    Over the past 15 years, research has shown that wind turbines in the Altamont Pass Wind Resource Area (APWRA) kill many birds, including raptors, which are protected by the Migratory Bird Treaty Act (MBTA), the Bald and Golden Eagle Protection Act, and/or state and federal Endangered Species Acts. Early research in the APWRA on avian mortality mainly attempted to identify the extent of the problem. In 1998, however, the National Renewable Energy Laboratory (NREL) initiated research to address the causal relationships between wind turbines and bird mortality. NREL funded a project by BioResource Consultants to perform this research directed at identifying and addressing the causes of mortality of various bird species from wind turbines in the APWRA.With 580 megawatts (MW) of installed wind turbine generating capacity in the APWRA, wind turbines there provide up to 1 billion kilowatt-hours (kWh) of emissions-free electricity annually. By identifying and implementing new methods and technologies to reduce or resolve bird mortality in the APWRA, power producers may be able to increase wind turbine electricity production at the site and apply similar mortality-reduction methods at other sites around the state and country.

  3. Columbia River Treaty 2014/2024 Review Phase 1 Report

    Under the Columbia River Treaty (Treaty or CRT) of 1964, Canada and the United States (U.S.) jointly regulate and manage the Columbia River as it flows from British Columbia into the U.S. The Treaty has provided substantial flood control and power generation benefits to both nations. The Treaty established Canadian and U.S. Entities as implementing agents for each government. British Columbia Hydro and Power Authority (BC Hydro) was designated as the Canadian Entity. The Bonneville Power Administration (BPA) Administrator and the U.S. Army Corps of Engineers (Corps) Division Engineer, Northwestern Division, were designated as the U.S. Entity. The Canadian and U.S. Entities are empowered by their respective governments with broad discretion to implement the existing Columbia River Treaty. They are not, however, authorized to terminate, renegotiate, or otherwise modify the Treaty. In the U.S., authority over international treaties rests with the President, assisted in foreign relations and international negotiations by the Department of State and subject in certain cases to the advice and consent of the U.S. Senate. In Canada, international treaties are within the prerogative of the executive branch of the federal government. Under current policy, treaties are tabled in the House of Commons, and are subject to a waiting period before the executive branch brings the treaty into effect. In the case of the Columbia River Treaty, Canada has assigned certain rights and obligations relating to the Treaty to British Columbia pursuant to the Canada-B.C. Agreement. The Phase 1 report is provided to those respective governmental bodies to support possible independent and/or joint decisions that may be made with respect to the future of the Treaty. The Treaty contains two important provisions that take effect on and after September 16, 2024, that could impact the current power and flood control benefits: 1. Canadian flood control obligations automatically change from a pre-determined annual operation to a Called Upon operation. 2. The year 2024 is the earliest date that either Canada or the U.S. can terminate most of the provisions of the Treaty, with a minimum 10-years advance written notice. Hence, September 16, 2014, is the latest date that either nation could provide notice of intent to terminate and still have the termination effective at its earliest possible date in 2024. While termination would end most Treaty obligations, Called Upon flood control and Libby coordination provisions will continue regardless of termination. However, it is important to note that the Treaty has no end date and absent either country using the termination option will continue indefinitely.

    The Treaty on Conventional Forces in Europe (CFE) was signed in November 1990 by sixteen nations, members of the North Atlantic Treaty Organization (NATO), and six nations, members of the Warsaw Treaty Organization (WTO). It was resigned to prevent a major surprise attack in Europe by the conventional forces of one Treaty Organization against those of the other and was the first major arms control treaty to address conventional weapons. This paper focuses on how CFE adapted to changes in the military-political situation in Europe which occurred after 1990 and failed to adapt to others. Suggestions are offered on how it might be changed to make it more relevant under these changed conditions.

    The Nuclear Non-Proliferation Treaty (NPT) is the most important international security arrangement that we have that is protecting the world community and this has been true for many years. But it did not happen by accident, it is a strategic bargain in which 184 states gave up the right forever to acquire the most powerful weapon ever created in exchange for a commitment from the five states allowed to keep nuclear weapons under the NPT (U.S., U.K., Russia, France and China), to share peaceful nuclear technology and to engage in disarmament negotiations aimed at the ultimate elimination of their nuclear stockpiles. The most important part of this is the comprehensive nuclear test ban (CTBT); the thinking by the 184 NPT non-nuclear weapon states was and is that they understand that the elimination of nuclear weapon stockpiles is a long way off, but at least the NPT nuclear weapon states could stop testing the weapons. The CTBT has been ratified by 161 states but by its terms it can only come into force if 44 nuclear potential states ratify; 36 have of the 44 have ratified it, the remaining eight include the United States and seven others, most of whom are in effect waiting for the United States. No state has tested a nuclear weapon-except for complete outlier North Korea-in 15 years. There appears to be no chance that the U.S. Senate will approve the CTBT for ratification in the foreseeable future, but the NPT may not survive without it. Perhaps it is time to consider an interim measure, for the UN Security Council to declare that any future nuclear weapon test any time, anywhere is a 'threat to peace and security', in effect a violation of international law, which in today's world it clearly would be.

    A Fissile Material Cutoff Treaty (FMCT) would ban the production of fissile material - in practice highly-enriched uranium and separated plutonium - for weapons. It has been supported by strong majorities in the United Nations. After it comes into force, newly produced fissile materials could only be produced under international - most likely International Atomic Energy Agency - monitoring. Many non-weapon states argue that the treaty should also place under safeguards pre-existing stocks of fissile material in civilian use or declared excess for weapons so as to make nuclear-weapons reductions irreversible. This paper discusses the scope of the FMCT, the ability to detect clandestine production and verification challenges in the nuclear-weapons states.

    In recent years, there is growing interest in formal negotiations on non-strategic or tactical nuclear weapons. With the negotiations of New START, there has been much speculation that a tactical nuclear weapons treaty should be included in the follow on to New START. This paper examines the current policy environment related to tactical weapons and some of the issues surrounding the definition of tactical nuclear weapons. We then map out the steps that would need to be taken in order to begin discussions on a tactical nuclear weapons treaty. These steps will review the potential role of the IAEA in verification of a tactical nuclear weapons treaty. Specifically, does IAEA involvement in various arms control treaties serve as a useful roadmap on how to overcome some of the issues pertaining to a tactical nuclear weapons treaty?

    Surface and underground mining operations generate seismic ground motions which are created by chemical explosions and ground failures. It may come as a surprise to some that the ground failures (coal bumps, first caves, pillar collapses, rockbursts, etc.) can send signals whose magnitudes are as strong or stronger than those from any mining blast. A verification system that includes seismic, infrasound, hydroacoustic and radionuclide sensors is being completed as part of the CTBT. The largest mine blasts and ground failures will be detected by this system and must be identified as distinct from signals generated by small nuclear explosions. Seismologists will analyze the seismic records and presumably should be able to separate them into earthquake-like and non earthquake-like categories, using a variety of so-called seismic discriminants. Non-earthquake essentially means explosion- or implosion-like. Such signals can be generated not only by mine blasts but also by a variety of ground failures. Because it is known that single-fired chemical explosions and nuclear explosion signals of the same yield give very similar seismic records, the non-earthquake signals will be of concern to the Treaty verification community. The magnitude of the mine-related events is in the range of seismicity created by smaller nuclear explosions or decoupled tests, which are of particular concern under the Treaty. It is conceivable that legitimate mining blasts or some mine-induced ground failures could occasionally be questioned. Information such as shot time, location and design parameters may be all that is necessary to resolve the event identity. In rare instances where the legitimate origin of the event could not be resolved by a consultation and clarification procedure, it might trigger on On-Site Inspection (OSI). Because there is uncertainty in the precise location of seismic event as determined by the International Monitoring System (IMS), the OSI can cover an area of up to 1,000 squared kilometers. In active mining districts this area could include several different mining operations. So, an OSI could be disruptive both to the mining community and to the US Government which must host the foreign inspection team. Accordingly, it is in the best interest of all US parties to try and eliminate the possible occurrence of false alarms. This can be achieved primarily by reducing the ambiguity of mine-induced seismic signals, so that even if these remain visible to the IMS they are clearly consistent with recognizable mining patterns.

    The Columbia River, the fourth largest river on the continent as measured by average annual flow, generates more power than any other river in North America. While its headwaters originate in British Columbia, only about 15 percent of the 259,500 square miles of the Columbia River Basin is actually located in Canada. Yet the Canadian waters account for about 38 percent of the average annual volume, and up to 50 percent of the peak flood waters, that flow by The Dalles Dam on the Columbia River between Oregon and Washington. In the 1940s, officials from the United States and Canada began a long process to seek a joint solution to the flooding caused by the unregulated Columbia River and to the postwar demand for greater energy resources. That effort culminated in the Columbia River Treaty, an international agreement between Canada and the United States for the cooperative development of water resources regulation in the upper Columbia River Basin. It was signed in 1961 and implemented in 1964.

    About 30 specialists in non-proliferation participated in a workshop to explore ideas for US Government preparatory steps leading to the 1995 Nuclear Non-Proliferation Treaty (NPT) Extension Conference. To that end, workshop sessions were devoted to reviewing the lessons learned from previous Review Conferences, discussing the threats to the non-proliferation regime together with ways of preserving and strengthening it, and examining the management of international nuclear commerce. A fundamental premise shared by workshop participants was that extension of the NPT is immensely important to international security. The importance of stemming proliferation and, more specifically, extending the Treaty, is growing as a result of the significant changes in the world. If the conferees of the Extension Conference decide on no extension or extension for a short limited duration, some technically advanced states that have foregone development of nuclear weapons may begin to rethink their options. Also, other arms control measures, such as the Chemical Weapons Convention, could start to unravel. The US must provide strong international leadership to ensure that the Extension Conference is a success, resulting in Treaty extension, perhaps through successive terms, into the indefinite future. Workshop participants were struck by the urgent need for the US to take organizational steps so that it is highly effective in its advance preparations for the Extension Conference. Moreover, the Extension Conference provides both a challenge and an opportunity to mold a cohesive set of US policy actions to define the future role of nuclear weapons and combat their proliferation.

  19. Phase II: Field Detector Development For Undeclared/Declared Nuclear Testing For Treaty Verfiation Monitoring

    Radioactive xenon isotopes are a critical part of the Comprehensive Nuclear Test Ban Treaty (CTBT) for the detection or confirmation of nuclear weapons tests as well as on-site treaty verification monitoring. On-site monitoring is not currently conducted because there are no commercially available small/robust field detector devices to measure the radioactive xenon isotopes. Xenon is an ideal signature to detect clandestine nuclear events since they are difficult to contain and can diffuse and migrate through soils due to their inert nature. There are four key radioxenon isotopes used in monitoring: 135Xe (9 hour half-life), 133mXe (2 day half-life), 133Xe (5 day half-life) and 131mXe (12 day half-life) that decay through beta emission and gamma emission. Savannah River National Laboratory (SRNL) is a leader in the field of gas collections and has developed highly selective molecular sieves that allow for the collection of xenon gas directly from air. Phase I assessed the development of a small, robust beta-gamma coincidence counting system, that combines collection and in situ detection methodologies. Phase II of the project began development of the custom electronics enabling 2D beta-gamma coincidence analysis in a field portable system. This will be a significant advancement for field detection/quantification of short-lived xenon isotopes that would not survive transport time for laboratory analysis.

  20. NEPA analysis of US-Canadian power transactions under the Columbia River Treaty

    The Columbia River Treaty of 1961 led to the development of three hydroelectric projects on the Columbia River in Canada and one in the United States. Canada sold its share of the downstream power generation benefits of these facilities to US utilities for 30 years. The administrator of the Bonneville Power Administration (BPA) of the US Department of Energy is the {open_quotes}United States Entity{close_quotes} under the Columbia River Treaty with Canada. BPA prepared the {open_quotes}Delivery of the Canadian Entitlement{close_quotes} Environmental Impact Statement (EIS) to evaluate alternative means for the US to return to Canada the Canadian share of the downstream benefits when these 30-year agreements expire. Alternatives on both sides of the US-Canada border included new high-voltage transmission lines; new generating and conservation resources; and power sales, exchanges, and other transactions. BPA developed an EIS methodology and graphical representation technique for comparing the diverse options associated with the Delivery of the Canadian Entitlement that were instrumental in helping managers understand the impacts of alternatives in a timely manner. A graphical, modular approach helped convey complex relationships in ways that were easy to read and understand. In addition, analysis of potential environmental impacts in Canada was developed in order to provide relevant information to US decision-makers, without compromising the Canadian environmental review process. As a result, environmental analysis was fully integrated into the decision process. The EIS approach used in this project has become a prototype for other Department of Energy NEPA documents, both site-specific and programmatic.

    A comprehensive ban on nuclear explosive testing is briefly characterized as an arms control initiative related to the Non-Proliferation Treaty. The work of monitoring for nuclear explosions uses several technologies of which the most important is seismology-a physics discipline that draws upon extensive and ever-growing assets to monitor for earthquakes and other ground-motion phenomena as well as for explosions. This paper outlines the basic methods of seismic monitoring within that wider context, and lists web-based and other resources for learning details. It also summarizes the main conclusions, concerning capability to monitor for test-ban treaty compliance, contained in a major study published in March 2012 by the US National Academy of Sciences.

Birds were recorded in a variety of habitats, including wetlands, interior forests, grasslands, ponds, corridors, forest edges, and more. Most of the information was gathered from waterfowl surveys conducted from 1990 to 2008, from Partners in Flight (PIF) breeding bird surveys conducted from 1995 to 2013, and from past publications and research on Reservation birds. We have also included our own observations and, in a few instances, credible observations of ORR birds of which we have been made aware through eBird or discussions with area ornithologists and bird watchers. For the period 1950 2014, we were able to document 228 species of birds on the ORR. Several of these species are known from historic records only, while others were not known to have ever occurred on the Reservation until recently. This report does not include PIF breeding bird data from the 2014 season or any records after July 2014. Twenty-two species approximately 10% of the total number of species observed have state-listed status in Tennessee as endangered, threatened, or in need of management. Of the 228 species we documented, 120 are believed to be breeding birds on the ORR.

    Traditional arms control treaty verification activities typically involve a combination of technical measurements via physical and chemical sensors, state declarations, political agreements, and on-site inspections involving international subject matter experts. However, the ubiquity of the internet, and the electronic sharing of data that it enables, has made available a wealth of open source information with the potential to benefit verification efforts. Open source information is already being used by organizations such as the International Atomic Energy Agency to support the verification of state-declared information, prepare inspectors for in-field activities, and to maintain situational awareness . The recent explosion in social media use has opened new doors to exploring the attitudes, moods, and activities around a given topic. Social media platforms, such as Twitter, Facebook, and YouTube, offer an opportunity for individuals, as well as institutions, to participate in a global conversation at minimal cost. Social media data can also provide a more data-rich environment, with text data being augmented with images, videos, and location data. The research described in this paper investigates the utility of applying social media signatures as potential arms control and nonproliferation treaty verification tools and technologies, as determined through a series of case studies. The treaty relevant events that these case studies touch upon include detection of undeclared facilities or activities, determination of unknown events recorded by the International Monitoring System (IMS), and the global media response to the occurrence of an Indian missile launch. The case studies examine how social media can be used to fill an information gap and provide additional confidence to a verification activity. The case studies represent, either directly or through a proxy, instances where social media information may be available that could potentially augment the evaluation of an event. The goal of this paper is to instigate a discussion within the verification community as to where and how social media can be effectively utilized to complement and enhance traditional treaty verification efforts. In addition, this paper seeks to identify areas of future research and development necessary to adapt social media analytic tools and techniques, and to form the seed for social media analytics to aid and inform arms control and nonproliferation policymakers and analysts. While social media analysis (as well as open source analysis as a whole) will not ever be able to replace traditional arms control verification measures, they do supply unique signatures that can augment existing analysis.

    While international nonproliferation and arms control verification capabilities have their foundations in physical and chemical sensors, state declarations, and on-site inspections, verification experts are beginning to consider the importance of open source data to complement and support traditional means of verification. One of those new, and increasingly expanding, sources of open source information is social media, which can be ingested and understood through social media analytics (SMA). Pacific Northwest National Laboratory (PNNL) is conducting research to further our ability to identify, visualize, and fuse social media data to support nonproliferation and arms control treaty verification efforts. This paper will describe our preliminary research to examine social media signatures of nonproliferation or arms control proxy events. We will describe the development of our preliminary nonproliferation and arms control proxy events, outline our initial findings, and propose ideas for future work.

    This paper is intended to serve as a scientific basis to start discussions of the available environmental sampling techniques and equipment that have been used in the past that could be considered for use within the context of the Comprehensive Nuclear-Test-Ban Treaty (CTBT) on-site inspections (OSI). This work contains information on the techniques, equipment, costs, and some operational procedures associated with environmental sampling that have actually been used in the past by the United States for the detection of nuclear explosions. This paper also includes a discussion of issues, recommendations, and questions needing further study within the context of the sampling and analysis of aquatic materials, atmospheric gases, atmospheric particulates, vegetation, sediments and soils, fauna, and drill-back materials.

    Most conservation groups support the development of wind energy in the US as an alternative to fossil and nuclear-fueled power plants to meet growing demand for electrical energy. However, concerns have surfaced over the potential threat to birds, bats, and other wildlife from the construction and operation of wind turbine facilities. Co-sponsored by the American Bird Conservancy (ABC) and the American Wind Energy Association (AWEA), the Wind Energy and Birds/Bats Workshop was convened to examine current research on the impacts of wind energy development on avian and bat species and to discuss the most effective ways to mitigate such impacts. On 18-19 May 2004, 82 representatives from government, non-government organizations, private business, and academia met to (1) review the status of the wind industry and current project development practices, including pre-development risk assessment and post-construction monitoring; (2) learn what is known about direct, indirect (habitat), and cumulative impacts on birds and bats from existing wind projects; about relevant aspects of bat and bird migration ecology; about offshore wind development experience in Europe; and about preventing, minimizing, and mitigating avian and bat impacts; (3) review wind development guidelines developed by the USFWS and the Washington State Department of Fish and Wildlife; and (4) identify topics needing further research and to discuss what can be done to ensure that research is both credible and accessible. These Workshop Proceedings include detailed summaries of the presentations made and the discussions that followed.

    The Georgia General Assembly passed the Shore Assistance Act in 1979 in order to fill a regulatory gap in the state's management of its coastal resources. A review of its legislative history, purposes, applications, and effects in terms of the sand sharing system of sand dunes, beaches, sandbars, and shoals concludes that the Act is poorly drafted. In its application on the oceanfront, it betrays its intent and protects the oceanfront owner. It has failed to satisfy the requirements of the public trust in the tidal foreshore. Amendments to clarify its understanding of the functions and values of the sand-sharing system should also conform with the state's duties under the public trust. 139 references.

    Departing from previous policy, in August 1993 the USEPA`s Water Office recommended that the agency regulate a proposed electric power plant`s cooling pond as a water of the US. At issue was a proposal by Florida Power corp. to build a new electric power plant in Polk County, Florida. A 2,600 acre cooling pond to collect heated and discharged water was included in the proposal. Region 4 USEPA staff asked USEPA Headquarters in Washington, DC to decide whether the pond was exempt from the CWA or a water of the US. The pond could be a habitat for migratory birds according to a memo prepared by Region 4 staff. The USEPA Water Office used the presence of migratory birds to claim a nexus to interstate commerce and therefore concluded that the pond should be regulated under the CWA. Electric power industry proponents have argued that an overly expansive definition of waters of the US may result in any new power plant being required to construct cooling towers. Cooling towers are said to be a more expensive and wasteful method to cool heated water. Region 4 ultimately recanted its earlier position after considerable discussions with various other Environmental Protection Agency offices and, no doubt industry pressure. Florida Power Corp. was not required to obtain an NPDES permit for the cooling pond. The lesson of Florida Power Corp. is that the regulatory environment for utilities can be uncertain under the Clean Water Act even in the face of a relatively straightforward exemption from regulation.

    Some 150 million years ago, a strange creature died in a tropical lagoon that today is located in Bavaria, Germany. In 1861, a single feather of this creature was discovered. Not long afterward, a complete fossil was found with the same bird-like feathers but dinosaur-like anatomical features. Darwin had just published 'On the Origin of Species'; could this be the missing link that Darwin's supporters hoped to find? Recently, two of the now eleven discovered Archaeopteryx fossils, and that first feather, were brought to SLAC, where, using the intense X-ray beam, researchers searched for the chemical remains of the original living creatures.     To address a critical verification issue for the current Non-Proliferation Treaty (NPT) and for a possible future Comprehensive Test Ban Treaty (CTBT), the Department of Energy sought to measure certain differences between an underground nuclear test and a chemical test in the same geology, so that other explosions could be identified. This was done in a field experiment code-named the NonProliferation Experiment (NPE).This comprehensive experiment was designed to determine the signatures of chemical explosions for a broad range of phenomena for comparison with those of previous nuclear tests. If significant differences can be measured, then these measures can be used to discriminate between the two types of explosions. In addition, when these differences are understood, large chemical explosions can be used to seismically calibrate regions to discriminate earthquakes from explosions. Toward this end, on-site and off-site measurements of transient phenomena were made, and on-site measurements of residual effects are in progress.Perhaps the most striking result was that the source function for the chemical explosion was identical to that of a nuclear one of about twice the yield. These proceedings provide more detailed results of the experiment.

    A double acting bit holder that permits bits held in it to be resharpened during cutting action to increase energy efficiency by reducing the amount of small chips produced. The holder consist of: a stationary base portion capable of being fixed to a cutter head of an excavation machine and having an integral extension therefrom with a bore hole therethrough to accommodate a pin shaft; a movable portion coextensive with the base having a pin shaft integrally extending therefrom that is insertable in the bore hole of the base member to permit the moveable portion to rotate about the axis of the pin shaft; a recess in the movable portion of the holder to accommodate a shank of a bit; and a biased spring disposed in adjoining openings in the base and moveable portions of the holder to permit the moveable portion to pivot around the pin shaft during cutting action of a bit fixed in a turret to allow front, mid and back positions of the bit during cutting to lessen creation of small chip amounts and resharpen the bit during excavation use.

    The wind power industry has grown rapidly in the UK to meet EU targets of sourcing 20% of energy from renewable sources by 2020. Although wind power is a renewable energy source, there are environmental concerns over increasing numbers of wind farm proposals and associated cumulative impacts. Individually, a wind farm, or indeed any action, may have minor effects on the environment, but collectively these may be significant, potentially greater than the sum of the individual parts acting alone. EU and UK legislation requires a cumulative impact assessment (CIA) as part of Environmental Impact Assessments (EIA). However, in the absence of detailed guidance and definitions, such assessments within EIA are rarely adequate, restricting the acquisition of basic knowledge about the cumulative impacts of wind farms on bird populations. Here we propose a conceptual framework to promote transparency in CIA through the explicit definition of impacts, actions and scales within an assessment. Our framework requires improved legislative guidance on the actions to include in assessments, and advice on the appropriate baselines against which to assess impacts. Cumulative impacts are currently considered on restricted scales (spatial and temporal) relating to individual development EIAs. We propose that benefits would be gained from elevating CIA to a strategic level, as a component of spatially explicit planning.

    The design of an instrument deployed in a project studying the high altitude Himalayan migrations of bar-headed geese (Anser indicus) is described. The electronics of this archival datalogger measured 22 14 6.5 mm, weighed 3 g, was powered by a AA-sized battery weighing 10 g and housed in a transparent biocompatible tube sealed with titanium electrodes for electrocardiography (ECG). The combined weight of 32 g represented less than 2% of the typical bodyweight of the geese. The primary tasks of the instrument were to continuously record a digitised ECG signal for heart-rate determination and store 12-bit triaxial accelerations sampled at 100 Hz with 15% coverage over each 2 min period. Measurement of atmospheric pressure provided an indication of altitude and rate of ascent or descent during flight. Geomagnetic field readings allowed for latitude estimation. These parameters were logged twice per minute along with body temperature. Data were stored to a memory card of 8 GB capacity. Instruments were implanted in geese captured on Mongolian lakes during the breeding season when the birds are temporarily flightless due to moulting. The goal was to collect data over a ten month period, covering both southward and northward migrations. This imposed extreme constraints on the design's power consumption. Raw ECG can be post-processed to obtain heart-rate, allowing improved rejection of signal interference due to strenuous activity of locomotory muscles during flight. Accelerometry can be used to monitor wing-beat frequency and body kinematics, and since the geese continued to flap their wings continuously even during rather steep descents, act as a proxy for biomechanical power. The instrument enables detailed investigation of the challenges faced by the geese during these arduous migrations which typically involve flying at extreme altitudes through cold, low density air where oxygen availability is significantly reduced compared to sea level.

    Surveying wildlife at risk from offshore wind energy development is difficult and expensive. Infrared video can be used to record birds and bats that pass through the camera view, but it is also time consuming and expensive to review video and determine what was recorded. We proposed to conduct algorithm and software development to identify and to differentiate thermally detected targets of interest that would allow automated processing of thermal image data to enumerate birds, bats, and insects. During FY2012 we developed computer code within MATLAB to identify objects recorded in video and extract attribute information that describes the objects recorded. We tested the efficiency of track identification using observer-based counts of tracks within segments of sample video. We examined object attributes, modeled the effects of random variability on attributes, and produced data smoothing techniques to limit random variation within attribute data. We also began drafting and testing methodology to identify objects recorded on video. We also recorded approximately 10 hours of infrared video of various marine birds, passerine birds, and bats near the Pacific Northwest National Laboratory (PNNL) Marine Sciences Laboratory (MSL) at Sequim, Washington. A total of 6 hours of bird video was captured overlooking Sequim Bay over a series of weeks. An additional 2 hours of video of birds was also captured during two weeks overlooking Dungeness Bay within the Strait of Juan de Fuca. Bats and passerine birds (swallows) were also recorded at dusk on the MSL campus during nine evenings. An observer noted the identity of objects viewed through the camera concurrently with recording. These video files will provide the information necessary to produce and test software developed during FY2013. The annotation will also form the basis for creation of a method to reliably identify recorded objects.

    A fast-acting valve actuator utilizes a spring driven pneumatically loaded piston to drive a valve gate. Rapid exhaust of pressurized gas from the pneumatically loaded side of the piston facilitates an extremely rapid piston stroke. A flexible selector diaphragm opens and closes an exhaust port in response to pressure differentials created by energizing and de-energizing a solenoid which controls the pneumatic input to the actuator as well as selectively providing a venting action to one side of the selector diaphragm.

    Recent declines in North American breeding populations have sparked great concern over the effects of habitat fragmentation. Neotropical migrant birds use and are influenced by two biomes during a single life span. Yet assessment of the relative importance of changes in tropical wintering areas versus temperate breeding areas is complicated by regional variation in rates and extent of habitat change. Landscape-level measurements of forest fragmentation derived from remotely-sensed data provide a means to compare the patterns of habitat modification on the wintering and breeding grounds of migrant birds. This study quantifies patterns of forest fragmentation in the Southern Appalachian Mountains and tropical Amazon and relates these patterns to the resource needs of neotropical migrant birds. Study sites were selected from remotely-sensed images to represent a range of forest fragmentation (highly fragmented landscape to continuous forest).

    The Solid Waste Authority of Palm Beach County (SWA) manages a waste-to-energy facility and landfill adjacent to a site which, during the 1985 Florida drought, served as the largest communal Snail Kite (Rostrhamus sociabilis plumbeus) roost documented in the United States. Listed as an endangered species, the Snail Kite initiated a Section 7 consulation process as a USCOAE Dredge & Fill permit was sought for construction in 1987. In response to environmental permit requirements, SWA developed and implemented a Wildlife Conservation & Management Program which evaluated the roost`s response to activities associated with site development. Specifically, a seven-year bird monitoring program was conducted on kite usage of this roost from 1987-1993. Impact assessment was expanded to include monitoring the mixed-species wading bird colony which inhabits the same roosting area. Monitoring at the community level serves as a better environmental indicator because Snail Kites are nomadic and respond to regional water level changes. This paper gives an overview of the environmental concerns and approach taken to monitor the roost, describes the different components of the bird monitoring program, and summarizes the findings of the 7-year data collection. An evaluation of the SWA project with regards to impacts on Snail Kite and wading bird usage of the area is also discussed.

    An overview of the Electric Consumers Protection Act of 1986 identifies it as the most important federal legislation dealing with hydroelectric development standards since the Federal Water Power Act of 1920. The author summarizes its major components, and identifies some of the existing and potential issues relation to its implementation. The most controversial issue is the selection of a new licensee for a project once the original licensee's term has expired. Other issues concern environmental criteria, comprehensive planning, amendments to the Public Utility Regulatory Policies Act, and enforcement procedures. The article concludes with a summary of miscellaneous provisions, including antitrust, modifications and time calculations of projects, wheeling, and other concerns.

    The Genetic Privacy Act is a proposal for federal legislation. The Act is based on the premise that genetic information is different from other types of personal information in ways that require special protection. Therefore, to effectively protect genetic privacy unauthorized collection and analysis of individually identifiable DNA must be prohibited. As a result, the premise of the Act is that no stranger should have or control identifiable DNA samples or genetic information about an individual unless that individual specifically authorizes the collection of DNA samples for the purpose of genetic analysis, authorized the creation of that private information, and has access to and control over the dissemination of that information.

    Wildlife-habitat relationships models are used widely by land managers to provide information on which species are likely to occur in an area of interest and may be impacted by a proposed management activity. Few such models have been tested. Recent Avian census data from the Savannah River Site, South Carolina was used to validate BIRDHAB, a geographic information system (GIS) model developed by United States Forest Service resource managers to predict relative habitat quality for birds at the stand level on national forests in the southeastern United States. BIRDHAB is based on the species-habitat matrices presented by Hamel (1992).

    The Genetic Privacy Act is a proposal for federal legislation. The Act is based on the premise that genetic information is different from other types of personal information in ways that require special protection. The DNA molecule holds an extensive amount of currently indecipherable information. The major goal of the Human Genome Project is to decipher this code so that the information it contains is accessible. The privacy question is, accessible to whom? The highly personal nature of the information contained in DNA can be illustrated by thinking of DNA as containing an individual`s {open_quotes}future diary.{close_quotes} A diary is perhaps the most personal and private document a person can create. It contains a person`s innermost thoughts and perceptions, and is usually hidden and locked to assure its secrecy. Diaries describe the past. The information in one`s genetic code can be thought of as a coded probabilistic future diary because it describes an important part of a unique and personal future. This document presents an introduction to the proposal for federal legislation `the Genetic Privacy Act`; a copy of the proposed act; and comment.

    Thermal infrared video can provide essential information about bird and bat presence and activity for risk assessment studies, but the analysis of recorded video can be time-consuming and may not extract all of the available information. Automated processing makes continuous monitoring over extended periods of time feasible, and maximizes the information provided by video. This is especially important for collecting data in remote locations that are difficult for human observers to access, such as proposed offshore wind turbine sites. We present guidelines for selecting an appropriate thermal camera based on environmental conditions and the physical characteristics of the target animals. We developed new video image processing algorithms that automate the extraction of bird and bat flight tracks from thermal video, and that characterize the extracted tracks to support animal identification and behavior inference. The algorithms use a video peak store process followed by background masking and perceptual grouping to extract flight tracks. The extracted tracks are automatically quantified in terms that could then be used to infer animal type and possibly behavior. The developed automated processing generates results that are reproducible and verifiable, and reduces the total amount of video data that must be retained and reviewed by human experts. Finally, we suggest models for interpreting thermal imaging information.

    We model a loss of flow accident (LOFA) in the ARIES-ACT1 tokamak design. ARIES-ACT1 features an advanced SiC blanket with LiPb as coolant and breeder, a helium cooled steel structural ring and tungsten divertors, a thin-walled, helium cooled vacuum vessel, and a room temperature water-cooled shield outside the vacuum vessel. The water heat transfer system is designed to remove heat by natural circulation during a LOFA. The MELCOR model uses time-dependent decay heats for each component determined by 1-D modeling. The MELCOR model shows that, despite periodic boiling of the water coolant, that structures are kept adequately cool by the passive safety system.

    A fast-acting nuclear reactor control device for moving and positioning a fety control rod to desired positions within the core of the reactor between a run position in which the safety control rod is outside the reactor core, and a shutdown position in which the rod is fully inserted in the reactor core. The device employs a hydraulic pump/motor, an electric gear motor, and solenoid valve to drive the safety control rod into the reactor core through the entire stroke of the safety control rod. An overrunning clutch allows the safety control rod to freely travel toward a safe position in the event of a partial drive system failure.

    A mechanical device for effecting a phase change between the expansion and compression volumes of a double-acting Stirling engine uses helical elements which produce opposite rotation of a pair of crankpins when a control rod is moved, so the phase between two pairs of pistons is changed by +.psi. and the phase between the other two pairs of pistons is changed by -.psi.. The phase can change beyond .psi.=90.degree. at which regenerative braking and then reversal of engine rotation occurs.
