    U.S. Department of Energy (DOE) employees and contractors frequently work with Indian tribes or nations as part of their jobs. The purpose of this guide is to help DOE employees and contractors initiate contact with tribes and build effective relationships. DOE maintains a unique government-to government relationship with tribal nations. This guide presents an overview of the history of the relationship between the tribes and the Federal government, as well as the laws and Executive Orders that define that relationship. The guide discusses the Federal government’s trust responsibility to the tribes, tribal treaty rights, and the Department of Energy’s American Indian policy. The guide also discusses important cultural differences that could lead to communication problems if not understood and provides examples of potential cultural misunderstandings. In particular the guide discusses tribal environmental beliefs that shape tribal responses to DOE actions. The guide also provides pointers on tribal etiquette during meetings and cultural ceremonies and when visiting tribal reservations. Appendix 1 gives examples of the tribal nations with whom DOE currently has Memoranda of Understanding. While this guide provides an introduction and overview of tribal relations for DOE staff and contractors, DOE has also designated Tribal Issues Points of Contacts at each of its facilities. A list of these Points of Contact for all DOE facilities is provided in Appendix 2. DOE staff and contractors should consult with the appropriate tribal representatives at their site before initiating contact with a tribal nation, because many tribes have rules and procedures that must be complied with before DOE staff or contractors may go on tribal lands or conduct interviews with tribal members. Appendix 3 is the complete DOE American Indian Policy. Appendices 4-6 are Executive Orders that govern the relationship of all federal agencies with tribal nations. DOE employees and staff are

    We found that DOE headquarters and some field offices have been unable to meet DOE goals to reinvestigate security clearances. Clearance reinvestigation are an important element of DOE's security program because they are aimed at identifying employees whose lifestyles raise questions about their eligibility for a clearance. DOE's failure to perform timely reinvestigation has contributed to having cleared employees in its work force who may not be suitable for a clearance because they have serious drug, alcohol, or other problems. DOE needs to develop a plan to ensure that all required reinvestigations are performed on time. Planning should start with a review of the appropriateness of the number and level of active clearances, since these factors largely determine the reinvestigation workload. The plan should then provide for the resources necessary to meet requirements.

    The second full-scale field exercise of the Federal Radiological Emergency Response Plan (FRERP) was held at the Zion Nuclear Power Station, Zion, Illinois, in June 1987. The exercise incorporated the annual compliance exercise for the Zion plant and involved the operating utility, Commonwealth Edison Company, the states of Illinois and Wisconsin, local governments, volunteer groups, and representatives from 12 federal agencies. The 3-day exercise was played from many locations in the Zion area; Springfield, Illinois; Madison, Wisconsin; and Washington, DC. Approximately 1000 people participated in the exercise, which used a scenario in which an accident at the plant resulted in the release of radioactive material outside the plant boundary. The US Department of Energy (DOE) had major responsibilities during the planning, playing, and critiquing of the exercise; these functions are outlined in the report. This document describes the DOE participation in the planning and response during the exercise. During a radiological emergency, the FRERP gives DOE the responsibility for coordinating the federal radiological monitoring and assessment activities in support of the states and the cognizant federal agency. At Zion, a self-sufficient Federal Radiological Monitoring and Assessment Center was established by DOE at a nearby fairground in which over 200 people from DOE, the two states, and other federal agencies participated. Before the field exercise, a tabletop exercise and a dry run were held for training purposes. 5 refs., 6 figs.

    The CILogon-HA project extended the existing open source CILogon service (initially developed with funding from the National Science Foundation) to provide credentials at multiple levels of assurance to users of DOE facilities for collaborative science. CILogon translates mechanism and policy across higher education and grid trust federations, bridging from the InCommon identity federation (which federates university and DOE lab identities) to the Interoperable Global Trust Federation (which defines standards across the Worldwide LHC Computing Grid, the Open Science Grid, and other cyberinfrastructure). The CILogon-HA project expanded the CILogon service to support over 160 identity providers (including 6 DOE facilities) and 3 internationally accredited certification authorities. To provide continuity of operations upon the end of the CILogon-HA project period, project staff transitioned the CILogon service to operation by XSEDE.

These twelve factors are commonly referred to as “Douglas Factors” and have been incorporated into the various Labor Agreements Grievance Procedures There are two grievance procedures available to DOE Headquarters employees.     A five-year initiative between the US Department of Energy (DOE) and the US Department of Housing and Urban Development (HUD) demonstrated the feasibility of improving the energy efficiency of publicly-assisted housing. Twenty-seven projects and activities undertaken during 1990--95 involved research and field demonstrations, institutional and administrative changes to HUD policies and procedures, innovative financing and leveraging of federal dollars with non-federal money, and education, training, and technical assistance. With most of the 27 projects and activities completed, the two departments have initiated a five-year deployment effort, the DOE-Energy Partnerships for Affordable Homes, to achieve energy and water savings in public and assisted housing on a large scale throughout the country. A Clearinghouse for Energy Efficiency in Public and Assisted Housing managed by the National Center for Appropriate Technology (NCAT), will offer hands-on energy assistance to housing providers to complement DOE`s assistance. This paper presents the findings of the DOE-HUD Initiative, with primary attention paid to those projects which successfully integrated energy efficiency into private and public single and multifamily housing. The paper includes examples of the publications, case-study reports, exhibits and videotapes developed during the course of the Initiative. Information on the new DOE Energy Partnerships and on the NCAT Clearinghouse is also presented. New Partnership projects with the Atlanta and Chicago Housing Authorities describe the technical assistance envisioned under the Partnership.

    These guidelines establish a uniform reporting system (URS) for grants and cooperative agreements. The purpose is to simplify reporting requirements, standardize reporting, and ensure that no assistance recipient submits more reports than needed to achieve accountability for public funds. This system replaces the many reporting procedures previously imposed by DOE component organizations. Uniform terminology and data elements will minimize ambiguity of meaning and intent. A glossary of terms is provided. A checklist is used to identify all reporting requirements at the time of award. The recipient is encouraged to discuss the requirements before the time of award in order to ensure that they are appropriate. The Guidelines describe planning forms which can be included in the Federal assistance application or proposal to present the planned approach and desired results. Flexibility has been built into the system to ensure that the information requested is relative to the activity performed. A recipient of Federal assistance submits information only once in each reporting period. The reporting system provides recipients with a formal method for identifying problems, including those originated by the Federal government. For purposes of illustration, a hypothetical project - partially funded by DOE under a cooperative agreement - using all the Program Management forms is presented in Part II, Program Management. Part III, Technical Information uses a research grant to illustrate Technical Reporting. Appendix B provides a complete example of the reporting requirements on a research grant.

    The Department of Energy (DOE) is issuing procedural rules to be used in applying its substantive regulations and orders relating to nuclear safety. These procedural rules are intended to be an essential part of the framework through which DOE deals with its contractors, subcontractors, and suppliers to ensure its nuclear facilities are operated in a manner that protects public and worker safety and the environment. In particular, this part sets forth the procedures to implement the provisions of the Price- Anderson Amendments Act of 1988 (PAAA) which subjects DOE contractors to potential civil and criminal penalties for violations of DOE rules, regulations and orders relating to nuclear safety (DOE Nuclear Safety Requirements).

    DOE Partnerships with States, Tribes and Other Federal Programs Help Responders Prepare for Challenges Involving Transport of Radioactive Materials Implementing adequate institutional programs and validating preparedness for emergency response to radiological transportation incidents along or near U.S. Department of Energy (DOE) shipping corridors poses unique challenges to transportation operations management. Delayed or insufficient attention to State and Tribal preparedness needs may significantly impact the transportation operations schedule and budget. The DOE Transportation Emergency Preparedness Program (TEPP) has successfully used a cooperative planning process to develop strong partnerships with States, Tribes, Federal agencies and other national programs to support responder preparedness across the United States. DOE TEPP has found that building solid partnerships with key emergency response agencies ensures responders have access to the planning, training, technical expertise and assistance necessary to safely, efficiently and effectively respond to a radiological transportation accident. Through the efforts of TEPP over the past fifteen years, partnerships have resulted in States and Tribal Nations either using significant portions of the TEPP planning resources in their programs and/or adopting the Modular Emergency Response Radiological Transportation Training (MERRTT) program into their hazardous material training curriculums to prepare their fire departments, law enforcement, hazardous materials response teams, emergency management officials, public information officers and emergency medical technicians for responding to transportation incidents involving radioactive materials. In addition, through strong partnerships with Federal Agencies and other national programs TEPP provided technical expertise to support a variety of radiological response initiatives and assisted several programs with integration of the nationally recognized MERRTT program

    Following the issuance of Title 10 Code of Federal Regulations Part 835 (10 CFR 835), {open_quotes}Occupational Radiation Protection,{close_quotes} in the Federal Register on 14 December 1993, all DOE facilities subject to the rule provisions were required to submit a radiation protection program that Sets forth the plans, schedules, and other measures for achieving compliance with the rule by 1 January 1996. Numerous DOE facilities identified areas of the rule where their facility needed either (1) a clarification of the intent and expectation of a provisions or (2) an exemption from the provisions. In response, the DOE Office of Worker Protection Programs and Hazards Management (EH-52) prepared and disseminated eight Radiological Control Technical Positions (RCTPs). These RCTPs provided clarifications of DOE`s intent and expectations for compliance with specific provisions of the rule. EH-52 also processed requests for exemptions from provisions of 10 CFR 835 received from twelve different DOE facilities. The DOE issued 21 separate responses to these facilities, each one addressing the specific exepemtion request. Each response contained (1) an Exemption Decision and (2) a Technical Position discussing the basis for either denying or granting with conditions, as applicable, the exemption request.

    This paper examines the legal issues involved with employer monitoring of employee e-mail. In addition to identifying pertinent legal issues, the paper provides guidelines that will help the Pacific Northwest National Laboratory (PNNL) establish a program for monitoring outgoing e-mail to insure compliance with company policies, particularly those regarding protection of trade secrets and proprietary information, and to comply with the Department of Energy`s (DOE) procedures for protecting Export Controlled Information (ECI). Electronic communication has allowed companies to enhance efficiency, responsiveness and effectiveness. E-mail allows employees to transmit all types of data to other individuals inside and outside of their companies. The ease with which information can be transmitted by e-mail has placed trade secrets, proprietary information, and other sensitive data at risk from inadvertent disclosure by employees. As employers attempt to protect their interests through measures such as monitoring e-mail, they may expose themselves to liability under federal and state laws for violating employee privacy. Business use of e-mail has proliferated so rapidly that the federal and state legal systems have not been able to adequately address the issues arising out of its use in the workplace.

    The US DOE is facing a growing jurisdictional dispute over which unions will perform the majority of clean-up work at its facilities. Unions affiliated with the AFL-CIO Metal Trades Council representing operations employees at the sites believe they have a fundamental right to work. Unions in the AFL-CIO's Building and Construction Trades Dept. insist that they have a clear mandate under federal labor law and the Davis-Bacon Act.   6. Implementation guide for use with DOE Order 440.1: Occupational exposure assessment

    DOE O 440.1, Worker Protection Management for DOE Federal and Contractor Employees, establishes the framework for an effective worker protection program that will reduce or prevent accidental injuries and illnesses. One element of the worker protection program in DOE O 440.1 is Exposure Assessment (EA). This Guide provides acceptable methodologies for conducting EA for workers. Exposure assessment should be included in the DOE and contractor written worker protection program, as required by DOE O 440.1. EA documentation should describe the methods and rationale a site uses to characterize and monitor workers` potential and actual exposures to hazardous agents. DOE O 440.1 applies to all activities (including design, construction, operation, maintenance, decontamination and decommissioning, research and development, and environmental restoration activities) performed by DOE and its contractors (and their subcontractors).

    The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.
