    The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

    The Atomic Energy Act of 1954 established, and later Congressional amendments have confirmed, that except in areas which have been explicitly granted to the states, the federal government possesses preemptive authority to regulate radiation hazards associated with the development and use of atomic energy. Since the passage of the original Act, numerous decisions by the courts have reaffirmed the legitimacy of federal preemption, and have defined and redefined its scope. In this study, the aim is to explore the underlying issues involved in federal preemption of radiation-hazard regulation, and to recommend actions that the Department of Energy and other agencies and groups should consider undertaking in the near term to protect the preemption principle. Appropriate roles of the states are discussed, as well as recent state-level activities and their rationale, and several current arenas in which state-federal conflicts about regulation of hazards are being played out. The emphasis here is on four particular arenas that are now important arenas of conflict, but the issues discussed are far broader in scope. These four arenas are: state-level moratorium activity; emergency planning for reactors; conflicts arising from state financial regulation; and inroads in federal preemption through litigation under state law.

    With the realignment and closure of Federal facilities, especially Department of Defense installations, Federal agencies have been presented with a unique opportunity: the chance to create and dispose of air emission reduction credits (ERCs). This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances.     The FHFA regulates Fannie Mae, Freddie Mac, and the 12 Federal Home Loan Banks (the government-sponsored enterprises - GSEs). On June 18, 2009, James B. Lockhart III, then Director of FHFA, released a letter expressing concern about the negative impact of energy loan tax assessment programs (ELTAPs) - also known as Property Assessed Clean Energy (PACE) programs - on both the housing finance system and homeowner program participants. Subsequently, a number of PACE proponents responded to the concerns laid out in the FHFA letter. In early Fall 2009, word circulated that FHFA was planning to follow its June letter with guidance to other agencies, possibly including Fannie Mae and Freddie Mac, discouraging them from buying loans on properties subject to PACE-type assessment liens. This triggered a second round of stakeholder letters, several of which were addressed to President Obama. On October 18, 2009, the White House, in what some believe was an attempt to obviate the need for FHFA guidance, released a Policy Framework for PACE Financing Programs that outlined best practices guidance for homeowner and lender protection. As of February 2010, FHFA and the GSEs have agreed to monitor PACE programs and work with stakeholders and the Administration to consider additional guidance beyond the Policy Framework and to collect more information on PACE program efficacy and risks. A summary of the communications timeline and highlights of the communications are provided.

    Implementing solar energy projects at federal facilities is a process. The project planning phase of the process includes determining goals, building a team, determining site feasibility and selecting the appropriate project funding tool. This fact sheet gives practical guidance to assist decision-makers with understanding and selecting the funding tool that would best address their site goals. Because project funding tools are complex, federal agencies should seek project assistance before making final decisions. High capital requirements combined with limits on federal agency energy contracts create challenges for funding solar projects. Solar developers typically require long-term contracts (15-20) years to spread out the initial investment and to enable payments similar to conventional utility bill payments. In the private sector, 20-year contracts have been developed, vetted, and accepted, but the General Services Administration (GSA) contract authority (federal acquisition regulation [FAR] part 41) typically limits contract terms to 10 years. Payments on shorter-term contracts make solar economically unattractive compared with conventional generation. However, in several instances, the federal sector has utilized innovative funding tools that allow long-term contracts or has created a project package that is economically attractive within a shorter contract term.

    The Energy Policy Act of 1992 calls for a program to further the commercialization of renewable energy and energy efficient technologies for the industrial sector.. The primary objective of the Office of Industrial Technologies Chemical Industry Team is to work in partnership with the US chemical industry to maximize economic, energy, and environmental benefits through research and development of innovative technologies. This document was developed to inventory organizations within the federal government on current chemical industry-related research and development. While an amount of funding or number of projects specifically relating to chemical industry research and development was not defined in all organizations, identified were about 60 distinct organizations representing 7 cabinet-level departments and 4 independent agencies, with research efforts exceeding $3.5 billion in fiscal year 1995. Effort were found to range from less than $500 thousand per year at the Departments of Agriculture and the Interior to over $100 million per year at the Departments of Commerce, Defense, Energy, and Health and Human Services and the National Aeronautics and Space Administration. The total number of projects in these programs exceeded 10,000. This document is complete to the extent that agencies volunteered information. Additions, corrections, and changes are encouraged and will be incorporated in future revisions.

    The one year internship required for partial fulfillment of the Doctor of Engineering Degree was completed at the Governor's Energy Management Center in Austin, Texas. The intern worked for the State Agencies Department of the Energy Management Center. The intern was involved in a variety of projects, but the primary projects requiring the greatest time were the involvement with the design reviews for energy efficiency of new prisons being constructed in Texas, conducting energy management audits at 18 major state universities, and the technical and administrative assistance to the State Cogeneration Council. Other project involvement included managing the preliminary engineering design of the cogeneration facility at Austin State Hospital, responsibility for applying for a $1.4 million dollar crude oil refund on the behalf of all state agencies in Texas, and assisting in the planning and coordination of the $48 million Revolving Loan Program for the state of Texas. The internship taught many things about management and communications. The experience also provided a better understanding of how the state and federal government operate. The greatest contribution of the internship experience was the improvement of the intern's written and oral communication skills.

Available plug-in electric vehicles (PEVs) provide an attractive option in the selection of alternative fuel vehicles. PEVs, which consist of both battery electric vehicles (BEVs) and plug-in hybrid electric vehicles (PHEVs), have significant advantages over internal combustion engine (ICE) vehicles in terms of energy efficiency, reduced petroleum consumption, and reduced production of greenhouse gas (GHG) emissions, and they provide performance benefits with quieter, smoother operation. Delayed or insufficient attention to State and Tribal preparedness needs may significantly impact the transportation operations schedule and budget. The DOE Transportation Emergency Preparedness Program (TEPP) has successfully used a cooperative planning process to develop strong partnerships with States, Tribes, Federal agencies and other national programs to support responder preparedness across the United States. DOE TEPP has found that building solid partnerships with key emergency response agencies ensures responders have access to the planning, training, technical expertise and assistance necessary to safely, efficiently and effectively respond to a radiological transportation accident. Through the efforts of TEPP over the past fifteen years, partnerships have resulted in States and Tribal Nations either using significant portions of the TEPP planning resources in their programs and/or adopting the Modular Emergency Response Radiological Transportation Training (MERRTT) program into their hazardous material training curriculums to prepare their fire departments, law enforcement, hazardous materials response teams, emergency management officials, public information officers and emergency medical technicians for responding to transportation incidents involving radioactive materials.     This document is part of a larger, programmatic effort to assist federal agencies in taking action and changing their institutions to achieve and maintain federal sustainability goals, while meeting their mission goals. FEMP is developing guidance for federal agency efforts to enable institutional behavior change for sustainability, and for making sustainability “business as usual.” The driving requirement for this change is Executive Order (EO) 13514, Federal Leadership in Environmental, Energy, and Economic Performance. FEMP emphasizes strategies for increasing energy efficiency and renewable energy utilization as critical components of attaining sustainability, and promotes additional non-energy action pathways contained in EO 13514. This report contributes to the larger goal by laying out the conceptual and evidentiary underpinnings of guidance to federal agencies. Conceptual frameworks focus and organize the development of guidance. We outline a series of progressively refined conceptual frameworks, including a multi-layer approach, key steps in sustainability implementation, a process view of specific approaches to institutional change, the agency Strategic Sustainability Performance Plans (SSPPs), and concepts related to context-specific rules, roles and tools for sustainability.     The United States is home to over 80,000 dams, of which approximately 3% are equipped with hydroelectric generating capabilities. When a dam serves as a hydropower facility, it provides a variety of energy services that range from clean, reliable power generation to load balancing that supports grid stability. In most cases, the benefits of dams and their associated reservoirs go far beyond supporting the nation s energy demand. As evidenced by the substantial presence of non-powered dams with the ability to store water in large capacities, the primary purpose of a dam may not be hydropower, but rather one of many other purposes. A dam and reservoir may support navigation, recreation, flood control, irrigation, and water supply, with each multipurpose benefit providing significant social and economic impacts on a local, regional, and national level. When hydropower is one of the services provided by a multipurpose reservoir, it is then part of an integrated system of competing uses. Operating rules, management practices, consumer demands, and environmental constraints must all be balanced to meet the multipurpose project s objectives. When federal dams are built, they are authorized by Congress to serve one or more functions. Legislation such as the Water Resources Development Act regulates the operation of the facility in order to coordinate the authorized uses and ensure the dam s intended objectives are being met. While multipurpose reservoirs account for billions of dollars in contributions to National Economic Development (NED) every year, no attempt has been made to evaluate their benefits on a national scale. This study is an on-going work conducted by Oak Ridge National Laboratory in an effort to estimate the economic benefits of multipurpose hydropower reservoirs in the United States. The organization is part of a tripartite arrangement in which the Pollution Control Board is the judicial arm, the Department of Energy and Natural Resources is the research arm, and the Illinois EPA is the enforcement arm. Other state agencies are also concerned with various aspects of the environment and may do risk assessments for chemicals. Although there are various risk assessment activities, both formal and informal, in our agency and in others, this paper will discuss only recent initiatives in water quality criteria.

These legal requirements are grouped into five categories: (1) establishing an Office of Research and Technology Applications, or providing the functions thereof; (2) information management; (3) enabling agreements with non-federal partners; (4) royalty sharing; and (5) invention ownership/obligations. These five categories provide the organizing framework for this study, which benchmarks other federal agencies/laboratories engaged in technology transfer/transition Four key agencies--the Department of Health & Human Services (HHS), the U.S. Department of Agriculture (USDA), the Department of Energy (DOE), and the Department of Defense (DoD)--and several of their laboratories have been surveyed.     ENERGY STAR is a voluntary energy efficiency-labeling program operated jointly by the United States Department of Energy and the United States Environmental Protection Agency (US EPA). Since the program inception in 1992, ENERGY STAR has become a leading international brand for energy efficient products. ENERGY STAR's central role in the development of regional, national, and international energy programs necessitates an open process whereby its program achievements to date as well as projected future savings are shared with committed stakeholders. Through 2006, US EPA?S ENERGY STAR labeled products saved 4.8 EJ of primary energy and avoided 82 Tg C equivalent. We project that US EPA?S ENERGY STAR labeled products will save 12.8 EJ and avoid 203 Tg C equivalent over the period 2007-2015. A sensitivity analysis examining two key inputs (carbon factor and ENERGY STAR unit sales) bounds the best estimate of carbon avoided between 54 Tg C and 107 Tg C (1993 to 2006) and between 132 Tg C and 278 Tg C (2007 to 2015).

    the National Historic Preservation Act (NHPA). Under Section 368, Congress divided the United States into two groups of states: the 11 contiguous western states and the remaining states. Direction for energy transportation corridor analysis and selection in the 11 western states was addressed in Section 368(a) of EPAct, while direction for energy transportation corridor analysis and selection in all other states was addressed under Section 368(b) of EPAct. It was clearly the priority of Congress to conduct corridor location studies and designation first on federal lands in the western states. Under Section 368(a), the Agencies produced a programmatic environmental impact statement (EIS), Designation of Energy Corridors on Federal Land in the 11 Western States (DOE and DOI 2008), that was used in part as the basis for designating more than 6,000 mi (9,656 km) of energy transportation corridors on federal land in 11 western states. Under Section 368(a) of EPAct, Congress clearly stated the Agencies needed to (1) designate energy transportation corridors on federal land, (2) conduct the necessary environmental review of the designated corridors, and (3) incorporate the designated corridors into the appropriate land use plans. Congressional direction under Section 368(b) of EPAct differs from that provided under Section 368(a). Specifically, Section 368(b) requires the secretaries of the Agencies, in consultation with the Federal Energy Regulatory Commission (FERC), affected utility industries, and other interested persons, to jointly: (1) Identify corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on federal land in states other than the 11 western states identified under Section 368(a) of EPAct, and (2) Schedule prompt action to identify, designate, and incorporate the corridors into the applicable land use plans.     Over the last several years, data have been collected by the U.S. Environmental Protection Agency, the Department of Energy, and various state government agencies on manufacturing waste generation and energy consumption. To date, however, little analysis of these data have been performed on the characteristics and distributions of waste types generated and energy forms consumed. Yet, these databases provide a wealth of information that can be used to draw useful conclusions on manufacturing efficiency. Although the data collected have weaknesses, the Toxics Release Inventory (TRI) and Consumption of Energy Report can be used to investigate possible relationships between industrial waste generation and energy consumption.

    A water treatment system at a United States Environmental Protection Agency (USEPA) Superfund site impacted by radiological contaminants is used to treat water entering the site. The United States Army Corps of Engineers (USACE) is actively managing the remedial action for the USEPA using contracts to support the multiple activities on site. The site is where former gas mantle production facilities operated around the turn of the century. The manufacturing facilities used thorium ores to develop the mantles and disposed of off-specification mantles and ore residuals in the surrounding areas. During Site remedial actions, both groundwater and surface water comes into contact with contaminated soils and must be collected and treated at an on-site treatment facility. The radionuclides thorium and radium with associated progeny are the main concern for treatment. Suspended solids, volatile organic compounds, and select metals are also monitored during water treatment. The water treatment process begins were water is pumped to a collection tank where debris and grit settle out. Stored water is pumped to a coagulant tank containing poly-aluminum chloride to collect dissolved solids. The water passes into a reaction tube where aspirated air is added or reagent added to remove Volatile Organic Compounds (VOC'S) by mass transfer and convert dissolved iron to a solid. The water enters the flocculent polymer tank to drop solids out. The flocculated water overflows to a fluidized bed contact chamber to increase precipitation. Flocculation is where colloids of material drop out of suspension and settle. The settled solids are periodically removed and disposed of as radioactive waste. The water is passed through filters and an ion exchange process to extract the radionuclides. Several million liters of water are processed each year from two water treatment plants servicing different areas of the remediation site. Ion exchange resin and filter material are periodically replaced

    The federal Surface Mining Control and Reclamation Act of 1977 not only established national performance standards and permitting procedures for the coal industry, but also provided for state primacy. The principle of state primacy is both simple and intuitively appealing. Because states do not have adequate resources to develop effective regulatory programs, the federal government would set up comprehensive procedures and criteria to guide the states in preparing their own plans. The obvious advantage of state primacy is that it provides for flexibility in implementation. Ultimately, state primacy is an experiment in cooperative federalism, a sharing of authority and responsibility between the states and the federal government to insure both the general welfare and sensitivity to local conditions. The history of surface mining regulation is instructive because it points out the pitfalls and promise of cooperative federalism as well as the critical role of the courts in making state primacy work.

    This thesis discusses a recent United States Supreme Court case that will have a profound influence on the licensure of hydroelectric projects and the related ability of States to protect the quality of their waters. On October 4, 1993, the Supreme Court granted a Writ of Certiorari to resolve a conflict among the state courts of last resort. This case involves two fundamental and competing national interests: the nation's thirst for cheap, dependable power versus its equally strong desire to improve the quality of its water resources. It also involves two underlying regulatory regimes that overlap and conflict with each other in some ways. This case illustrates how those two national interests and their underlying regulatory regimes cannot always be reconciled. It also demonstrates how Congress, with its muddled ways of passing legislation, can create conflicts between federal and state regulatory agencies.

    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    The Army Corps of Engineers, Pacific Ocean Division, participated in the interagency case study of sea level rise for Yap State in the Federated States of Micronesia. The study, on behalf of the National Oceanic and Atmospheric Administration, was in support of the Intergovernmental Panel on Climate Change. Engineering and environmental analyses indicate that resources within Yap State at risk from a 1.0 meter rise in sea level by the year 2100 are substantial, including coral reefs, sea grass beds, wetlands, native mangrove forests, groundwater, archaeological and cultural resources, and shoreline infrastructure. Severe constraints associated with land ownership patterns have helped prevent the potential for greater impact. Yet these same constraints will likely hinder future decisions regarding retreat, accommodation, or protection strategies. As a result, there are special institutional and cultural challenges that face Yap in developing and implementing appropriate responses to accelerated sea level rise. These are made more difficult with the many uncertainties associated with current predictions regarding the greenhouse effect.

    On October 9, 2008, federal, state and local policy makers, emergency managers, and medical and public health officials convened in Seattle, Washington, for a workshop on Addressing the Federal-State-Local Interface Issues During a Catastrophic Event Such as an Anthrax Attack. The day-long symposium was aimed at generating a dialogue about recovery and restoration through a discussion of the associated challenges that impact entire communities, including people, infrastructure, and critical systems. The Principal Federal Official (PFO) provided an overview of the role of the PFO in a catastrophic event. A high-level summary of an anthrax scenario was presented. The remainder of the day was focused on interactive discussions among federal, state and local emergency management experts in the areas of: • Decision-making, prioritization, and command and control • Public health/medical services • Community resiliency and continuity of government. Key topics and issues that resulted from discussions included: • Local representation in the Joint Field Office (JFO) • JFO transition to the Long-Term Recovery Office • Process for prioritization of needs • Process for regional coordination • Prioritization - process and federal/military intervention • Allocation of limited resources • Re-entry decision and consistency • Importance of maintaining a healthy hospital system • Need for a process to establish a consensus on when it is safe to re-enter. This needs to be across all jurisdictions including the military. • Insurance coverage for both private businesses and individuals • Interaction between the government and industry. Additional information beyond this level is generally limited to distribution of that total by agency and maybe distribution of the total by state. However, additional characterization of the Federal building stock is required as the Federal sector seeks ways to implement efficiency projects to reduce energy and water use intensity as mandated by legislation and Executive Order. Using a Federal facility database that was assembled for use in a geographic information system tool, additional characterization of the Federal building stock is provided including information regarding the geographical distribution of sites, building counts and percentage of total by agency, distribution of sites and building totals by agency, distribution of building count and floor space by Federal building type classification by agency, and rank ordering of sites, buildings, and floor space by state. A case study is provided regarding how the building stock has changed for the Department of Energy from 2000 through 2008.

    The most important indicator of a well-managed site cleanup effort may no longer be funding or scientific expertise. While support for federal facility cleanup has included appropriations of more than $10 billion annually, these expenditures alone are unlikely to assure progress toward environmental remediation. {open_quotes}Trust{close_quotes} is now overwhelmingly mentioned as a prerequisite for progress with site cleanup in DOE`s weapons complex. In part, federal budget deficits are forcing participants to focus on factors that build consensus and lead to cost-effective cleanup actions. In some cases, the stakeholders at cleanup sites are making efforts to work cooperatively with federal agencies. A report by 40 representatives of federal agencies, tribal and state governments, associations, and others developed recommendations to create a {open_quotes}new era of trust and consensus-building that allows all parties to get on with the job of cleaning up federal facilities in a manner that reflects the priorities and concerns of all stakeholders.{close_quotes} Changes are underway affecting how federal agencies work with federal and state regulators reflecting this concept of shared responsibility for conducting cleanup. This paper addresses these changes and provides examples of the successes and failures underway.

    In the Department of Energy (DOE) Implementation Plan (IP) for Defense Nuclear Facilities Safety Board's Recommendation 2009-1, the DOE committed to studying the use of quantitative risk assessment methodologies at government agencies and industry. This study consisted of document reviews and interviews of senior management and risk assessment staff at six organizations. Data were collected and analyzed on risk assessment applications, risk assessment tools, and controls and infrastructure supporting the correct usage of risk assessment and risk management tools. The study found that the agencies were in different degrees of maturity in the use of risk assessment to support the analysis of high hazard operations and to support decisions related to these operations. Agencies did not share a simple, 'one size fits all' approach to tools, controls, and infrastructure needs. The agencies recognized that flexibility was warranted to allow use of risk assessment tools in a manner that is commensurate with the complexity of the application. The study also found that, even with the lack of some data, agencies application of the risk analysis structured approach could provide useful insights such as potential system vulnerabilities. This study, in combination with a companion study of risk assessment programs in the DOE Offices involved in high hazard operations, is being used to determine the nature and type of controls and infrastructure needed to support risk assessments at the DOE.

    Numerous pre-existing and newly emerging state- and locally-managed revolving loan funds (RLFs) are being used in conjunction with energy savings performance contracts (ESPCs) as an option for financing of energy efficiency projects. This document presents an overview of ESPCs and how they fit within the RLF framework. There are a variety of options available to state and local governments to catalyze the disbursement of available capital from RLFs and increase the number of ESPC projects within their jurisdictions. To demonstrate the implementation of this type of financing program in action, this report concludes with four program case studies of state-sponsored RLFs where ESPCs are an allowed use of funds.

    The Department of Energy's Office of Civilian Radioactive Waste Management (OCRWM) committed in its November 2003 Strategic Plan for the Safe Transportation of Spent Nuclear Fuel and High-Level Radioactive Waste to Yucca Mountain: A Guide to Stakeholder Interactions to develop the transportation system collaboratively with stakeholders. The Strategic Plan further stated that four state regional groups (SRGs) would be the 'anchors' for OCRWM's collaboration with the states. The first major transportation planning activity that OCRWM initiated after publication of the Strategic Plan was the development of the Section 180(c) grant program. This document describes that collaboration and its outcomes from the perspective of the OCRWM participants and one of the SRGs, the Council of State Governments - Midwestern Office (CSG Midwest).     Annual highway fuel taxes are collected by the Treasury Department and placed in the Highway Trust Fund (HTF). There is, however, no direct connection between the taxes collected by the Treasury Department and the gallons of on-highway fuel use, which can lead to a discrepancy between these totals. This study was conducted to determine how much of a discrepancy exists between the total fuel usages estimated based on highway revenue funds as reported by the Treasury Department and the total fuel usages used in the apportionment of the HTF to the States. The analysis was conducted using data from Highway Statistics Tables MF-27 and FE-9 for the years 1991-2001. It was found that the overall discrepancy is relatively small, mostly within 5% difference. The amount of the discrepancy varies from year to year and varies among the three fuel types (gasoline, gasohol, special fuels). Several potential explanations for these discrepancies were identified, including issues on data, tax measurement, gallon measurement, HTF receipts, and timing. Data anomalies caused by outside forces, such as deferment of tax payments from one fiscal year to the next, can skew fuel tax data. Fuel tax evasion can lead to differences between actual fuel use and fuel taxes collected. Furthermore, differences in data collection and reporting among States can impact fuel use data. Refunds, credits, and transfers from the HTF can impact the total fuel tax receipt data. Timing issues, such as calendar year vs. fiscal year, can also cause some discrepancy between the two data sources.
