scenarios.

    The U.S. Department of Energy (DOE) owns, operates, and manages the buildings and land areas on the Oak Ridge Reservation (ORR) in Oak Ridge, Tennessee. As land and buildings are declared excess or underutilized, it is the intent of DOE to either transfer the title of or lease suitable property to the Community Reuse Organization of East Tennessee (CROET) or other entities for public use. It is DOE's responsibility, in coordination with the U.S. Environmental Protection Agency (EPA), Region 4, and the Tennessee Department of Environment and Conservation (TDEC), to ensure that the land, facilities, and personal property that are to have the title transferred or are to be leased are suitable for public use. Release of personal property must also meet site requirements and be approved by the DOE contractor responsible for site radiological control. The terms title transfer and lease in this document have unique meanings. Title transfer will result in release of ownership without any restriction or further control by DOE. Under lease conditions, the government retains ownership of the property along with the responsibility to oversee property utilization. This includes involvement in the lessee's health, safety, and radiological control plans and conduct of site inspections. It may also entail lease restrictions, such as limiting access to certain areas or prohibiting digging, drilling, or disturbing material under surface coatings. Survey and sampling requirements are generally more rigorous for title transfer than for lease. Because of the accelerated clean up process, there is an increasing emphasis on title transfers of facilities and land. The purpose of this document is to describe the radiological survey and sampling protocols that are being used for assessing the radiological conditions and characteristics of building and land areas on the Oak Ridge Reservation that contain space potentially available for title transfer or lease. After necessary surveys and sampling and laboratory analyses are completed, the data are analyzed and included in an Environmental Baseline Summary (EBS) report for title transfer or in a Baseline Environmental Analysis Report (BEAR) for lease. The data from the BEAR is then used in a Screening-Level Human Health Risk Assessment (SHHRA) or a risk calculation (RC) to assess the potential risks to future owners/occupants. If title is to be transferred, release criteria in the form of specific activity concentrations called Derived Concentration Guideline Levels (DCGLs) will be developed for the each property. The DCGLs are based on the risk model and are used with the data in the EBS to determine, with statistical confidence, that the release criteria for the property have been met. The goal of the survey and sampling efforts is to (1) document the baseline conditions of the property (real or personal) prior to title transfer or lease, (2) obtain enough information that an evaluation of radiological risks can be made, and (3) collect sufftcient data so that areas that contain minimal residual levels of radioactivity can be identified and, following radiological control procedures, be released from radiological control. (It should be noted that release from radiological control does not necessarily mean free release because DOE may maintain institutional control of the site after it is released from radiological control). To meet the goals of this document, a Data Quality Objective (DQO) process will be used to enhance data collection efficiency and assist with decision-making. The steps of the DQO process involve stating the problem, identifying the decision, identifying inputs to the decision, developing study boundaries, developing the decision rule, and optimizing the design. This document describes the DQOs chosen for surveys and sampling efforts performed for the purposes listed above. The previous version to this document focused on the requirements for radiological survey and sampling protocols that are be used for leasing. Because the primary focus at this time is on title transfer, this revision applies to both situations.

    The US Department of Energy (DOE) has completed an environmental assessment (DOE/EA-1113) for the proposed lease of 957.16 acres of the Oak Ridge Reservation (ORR) to the East Tennessee Economic Council (ETEC), a non-profit community organization, for a period of 10 years, with an option for renewal. ETEC proposes to develop an industrial park on the leased site to provide employment opportunities for DOE and contractor employees affected by decreased federal funding. Based on the results of the analysis reported in the EA and implementation of mitigation measures defined in this Finding of No Significant Impact (FONSI), DOE has determined that the proposed action is not a major Federal action that would significantly affect the quality of the human environment within the context of the National Environmental Policy Act of 1969 (NEPA). Therefore, preparation of an environmental impact statement (EIS) is not necessary, and DOE is issuing this mitigated FONSI. DOE will implement a Mitigation Action Plan for this project and provide annual reports on mitigation and monitoring.
