    To assist in its these responsibilities in the area of electric power, EIA has prepared this report, Financial Impacts of Nonutility Power Purchases on Investor-Owned Electric Utilities. The primary purpose of this report is to provide an overview of the issues surrounding the financial impacts of nonutility generation contracts (since the passage of the Public Utility Regulatory Policies Act of 1978) on investor-owned utilities. The existing concern in this area is manifest in the provisions of Section 712 of the Energy Policy Act of 1992, which required State regulatory commissions to evaluate various aspects of long-term power purchase contracts, including their impact on investor-owned utilities` cost of capital and rates charged to customers. The EIA does not take positions on policy questions. The EIA`s responsibility is to provide timely, high quality information and to perform objective, credible analyses in support of the deliberations by both public and private decision-makers. Accordingly, this report does not purport to represent the policy positions of the US Department of Energy or the Administration.

  7. Revenue and earnings performance masked continuing investor-owned utility problems

    The 1982 increase in revenues and net income for the top 100 electric utilities is misleading because the figure is distorted by the allowance for funds used during construction (AFUDC), which overstates the real dollar strength of most investor-owned utilities. A random sampling of profit and loss statements shows that companies heavily involved in plant construction can have AFUDC over 100% of net income. The average is 50% of utility earnings, while cash dividends run 75% of earnings. The problem is short-term, however, and will diminish as construction is completed. A summary of utility performance presents earnings growth statistics, sales data and comparisons, financial statistics, and income statistics and comparisons. A summary financial table lists the 100 utilities in alphabetical order. 7 tables. (DCK)

    The US Nuclear Regulatory Commission (NRC) periodically surveys the Federal Energy Regulatory Commission (FERC) and state regulatory commissions that regulate utility owners of nuclear power plants. The NRC is interested in identifying states that have established economic or performance incentive programs applicable to nuclear power plants, how the programs are being implemented, and in determining the financial impact of the programs on the utilities. The NRC interest stems from the fact that such programs have the potential to adversely affect the safety of nuclear power plants. The current report is an update of NUREG/CR-5975, Incentive Regulation of Investor-Owned Nuclear Power Plants by Public Utility Regulators, published in January 1993. The information in this report was obtained from interviews conducted with each state regulatory agency that administers an incentive program and each utility that owns at least 10% of an affected nuclear power plant. The agreements, orders, and settlements that form the basis for each incentive program were reviewed as required. The interviews and supporting documentation form the basis for the individual state reports describing the structure and financial impact of each incentive program.

    The market for utility securities generally tends to be fairly static. Innovative financing techniques are rarely used because of the marketability of utility securities stemming from the companies' generally strong financial credit and the monopoly markets most utilities serve. To many people, utility securities are considered the pillars of the financial world, and innovation is not needed. Further, plain vanilla utility issues are easily understood by investors, as well as by regulators and customers. Over the past several years, however, a new utility bond product has crept into the world of utility securities - insured secondary utility bonds. These insured bonds may possibly be used as an alternative financing technique for newly issued debt. Individual investors often tend to rely on insurance as a tool for reducing credit risk and are willing to take the lower yields as a tradeoff. Insured utility bonds are created by brokerage firms through the acqusition of a portion of an outstanding utility bond issue and subsequent solicitation of the insurance companies for bids. The insurance company then agrees to insure that portion of the issue until maturity for a fee, and the brokerage firm sells those bonds to their customers as a AAA-insured bond. Issuers are encouraged to explore the retail market as a financing alternative. They may find a most cost-effective means of raising capital.

    The overall purpose of this study is to provide information and guidance to the Office of Environmental Management of the U.S. Department of Energy (DOE) about the level of characterization necessary to dispose of DOE-owned spent nuclear fuel (SNF). The disposal option modeled was codisposal of DOE SNF with defense high-level waste (DHLW). A specific goal was to demonstrate the influence of DOE SNF, expected to be minor, in a predominately commercial repository using modeling conditions similar to those currently assumed by the Yucca Mountain Project (YMP). A performance assessment (PA) was chosen as the method of analysis. The performance metric for this analysis (referred to as the 1997 PA) was dose to an individual; the time period of interest was 100,000 yr. Results indicated that cumulative releases of 99Tc and 237Np (primary contributors to human dose) from commercial SNF exceed those of DOE SNF both on a per MTHM and per package basis. Thus, if commercial SNF can meet regulatory performance criteria for dose to an individual, then the DOE SNF can also meet the criteria. This result is due in large part to lower burnup of the DOE SNF (less time for irradiation) and to the DOE SNF's small percentage of the total activity (1.5%) and mass (3.8%) of waste in the potential repository. Consistent with the analyses performed for the YMP, the 1997 PA assumed all cladding as failed, which also contributed to the relatively poor performance of commercial SNF compared to DOE SNF.

    We explain the relationship between Majorana neutrinos, which are their own antiparticles, and Majorana neutrino masses. We point out that Majorana masses would make the neutrinos very distinctive particles, and explain why many theorists strongly suspect that neutrinos do have Majorana masses. The promising approach to confirming this suspicion is to seek neutrinoless double beta decay. We introduce a toy model that illustrates why this decay requires nonzero neutrino masses, even when there are both right-handed and left-handed weak currents.

  10. Who Owns Renewable Energy Certificates?

    Renewable energy certificates (RECs) are tradable instruments that convey the attributes of a renewable energy generator and the right to make certain claims about energy purchases. RECs first appeared in US markets in the late 1990s and are particularly important in states that accept or require them as evidence of compliance with renewables portfolio standards (RPS). The emergence of RECs as a tradable commodity has made utilities, generators, and regulators increasingly aware of the need to specify who owns the RECs in energy transactions. In voluntary transactions, most agree that the question of REC ownership can and should be negotiated privately between the buyer and the seller, and should be clearly established by contract. Claims about purchasing or using renewable energy should only be made if REC ownership can be documented. In many other cases, however, renewable energy transactions are either mandated or encouraged through state or federal policy. Because of the recent appearance of RECs, legislation and regulation mandating the purchase of renewable energy has sometimes been silent on the disposition of the RECs associated with that generation. Furthermore, some renewable energy contracts pre-date the existence of RECs, and therefore do not address REC ownership. In both of these instances, the issue of REC ownership must often be answered by legislative or regulatory authorities. The resulting uncertainty in REC ownership has hindered the development of robust REC markets and has, in some cases, led to contention between buyers and sellers of renewable generation. This article, which is based on a longer Berkeley Lab report, reviews federal and state efforts to clarify the ownership of RECs from Qualifying Facilities (QFs) that sell their generation under the Public Utility Regulatory Policies Act (PURPA) of 1978.     This report contains the energy use data for Wisconsin's 32 largest state-owned government facilities. These facilities account for the majority of both fuels consumed in Wisconsin state buildings and total state-owned gross square footage. Figures for each agency reflect buildings owned but not necessarily occupied by that agency. Information is presented for each of the sixteen years from and including the base year, fiscal 1972--1973 (chosen because it was the last year before the oil embargo). Agencies addressed in this report are the Department of Public Instruction (DPI), the University of Wisconsin System (UWS), the Department of Health and Social Services (DHSS), the Department of Veterans Affairs (DVA), and the Department of Administration (DOA). 16 figs., 40 tabs.

    This report discusses the topic geothermal resource assessment and its importance to laymen and investors for finding geothermal resources for direct-use applications. These are applications where the heat from lower-temperature geothermal fluids, 120 to 200/sup 0/F, are used directly rather than for generating electricity. The temperatures required for various applications are listed and the various types of geothermal resources are described. Sources of existing resource data are indicated, and the types and suitability of tests to develop more data are described. Potential development problems are indicated and guidance is given on how to decrease technical and financial risk and how to use technical consultants effectively. The objectives of this report are to provide: (1) an introduction low-temperature geothermal resource assessment; (2) experience from a series of recent direct-use projects; and (3) references to additional information.

  5. Empirical test of the effects of Internal Revenue Code Section 465 on risk-taking by investors in oil and gas drilling programs

    Taxation affects the cash flows generated by financial investments, and, under some conditions, it also affects the degree of risk investors are willing to bear. This study investigates the effects of the Internal Revenue Code Section 465 on risk-taking by financial investors in oil and gas drilling programs. Section 465 added new rules limiting loss deductions from certain activities, explicitly including oil and gas drilling. Prior research reached varying conclusions analytically, but most research concurs that investor risk-taking is reduced when a tax structure reduces loss-offsetting, i.e., reduces the deductibility of investment losses against other income. Section 465 does that under certain circumstances, so it presents an opportunity to empirically reexamine the question. This study presents null hypotheses that state that the percentage of limited-partner investment in drilling programs with different drilling objectives and deal term structures (and different levels of risk) was unchanged between the time periods before and after the enactment of Section 465. The study concludes that the loss deduction limitations of I.R.C. Section 465 did play a role in the reduction of risk-taking by limited partners in oil and gas drilling programs.

In previous editions of this publication, data were aggregated by the two most commonly reported fiscal years, June 30 and December 31. This omitted approximately 20 percent of the respondents who operate on fiscal years ending in other months. Accordingly, the EIA undertook a review of the Form EIA-412 submissions to determine if alternative classifications of publicly owned electric utilities would permit the inclusion of all respondents.

  7. Direct participation of electrical loads in the California independent system operator markets during the Summer of 2000

    California's restructured electricity markets opened on 1 April 1998. The former investor-owned utilities were functionally divided into generation, transmission, and distribution activities, all of their gas-fired generating capacity was divested, and the retail market was opened to competition. To ensure that small customers shared in the expected benefit of lower prices, the enabling legislation mandated a 10% rate cut for all customers, which was implemented in a simplistic way that fossilized 1996 tariff structures. Rising fuel and environmental compliance costs, together with a reduced ability to import electricity, numerous plant outages, and exercise of market power by generators drove up wholesale electricity prices steeply in 2000, while retail tariffs remained unchanged. One of the distribution/supply companies entered bankruptcy in April 2001, and another was insolvent. During this period, two sets of interruptible load programs were in place, longstanding ones organized as special tariffs by the distribution/supply companies and hastily established ones run directly by the California Independent System Operator (CAISO). The distribution/supply company programs were effective at reducing load during the summer of 2000, but because of the high frequency of outages required by a system on the brink of failure, customer response declined and many left the tariff. The CAISO programs failed to attract enough participation to make a significant difference to the California supply demand imbalance. The poor performance of direct load participation in California's markets reinforces the argument for accurate pricing of electricity as a stimulus to energy efficiency investment and as a constraint on market volatility.

    Spacecraft contamination has long been a subject of study in the rarefied gas dynamics community. Professor Mikhail Ivanov coined the term a spacecraft's 'own ambient environment' to describe the effects of natural and satellite driven processes on the conditions encountered by a spacecraft in orbit. Outgassing, thruster firings, and gas and liquid dumps all contribute to the spacecraft's contamination environment. Rarefied gas dynamic modeling techniques, such as Direct Simulation Monte Carlo, are well suited to investigate these spacebased environments. However, many advances were necessary to fully characterize the extent of this problem. A better understanding of modeling flows over large pressure ranges, for example hybrid continuum and rarefied numerical schemes, were required. Two-phase flow modeling under rarefied conditions was necessary. And the ability to model plasma flows for a new era of propulsion systems was also required. Through the work of Professor Ivanov and his team, we now have a better understanding of processes that create a spacecraft's own ambient environment and are able to better characterize these environments. Advances in numerical simulation have also spurred on the development of experimental facilities to study these effects. The relationship between numerical results and experimental advances will be explored in this manuscript.

Stripline conductors of non-rectilinear configuration, and separated from each other by a thin dielectric spacer. cross each other at least at two locations at right angles, thus providing practically pure capacitive coupling which substantially eliminates undesirable inductive coupling. The conductors are sandwiched between a pair of ground planes. The coupling factor is dependent only on the thickness and dielectric constant of the dielectric spacer at the point of conductor crossover. (AEC)

    A high-frequency directional antenna of the 360 d scaring type is described. The antenna has for its desirable features the reduction in both size and complexity of the mechanism for rotating the antenna through its scanning movement. These advantages result from the rotation of only the driven element, the reflector remaining stationary. The particular antenna structure comprises a refiector formed by a plurality of metallic slats arranged in the configuration of an annular cage having the shape of a zone of revolution. The slats are parallel to each other and are disposed at an angle of 45 d to the axis of the cage. A directional radiator is disposed inside the cage at an angle of 45 d to the axis of the cage in the same direction as the reflecting slats which it faces. As the radiator is rotated, the electromagnetic wave is reflected from the slats facing the radiator and thereafter passes through the cage on the opposite side, since these slats are not parallel with the E vector of the wave.

    The 1997 edition of the ``Financial Statistics of Major U.S. Publicly Owned Electric Utilities`` publication presents 5 years (1993 through 1997) of summary financial data and current year detailed financial data on the major publicly owned electric utilities. The objective of the publication is to provide Federal and State governments, industry, and the general public with current and historical data that can be used for policymaking and decisionmaking purposes related to publicly owned electric utility issues. Generator (Tables 3 through 11) and nongenerator (Tables 12 through 20) summaries are presented in this publication. Five years of summary financial data are provided (Tables 5 through 11 and 14 through 20). Summaries of generators for fiscal years ending June 30 and December 31, nongenerators for fiscal years ending June 30 and December 31, and summaries of all respondents are provided in Appendix C. The composite tables present aggregates of income statement and balance sheet data, as well as financial indicators. Composite tables also display electric operation and maintenance expenses, electric utility plant, number of consumers, sales of electricity, operating revenue, and electric energy account data. The primary source of publicly owned financial data is the Form EIA-412, ``Annual Report of Public Electric Utilities.`` Public electric utilities file this survey on a fiscal year basis, in conformance with their recordkeeping practices. The EIA undertook a review of the Form EIA-412 submissions to determine if alternative classifications of publicly owned electric utilities would permit the inclusion of all respondents. The review indicated that financial indicators differ most according to whether or not a publicly owned electric utility generates electricity. Therefore, the main body of the report provides summary information in generator/nongenerator classifications. 2 figs., 101 tabs.

    This paper will discuss some of the unique aspects of a build/own/operate cogeneration project for an oil refinery in which Foster Wheeler is involved. The organization is constructing a 90 MW plant that will supply 55 MW and 160,000 lb/hr of 600 psi, 700F steam to the Tosco Corporation's 130,000 bd Avon Oil Refinery in Martinez, California. (The refinery is located about 45 miles northeast of San Francisco.) Surplus power production will be sold to the local utility, Pacific Gas and Electric Co. (PG and E). Many of the aspects of this project took on a different perspective, since the contractor would build, own and operate the plant.

    Highlights: • Y-encoded proto-oncoprotein TSPY amplifies its expression level via a positive feedback loop. • TSPY binds to the chromatin/DNA at exon 1 of TSPY gene. • TSPY enhances the gene expression in a TSPY exon 1 sequence dependent manner. • The conserved SET/NAP-domain is essential for TSPY transactivation. • Insights on probable mechanisms on TSPY exacerbation on cancer development in men. - Abstract: The testis-specific protein Y-encoded (TSPY) is a repetitive gene located on the gonadoblastoma region of the Y chromosome, and has been considered to be the putative gene for this oncogenic locus on the male-only chromosome. It is expressed in spermatogonial cells and spermatocytes in normal human testis, but abundantly in gonadoblastoma, testicular germ cell tumors and a variety of somatic cancers, including melanoma, hepatocellular carcinoma and prostate cancer. Various studies suggest that TSPY accelerates cell proliferation and growth, and promotes tumorigenesis. In this report, we show that TSPY could bind directly to the chromatin/DNA at exon 1 of its own gene, and greatly enhance the transcriptional activities of the endogenous gene in the LNCaP prostate cancer cells. Domain mapping analyses of TSPY have localized the critical and sufficient domain to the SET/NAP-domain. These results suggest that TSPY could efficiently amplify its expression and oncogenic functions through a positive feedback loop, and contribute to the overall tumorigenic processes when it is expressed in various human cancers.

    New techniques for the laboratory direct detection of dark matter weakly interacting massive particles (WIMPs) are sensitive to the recoil direction of the struck nuclei. We compute and compare the directional recoil rates dR/dcos{theta} (where {theta} is the angle measured from a reference direction in the sky) for several WIMP velocity distributions including the standard dark halo and anisotropic models such as Sikivie's late-infall halo model and logarithmic-ellipsoidal models. Since some detectors may be unable to distinguish the beginning of the recoil track from its end (lack of head-tail discrimination), we introduce a folded directional recoil rate dR/d|cos{theta}|, where |cos{theta}| does not distinguish the head from the tail of the track. We compute the CS{sub 2} and CF{sub 4} exposures required to distinguish a signal from an isotropic background noise, and find that dR/d|cos{theta}| is effective for the standard dark halo and some but not all anisotropic models.

    This report examines the tradeoffs among financing methods for businesses installing onsite photovoltaics (PV). We present case studies of PV financing strategies used by two large commercial retailers that have deployed substantial U.S. PV capacity: IKEA, which owns its PV, and Staples, which purchases power generated from onsite PV systems through power purchase agreements (PPAs). We also analyze the financial considerations that influence any company's choice of PV financing strategy. Our goal in this report is to clarify the financial and institutional costs and benefits of financing strategies and to inform other companies that are considering launching or expanding similar PV programs.

    This report presents information on the preliminary process knowledge to be used in characterizing all Department of Energy (DOE)-owned Spent Nuclear Fuel (SNF) types that potentially exhibit a Resource Conservation and Recovery Act (RCRA) characteristic. This report also includes the process knowledge, analyses, and rationale used to preliminarily exclude certain SNF types from RCRA regulation under 40 CFR {section}261.4(a)(4), ``Identification and Listing of Hazardous Waste,`` as special nuclear and byproduct material. The evaluations and analyses detailed herein have been undertaken as a proactive approach. In the event that DOE-owned SNF is determined to be a RCRA solid waste, this report provides general direction for each site regarding further characterization efforts. The intent of this report is also to define the path forward to be taken for further evaluation of specific SNF types and a recommended position to be negotiated and established with regional and state regulators throughout the DOE Complex regarding the RCRA-related policy issues.

    This assessment studied the performance of high-level radioactive waste and spent nuclear fuel in a hypothetical repository in unsaturated tuff. The results of this 10-month study are intended to help guide the Office of Environment Management of the US Department of Energy (DOE) on how to prepare its wastes for eventual permanent disposal. The waste forms comprised spent fuel and high-level waste currently stored at the Idaho National Engineering Laboratory (INEL) and the Hanford reservations. About 700 metric tons heavy metal (MTHM) of the waste under study is stored at INEL, including graphite spent nuclear fuel, highly enriched uranium spent fuel, low enriched uranium spent fuel, and calcined high-level waste. About 2100 MTHM of weapons production fuel, currently stored on the Hanford reservation, was also included. The behavior of the waste was analyzed by waste form and also as a group of waste forms in the hypothetical tuff repository. When the waste forms were studied together, the repository was assumed also to contain about 9200 MTHM high-level waste in borosilicate glass from three DOE sites. The addition of the borosilicate glass, which has already been proposed as a final waste form, brought the total to about 12,000 MTHM.

    California is pushing ahead with its own climate bill to reduce statewide emissions to 1990 levels by 2020. Some 75--80 percent of the measures required to meet the 2020 reductions in greenhouse gas (GHG) emissions will be met through the 33 percent renewable portfolio standard (RPS), stringent energy efficiency initiatives, and a long list of other mandatory requirements affecting the transport sector. The balance will be met through market- and pricing-oriented mechanisms, including auctioning of GHG emission permits. In early January, an advisory committee proposed that roughly 75 percent of the collected proceeds should be distributed directly to households with the balance used to assist badly affected industries, especially those with few options to transition to a lower carbon regime.
