    In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    A method has been developed and applied to measure the beam waist and spot size of a focused soft x-ray beam at the free-electron laser FLASH of the Deutsches Elektronen-Synchrotron in Hamburg. The method is based on a saturation effect upon atomic photoionization and represents an indestructible tool for the characterization of powerful beams of ionizing electromagnetic radiation. At the microfocus beamline BL2 at FLASH, a full width at half maximum focus diameter of (15{+-}2) {mu}m was determined.

    We report the development and implementation of four FPGA-based predistortion-type klystron linearization algorithms. Klystron linearization is essential for the realization of ILC, since it is required to operate the klystrons 7% in power below their saturation. The work presented was performed in international collaborations at the Fermi National Accelerator Laboratory (FNAL), USA and the Deutsches Elektronen Synchrotron (DESY), Germany. With the newly developed algorithms, the generation of correction factors on the FPGA was improved compared to past algorithms, avoiding quantization and decreasing memory requirements. At FNAL, three algorithms were tested at the Advanced Superconducting Test Accelerator (ASTA), demonstrating a successfulmore » implementation for one algorithm and a proof of principle for two algorithms.   14. Three-dimensional mapping of equiprobable hydrostratigraphic units at the Frenchman Flat Corrective Action Unit, Nevada Test Site

    Geological and geophysical data are used with the sequential indicator simulation algorithm of Gomez-Hernandez and Srivastava to produce multiple, equiprobable, three-dimensional maps of informal hydrostratigraphic units at the Frenchman Flat Corrective Action Unit, Nevada Test Site. The upper 50 percent of the Tertiary volcanic lithostratigraphic column comprises the study volume. Semivariograms are modeled from indicator-transformed geophysical tool signals. Each equiprobable study volume is subdivided into discrete classes using the ISIM3D implementation of the sequential indicator simulation algorithm. Hydraulic conductivity is assigned within each class using the sequential Gaussian simulation method of Deutsch and Journel. The resulting maps show the contiguity of high and low hydraulic conductivity regions.

  16. R&D progress in SRF surface preparation with centrifugal barrel polishing (cbp) for both Nb and Cu

    Centrifugal Barrel polishing (CBP) is becoming a common R&D tool for SRF cavity preparation around the world. During the CBP process a cylindrically symmetric SRF cavity is filled with relatively cheap and environmentally friendly abrasive and sealed. The cavity is then spun around a cylindrically symmetric axis at high speeds uniformly conditioning the inner surface. This uniformity is especially relevant for SRF application because many times a single manufacturing defects limits cavity?s performance well below it?s theoretical limit. In addition CBP has created surfaces with roughness?s on the order of 10?s of nm which create a unique surface for wet chemistry or thin film deposition. CBP is now being utilized at Jefferson Laboratory, Fermi Laboratory and Cornell University in the US, Deutsches Elektronen-Synchrotron in Germany, Laboratori Nazionali di Legnaro in Italy, and Raja Ramanna Centre for Advanced Technology in India. In this talk we will present current CBP research from each lab including equipment, baseline recipes, cavity removal rates and subsequent cryogenic cavity tests on niobium as well as copper cavities where available.

    The work described here revealed the presence of diverse microbial communities located across 19 subsurface sites at the NNSS/NTTR and nearby locations. Overall, the diversity of microorganisms was high for subsurface habitats and variable between sites. As of this writing, preparations are being made to combine the Illumina sequences and 16S rRNA clone libraries with other non-NNSS/NTTR well sites of Southern Nevada Regional Flow System for a publication manuscript describing our very broad landscape scale survey of subsurface microbial diversity. Isolates DRI-13 and DRI-14 remain to be fully characterized and named in accordance with the conventions established by Bergey's Manual of Systematic Bacteriology. In preparation to be published, these microorganisms will be submitted to the American Type Culture Collection (ATCC) and the Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH (DSMZ).It is anticipated that the data resulting from this study in combination with other data sets that will allow us to produce a number of publications that will be impactful to the subsurface microbiology community.

  18. The European XFEL Free Electron Laser at DESY

    The European X-ray Free-Electron laser Facility (XFEL) is going to be built in an international collaboration at the Deutsches Elektronen-Synchrotron (DESY), Germany, and the Technical Design Report was published in 2006. The official project is expected for summer 2007. This new facility will offer photon beams at wavelengths as short as 1 angstrom with highest peak brilliance being more than 100 million times higher than present day synchrotron radiation sources. The radiation has a high degree of transverse coherence and the pulse duration is reduced from {approx}100 picoseconds (typ. for SR light sources) down to the {approx}10 femtosecond time domain. The overall layout of the XFEL will be described. This includes the envisaged operation parameters for the linear accelerator using superconducting TESLA technology. The complete design is based on the actually operated FLASH free-electron laser at DESY. Experience with the operation during first long user runs at wavelengths from 30 to 13 nm will be described in detail.

  19. GET FiT Plus: De-risking clean energy business models in a developing country context

    GET Fit was first conceived in January 2010 when the United Nations Secretary General's Advisory Group on Energy and Climate Change (AGECC) invited Deutsche Bank Climate Change Advisors (DBCCA) to present new concepts to drive renewable energy investment in developing regions. DBCCA responded with the Global Energy Transfer Feed-in Tariffs Program (GET FiT), a proposal to support both renewable energy scale up and energy access through the creation of new international public-private partnerships. The concept was inspired by the theory that feed-in tariffs could serve as an effective policy structure for both public and private investment and knowledge transfer from the developed world. The original GET FiT concept was designed with input from over 160 individuals from the renewable energy, financial and international development communities. The original GET FiT report was issued in April 2010. This report reflects continued engagement of stakeholders around the world. GET FiT plus is an effort to capture the key outcomes of the GET FiT consultation process and use them to catalyze ongoing dialogue and debate about the future of international support for renewable energy in developing regions. These outcomes have been translated into key research priorities. These priorities, as well as some short issue briefs are part of this report.

  20. Dielectric breakdown properties of hot SF{sub 6}-CO{sub 2} mixtures at temperatures of 300–3500?K and pressures of 0.01–1.0?MPa

    Recently, much attention has been paid to SF{sub 6}-CO{sub 2} mixtures as one of substitutes for pure SF{sub 6} gas. In this paper, the dielectric breakdown properties of hot SF{sub 6}-CO{sub 2} mixtures are investigated at temperatures of 300–3500?K and pressures of 0.01–1.0?MPa. Under the assumptions of local thermodynamic equilibrium and local chemical equilibrium, the equilibrium compositions of hot SF{sub 6}-CO{sub 2} mixtures with different CO{sub 2} proportions are obtained based on Gibbs free energy minimization. The cross sections for interactions between electrons and neutral species are presented. Some unknown ionization cross sections are determined theoretically using Deutsch–Märk (DM) formalism based on quantum chemistry. Two-term Boltzmann equation is adopted to calculate the electron energy distribution function, reduced ionization coefficient, reduced attachment coefficient, and reduced effective ionization coefficient. Then the reduced critical electric field strength of mixtures, corresponding to dielectric breakdown performances, is determined when the generation and loss of electrons are balanced. Finally, the influences of temperature, pressure, and CO{sub 2} proportion on the reduced critical electric field strength are studied. It is found that a large percentage of CO{sub 2} can obviously reduce concentrations of high-energy electrons. At temperatures above 1750?K, an addition of CO{sub 2} to SF{sub 6} gas can enhance dielectric breakdown performances. However, at low temperatures, too much CO{sub 2} added into mixtures can reduce dielectric breakdown abilities. In addition, increasing gas pressure can improve dielectric breakdown performances. But the influence will be no more significant if pressure is over 0.8?MPa.
