    The Annual Energy Outlook 2007 (AEO) reference case and alternative cases generally assume compliance with current laws and regulations affecting the energy sector. Some provisions of the U.S. Tax Code are scheduled to expire, or may be subject to adjustment, before the end of the projection period. In general, scheduled expirations and adjustments provided in legislation or regulations are assumed to occur, unless there is significant historical evidence to support an alternative assumption. This section examines the AEO2007 treatment of three provisions that could have significant impacts on U.S. energy markets: the gasoline excise tax, biofuel (ethanol and biodiesel) tax credits, and the production tax credit for electricity generation from certain renewable resources.

    A new report from the National Renewable Energy Laboratory (NREL) explores the role of alternative fuels and energy efficient vehicles in motor fuel taxes. Throughout the United States, it is common practice for federal, state, and local governments to tax motor fuels on a per gallon basis to fund construction and maintenance of our transportation infrastructure. In recent years, however, expenses have outpaced revenues creating substantial funding shortfalls that have required supplemental funding sources. While rising infrastructure costs and the decreasing purchasing power of the gas tax are significant factors contributing to the shortfall, the increased use of alternative fuels and more stringent fuel economy standards are also exacerbating revenue shortfalls. The current dynamic places vehicle efficiency and petroleum use reduction polices at direct odds with policies promoting robust transportation infrastructure. Understanding the energy, transportation, and environmental tradeoffs of motor fuel tax policies can be complicated, but recent experiences at the state level are helping policymakers align their energy and environmental priorities with highway funding requirements.

    Motor fuel taxes were established to finance our nation’s transportation infrastructure, yet evolving economic, political, and technological influences are constraining this ability. At the federal level, the Highway Trust Fund (HTF), which is primarily funded by motor fuel taxes, has become increasingly dependent on general fund contributions and short-term reauthorizations to prevent insolvency. As a result, there are discussions at both the federal and state levels in which stakeholders are examining the future of motor fuel excise taxes as well as the role of electric and alternative fuel vehicles in that future. On July 1, 2015, six states increased their motor fuel tax rates.

    The long-term U.S. natural gas resource base (1300 + TCF) exists. The challenge is the timely conversion of that resource base to proved, deliverable reserves. Tax credits stimulate the transfer of the natural gas resource base to deliverable proved reserves by effective price enhancement and through the discovery, application, and dissemination of technology. Tax incentives act as net price increases to gas producers as long as all companies have roughly the same tax rate and all are able to utilize the credit. Tax incentives can thus be merged with gas price for statistical purposes. This paper demonstrates how the existence of the 29 credits stimulated drilling, increased relatively clean burning gas reserves, resulted in new technological advances and possibly increased federal tax receipts with no upward pressure on gas prices. New tax-stimulus mechanisms are introduced that will help ensure that tax credits both stimulate drilling and increase tax revenue.

    This report documents a review of State practices of reporting International Fuel Tax Agreement (IFTA) data to the U.S. Federal Highway Administration (FHWA). The purpose of the review is described in a notice published in the Federal Register (Vol. 65, No. 160, August 17, 2000, 50269-50272). The purpose is ''to increase the understanding of States on the importance of reporting adjusted IFTA data to the FHWA'', and ''to develop additional guidance on IFTA reporting''. The purpose is not to critique IFTA or any State. The review includes a survey of the forty eight IFTA member States, which was conducted January-April 2002. The States' responses to the survey are discussed in this report. The organization of the report follows further discussion in the Federal Register notice. Section 2 of the report is a general overview of IFTA. Section 3 describes in more detail how each State collects IFTA revenues. Section 4 is about how States separate out revenues not related to gallons of motor-fuel and direct motor-fuel gallon taxes. Section 5 describes how States calculate net IFTA gallons and the time delay in the processing. Section 6 is about difficulties in processing and reporting IFTA data. Timeliness is discussed further in Section 7, and alternatives for IFTA calculations if complete IFTA data are not available are discussed in Section 8. The IFTA survey questionnaire and instructions are in Appendices A and B. The survey responses of the States and the review of the IFTA system suggest that IFTA collections and data reporting are for the most part working well. Possible exceptions include (1) using off-road fuel use in IFTA mileage-per-gallon (mpg) estimates, (2) inconsistencies among States in definitions of taxable mileage or taxable fuel and consequential reporting differences, and (3) possible misinterpretations of ''net taxable gallons''.

    The Scandinavian countries, and in particular Norway and Sweden, have since 1990/91 taxed CO{sub 2}-emissions with carbon tax of about US $150 per ton of CO{sub 2}. One may therefore say that these countries have placed themselves in a role as {open_quotes}carbon tax laboratories{close_quotes}. These very high CO{sub 2}-taxes have been in place for about four years and the first lessons from this experience are reported. In general it would seem as if the taxation mechanism is less efficient than economists have expected. The CO{sub 2}-emissions are increasing in both Norway and Sweden and the stabilization goal to the year 2000 will not be achieved in spite of the high taxation. The fossil fuel industry will have to learn to live with the climate change question which is inherently hostile to fossil fuels. It is argued that a more informed and active participation by the fossil fuel industry is needed in the climate change discussion. In addition the image of fossil fuels will benefit from showing real and potential improvement in the area of greenhouse gas emissions in the whole energy chain from production to combustion. The R&D effort being done into CO{sub 2}-capture and -disposal is creating such an option for the future. It is argued that the image of the entire fossil fuel industry will benefit from the creation of a {open_quotes}CO{sub 2}-free{close_quote} option or vision for oil, gas and coal. A number of examples are shown where today (or in the near future) actual CO{sub 2}-disposal in underground formations are taking place.

    The purpose of this study was to quantify the impact of the Solar Thermal Central Receiver (STCR) tax incentives and commercialization on the federal treasury revenues. The initial STCR market penetration was assumed to take place in California, because of favorable local conditions. The initial financing was assumed to be underwritten by intermediary partnerships under long-term avoided cost contracts with the local utility companies with subsequent sale of the plants to utilities at competitive prices. To estimate the impacts of these various tax incentives associated with the commercialization of the STCR technology, the tax revenues and costs for the STCR plants were compared with the tax revenues and costs for the displaced conventional power plants. This differential analysis takes into account the different operating expenses, as well as the different depreciation charges, financing costs, and tax credits associated with STCR and conventional plants. The study also evaluated the impact of both the previous (1983) and current (1984) proposed federal energy tax credits. The resulting total annual tax cash flows were subsequently cumulated to determine the aggregate tax revenues and costs throughout the 1985 to 2034 time period. The results of this analysis indicate that the initial federal tax revenues are negative. With increasing market penetration, the installed costs of the STCR plants decrease rapidly and the net present values of the tax revenue cash flows associated with plants constructed after 1995 are positive, and become significantly larger than those for the corresponding displaced conventional plants.

    Annual highway fuel taxes are collected by the Treasury Department and placed in the Highway Trust Fund (HTF). There is, however, no direct connection between the taxes collected by the Treasury Department and the gallons of on-highway fuel use, which can lead to a discrepancy between these totals. This study was conducted to determine how much of a discrepancy exists between the total fuel usages estimated based on highway revenue funds as reported by the Treasury Department and the total fuel usages used in the apportionment of the HTF to the States. The analysis was conducted using data from Highway Statistics Tables MF-27 and FE-9 for the years 1991-2001. It was found that the overall discrepancy is relatively small, mostly within 5% difference. The amount of the discrepancy varies from year to year and varies among the three fuel types (gasoline, gasohol, special fuels). Several potential explanations for these discrepancies were identified, including issues on data, tax measurement, gallon measurement, HTF receipts, and timing. Data anomalies caused by outside forces, such as deferment of tax payments from one fiscal year to the next, can skew fuel tax data. Fuel tax evasion can lead to differences between actual fuel use and fuel taxes collected. Furthermore, differences in data collection and reporting among States can impact fuel use data. Refunds, credits, and transfers from the HTF can impact the total fuel tax receipt data. Timing issues, such as calendar year vs. fiscal year, can also cause some discrepancy between the two data sources.

    On December 19, 2007, the Energy Independence and Security Act of 2007 (EISA) was signed into law as Public Law 110-140. Section 246(a) of EISA directs Federal agencies to install at least one renewable fuel pump at each Federal fleet fueling center under their jurisdiction by January 1, 2010. Section 246(b) requires the President to submit an annual report to Congress on Federal agency progress in meeting this renewable fuel pump installation mandate. This guidance document provides guidelines to help agencies understand these requirements and how to comply with EISA Section 246.

  19. Effects of federal income taxes on the cash flow, operating revenue, and net income of electric utilities

    The idea to do this research was suggested by the efforts of some consumer groups and others to seek passage of a law in the United States to exempt investor-owned electric utilities from federal income taxes. The goal of the consumer groups is to reduce the charges to utility customers (which is measured in this study by the amount of the operating revenues of the utilities) while not causing any harm to the utilities. The population of interest consisted of all investor-owned electric utilities included on a current Compustat utility tape. In the analysis of the data, the changes in cash flow, operating revenue, and net income were summarized by the 89 utilities as a total group and by the division of the utilities into smaller groups or combinations which used the same accounting methods during the test period. The results of this research suggest the following conclusions concerning the change to a situation in which electric utilities are not subject to federal income taxes: (1) as a group, the decrease in cash flow would be significant, (2) as a group, the decrease in operating revenue (charges to customers) would not be significant, (3) as a group, the increase in net income would be significant, and (4) in analyzing the effects of any financial adjustments or changes on electric utilities, the accounting policies used to the utilities are an important factor.

    This report presents the status of the US Department of Energy`s alternative fuel vehicle demonstration and performance tracking programs being conducted in accordance with the Energy Policy and Conservation Act. These programs comprise the most comprehensive data collection effort ever undertaken on alternative transportation fuels and alternative fuel vehicles. The report summarizes tests and results from the fifth year. Electric vehicles are not included in these programs, and the annual report does not include information on them. Since the inception of the programs, great strides have been made in developing commercially viable alternative fuel vehicle technologies. However, as is the case in the commercialization of all new technologies, some performance problems have been experienced on vehicles involved in early demonstration efforts. Substantial improvements have been recorded in vehicle practicality, safety, and performance in real-world demonstrations. An aspect of particular interest is emissions output. Results from light duty alternative fuel vehicles have demonstrated superior inservice emissions performance. Heavy duty alternative fuel vehicles have demonstrated dramatic reductions in particulate emissions. However, emissions results from vehicles converted to run on alternative fuel have not been as promising. Although the technologies available today are commercially viable in some markets, further improvements in infrastructure and economics will result in greater market expansion. Information is included in this report on light and heavy duty vehicles, transit buses, vehicle conversions, safety, infrastructure support, vehicle availability, and information dissemination.

    In this study, the authors conducted a literature review of approaches and assumptions used by other modeling teams and consultants with respect to solar project financing; developed and incorporated an ability to model the likely financing shift away from more expensive sources of capital and toward cheaper sources as the investment tax credit declines in the ReEDS model; and used the 'before and after' versions of the ReEDS model to isolate and analyze the deployment impact of the financing shift under a range of conditions. Using ReEDS scenarios with this improved capability, we find that this 'financing' shift would soften the blow of the ITC reversion; however, the overall impacts of such a shift in capital structure are estimated to be small and near-term utility-scale PV deployment is found to be much more sensitive to other factors that might drive down utility-scale PV prices.

    Federal fleets are a frequent subject of legislative and executive efforts to lead a national transition to alternative fuels and advanced vehicle technologies. Section 701 of the Energy Policy Act of 2005 requires that all dual-fueled alternative fuel vehicles in the federal fleet be operated on alternative fuel 100% of the time when they have access to it. However, in Fiscal Year (FY) 2012, drivers of federal flex fuel vehicles (FFV) leased through the General Services Administration refueled with E85 24% of the time when it was available--falling well short of the mandate. The U.S. Department of Energy's National Renewable Energy Laboratory completed a 2-year Laboratory Directed Research and Development project to identify the factors that influence the refueling behavior of federal FFV drivers. The project began with two primary hypotheses. First, information scarcity increases the tendency to miss opportunities to purchase E85. Second, even with perfect information, there are limits to how far drivers will go out of their way to purchase E85. This paper discusses the results of the project, which included a June 2012 survey of federal fleet drivers and an empirical analysis of actual refueling behavior from FY 2009 to 2012. This research will aid in the design and implementation of intervention programs aimed at increasing alternative fuel use and reducing petroleum consumption.

Fuel cell CHP can deliver reliable electricity and heat with 70% to 85% efficiency. Implementing this technology can be a high efficiency, clean energy solution for agencies striving to meet ambitious sustainability requirements with limited budgets. Fuel cell CHP systems can use natural gas or renewable fuels, such as biogas. Procuring Stationary Fuel Cells for CHP: A Guide for Federal Facility Decision Makers presents an overview of the process for planning and implementing a fuel cell CHP project in a concise, step-by-step format. This guide is designed to help agency leaders turn their interest in fuel cell technology into successful installations. This guide concentrates on larger (100 kW and greater) fuel cell CHP systems and does not consider other fuel cell applications such as cars, forklifts, backup power supplies or small generators (<100 kW). Because fuel cell technologies are rapidly evolving and have high up front costs, their deployment poses unique challenges. The electrical and thermal output of the CHP system must be integrated with the building s energy systems. Each agency and division, however, has its own set of procurement procedures. This guide was written as a starting point, and it defers to the reader s set of rules if differences exist. The fuel cell industry is maturing, and project developers are gaining experience in working with federal agencies. Technology improvements, cost reductions, and experienced project developers are making fuel cell projects easier to put into service. In this environment, federal decision makers can focus on being smart buyers of fuel cell energy instead of attempting to become experts in fuel cell technology. For agencies that want to pursue a fuel cell CHP this guide presents a four step process for a successful project. 1. Perform a preliminary screening of the energy needs energy costs and incentives. 2. Compare a detailed project plan. 3. Make a financing and contracting decision. 4. Execute the project plan including financing, installation, and operation. The simplest procurement method is designated funding for the outright purchase of the fuel cell CHP system, although this is usually not the most cost-effective option. This guide describes the following financing options: Power purchase agreement Energy savings performance contract Utility energy services contract Enhanced use lease Fuel cell CHP technology can help federal facility managers comply with agency objectives for reducing energy consumption and air pollution emissions. Fuel cells do not generate particulate pollutants, unburned hydrocarbons or the gases that produce acid rain. Fuel cells emit less carbon dioxide (CO2) than other, less efficient technologies and use of renewable fuels can make them carbon neutral. Fuel cell CHP technology can deliver reliable electricity and heat with high efficiency (70% to 85%) in a small physical footprint with little noise, making it a cost-effective option for federal facilities.

The research worked to fill the need to validate the legitimacy of individual loads, offloads, and movements by integrating and validating, on a near-real-time basis, information from global positioning system (GPS), valve sensors, level sensors, and fuel-marker sensors.

    A new subchapter would be added to the Internal Revenue Code entitled Carbon Tax on Primary Fossil Fuels. The tax is imposed on coal, petroleum, and natural gas, and is phased in over five years beginning in 1992. The tax on coal is $3.60 per ton in 1992 and climbs to $18.00 per ton in 1996. The tax on petroleum begins at $0.78 per barrel and climbs to $3.90 per barrel in 1996. Natural gas is taxed at $0.096 per MCF in 1992 and $0.48 per MCF in 1996. (JAI) under ORNL's contract with DOE's OCRWM Systems Integration Program and in support of the Annual Capacity Report (ACR) Issue Resolution Process. The report topics relate specifically to the list of high priority technical waste acceptance issues developed jointly by DOE and a utility-working group. JAI performed various analyses and studies on each topic to serve as starting points for further discussion and analysis leading eventually to finalizing the process by which DOE will accept spent fuel and waste into its waste management system.     On December 8, 2007, the largest shipment of high-enriched uranium spent nuclear fuel was successfully made from a Russian-designed nuclear research reactor in the Czech Republic to the Russian Federation. This accomplishment is the culmination of years of planning, negotiations, and hard work. The United States, Russian Federation, and the International Atomic Energy Agency have been working together on the Russian Research Reactor Fuel Return (RRRFR) Program in support of the Global Threat Reduction Initiative. In February 2003, RRRFR Program representatives met with the Nuclear Research Institute in Re, Czech Republic, and discussed the return of their high-enriched uranium spent nuclear fuel to the Russian Federation for reprocessing. Nearly 5 years later, the shipment was made. This paper discusses the planning, preparations, coordination, and cooperation required to make this important international shipment.

    This paper examines fiscal reform options in the United States with an intertemporal computable general equilibrium model of the world economy called G-Cubed. Six policy scenarios explore two overarching issues: (1) the effects of a carbon tax under alternative assumptions about the use of the resulting revenue, and (2) the effects of alternative measures that could be used to reduce the budget deficit. We examine a simple excise tax on the carbon content of fossil fuels in the U.S. energy sector starting immediately at $15 per metric ton of carbon dioxide (CO2) and rising at 4 percent above inflation each year through 2050. We investigate policies that allow the revenue from the illustrative carbon tax to reduce the long run federal budget deficit or the marginal tax rates on labor and capital income. We also compare the carbon tax to other means of reducing the deficit by the same amount. We find that the carbon tax will raise considerable revenue: $80 billion at the outset, rising to $170 billion in 2030 and $310 billion by 2050. It also significantly reduces U.S. CO2 emissions by an amount that is largely independent of the use of the revenue. By 2050, annual CO2 emissions fall by 2.5 billion metric tons (BMT), or 34 percent, relative to baseline, and cumulative emissions fall by 40 BMT through 2050. The use of the revenue affects both broad economic impacts and the composition of GDP across consumption, investment and net exports. In most scenarios, the carbon tax lowers GDP slightly, reduces investment and exports, and increases imports. The effect on consumption varies across policies and can be positive if households receive the revenue as a lump sum transfer. Using the revenue for a capital tax cut, however, is significantly different than the other policies. In that case, investment booms, employment rises, consumption declines slightly, imports increase, and overall GDP rises significantly relative to baseline through about 2040. Thus, a tax reform that uses a carbon tax to reduce capital taxes would achieve two goals: reducing CO2 emissions significantly and expanding short-run employment and the economy. We examine three ways to reduce the deficit by an equal amount. We find that raising marginal tax rates on labor income has advantages over raising tax rates on capital income or establishing a carbon tax. A labor tax increase leaves GDP close to its baseline, reduces consumption very slightly and expands net exports slightly. Investment remains essentially unchanged. In contrast, a capital tax increase causes a significant and persistent drop in investment and much larger reductions in GDP. A carbon tax falls between the two: it lowers GDP more than a labor tax increase because it reduces investment. However, its effects on investment and GDP are more moderate than the capital tax increase, and it also significantly reduces CO2 emissions. A carbon tax thus offers a way to help reduce the deficit and improve the environment, and do so with minimal disturbance to overall economic activity.

    As a policy tool, state tax incentives can be structured to help states meet clean energy goals. Policymakers often use state tax incentives in concert with state and federal policies to support renewable energy deployment or reduce market barriers. This analysis used case studies of four states to assess the contributions of state tax incentives to the development of renewable energy markets. State tax incentives that are appropriately paired with complementary state and federal policies generally provide viable mechanisms to support renewable energy deployment. However, challenges to successful implementation of state tax incentives include serving project owners with limited state tax liability, assessing appropriate incentive levels, and differentiating levels of incentives for technologies with different costs. Additionally, state tax incentives may result in moderately higher federal tax burdens. These challenges notwithstanding, state tax incentives that consider certain policy design characteristics can support renewable energy markets and state clean energy goals.The scale of their impact though is directly related to the degree to which they support the renewable energy markets for targeted sectors and technologies. This report highlights important policy design considerations for policymakers using state tax incentives to meet clean energy goals.

    The Internal Revenue Service added confusion to the calculation of the net income limitation for the Windfall Profits Tax (WPT) in Revenue Ruling 85-79 and Private Letter Ruling 8406006, which appear to have no other purpose than to increase federal revenues. The result was to confuse the meaning of intangible drilling and development costs (IDC), the minimum and alternative minimum tax, and recapture of excess IDC as well. The ruling fragments identical concepts of IDC and costs for income and windfall profit tax purposes, which broadens the scope of the minimum and alternative minimum taxes without signaling that the converse tax burden of Section 1254 recapture has also narrowed. It also warps the concept of taxable income from the property. The situation calls for a withdrawal and new thinking to minimize dissonance in the tax law.

    After more than 50 years of operation of the LVR-15 research reactor operated by the UJV Rez, a. s. (formerly Nuclear Research Institute - NRI), a large amount of the spent nuclear fuel (SNF) of Russian origin has been accumulated. In 2005 UJV Rez, a. s. jointed the Russian Research Reactor Fuel Return (RRRFR) program under the United States (US) - Russian Global Threat Reduction Initiative (GTRI) and started the process of SNF shipment from the LVR-15 research reactor back to the Russian Federation (RF). In 2007 the first shipment of SNF was realized. In 2011, preparation of the second shipment of spent fuel from the Czech Republic started. The experience obtained from the first shipment will be widely used, but some differences must be taken into the account. The second shipment will be realized in 2013 and will conclude the return transport of all, both fresh and spent, high-enriched nuclear fuel from the Czech Republic to the Russian Federation. After the shipment is completed, there will be only low-enriched nuclear fuel on the territory of the Czech Republic, containing maximum of 20% of U-235, which is the conventionally recognized limit between the low- and high-enriched nuclear materials. The experience (technical, organizational, administrative, logistic) obtained from the each SNF shipment as from the Czech Republic as from other countries using the Russian type research reactors are evaluated and projected onto preparation of next shipment of high enriched nuclear fuel back to the Russian Federation. The results shown all shipments provided by the UJV Rez, a. s. in the frame of the GTRI Program have been performed successfully and safely. It is expected the experience and results will be applied to preparation and completing of the Chinese Miniature Neutron Source Reactors (MNSR) Spent Nuclear Fuel Repatriation in the near future. This 'revenue recycling' plan makes little progress toward the province's goal to reduce CO{sub 2} emissions 33% by 2020, yet it is hailed by proponents as a legislative milestone.     Volatile fuel prices affect both the cost and price of electricity in a liberalized market. Generators with the price-setting technology will face less risk to their profit margins than those with costs that are not correlated with price, even if those costs are not volatile. Emissions permit prices may respond to relative fuel prices, further increasing volatility. This paper simulates the impact of this on generators' profits, comparing an emissions trading scheme and a carbon tax against predictions for the UK in 2020. The carbon tax reduces the volatility faced by nuclear generators, but raises that faced by fossil fuel stations. Optimal portfolios would contain a higher proportion of nuclear plant if a carbon tax was adopted.

    Liquefied Natural Gas (LNG) Tax LNG is taxed at a rate of $0.14 per gallon when used as a motor fuel.
