    For over two years, The Keystone Center facilitated a dialogue on State and Federal Regulation of the Electricity Industry. The intent of this report is to assist policy-makers faced with decisions about changes to traditional utility regulation and planning and provide an overview of a diverse group`s deliberations on regulatory jurisdictional conflicts. This report is not a consensus document, rather it is a staff written summary of two years of discussion on the issues. The participants in the Keystone Dialogue believed that all affected interests could benefit from, if nothing else, a summary of their discussions of state/federal issues. The electric utility industry is one of the last remaining, heavily regulated industries in the United States. Rate and corporate regulation is split between state and federal governments and there is distinct regulatory authority at each level. For example, retail rate regulation occurs at the state level, the Federal Energy Regulatory Commission is responsible for wholesale rate regulation under the Federal Power Act, and the Securities and Exchange Commission oversees registered utility holding companies as defined under the Public Utility Holding Company Act of 1935. This jurisdictional split between state and federal regulation has evolved over many years through legislation and litigation on such matters. The creation of this allocation of regulatory responsibility was initiated in 1935 with the passage of the Public Utility Holding Company Act and the Federal Power Act when the economic and technological changes that are now occurring in the industry simply could not have been envisioned.

    Oil shale and oil sands resources located within the intermountain west represent a vast, and as of yet, commercially untapped source of energy. Development will require water, and demand for scarce water resources stands at the front of a long list of barriers to commercialization. Water requirements and the consequences of commercial development will depend on the number, size, and location of facilities, as well as the technologies employed to develop these unconventional fuels. While the details remain unclear, the implication is not – unconventional fuel development will increase demand for water in an arid region where demand for water often exceeds supply. Water demands in excess of supplies have long been the norm in the west, and for more than a century water has been apportioned on a first-come, first-served basis. Unconventional fuel developers who have not already secured water rights stand at the back of a long line and will need to obtain water from willing water purveyors. However, uncertainty regarding the nature and extent of some senior water claims combine with indeterminate interstate river management to cast a cloud over water resource allocation and management. Quantitative and qualitative water requirements associated with Endangered Species protection also stand as barriers to significant water development, and complex water quality regulations will apply to unconventional fuel development. Legal and political decisions can give shape to an indeterminate landscape. Settlement of Northern Ute reserved rights claims would help clarify the worth of existing water rights and viability of alternative sources of supply. Interstate apportionment of the White River would go a long way towards resolving water availability in downstream Utah. And energy policy clarification will help determine the role oil shale and oil sands will play in our nation’s future.

    In June 1995, the New York Public Service Commission (NYPSC) released a Staff investigation of Orange and Rockland Utilities, Inc. (O&R). The primary focus of the Staffs investigation was the Corporate Policy and External Affairs Department, a restricted disbursements account, the Internal Auditing Department, and O&R officer malfeasance. The Staffs` investigation uncovered widespread, alleged instances of lax internal controls, unethical and illegal actions, and lavish officer behavior. In addition, the Staff investigated O&R`s internal control and purchasing functions. The Staff proposed a series of recommendations to improve the Company`s internal control, purchasing, ethical, climate and addressed the issue of a New York ratepayer reimbursement. The Staffs findings and recommendations were presented in the form of a report, entitled Staff Investigation of Orange and Rockland Utilities, Inc. This article summarizes the Report.

    Geothermal electricity production capacity has grown over time because of multiple factors, including its renewable, baseload, and domestic attributes; volatile and high prices for competing technologies; and policy intervention. Overarching federal policies, namely the Public Utilities Regulatory Policies Act (PURPA), provided certainty to project investors in the 1980s, leading to a boom in geothermal development. In addition to market expansion through PURPA, research and development policies provided an investment of public dollars toward developing technologies and reducing costs over time to increase the market competitiveness of geothermal electricity. Together, these efforts are cited as the primary policy drivers for the currently installed capacity. Informing policy decisions depends on the combined impacts of policies at the federal and state level on geothermal development. Identifying high-impact suites of policies for different contexts, and the government levels best equipped to implement them, would provide a wealth of information to both policy makers and project developers.

    This Site Characterization Analysis (SCA) documents the NRC staff`s concerns resulting from its review of the US Department of Energy`s (DOE`s) Site Characterization Plan (SCP) for the Yucca Mountain site in southern Nevada, which is the candidate site selected for characterization as the nation`s first geologic repository for high-level radioactive waste. DOE`s SCP explains how DOE plans to obtain the information necessary to determine the suitability of the Yucca Mountain site for a repository. NRC`s specific objections related to the SCP, and major comments and recommendations on the various parts of DOE`s program, are presented in SCA Section 2, Director`s Comments and Recommendations. Section 3 contains summaries of the NRC staff`s concerns for each specific program, and Section 4 contains NRC staff point papers which set forth in greater detail particular staff concerns regarding DOE`s program. Appendix A presents NRC staff evaluations of those NRC staff Consultation Draft SCP concerns that NRC considers resolved on the basis of the SCP.     This study was designed to develop and test a procedure to measure the electrical consumption of ice making in domestic refrigerators. The Department of Energy (DOE) test procedure was modified to include the energy used for icemaking in conventional refrigerators and those equipped with automatic icemakers. The procedure assumed that 500 grams of ice would be produced daily. Using the new test procedure and the existing DOE test (as a benchmark), four refrigerators equipped with automatic icemakers were tested for ice-making energy use. With the revised test, gross electricity consumption increased about 10% (100 kWh/yr) due to automatic icemaking but about 5% (55 kWh/yr) could be attributed to the special features of the automatic icemaker. The test also confirmed the feasibility of establishing procedures for measuring energy use of specific loads and other activities related to domestic refrigerators. Field testing and subsequent retesting revealed a 14% increase in energy use.

    The NRC staff uses probabilistic risk assessment (PRA) and risk management as important elements its licensing and regulatory processes. In October 1991, the NRC`s Executive Director for Operations established the PRA Working Group to address concerns identified by the Advisory Committee on Reactor Safeguards with respect to unevenness and inconsistency in the staff`s current uses of PRA. After surveying current staff uses of PRA and identifying needed improvements, the Working Group defined a set of basic principles for staff PRA use and identified three areas for improvements: guidance development, training enhancements, and PRA methods development. For each area of improvement, the Working Group took certain actions and recommended additional work. The Working Group recommended integrating its work with other recent PRA-related activities the staff completed and improving staff interactions with PRA users in the nuclear industry. The Working Group took two key actions by developing general guidance for two uses of PRA within the NRC (that is, screening or prioritizing reactor safety issues and analyzing such issues in detail) and developing guidance on basic terms and methods important to the staff`s uses of PRA.

    Regulation of natural gas imports from Mexico has been dominated by the industry's domestic regulatory-issue agenda throughout the 30-year trade history. Three distinct phases are identified. In the 1950's, Mexican imports were assessed in terms of their effect on a domestic industry experiencing rapid growth and inter-fuel competition. In the 1960's and thereafter, preservation of domestic price regulation was the overriding criterion for determination of the public interest in Mexican import applications. In the most recent phase, national security considerations activated by the energy crisis have increased the salience of foreign economic policy in the regulation of Mexican natural gas imports. Notwithstanding, domestic issues have continued to predominate. The increasing importance of foreign economic policy in determination of the public interest in Mexican imports is apparent in the transformation of regulatory practice. An administrative process in which the Federal Power Commission interpreted a vague Congressional mandate for the public interest in adversarial public hearings was transformed in the Carter Administration. Explicit policy guidelines were enunciated and interpreted in the Department of Energy under the jurisdiction of its Secretary. Policy consistency and containment of pluralist participatory politics were explicit objectives of a new Congressional mandate that greatly modified regulatory procedures initiated by the Natural Gas Act in 1938.

    On April 13, 1983, the US Nuclear Regulatory Commission issued for public comment a ''Proposed Commission Policy Statement on Severe Accidents and Related Views on Nuclear Reactor Regulation'' (48 FR 16014). This report presents and discusses the Commission's final version of that policy statement now entitled, ''Policy Statement on Severe Reactor Accidents Regarding Future Designs and Existing Plants.'' It provides an overview of comments received from the public and the Advisory Committee on Reactor Safeguards and the staff response to these. In addition to the Policy Statement, the report discusses how the policies of this statement relate to other NRC programs including the Severe Accident Research Program; the implementation of safety measures resulting from lessons learned in the accident at Three Mile Island; safety goal development; the resolution of Unresolved Safety Issues and other Generic Safety Issues; and possible revisions of rules or regulatory requirements resulting from the Severe Accident Source Term Program. Also discussed are the main features of a generic decision strategy for resolving Regulatory Questions and Technical Issues relating to severe accidents; the development and regulatory use of new safety information; the treatment of uncertainty in severe accident decision making; and the development and implementation of a Systems Reliability Program for both existing and future plants to ensure that the realized level of safety is commensurate with the safety analyses used in regulatory decisions.

    This final report summarizes work carried out under agreement with the US Department of Energy, related to wind energy policy issues. This project has involved a combination of outreach and publications on wind energy, with a specific focus on educating state-level policymakers. Education of state policymakers is vitally important because state policy (in the form of incentives or regulation) is a crucial part of the success of wind energy. State policymakers wield a significant influence over all of these policies. They are also in need of high quality, non-biased educational resources which this project provided. This project provided outreach to legislatures, in the form of meetings designed specifically for state legislators and legislative staff, responses to information requests on wind energy, and publications. The publications addressed: renewable energy portfolio standards, wind energy transmission, wind energy siting, case studies of wind energy policy, avian issues, economic development, and other related issues. These publications were distributed to legislative energy committee members, and chairs, legislative staff, legislative libraries, and other related state officials. The effect of this effort has been to provide an extensive resource of information about wind information for state policymakers in a form that is useful to them. This non-partisan information has been used as state policymakers attempt to develop their own policy proposals related to wind energy in the states.

    Two key overarching goals of this Initiative are enhancing the efficiency and competitiveness of U.S. industry and reducing the trends toward higher imports. These goals take into account new Federal policies that reflect economic needs, including economic growth, deficit reduction, job creation and security, and global competitiveness, as well as the need to preserve the environment, improve energy efficiency, and provide for national security. The success of this Initiative clearly requires coordinated strategies that range far beyond policies primarily directed at natural gas and oil supplies. Therefore, this Initiative proposes three major strategic activities: Strategic Activity 1 -- increase domestic natural gas and oil production and environmental protection by advancing and disseminating new exploration, production, and refining technologies; Strategic Activity 2 -- stimulate markets for natural gas and natural-gas-derived products, including their use as substitutes for imported oil where feasible; and Strategic Activity 3 -- ensure cost-effective environmental protection by streamlining and improving government communication, decision making, and regulation. Finally, the Initiative will reexamine the costs and benefits of increase oil imports through a broad new Department of Energy study. This study will form the basis for additional actions found to be warranted under the study.

    Studies of arms control and disarmament tend to focus on political, military, and diplomatic processes. Recently, in the context of the conversion of defense activities to civilian use, the economic aspects of arms control have also received renewed interest. The legal dimension, however, is in need of fresh examination. Both international and domestic law are sailing increasingly in uncharted waters. Recent arms control agreements and related developments in international peacekeeping have expanded the scope of international law and altered how one perceives certain fundamentals, including the principle of national sovereignty. Still, the nation state is largely unchallenged as the primary actor in international affairs. National governments retain near absolute sovereign rights and responsibilities even in an age of trans-national economic integration and codified international norms for human rights, freedom of the press, and the peaceful resolution of disputes. Indeed, the role of domestic law in arms control and disarmament may be more significant now than ever before. A brief review of relationships between arms control and domestic law should illustrate ways in which ones thinking has been underestimating the importance of domestic law. Hopefully, this survey will set the stage properly for the excellent, more detailed case studies by Elinor Hammarskjold and Alan Crawford. Toward that end, this paper will highlight a number of more general, and sometimes provocative, themes. These themes should be kept in mind when those two complementary presentations are considered.

    Commodity program changes, such as planting flexibility, are estimated to achieve some net aggregate reductions in agrichemical use and erosion, while improving agriculture's market orientation and lowering government cost. However, the potential environmental effects vary widely by region. Although commodity program alteration can lessen some undesirable environmental effects in the short term, it does not remedy the basic externality causes of environmental problems. New land retirement approaches targeted to wetlands restoration and to land use change for water quality and other environmental services can achieve longrun environmental improvement. The net effects of land retirement on environmental quality, food and fiber production, consumer price, and government cost depend on simultaneous commodity program management. Any effects on commodities or the environment ultimately depend also on a host of external conditions (such as trade flows) affecting relative crop prices and input costs.

    Biomass is increasingly being considered as a feedstock to provide a clean and renewable source of energy in the form of both liquid fuels and electric power. In the United States, the biofuels and biopower industries are regulated by different policies and have different drivers which impact the maximum price the industries are willing to pay for biomass. This article describes a dynamic computer simulation model that analyzes future behavior of bioenergy feedstock markets given policy and technical options. The model simulates the long-term dynamics of these markets by treating advanced biomass feedstocks as a commodity and projecting the total demand of each industry as well as the market price over time. The model is used for an analysis of the United States bioenergy feedstock market that projects supply, demand, and market price given three independent buyers: domestic biopower, domestic biofuels, and foreign exports. With base-case assumptions, the biofuels industry is able to dominate the market and meet the federal Renewable Fuel Standard (RFS) targets for advanced biofuels. Further analyses suggest that United States bioenergy studies should include estimates of export demand in their projections, and that GHG-limiting policy would partially shield both industries from exporter dominance.

    The Alliance to Save Energy initiated this workshop as a means of bringing climate change policy makers and economists together on the eve of the opening negotiating session for a climate change convention. The one and one-half day workshop was attended by 16 analysts who provided presentations on modeling approaches. There is a need for policy makers to be better able to evaluate the growing literature estimating the potential cost of policy options. Our hope is that this report, to be presented at the conclusion of the negotiations on the framework convention on climate change at the Earth Summit in Brazil, will help policy makers in the US and elsewhere evaluate the costs and benefits of national climate change mitigation policies. Although it is still unclear how far the convention will go in requiring emissions reductions, many countries are proceeding with detailed plans to reduce domestic carbon dioxide (CO{sub 2}) emissions. Our goal in holding the workshop and writing this report is to spark a new level of dialogue between the producers and users of information on the costs and benefits of climate mitigation policies leading to the development of more cost-effective policy solutions at the national and international levels.
