It explains state-level cash incentives available, the importance of solar renewable energy certificate revenues (in certain markets), existing financing structures, as well as innovative financing structures being used by federal agencies to deploy on-site PV. Specific examples from the DOD, DOE, and other federal agencies are highlighted to explain federal project financing in detail.

    The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

    Public Works and Government Services Canada (PWGSC) is the equivalent to the U.S. General Services Administration (GSA). The Central Procurement Agency purchases all goods and services for the federal public sector-$1.5 billion per annum expenditure for information technology. The personal computer (PC) group buys about 300 million PCs per annum. All requirements are fulfilled through a competitive process, which involves a Request for Proposal. The lowest compliant bidder always wins. All requirements are computed under GATT and NAFTA. PWGSC and GSA purchase the same office technology. PWGSC has a standing offer method of supply, much like a GSA schedule. Only the least expensive vendors are allowed on the standing offer after a Request for Standing Offer. The price is determined by a mean plus one standard deviation, so 68% of the bidders make it on to the standing offer. Multiple vendors offer multiple platforms, and a wide variety are from the United States and the Canadian Pacific Rim. New PC technology introduced through categories is where the `green` issue comes in. Those categories reflect new PC technology, usually models with Intel CPUs. A green PC category was created in parallel with other nongreen categories. All the testing - not necessarily green testing - was done by the Philadelphia based National Software Testing Laboratory. Again, the lowest compliant bidder is always used. This laboratory does a good job of performance, usability, and compatibility studies. The green category, one category out of a possible six, specifies Energy Star. All the suppliers to the Canadian Government also supply to the U.S. Government. Canadian PC manufacturers essentially repackage Taiwanese or U.S. components, and through the insight of GSA, it is very easy for a vendor to become an Energy Star partner. An in-house test methodology with a watt meter was developed.

    The FHFA regulates Fannie Mae, Freddie Mac, and the 12 Federal Home Loan Banks (the government-sponsored enterprises - GSEs). On June 18, 2009, James B. Lockhart III, then Director of FHFA, released a letter expressing concern about the negative impact of energy loan tax assessment programs (ELTAPs) - also known as Property Assessed Clean Energy (PACE) programs - on both the housing finance system and homeowner program participants. Subsequently, a number of PACE proponents responded to the concerns laid out in the FHFA letter. In early Fall 2009, word circulated that FHFA was planning to follow its June letter with guidance to other agencies, possibly including Fannie Mae and Freddie Mac, discouraging them from buying loans on properties subject to PACE-type assessment liens. This triggered a second round of stakeholder letters, several of which were addressed to President Obama. On October 18, 2009, the White House, in what some believe was an attempt to obviate the need for FHFA guidance, released a Policy Framework for PACE Financing Programs that outlined best practices guidance for homeowner and lender protection. As of February 2010, FHFA and the GSEs have agreed to monitor PACE programs and work with stakeholders and the Administration to consider additional guidance beyond the Policy Framework and to collect more information on PACE program efficacy and risks. A summary of the communications timeline and highlights of the communications are provided.

    The Energy Policy Act of 1992 calls for a program to further the commercialization of renewable energy and energy efficient technologies for the industrial sector.. The primary objective of the Office of Industrial Technologies Chemical Industry Team is to work in partnership with the US chemical industry to maximize economic, energy, and environmental benefits through research and development of innovative technologies. This document was developed to inventory organizations within the federal government on current chemical industry-related research and development. While an amount of funding or number of projects specifically relating to chemical industry research and development was not defined in all organizations, identified were about 60 distinct organizations representing 7 cabinet-level departments and 4 independent agencies, with research efforts exceeding $3.5 billion in fiscal year 1995. Effort were found to range from less than $500 thousand per year at the Departments of Agriculture and the Interior to over $100 million per year at the Departments of Commerce, Defense, Energy, and Health and Human Services and the National Aeronautics and Space Administration. The total number of projects in these programs exceeded 10,000. This document is complete to the extent that agencies volunteered information. Additions, corrections, and changes are encouraged and will be incorporated in future revisions.

    Implementing solar energy projects at federal facilities is a process. The project planning phase of the process includes determining goals, building a team, determining site feasibility and selecting the appropriate project funding tool. This fact sheet gives practical guidance to assist decision-makers with understanding and selecting the funding tool that would best address their site goals. Because project funding tools are complex, federal agencies should seek project assistance before making final decisions. High capital requirements combined with limits on federal agency energy contracts create challenges for funding solar projects. Solar developers typically require long-term contracts (15-20) years to spread out the initial investment and to enable payments similar to conventional utility bill payments. In the private sector, 20-year contracts have been developed, vetted, and accepted, but the General Services Administration (GSA) contract authority (federal acquisition regulation [FAR] part 41) typically limits contract terms to 10 years. Payments on shorter-term contracts make solar economically unattractive compared with conventional generation. However, in several instances, the federal sector has utilized innovative funding tools that allow long-term contracts or has created a project package that is economically attractive within a shorter contract term.

    This report focuses on the National Renewable Energy Laboratory's (NREL) fiscal year (FY) 2012 effort that used the NREL Optimal Vehicle Acquisition (NOVA) analysis to identify optimal vehicle acquisition recommendations for eleven diverse federal agencies. Results of the study show that by following a vehicle acquisition plan that maximizes the reduction in greenhouse gas (GHG) emissions, significant progress is also made toward the mandated complementary goals of acquiring alternative fuel vehicles, petroleum use reduction, and alternative fuel use increase.

  16. Selectively reducing offshore royalty rates in the Gulf of Mexico could increase oil production and federal government revenue

    The US government leases large areas in the Outer Continental Shelf in the Gulf of Mexico for the development of oil resources and receives royalties on the oil produced. Conventional methods of oil recovery have recovered or are expected to recover about half of the 16 billion barrels of oil discovered in this area. Other oil recovery methods, collectively known as enhanced oil recovery (EOR), could potentially increase production by about 1 billion barrels of oil. EOR in the Gulf is expensive and does not appear to be economically justified in most cases. Under existing economic conditions and federal policies, GAO's review indicates that utilizing EOR methods will probably produce only about 10 percent of the additional recoverable oil. However, financial incentives in the form of royalty reductions could increase both oil production and federal government revenue if applied on a project-by-project basis. Universal applications of royalty reduction for EOR, however, while achieving increased oil production, would not increase federal government revenue. GAO recommends that the Department of the Interior's Minerals Management Service initiate action that would allow for selective royalty reductions for EOR projects in the Gulf in instances where both total oil production and federal government revenue will increase. 6 figs., 1 tab.

    The economic implications of Federal Government programs for responding to an energy emergency (i.e., a sudden, temporary reduction in energy supply) are analyzed. Section 1 considers both the effects of the limited duration of an emergency and of the expectations of an emergency occurring; Section 2 describes the Government energy emergency programs and discusses their economic implications; and Section 3 sets forth the framework for an analysis of the costs and benefits resulting from enactment of the Government programs. The energy emergency programs discussed were developed in response to the 1973 Arab oil embargo. They include: use of the Strategic Petroleum Reserve, enactment of price controls on crude oil and refined products, mandatory allocation of crude oil and refined products, mandatory yield controls, gasoline rationing, mandatory conservation, mandatory fuel shifts, and supply enhancement programs. This mission requires that emphasis be continually placed on identifying technologies currently employed or under development in other nuclear as well as nonnuclear industries and government agencies.     This document is part of a larger, programmatic effort to assist federal agencies in taking action and changing their institutions to achieve and maintain federal sustainability goals, while meeting their mission goals. FEMP is developing guidance for federal agency efforts to enable institutional behavior change for sustainability, and for making sustainability “business as usual.” The driving requirement for this change is Executive Order (EO) 13514, Federal Leadership in Environmental, Energy, and Economic Performance. FEMP emphasizes strategies for increasing energy efficiency and renewable energy utilization as critical components of attaining sustainability, and promotes additional non-energy action pathways contained in EO 13514. This report contributes to the larger goal by laying out the conceptual and evidentiary underpinnings of guidance to federal agencies. Conceptual frameworks focus and organize the development of guidance. We outline a series of progressively refined conceptual frameworks, including a multi-layer approach, key steps in sustainability implementation, a process view of specific approaches to institutional change, the agency Strategic Sustainability Performance Plans (SSPPs), and concepts related to context-specific rules, roles and tools for sustainability. Additionally, we tap pertinent bodies of literature in drawing eight evidence-based principles for behavior change. These principles are important foundations upon which to build in selecting strategies to effect change in organizations. Taken together, this report presents a suite of components that inform the training materials, presentations, web site, and other products that provide guidance to federal agencies.

    Since the announcement of the first nuclear program in 1956, nuclear R and D in Germany has been supported by the Federal Government under four nuclear programs and later on under more general energy R and D programs. The original goal was to help German industry to achieve safe, low-cost generation of energy and self-sufficiency in the various branches of nuclear technology, including the fast breeder reactor and the fuel cycle. Several national research centers were established to host or operate experimental and demonstration plants. These are mainly located at the sites of the national research centers at Juelich and Karlsruhe. In the meantime, all these facilities were shut down and most of them are now in a state of decommissioning and dismantling (D and D). Meanwhile, Germany is one of the leading countries in the world in the field of D and D. Two big demonstration plants, the Niederaichbach Nuclear Power Plant (KKN) a heavy-water cooled pressure tube reactor with carbon-dioxide cooling and the Karlstein Superheated Steam Reactor (HDR) a boiling light water reactor with a thermal power of 100 MW, are totally dismantled and 'green field' is reached. For two other projects the return to 'green field' sites will be reached by the end of this decade. These are the dismantling of the Multi-Purpose Research Reactor (MZFR) and the Compact Sodium Cooled Reactor (KNK) both located at the Forschungszentrum Karlsruhe. Within these projects a lot of new solutions und innovative techniques were tested, which were developed at German universities and in small and medium sized companies mostly funded by the Federal Ministry of Education and Research (BMBF).     Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    Since 1956, nuclear research and development (R and D) in Germany has been supported by the Federal Government. The goal was to help German industry to become competitive in all fields of nuclear technology. National research centers were established and demonstration plants were built. In the meantime, all these facilities were shut down and are now in a state of decommissioning and dismantling (D and D). Meanwhile, Germany is one of the leading countries in the world in the field of D and D. Two big demonstration plants, the Niederaichbach Nuclear Power Plant (KKN) a heavy-water cooled pressure tube reactor with carbon-dioxide cooling and the Karlstein Superheated Steam Reactor (HDR) a boiling light water reactor with a thermal power of 100 MW, are totally dismantled and 'green field' is reached. Another big project was finished in 2008. The Forschungs-Reaktor Juelich 1 (FRJ1), a research reactor with a thermal power of 10 MW was completely dismantled and in September 2008 an oak tree was planted on a green field at the site, where the FRJ1 was standing before. This is another example for German success in the field of D and D. Within these projects a lot of new solutions and innovative techniques were tested, which were developed at German universities and in small and medium sized companies mostly funded by the Federal Ministry of Education and Research (BMBF). Some examples are underwater-cutting technologies like plasma arc cutting and contact arc metal cutting. This clearly shows that research on the field of D and D is important for the future. Moreover, these research activities are important to save the know-how in nuclear engineering in Germany and will enable enterprises to compete on the increasing market of D and D services. The author assumes that an efficient decommissioning of nuclear installations will help stabilize the credibility of nuclear energy.     This report provides relevant information and analysis to the Department of Homeland Security (DHS) that will assist DHS in determining how to meet the requirements of federal technology transfer legislation. These legal requirements are grouped into five categories: (1) establishing an Office of Research and Technology Applications, or providing the functions thereof; (2) information management; (3) enabling agreements with non-federal partners; (4) royalty sharing; and (5) invention ownership/obligations. These five categories provide the organizing framework for this study, which benchmarks other federal agencies/laboratories engaged in technology transfer/transition Four key agencies--the Department of Health & Human Services (HHS), the U.S. Department of Agriculture (USDA), the Department of Energy (DOE), and the Department of Defense (DoD)--and several of their laboratories have been surveyed. An analysis of DHS's mission needs for commercializing R&D compared to those agencies/laboratories is presented with implications and next steps for DHS's consideration. Federal technology transfer legislation, requirements, and practices have evolved over the decades as agencies and laboratories have grown more knowledgeable and sophisticated in their efforts to conduct technology transfer and as needs and opinions in the federal sector have changed with regards to what is appropriate.     In the Department of Energy (DOE) Implementation Plan (IP) for Defense Nuclear Facilities Safety Board's Recommendation 2009-1, the DOE committed to studying the use of quantitative risk assessment methodologies at government agencies and industry. This study consisted of document reviews and interviews of senior management and risk assessment staff at six organizations. Data were collected and analyzed on risk assessment applications, risk assessment tools, and controls and infrastructure supporting the correct usage of risk assessment and risk management tools. The study found that the agencies were in different degrees of maturity in the use of risk assessment to support the analysis of high hazard operations and to support decisions related to these operations. Agencies did not share a simple, 'one size fits all' approach to tools, controls, and infrastructure needs. The agencies recognized that flexibility was warranted to allow use of risk assessment tools in a manner that is commensurate with the complexity of the application. The study also found that, even with the lack of some data, agencies application of the risk analysis structured approach could provide useful insights such as potential system vulnerabilities. This study, in combination with a companion study of risk assessment programs in the DOE Offices involved in high hazard operations, is being used to determine the nature and type of controls and infrastructure needed to support risk assessments at the DOE.

    This report provides an overview of the regulatory frameworks governing natural gas supply chain infrastructure siting, construction, operation, and maintenance. Information was drawn from a number of sources, including published analyses, government reports, in addition to relevant statutes, court decisions and regulatory language, as needed. The scope includes all onshore facilities that contribute to methane emissions from the natural gas sector, focusing on three areas of state and federal regulations: (1) natural gas pipeline infrastructure siting and transportation service (including gathering, transmission, and distribution pipelines), (2) natural gas pipeline safety, and (3) air emissions associated with the natural gas supply chain. In addition, the report identifies the incentives under current regulatory frameworks to invest in measures to reduce leakage, as well as the barriers facing investment in infrastructure improvement to reduce leakage. Policy recommendations regarding how federal or state authorities could regulate methane emissions are not provided; rather, existing frameworks are identified and some of the options for modifying existing regulations or adopting new regulations to reduce methane leakage are discussed.

    The Savannah River Site (SRS) is a 310-square-mile United States Department of Energy nuclear facility located along the Savannah River (SRS) near Aiken, South Carolina. Nuclear weapons material production began in the early 1950s, utilizing five production reactors. In the early 1990s all SRS production reactor operations were terminated. The first reactor closure end state declaration was recently institutionalized in a Comprehensive Environmental Response and Compensation and Liability Act (CERCLA) Early Action Record of Decision. The decision for the final closure of the 318,000 square foot 105-P Reactor was determined to be in situ decommissioning (ISD). ISD is an acceptable and cost effective alternative to off-site disposal for the reactor building, which will allow for consolidation of remedial action wastes generated from other cleanup activities within the P Area. ISD is considered protective by the regulators, U. S. Environmental Protection Agency (US EPA) and the South Carolina Department of Health and Environmental Control (SCDHEC), public and stakeholders as waste materials are stabilized/immobilized, and radioactivity is allowed to naturally decay, thus preventing future exposure to the environment. Stakeholder buy-in was critical in the upfront planning in order to achieve this monumental final decision. Numerous public meetings and workshops were held in two different states (covering a 200 mile radius) with stakeholder and SRS Citizens Advisory Board participation. These meetings were conducted over an eight month period as the end state decision making progressed.     The Savannah River Site (SRS) is a 310-square-mile United States Department of Energy nuclear facility located along the Savannah River (SRS) near Aiken, South Carolina. Nuclear weapons material production began in the early 1950s, utilizing five production reactors. In the early 1990s all SRS production reactor operations were terminated. The first reactor closure end state declaration was recently institutionalized in a Comprehensive Environmental Response and Compensation and Liability Act (CERCLA) Early Action Record of Decision. The decision for the final closure of the 318,000 square foot 105-P Reactor was determined to be in situ decommissioning (ISD). ISD is an acceptable and cost effective alternative to off-site disposal for the reactor building, which will allow for consolidation of remedial action wastes generated from other cleanup activities within the P Area. ISD is considered protective by the regulators, U. S. Environmental Protection Agency (US EPA) and the South Carolina Department of Health and Environmental Control (SCDHEC), public and stakeholders as waste materials are stabilized/immobilized, and radioactivity is allowed to naturally decay, thus preventing future exposure to the environment. Stakeholder buy-in was critical in the upfront planning in order to achieve this monumental final decision. Numerous public meetings and workshops were held in two different states (covering a 200 mile radius) with stakeholder and SRS Citizens Advisory Board participation. These meetings were conducted over an eight month period as the end state decision making progressed.     With the coming liberalization of trade and industry within the European Community (EC) and a more centrally-coordinated EC external trade policy, it is timely to ask if in the 1990s there will be any significant changes in the commercial relations between the EC and non-EC companies trading in nuclear fuel. The key vehicle for implementing any change of policy would probably be the European Atomic Energy Community (EURATOM) Supply Agency in Brussels, which is charged under the EURATOM Treaty with overseeing the equitable supply of nuclear fuel to and among EC companies. The EURATOM Supply Agency (the Agency) is a signatory to almost all EC-company contracts for transactions that occur on the territory of the Community, which includes Belgium, Denmark, France, the Federal Republic of Germany (FRG), Great Britain, Greece, Ireland, Italy, Luxembourg, the Netherlands, Portugal, and Spain. During the 1980s, the Supply Agency has rarely tried to influence the commercial decisions of EC member companies. The nuclear fuel industry has largely perceived the Agency as an administrative office that registers contracts and maintains relations with some outside governments, particularly Australia, Canada, and the USA. However, in 1988 the Agency began to have a more direct commercial impact when it reviewed the practice-previously conducted routinely by the EURATOM Safeguards Directorate in Luxembourg at the request of EC-member companies-of swapping safeguards obligations on equivalent quantities of uranium at different locations (flag swapping). The Agency`s actions inhibiting flag swaps, as well as a related de facto policy restricting material swaps of Southern African uranium, caused it to be viewed as obstructive by some EC companies. During 1989 the discussion about flag swaps and swaps involving South African and Namibian uranium has subsided, and a far-reaching discussion has arisen about EC trade policy in general.

    The most important indicator of a well-managed site cleanup effort may no longer be funding or scientific expertise. While support for federal facility cleanup has included appropriations of more than $10 billion annually, these expenditures alone are unlikely to assure progress toward environmental remediation. {open_quotes}Trust{close_quotes} is now overwhelmingly mentioned as a prerequisite for progress with site cleanup in DOE`s weapons complex. In part, federal budget deficits are forcing participants to focus on factors that build consensus and lead to cost-effective cleanup actions. In some cases, the stakeholders at cleanup sites are making efforts to work cooperatively with federal agencies. A report by 40 representatives of federal agencies, tribal and state governments, associations, and others developed recommendations to create a {open_quotes}new era of trust and consensus-building that allows all parties to get on with the job of cleaning up federal facilities in a manner that reflects the priorities and concerns of all stakeholders.{close_quotes} Changes are underway affecting how federal agencies work with federal and state regulators reflecting this concept of shared responsibility for conducting cleanup. This paper addresses these changes and provides examples of the successes and failures underway.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services

The purpose was to provide an estimate of the national potential for combined heat and power (also known as CHP; cogeneration; or cooling, heating, and power) applications at federal facilities and the associated costs and benefits including energy and emission savings. The report provides a broad overview for the U.S. Department of Energy (DOE) and other agencies on when and where CHP systems are most likely to serve the government's best interest. FEMP's mission is to reduce the cost to and environmental impact of the federal government by advancing energy efficiency and water conservation, promoting the use of renewable energy, and improving utility management decisions at federal sites. FEMP programs are driven by its customers: federal agency sites. FEMP monitors energy efficiency and renewable energy technology developments and mounts ''technology-specific'' programs to make technologies that are in strong demand by agencies more accessible. FEMP's role is often one of helping the federal government ''lead by example'' through the use of advanced energy efficiency/renewable energy (EERE) technologies in its own buildings and facilities.
