The Picatinny Technology Transfer Innovation Center: A business incubator concept adapted to federal laboratory technology transfer

In recent years, the US defense industrial base spawned the aerospace industry, among other successes, and served as the nation`s technology seed bed. However, as the defense industrial base shrinks and public and private resources become scarcer, the merging of the commercial and defense communities becomes necessary to maintain national technological competencies. Cooperative efforts such as technology transfer provide an attractive, cost-effective, well-leveraged alternative to independently funded research and development (R and D). The sharing of knowledge, resources, and innovation among defense contractors and other public sector firms, academia, and other organizations has become exceedingly attractive. Recent legislation involving technology transfer provides for the sharing of federal laboratory resources with the private sector. The Army Research, Development and Engineering Center (ARDEC), Picatinny Arsenal, NJ, a designer of weapons systems, is one of the nation`s major laboratories with this requirement. To achieve its important technology transfer mission, ARDEC reviewed its capabilities, resources, intellectual property, and products with commercial potential. The purpose of the review was to develop a viable plan for effecting a technology transfer cultural change within the ARDEC, Picatinny Arsenal and with the private sector. This report highlights the issues identified, discussed, and resolved prior to the transformation of a temporarily vacant federal building on the Picatinny installation into a business incubator. ARDEC`s discussions and rationale for the decisions and actions that led to the implementation of the Picatinny Technology Transfer Innovation Center are discussed.

Washington State's geothermal potential is wide spread. Hot springs and five strato volcanoes existing throughout the Cascade Range, limited hot spring activity on the Olympic Peninsula, and broad reaching, low temperature geothermal resources found in the Columbia Basin comprise the extent of Washington's known geothermal resources. Determination of resource ownership is the first step in proceeding with geothermal exploration and development activities. The federal and state processes are examined from pre-lease activity through leasing and post-lease development concerns. Plans, permits, licenses, and other requirements are addressed for the federal, state, and local level. Lease, permit, and other forms for a number of geothermal exploration and development activities are included. A map of public lands and another displaying the measured geothermal resources throughout the state are provided.

On October 9, 2008, federal, state and local policy makers, emergency managers, and medical and public health officials convened in Seattle, Washington, for a workshop on Addressing the Federal-State-Local Interface Issues During a Catastrophic Event Such as an Anthrax Attack. The day-long symposium was aimed at generating a dialogue about recovery and restoration through a discussion of the associated challenges that impact entire communities, including people, infrastructure, and critical systems. The Principal Federal Official (PFO) provided an overview of the role of the PFO in a catastrophic event. A high-level summary of an anthrax scenario was presented. The remainder of the day was focused on interactive discussions among federal, state and local emergency management experts in the areas of: Decision-making, prioritization, and command and control Public health/medical services Community resiliency and continuity of government. Key topics and issues that resulted from discussions included: Local representation in the Joint Field Office (JFO) JFO transition to the Long-Term Recovery Office Process for prioritization of needs Process for regional coordination Prioritization - process and federal/military intervention Allocation of limited resources Re-entry decision and consistency Importance of maintaining a healthy hospital system Need for a process to establish a consensus on when it is safe to re-enter. This needs to be across all jurisdictions including the military. Insurance coverage for both private businesses and individuals Interaction between the government and industry. The symposium was sponsored by the Interagency Biological Restoration Demonstration, a collaborative regional program jointly funded by the U.S. Department of Homeland Security and the U.S. Department of Defense. To aid the programs efforts and inform the development of blueprint for recovery from a biological incident, this report presents the key issues identified at the symposium.

In the Fall of 1993, the Washington State Energy Office funded the Washington Home Energy Rating System project to investigate the benefits of a Washington state HERS. WSEO established a HERS and EEM Advisory Group. Composed of mortgage lenders/brokers, realtors, builders, utility staff, remodelers, and other state agency representatives, the Advisory Group met for the first time on November 17, 1993. The Advisory Group established several subcommittees to identify issues and options. During its March 1994 meeting, the Advisory Group formed a consensus directing WSEO to develop a HERS business plan for consideration. The Advisory Group also established a business plan subcommittee to help draft the plan. Under the guidance of the business plan subcommittee, WSEO conducted research on how customers value energy efficiency in the housing market. This plan represents WSEO`s effort to comply with the Advisory Group`s request. Why is a HERS Business Plan necessary? Strictly speaking this plan is more of a feasibility plan than a business plan since it is designed to help determine the feasibility of a new business venture: a statewide home energy rating system. To make this determination decision makers or possible investors require strategic information about the proposed enterprise. Ideally, the plan should anticipate the significant questions parties may want to know. Among other things, this document should establish decision points for action.

A comparative analysis of business structures suitable forfarmer-owned wind power projects in the United States

For years, farmers in the United States have looked with envy on their European counterparts' ability to profitably farm the wind through ownership of distributed, utility-scale wind projects. Only within the past few years, however, has farmer- or community-owned wind power development become a reality in the United States. The primary hurdle to this type of development in the United States has been devising and implementing suitable business and legal structures that enable such projects to take advantage of tax-based federal incentives for wind power. This article discusses the limitations of such incentives in supporting farmer- or community-owned wind projects, describes four ownership structures that potentially overcome such limitations, and finally conducts comparative financial analysis on those four structures, using as an example a hypothetical 1.5 MW farmer-owned project located in the state of Oregon. We find that material differences in the competitiveness of each structure do exist, but that choosing the best structure for a given project will largely depend on the conditions at hand; e.g., the ability of the farmer(s) to utilize tax credits, preference for individual versus ''cooperative'' ownership, and the state and utility service territory in which the project will be located.

The regulatory divide: Federal and state jurisdiction in a restructured electricity industry

In any restructuring, close attention should be paid to how transactions are characterized. The approach adopted in California tends to minimize jurisdictional complications and preserve state jurisdiction over local distribution, while a retail wheeling approach may raise preemption and Commerce Clause concerns. In the United States, the wholesale electricity market and the interstate transmission of electricity have been subject to exclusive federal jurisdiction, while the retail sale and local distribution of electricity have been subject to the jurisdiction of the separate states. Until recently, the jurisdictional dividing line has been relatively clear. Indeed, Congress intended to establish a {open_quotes}bright line{close_quotes} between state and federal jurisdiction. This bright line, however, is becoming blurred by proposals to allow retail customers direct access to competitive generation markets. Regulation of transactions relating to the transmission and sale of electricity at wholesale is within the exclusive jurisdiction of the federal government. Thus, historically, {open_quotes}transmission{close_quotes} has coincided precisely with wholesale transactions, while {open_quotes}local distribution{close_quotes} has coincided precisely with retail transactions. Since 1978, Congress and the Federal Energy Regulatory Commission (FERC) have promulgated statutes and regulations to enhance the competitiveness of the wholesale generation market. As a consequence, there are many more non-utility entities competing as sellers of wholesale electricity. Now the push is on at the state level to introduce retail competition in the generation supply side of the electricity market. Introduction of retail competition has the potential to upset, if not extinguish, the traditional bright line between federal and state jurisdiction.

Renewable Energy Prices in State-Level Feed-in Tariffs: Federal Law Constraints and Possible Solutions

State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

Federal strategies to increase the implementation of combined heat and power technologies in the United States

Recent interest in combined heat and power (CHP) is providing momentum to efforts aimed at increasing the capacity of this highly-efficient technology. Factors driving this increase in interest include the need to increase the efficiency of the nation's electricity generation infrastructure, DOE Assistant Secretary Dan Reicher's challenge to double the capacity of CHP by 2010, the success of DOE's Advanced Turbine Systems Program in supporting ultra-efficient CHP technologies, and the necessity of finding cost-effective solutions to address climate change and air quality issues. The federal government is committed to increasing the penetration of CHP technologies in the US. The ultimate goal is to build a competitive market for CHP in which policies and regulations support the implementation of a full suite of technologies for multiple applications. Specific actions underway at the federal level include technology strategies to improve CHP data collection and assessment and work with industry to encourage the development of advanced CHP technologies. Policy strategies include changes to federal environmental permitting procedures including CHP-friendly strategies in federal restructuring legislation, supporting tax credits and changes to depreciation requirements as economic incentives to CHP, working with industry to leverage resources in the development of advanced CHP technologies, educating state officials about the things they can do to encourage CHP, and increasing awareness about the benefits of CHP and the barriers limiting its increased implementation.

For over two years, The Keystone Center facilitated a dialogue on State and Federal Regulation of the Electricity Industry. The intent of this report is to assist policy-makers faced with decisions about changes to traditional utility regulation and planning and provide an overview of a diverse group`s deliberations on regulatory jurisdictional conflicts. This report is not a consensus document, rather it is a staff written summary of two years of discussion on the issues. The participants in the Keystone Dialogue believed that all affected interests could benefit from, if nothing else, a summary of their discussions of state/federal issues. The electric utility industry is one of the last remaining, heavily regulated industries in the United States. Rate and corporate regulation is split between state and federal governments and there is distinct regulatory authority at each level. For example, retail rate regulation occurs at the state level, the Federal Energy Regulatory Commission is responsible for wholesale rate regulation under the Federal Power Act, and the Securities and Exchange Commission oversees registered utility holding companies as defined under the Public Utility Holding Company Act of 1935. This jurisdictional split between state and federal regulation has evolved over many years through legislation and litigation on such matters. The creation of this allocation of regulatory responsibility was initiated in 1935 with the passage of the Public Utility Holding Company Act and the Federal Power Act when the economic and technological changes that are now occurring in the industry simply could not have been envisioned.

DOE Partnerships with States, Tribes and Other Federal Programs Help Responders Prepare for Challenges Involving Transport of Radioactive Materials Implementing adequate institutional programs and validating preparedness for emergency response to radiological transportation incidents along or near U.S. Department of Energy (DOE) shipping corridors poses unique challenges to transportation operations management. Delayed or insufficient attention to State and Tribal preparedness needs may significantly impact the transportation operations schedule and budget. The DOE Transportation Emergency Preparedness Program (TEPP) has successfully used a cooperative planning process to develop strong partnerships with States, Tribes, Federal agencies and other national programs to support responder preparedness across the United States. DOE TEPP has found that building solid partnerships with key emergency response agencies ensures responders have access to the planning, training, technical expertise and assistance necessary to safely, efficiently and effectively respond to a radiological transportation accident. Through the efforts of TEPP over the past fifteen years, partnerships have resulted in States and Tribal Nations either using significant portions of the TEPP planning resources in their programs and/or adopting the Modular Emergency Response Radiological Transportation Training (MERRTT) program into their hazardous material training curriculums to prepare their fire departments, law enforcement, hazardous materials response teams, emergency management officials, public information officers and emergency medical technicians for responding to transportation incidents involving radioactive materials. In addition, through strong partnerships with Federal Agencies and other national programs TEPP provided technical expertise to support a variety of radiological response initiatives and assisted several programs with integration of the nationally recognized MERRTT program into other training venues, thus ensuring consistency of radiological response curriculums delivered to responders. This presentation will provide an overview of the steps to achieve coordination, to avoid redundancy, and to highlight several of the successful partnerships TEPP has formed with States, Tribes, Federal agencies and other national programs. Events, accident scenarios, and training where TEPP was proven to be integral in building the radiological response capabilities for first responders to actual radiological incidents are also highlighted. Participants will gain an appreciation for the collaborative efforts States and Tribes are engaging in with the DOE to ensure that responders all along the DOE transportation corridors are adequately prepared to respond to shipments of radioactive materials through their communities.

A STUDY OF THE DISCREPANCY BETWEEN FEDERAL AND STATE MEASUREMENTS OF ON-HIGHWAY FUEL CONSUMPTION

Annual highway fuel taxes are collected by the Treasury Department and placed in the Highway Trust Fund (HTF). There is, however, no direct connection between the taxes collected by the Treasury Department and the gallons of on-highway fuel use, which can lead to a discrepancy between these totals. This study was conducted to determine how much of a discrepancy exists between the total fuel usages estimated based on highway revenue funds as reported by the Treasury Department and the total fuel usages used in the apportionment of the HTF to the States. The analysis was conducted using data from Highway Statistics Tables MF-27 and FE-9 for the years 1991-2001. It was found that the overall discrepancy is relatively small, mostly within 5% difference. The amount of the discrepancy varies from year to year and varies among the three fuel types (gasoline, gasohol, special fuels). Several potential explanations for these discrepancies were identified, including issues on data, tax measurement, gallon measurement, HTF receipts, and timing. Data anomalies caused by outside forces, such as deferment of tax payments from one fiscal year to the next, can skew fuel tax data. Fuel tax evasion can lead to differences between actual fuel use and fuel taxes collected. Furthermore, differences in data collection and reporting among States can impact fuel use data. Refunds, credits, and transfers from the HTF can impact the total fuel tax receipt data. Timing issues, such as calendar year vs. fiscal year, can also cause some discrepancy between the two data sources.

purpose of the workshop was to solicit early public input on major issues associated with a potential rulemaking for land disposal of unique waste streams including significant quantities of depleted uranium in radioactive waste disposal facilities. The public workshop was intended to solicit the views from a variety of stakeholders that may be affected by the rulemaking. Approximately 75 people attended the workshop including roundtable participants from the U.S. Department of Energy (DOE), the State of South Carolina, low-level waste disposal facility operators, academic experts, and public interest groups. U.S. Nuclear Regulatory Commission staff delivered technical presentations on various aspects of the proposed rulemaking. Participants at the roundtable engaged the NRC staff and other panelists in a discussion of technical, regulatory, and legislative issues. Members of the public in attendance were also given the opportunity to participate in the discussion. Energy transport corridors: the potential role of Federal lands in states identified by the Energy Policy Act of 2005, section 368(b).

On August 8, 2005, the President signed the Energy Policy Act of 2005 (EPAct) into law. In Subtitle F of EPAct, Congress set forth various provisions that would change the way certain federal agencies (Agencies) coordinate to authorize the use of land for a variety of energy-related purposes. As part of Subtitle F of EPAct, Section 368 addresses the issue of energy transportation corridors on federal land for oil, gas, and hydrogen pipelines, as well as electricity transmission and distribution facilities. Because of the critical importance of improving the nation's electrical transmission grid, Congress recognized that electricity transmission issues should receive added attention when the Agencies address corridor location and analysis issues. In Section 368, Congress specifically directed the Agencies to consider the need for upgraded and new facilities to deliver electricity: In carrying out [Section 368], the Secretaries shall take into account the need for upgraded and new electricity transmission and distribution facilities to (1) improve reliability; (2) relieve congestion; and (3) enhance capability of the national grid to deliver electricity. Section 368 does not require the Agencies to consider or approve specific projects, applications for rights-of-way (ROWs), or other permits within designated energy corridors. Importantly, Section 368 does not direct, license, or otherwise permit any on-the-ground activity of any sort. If an applicant is interested in obtaining an authorization to develop a project within any corridor designated under Section 368, the applicant would have to apply for a ROW authorization and applicable permits. The Agencies would consider each application by applying appropriate project-specific reviews under requirements of laws and related regulations, including, but not limited to, the National Environmental Policy Act (NEPA), the Clean Water Act, the Clean Air Act, Section 7 of the Endangered Species Act (ESA), and Section 106 of the National Historic Preservation Act (NHPA). Under Section 368, Congress divided the United States into two groups of states: the 11 contiguous western states and the remaining states. Direction for energy transportation corridor analysis and selection in the 11 western states was addressed in Section 368(a) of EPAct, while direction for energy transportation corridor analysis and selection in all other states was addressed under Section 368(b) of EPAct. It was clearly the priority of Congress to conduct corridor location studies and designation first on federal lands in the western states. Under Section 368(a), the Agencies produced a programmatic environmental impact statement (EIS), Designation of Energy Corridors on Federal Land in the 11 Western States (DOE and DOI 2008), that was used in part as the basis for designating more than 6,000 mi (9,656 km) of energy transportation corridors on federal land in 11 western states. Under Section 368(a) of EPAct, Congress clearly stated the Agencies needed to (1) designate energy transportation corridors on federal land, (2) conduct the necessary environmental review of the designated corridors, and (3) incorporate the designated corridors into the appropriate land use plans. Congressional direction under Section 368(b) of EPAct differs from that provided under Section 368(a). Specifically, Section 368(b) requires the secretaries of the Agencies, in consultation with the Federal Energy Regulatory Commission (FERC), affected utility industries, and other interested persons, to jointly: (1) Identify corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on federal land in states other than the 11 western states identified under Section 368(a) of EPAct, and (2) Schedule prompt action to identify, designate, and incorporate the corridors into the applicable land use plans. While Section 368(a) clearly directs designation as a necessary first step for energy transportation corridors in the 11 western states, Section 368(b) directs the Agencies to first identify corridor

This thesis discusses a recent United States Supreme Court case that will have a profound influence on the licensure of hydroelectric projects and the related ability of States to protect the quality of their waters. On October 4, 1993, the Supreme Court granted a Writ of Certiorari to resolve a conflict among the state courts of last resort. This case involves two fundamental and competing national interests: the nation's thirst for cheap, dependable power versus its equally strong desire to improve the quality of its water resources. It also involves two underlying regulatory regimes that overlap and conflict with each other in some ways. This case illustrates how those two national interests and their underlying regulatory regimes cannot always be reconciled. It also demonstrates how Congress, with its muddled ways of passing legislation, can create conflicts between federal and state regulatory agencies.

superior lighting services to low income people in off-grid areas of developing countries, many of whom currently rely on fuel based lighting sources such as kerosene. If this potential is to be achieved in the near term, however, manufacturers must produce off-grid lighting products that are inexpensive, perform well, and meet the needs of potential end users. At present, relatively few products meet all three of these goals. In this article, we report results from a detailed study of lighting use by micro-enterprises in two small towns in Kenya's Rift Valley Province. The work included a survey about lighting use by 50 small businesses, careful measurements of kerosene lighting use patterns and associated costs for 23 of these businesses, and a subsequent field trial in which 14 of the 23 businesses purchased and used low cost LED lamps over a number of months.

The Savannah River Site (SRS) is a 310-square-mile United States Department of Energy nuclear facility located along the Savannah River (SRS) near Aiken, South Carolina. Nuclear weapons material production began in the early 1950s, utilizing five production reactors. In the early 1990s all SRS production reactor operations were terminated. The first reactor closure end state declaration was recently institutionalized in a Comprehensive Environmental Response and Compensation and Liability Act (CERCLA) Early Action Record of Decision. The decision for the final closure of the 318,000 square foot 105-P Reactor was determined to be in situ decommissioning (ISD). ISD is an acceptable and cost effective alternative to off-site disposal for the reactor building, which will allow for consolidation of remedial action wastes generated from other cleanup activities within the P Area. ISD is considered protective by the regulators, U. S. Environmental Protection Agency (US EPA) and the South Carolina Department of Health and Environmental Control (SCDHEC), public and stakeholders as waste materials are stabilized/immobilized, and radioactivity is allowed to naturally decay, thus preventing future exposure to the environment. Stakeholder buy-in was critical in the upfront planning in order to achieve this monumental final decision. Numerous public meetings and workshops were held in two different states (covering a 200 mile radius) with stakeholder and SRS Citizens Advisory Board participation. These meetings were conducted over an eight month period as the end state decision making progressed. Information provided to the public evolved from workshop to workshop as data became available and public input from the public meetings were gathered. ISD is being considered for the balance of the four SRS reactors and other hardened facilities such as the chemical Separation Facilities (canyons).

Electricity Transmission, Pipelines, and National Trails. An Analysis of Current and Potential Intersections on Federal Lands in the Eastern United States, Alaska, and Hawaii

As has been noted in many reports and publications, acquiring new or expanded rights-of-way for transmission is a challenging process, because numerous land use and land ownership constraints must be overcome to develop pathways suitable for energy transmission infrastructure. In the eastern U.S., more than twenty federally protected national trails (some of which are thousands of miles long, and cross many states) pose a potential obstacle to the development of new or expanded electricity transmission capacity. However, the scope of this potential problem is not well-documented, and there is no baseline information available that could allow all stakeholders to study routing scenarios that could mitigate impacts on national trails. This report, Electricity Transmission, Pipelines, and National Trails: An Analysis of Current and Potential Intersections on Federal Lands in the Eastern United States, was prepared by the Environmental Science Division of Argonne National Laboratory (Argonne). Argonne was tasked by DOE to analyze the footprint of the current network of National Historic and Scenic Trails and the electricity transmission system in the 37 eastern contiguous states, Alaska, and Hawaii; assess the extent to which national trails are affected by electrical transmission; and investigate the extent to which national trails and other sensitive land use types may be affected in the near future by planned transmission lines. Pipelines are secondary to transmission lines for analysis, but are also within the analysis scope in connection with the overall directives of Section 368 of the Energy Policy Act of 2005, and because of the potential for electrical transmission lines being collocated with pipelines. Based on Platts electrical transmission line data, a total of 101 existing intersections with national trails on federal land were found, and 20 proposed intersections. Transmission lines and pipelines are proposed in Alaska; however there are no locations that intersect national trails. Source data did not indicate any planned transmission lines or pipelines in Hawaii. A map atlas provides more detailed mapping of the topics investigated in this study, and the accompanying GIS database provides the baseline information for further investigating locations of interest. In many cases the locations of proposed transmission lines are not accurately mapped (or a specific route may not yet be determined), and accordingly the specific crossing locations are speculative. However since both national trails and electrical transmission lines are long linear systems, the characteristics of the crossings reported in this study are expected to be similar to both observed characteristics of the existing infrastructure provided in this report, and of the new infrastructure if these proposed projects are built. More focused study of these siting challenges is expected to mitigate some of potential impacts by choosing routes that minimize or eliminate them. The current study primarily addresses a set of screening-level characterizations that provide insights into how the National Trail System may influence the siting of energy transport facilities in the states identified under Section 368(b) of the Energy Policy Act of 2005. As such, it initializes gathering and beginning analysis of the primary environmental and energy data, and maps the contextual relationships between an important national environmental asset and how this asset intersects with energy planning activities. Thus the current study sets the stage for more in-depth analyses and data development activities that begin to solve key transmission siting constraints. Our recommendations for future work incorporate two major areas: (1) database development and analytics and (2) modeling and scenario analysis for energy planning. These recommendations provide a path forward to address key issues originally developed under the Energy Policy Act of 2005 that are now being carried forward under the Presidents Climate Action Plan.

The VNIIEF/LANL collaboration : ten years of scientific benefit to the Russian Federation and the United States

Since 1992, the All-Russian Scientific Research Institute of Experimental Physics (VNIIEF) and the Los Alamos National Laboratory (LANL), the institutes that designed the first nuclear weapons of the Soviet Union and the United States, respectively, have been working together in fundamental research related to pulsed power technology and high energy density science. Experimental and theoretical work has been performed at Sarov and Los Alamos in areas as diverse as imploding liner physics and applications, fusion plasma formation, isentropic compression of noble gases, and explosively driven high current generation technology, all traditional areas of the Megagauss series of conferences. Recent joint work has focused on the Atlas capacitor bank (23 MJ, 30 MA, 6 ps) now operational at LANL. Even before Atlas became operational, VNIIEF's DEMG capability was used to provide the US with the first available data at ATLAS! upper performance limit (31 MA, 4 ps, 12 km/s velocity for 50 g liner mass). VNIIEF has recently designed and fielded imploding liner experiments on Atlas, with the goal of studying material strength properties by observing unstable perturbation growth. This paper traces the origins of this collaboration and reviews the scientific accomplishments.

Implications of an Improvised Nuclear Device Detonation on Command and Control for Surrounding Regions at the Local, State and Federal Levels

This paper discusses command and control issues relating to the operation of Incident Command Posts (ICPs) and Emergency Operations Centers (EOCs) in the surrounding area jurisdictions following the detonation of an Improvised Nuclear Device (IND). Although many aspects of command and control will be similar to what is considered to be normal operations using the Incident Command System (ICS) and the National Incident Management System (NIMS), the IND response will require many new procedures and associations in order to design and implement a successful response. The scope of this white paper is to address the following questions: Would the current command and control framework change in the face of an IND incident? What would the management of operations look like as the event unfolded? How do neighboring and/or affected jurisdictions coordinate with the state? If the target areas command and control infrastructure is destroyed or disabled, how could neighboring jurisdictions assist with command and control of the targeted jurisdiction? How would public health and medical services fit into the command and control structure? How can pre-planning and common policies improve coordination and response effectiveness? Where can public health officials get federal guidance on radiation, contamination and other health and safety issues for IND response planning and operations?

Environmental enforcement of federal agencies: A struggle for power under the New Federalism. Master's thesis

The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

DOE facilities, if not already faced with the need, could be confronted with the necessity of or request to train civil authorities near DOE facilities. SARA Title 3 and the recent high visibility of DOE safety programs have prompted civil authorities to seek out specialized emergency response training for their community's first responders. In 1988, the states through which the DOE is scheduled to transport transuranic (TRU) waste for disposal at the Waste Isolation Pilot Plant expressed the concerns that their fire, medical, and law enforcement personnel were not prepared to handle an accident involving shipments of TRU waste. In response, the DOE authorized their contractor, Westinghouse Electric Corporation, to develop and deliver a training program to emergency responders along the transportation routes to mitigate this specific institutional concern. The lessons learned by DOE and Westinghouse in creating, coordinating, and delivering this program could be modified to apply to the concerns of governmental jurisdictions, including adjoining DOE facilities.

The Department of Energy (DOE) and its predecessors have conducted research and development (R&D) in geothermal energy since 1971. To develop the technology needed to harness the Nation's vast geothermal resources, DOE's Office of Geothermal Technologies oversees a network of national laboratories, industrial contractors, universities, and their subcontractors. The following mission and goal statements guide the overall activities of the Office. The goals are: (1) Reduce the levelized cost of generating geothermal power to 3-5 cents per kWh by 2007; (2) Double the number of States with geothermal electric power facilities to eight by 2006; and (3) Supply the electrical power or heat energy needs of 7 million homes and businesses in the United States by 2010. This Federal Geothermal Program Research Update reviews the accomplishments of DOE's Geothermal Program for Federal Fiscal Year (FY) 2003. Money crunch looms for Federal cleanup effort

In an unprecedented acknowledgement that federal facility cleanup activities face a money crunch, a federal-state advisory panel is preparing a new strategy to avert enforcement showdowns when funding cuts prevent federal agencies from meeting legally required cleanup schedules set by states. In a draft report the panel said states must recognize that some cleanup [open quotes]milestones[close quotes] will have to be delayed due to budget pressures - a concession that will be politically difficult in some states. At the same time, the panel said federal agencies must be more forthcoming in working with states and local groups to determine how increasingly scarce resources will be distributed. As a general rule, the report recommended that federal agencies and state environmental officials agree on a [open quotes]fair share[close quotes] allocation method under which the pain of a budget cutback would be spread equally among all cleanup sites within an affected federal agency. That fair share approach would be altered only if the federal agency reached agreement with states that a funding cutback could be absorbed at selected sites without affecting any cleanup milestone.

Battelle Energy Alliance, LLC contracted with Intertek Testing Services, North America (ITSNA) to collect and evaluate data on federal fleet operations as part of the Advanced Vehicle Testing Activitys Federal Fleet Vehicle Data Logging and Characterization study. The Advanced Vehicle Testing Activity study seeks to collect and evaluate data to validate the utilization of advanced electric drive vehicle transportation. This report focuses on the Caribou-Targhee National Forest (CTNF) fleet to identify daily operational characteristics of select vehicles and report findings on vehicle and mission characterizations to support the successful introduction of plug-in electric vehicles (PEVs) into the agencies fleets. Individual observations of these selected vehicles provide the basis for recommendations related to electric vehicle adoption and whether a battery electric vehicle (BEV) or plug-in hybrid electric vehicle (PHEV) (collectively plug-in electric vehicles, or PEVs) can fulfill the mission requirements. ITSNA acknowledges the support of Idaho National Laboratory and CTNF for participation in the study. ITSNA is pleased to provide this report and is encouraged by enthusiasm and support from the Forest Service and CTNF personnel.

Mayak Production Association (MPA) is a major Russian nuclear enterprise within the nuclear complex that is operated by MINATOM. This paper describes the nature, scope, and status of the joint, cooperative efforts to enhance existing MPC&A systems at MPA. Current cooperative efforts are focused on enhancements to the existing MPC&A systems at four plants that are operated by MPA and that produce, process, handle and/or store proliferation-sensitive nuclear materials.

Regulatory and policy implications of Federal legislation on utility DSM programs

This paper reviews some potential consequences of recent Federal legislation to demand-side management (DSM) at utilities. The legislation discussed are the 1992 Energy Policy Act (EPAct), the 1990 Amendments to the Clean Air Act, and FERC Order No. 636. Examples of specific activities regarding DSM in Pennsylvania are included for illustration. Each of the Federal laws under discussion is unique in terms of origin, goals, and focus. Nevertheless, they all focus on the regulated energy industries such that their effects tend to combine to force massive changes. In die regulated electric and natural gas industries, this synergy is compounding the complexity of management and, at least in the short term, contributing to increases in the cost of doing business. In the long term, these Federal initiatives are likely to lead to a massive reassessment of state-regulated energy sources in production and end use, and their environmental consequences. The overall effect of all three pieces of legislation is to increase competition among the state-regulated utilities. The differences between competitive and regulated industries are noted in a effort to explain the effect of inducing competition among energy utilities. This has particular relevance to utility-sponsored energy-efficiency programs such as DSM and other customer assistance activities. This paper has three objectives. First, it outlines the contents of the Federal legislation regarding utility DSM programs. Second, it explains some of the impacts of these laws and regulations on utility programs, particularly the likely effects of the emerging competitive utility market. Third, it seeks to understand where and how action will be needed to carry out many of the provisions of these laws in the most cost-effective manner.

What is the Federal Demonstration Project

The Federal Demonstration Project is a cooperative effort between a number of universities, a private research institute, and several federal agencies to increase research productivity by eliminating unnecessary administrative procedures and by streamlining and standardizing needed controls. The Project aims to locate responsibility for decision-making as close as possible to principal investigators while maintaining necessary institutional and agency oversight to ensure accountability. By freeing researchers from some of their paperwork burden, more efficient research administration systems will enable investigators to spend more of their time doing science and engineering. The Federal Demonstration Project is an outgrowth of an earlier activity sponsored by five major federal R D agencies at the Florida State University System and the University of Miami. In Florida, the focus was on standardizing and streamlining procedures for administering research grants after the grants had been awarded to the universities. (See Attachment 1 for descriptions of the demonstrations carried out under the Florida Demonstration Project). In May 1988, the most successful of the demonstrated procedures were approved by the US Office of Management and Budget for use in grants awarded by any federal agency to any research organization. The new procedures give agencies authority to waive requirements that grantees obtain federal approval prior to taking a number of administrative actions with respect to grant management. The FDP institutions together with the participating federal agencies are designing and demonstrating innovative research administration procedures and are assessing the impact of those new procedures.

The courts ruled in the 1979 Plateau decision that the Secretary of the Interior is obligated to allocate federal royalty oil among all refineries not having their own crude oil source of supply, and can not impose Small Business Administration (SBA) eligibility requirements on potential purchasers of federal royalty oil. The effects of this decision was to derail the government's attempt to make royalty oil produced from Outer Continental Shelf leases and onshore sites available to the same refiners. The Minerals Management Service has yet to adopt final regulations harmonizing the court's ruling with applicable statutory requirements, resulting in actions of dubious legality. 75 references.

Typically, the Federal building stock is referred to as a group of about one-half million buildings throughout the United States. Additional information beyond this level is generally limited to distribution of that total by agency and maybe distribution of the total by state. However, additional characterization of the Federal building stock is required as the Federal sector seeks ways to implement efficiency projects to reduce energy and water use intensity as mandated by legislation and Executive Order. Using a Federal facility database that was assembled for use in a geographic information system tool, additional characterization of the Federal building stock is provided including information regarding the geographical distribution of sites, building counts and percentage of total by agency, distribution of sites and building totals by agency, distribution of building count and floor space by Federal building type classification by agency, and rank ordering of sites, buildings, and floor space by state. A case study is provided regarding how the building stock has changed for the Department of Energy from 2000 through 2008.

Energy efficiency resource standards (EERS) are a prominent strategy to potentially achieve rapid and aggressive energy savings goals in the U.S. As of December 2010, twenty-six U.S. states had some form of an EERS with savings goals applicable to energy efficiency (EE) programs paid for by utility customers. The European Union has initiated a similar type of savings goal, the Energy End-use Efficiency and Energy Services Directive, where it is being implemented in some countries through direct partnership with regulated electric utilities. U.S. utilities face significant financial disincentives under traditional regulation which affects the interest of shareholders and managers in aggressively pursuing cost-effective energy efficiency. Regulators are considering some combination of mandated goals ('sticks') and alternative utility business model components ('carrots' such as performance incentives) to align the utility's business and financial interests with state and federal energy efficiency public policy goals. European countries that have directed their utilities to administer EE programs have generally relied on non-binding mandates and targets; in the U.S., most state regulators have increasingly viewed 'carrots' as a necessary condition for successful achievement of energy efficiency goals and targets. In this paper, we analyze the financial impacts of an EERS on a large electric utility in the State of Arizona using a pro-forma utility financial model, including impacts on utility earnings, customer bills and rates. We demonstrate how a viable business model can be designed to improve the business case while retaining sizable ratepayer benefits. Quantifying these concerns and identifying ways they can be addressed are crucial steps in gaining the support of major stakeholder groups - lessons that can apply to other countries looking to significantly increase savings targets that can be achieved from their own utility-administered EE programs.

The Russian Federation's Ministry of Atomic Energy: Programs and Developments

This paper reviews select programs driving the Ministry of Atomic Energy of the Russian Federation's (Minatom) efforts to raise funds, comments on their potential viability, and highlights areas likely to be of particular concern for the US over the next three to five years. The paper's findings are: (1) Despite numerous cabinet displacements throughout the Yeltsin administration, Yevgeny Adamov was reappointed Minister on four occasions. With Boris Yeltsin's January 1, 2000 resignation, Adamov's long-term position as the head of the Ministry is more tenuous, but he will likely retain his position until at least the March 2000 elections. Acting President Vladimir Putin is unlikely to reorganize his cabinet prior to that date and there are no signs that Putin is dissatisfied with Adamov's leadership of Minatom. (2) Adamov's chief priorities are downsizing Minatom's defense sector, increasing the oversight of subsidiary bodies by the central bureaucracy and consolidating commercial elements of the Ministry within an umbrella organization called Atomprom. (3) Viktor Mikhaylov, Adamov's predecessor and critic of his reform efforts, has been relieved of his duties as First Deputy Minister. While he retains his positions as Chief of the Science Councils and Chief Scientist at Arzamas-16, his influence on Minatom's direction is greatly diminished. Adamov will likely continue his efforts to further marginalize Mikhaylov in the coming year. (4) Securing extra-budgetary sources of income continues to be the major factor guiding Minatom's international business dealings. The Ministry will continue to aggressively promote the sale of nuclear technology abroad, often to countries with questionable nonproliferation commitments. (5) Given the financial difficulties in Russia and Minatom's client states, however, few nuclear development programs will come to fruition for a number of years, if ever. Nevertheless, certain peaceful nuclear cooperation agreements should be carefully monitored--particularly those negotiated with Cuba, Iran, Libya and Syria. (6) Waste management has also risen in importance for Minatom. Opportunities for raising funds by reprocessing, storing and permanently disposing of spent fuel from foreign states are being explored. Although currently prohibited by federal law, the Russian Parliament will likely pass legislation in support of this program.

Business process re-engineering is becoming a main focus in todays efforts to overcome problems and deficits in the automotive and aerospace industries (e.g., integration in international markets, product complexity, increasing number of product variants, reduction in product development time and cost). In this paper, we investigate the steps needed to apply virtual reality (VR) for virtual prototyping (VP) to verify assembly and maintenance processes. After a review of todays business process in vehicle prototyping, we discuss CAD-VR data integration and identify new requirements for design quality. We present several new interaction paradigms so that engineers and designers can experiment naturally with the prototype. Finally, some results of a user survey performed at BMW are presented, showing the acceptance and feasability of VP and the paradigms implemented for our key process. The results show that VR will play an important role for VP in the near future.

Small businesses are the cornerstone of the American economy. Over 22 million small businesses account for approximately 99% of employers, employ about half of the private sector workforce, and are responsible for about two-thirds of net new jobs. Many small businesses fared better than the Fortune 500 in 2001. Non-farm proprietors income rose 2.4% in 2001 while corporate profits declined 7.2%. Yet not all is rosy for small businesses, particularly new ones. One-third close within two years of opening. From 1989 to 1992, almost half closed within four years; only 39.5% were still open after six years. Why do some new businesses thrive and some fail? What helps a new business succeed? Industry knowledge, business and financial planning, and good management. Small geothermal businesses are no different. Low- and medium-temperature geothermal resources exist throughout the western United States, the majority not yet tapped. A recent survey of ten western states identified more than 9,000 thermal wells and springs, over 900 low- to moderate-temperature geothermal resource areas, and hundreds of direct-use sites. Many opportunities exist for geothermal entrepreneurs to develop many of these sites into thriving small businesses. The ''Geothermal Small Business Workbook'' (''Workbook'') was written to give geothermal entrepreneurs, small businesses, and developers the tools they need to understand geothermal applications--both direct use and small-scale power generation--and to write a business and financing plan. The Workbook will: Provide background, market, and regulatory data for direct use and small-scale (< 1 megawatt) power generation geothermal projects; Refer you to several sources of useful information including owners of existing geothermal businesses, trade associations, and other organizations; Break down the complicated and sometimes tedious process of writing a business plan into five easy steps; Lead you--the geothermal entrepreneur, small company, or project developer--step-by-step through the process needed to structure a business and financing plan for a small geothermal project; and Help you develop a financing plan that can be adapted and taken to potential financing sources. The Workbook will not: Substitute for financial advice; Overcome the high exploration, development, and financing costs associated with smaller geothermal projects; Remedy the lack of financing for the exploration stage of a geothermal project; or Solve financing problems that are not related to the economic soundness of your project or are caused by things outside of your control.

The purpose of this guidebook is to help transfer information concerning alternative energy projects that have been tried on the Pacific islands affiliated with the US. These islands include those in American Samoa, the Commonwealth of the Northern Mariana Islands, the Federated States of Micronesia (Kosrae, Pohnpei, Truk, and Yap), Guam, and the Republics of the Marshall Islands and Palau. Distances are long between islands and populations are sparse, making communication and the transfer of information particularly difficult. A project that works on American Samoa might be appropriate for Yap, but to get this information to the proper people on Yap in a reasonable period of time is extremely difficult. This book describes 100 alternative energy projects that have been tried on the islands since the mid-1970's. This description and record of what has been done to date should be a source of ideas for energy workers, reduce duplication of work, and help encourage successes by describing other successes and failures. Alternative energy projects are projects that use indigenous, renewable resources in order to reduce local dependency on imported petroleum for electricity or liquid fuels. The islands have an apparent abundance of natural resources for this purpose such as the sun, rivers, vegetation, the ocean, and wind; and, ideally, it should be relatively simple to convert these resources to electricity or fuel. However, there are problems unique to the remote, tropical Pacific that often appear insurmountable, and successes to date are the results of unusual persistence, hard work, and ingenuity of those on the islands. Projects are confined to those that actually develop or demonstrate hardware. These projects use the complete spectrum of alternative technologies such as biomass conversion, wind electric, solar water heating, photovoltaics, wind water pumping, hydroelectric, water desalination, and integrated systems. 381 refs., 85 figs.

That could lead to unnoticed complete compromise of cryptographic systems, without a chance of control by its legitimate owners. The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.

The 1987 Federal field exercise: The DOE experience

The second full-scale field exercise of the Federal Radiological Emergency Response Plan (FRERP) was held at the Zion Nuclear Power Station, Zion, Illinois, in June 1987. The exercise incorporated the annual compliance exercise for the Zion plant and involved the operating utility, Commonwealth Edison Company, the states of Illinois and Wisconsin, local governments, volunteer groups, and representatives from 12 federal agencies. The 3-day exercise was played from many locations in the Zion area; Springfield, Illinois; Madison, Wisconsin; and Washington, DC. Approximately 1000 people participated in the exercise, which used a scenario in which an accident at the plant resulted in the release of radioactive material outside the plant boundary. The US Department of Energy (DOE) had major responsibilities during the planning, playing, and critiquing of the exercise; these functions are outlined in the report. This document describes the DOE participation in the planning and response during the exercise. During a radiological emergency, the FRERP gives DOE the responsibility for coordinating the federal radiological monitoring and assessment activities in support of the states and the cognizant federal agency. At Zion, a self-sufficient Federal Radiological Monitoring and Assessment Center was established by DOE at a nearby fairground in which over 200 people from DOE, the two states, and other federal agencies participated. Before the field exercise, a tabletop exercise and a dry run were held for training purposes. 5 refs., 6 figs.

This report is organized in a fashion that is intended to explain the legal duties imposed on officials responsible for hazardous waste at each stage of its existence. Section 2 describes federal hazardous waste laws, explaining the legal meaning of hazardous waste and the protective measures that are required to be taken by its generators, transporters, and storers. In addition, penalties for violation of the standards are summarized, and a special discussion is presented of so-called imminent hazard provisions for handling hazardous waste that immediately threatens public health and safety. Although the focus of Sec. 2 is on RCRA, which is the principal federal law regulating hazardous waste, other federal statutes are discussed as appropriate. Section 3 covers state regulation of hazardous waste. First, Sec. 3 explains the system of state enforcement of the federal RCRA requirements on hazardous waste within their borders. Second, Sec. 3 discusses two peculiar provisions of RCRA that appear to permit states to regulate federal facilities more strictly than RCRA otherwise would require.
