    A detailed description is presented of the laws and programs of the Federal government governing the regulation of public energy utilities, the siting of energy generating and transmission facilities, the municipal franchising of public energy utilities, and the prescription of rates to be charged by utilities including attendant problems of cost allocations, rate base and operating expense determinations, and rate of return allowances. These laws and programs are analyzed to identify impediments which they may present to the implementation of Integrated Community Energy Systems (ICES). This report is one of fifty-one separate volumes which describe such regulatory programs at the Federal level and in each state as background to the report entitled Community Energy Systems and the Law of Public Utilities - Volume One: An Overview. This report also contains a summary of a strategy described in Volume One - An Overview for overcoming these impediments by working within the existing regulatory framework and by making changes in the regulatory programs to enhance the likelihood of ICES implementation.

    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    A simple, highly accurate, mathematical model of heat-to-electricity conversion is developed from Planck's law for the distribution of the radiant exitance of heat at a selected temperature. An electrical power curve is calculated by integration of the heat law over a selected range of electromagnetic wavelength corresponding to electrical voltage. A novel wavelength-voltage conversion factor, developed from the known wavelength-electron volt conversion factor, establishes the wavelength ({lambda}) for the integration. The Planck law is integrated within the limits {lambda} to 2{lambda}. The integration provides the ideal electrical power that is available from heat at the emitter temperature. When multiplied by a simple ratio, the calculated ideal power closely matches published thermionic converter experimental data. The thermal power model of thermionic conversion is validated by experiments with thermionic emission of ordinary electron tubes. A theoretical basis for the heat law based model of thermionic conversion is found in linear oscillator theory.

    Solar thermal technologies are capable of providing heat across a wide range of temperatures, making them potentially attractive for meeting energy requirements for industrial process heat applications and institutional heating. The energy savings that could be realized by solar thermal heat are quite large, potentially several quads annually. Although technologies for delivering heat at temperatures above 100{degrees}C currently exit within industry, only a fairly small number of commercial systems have been installed to date. The objective of this paper is to investigate and discuss the prospects for near-term solar heat sales to federal facilities as a mechanism for providing an early market niche to the aid the widespread development and implementation of the technology. The specific technical focus is on mid-temperature (100{degrees}--350{degrees}C) heat demands that could be met with parabolic trough systems. Federal facilities have several relative to private industry that may make them attractive for solar heat applications relative to other sectors. Key features are specific policy mandates for conserving energy, a long-term planning horizon with well-defined decision criteria, and prescribed economic return criteria for conservation and solar investments that are generally less stringent than the investment criteria used by private industry. Federal facilities also have specific difficulties in the sale of solar heat technologies and strategies to mitigate these difficulties will be important. For the baseline scenario developed in this paper, the solar heat application was economically competitive with heat provided by natural gas. The system levelized energy cost was $5.9/MBtu for the solar heat case, compared to $6.8/MBtu for the life-cycle fuel cost of a natural gas case. A third-party ownership would also be attractive to federal users, since it would guarantee energy savings and would not need initial federal funds. 11 refs., 2 figs., 3 tabs.

    Section 121 of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) of 1980 specifies that remedial actions for cleanup of hazardous substances must comply with applicable or relevant and appropriate requirements (ARARS) or standards under federal and state environmental laws. The US Department of Energy (DOE) Oak Ridge Reservation (ORR) was placed on the National Priorities List by the US Environmental Protection Agency (EPA) on November 21, 1989, effective December 21, 1989. As a result of this listing, DOE, EPA, and the Tennessee Department of Environment and Conservation have signed a Federal Facility Agreement (FFA) for the environmental restoration of the ORR. Section XXI(F) of the FFA calls for the preparation of a draft listing of all ARARs as mandated by CERCLA {section}121. This report supplies a preliminary list of available federal and state ARARs that might be considered for remedial response at the ORR. A description of the terms ``applicable`` and ``relevant and appropriate`` is provided, as well as definitions of chemical-, location-, and action-specific ARARS. ARARs promulgated by the federal government and by the state of Tennessee are listed in tables. In addition, the major provisions of the Resource Conservation and Recovery Act, the Safe Drinking Water Act, the Clean Water Act, the Clean Air and other acts, as they apply to hazardous waste cleanup, are discussed. In the absence of ARARS, CERCLA {section}121 provides for the use of nonpromulgated federal criteria, guidelines, and advisories in evaluating the human risk associated with remedial action alternatives. Such nonpromulgated standards are classified as ``to-be-considered`` (TBC) guidance. A ion of available guidance is given; summary tables fist the available federal standards and guidance information. In addition, the substantive contents of the DOE orders as they apply to remediation of radioactively contaminated sites are discussed as TBC guidance.

    The potential for solr process heat applications for federal buildings in Texas is assessed. The three sites considered are Reese Air Force Base, Lubbock; Fort Bliss, El Paso; and Dyess Air Force Base, Abilene. The application at Lubbock is an electroplating and descaling facility for aircraft maintenance. The one at El Paso is a laundry facility. The Abilene system would use solar heat to preheat boiler feedwater makeup for the base hospital boiler plant. The Lubbock site is found to be the most appropriate one for a demonstration plant, with the Abilene site as an alternate. The processes at each site are described. A preliminary evaluation of the potential contribution by solar energy to the electroplating facility at Reese AFB is included. (LEW)

    By applying fractional calculus to the equation proposed by M. Planck in 1900, we obtain a new blackbody radiation law described by a Mittag-Leffler (ML) function. We have analyzed NASA COBE data by means of a non-extensive formula with a parameter $(q-1)$, a formula proposed by Ertik et al. with a fractional parameter $(\\alpha-1)$, and our new formula including a parameter $(p-1)$, as well as the Bose-Einstein distribution with a dimensionless chemical potential $\\mu$. It can be said that one role of the fractional parameter $(p-1)$ is almost the same as that of chemical potential $(\\mu)$ as well as that of the parameter $(q-1)$ in the non-extensive approach.

    The United States has economically recoverable coal reserves of about 261 billion tons, which is in excess of a 250-­?year supply based on 2009 consumption rates. However, in the near future the use of coal may be legally restricted because of concerns over the effects of its combustion on atmospheric carbon dioxide concentrations. In response, the U.S. Department of Energy is making significant efforts to help develop and implement a commercial scale program of geologic carbon sequestration that involves capturing and storing carbon dioxide emitted from coal-­?burning electric power plants in deep underground formations. This article explores the technical and legal problems that must be resolved in order to have a viable carbon sequestration program. It covers the responsibilities of the United States Environmental Protection Agency and the Departments of Energy, Transportation and Interior. It discusses the use of the Safe Drinking Water Act, the Clean Air Act, the National Environmental Policy Act, the Endangered Species Act, and other applicable federal laws. Finally, it discusses the provisions related to carbon sequestration that have been included in the major bills dealing with climate change that Congress has been considering in 2009 and 2010. The article concludes that the many legal issues that exist can be resolved, but whether carbon sequestration becomes a commercial reality will depend on reducing its costs or by imposing legal requirements on fossil-­?fired power plants that result in the costs of carbon emissions increasing to the point that carbon sequestration becomes a feasible option.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services obtained through conventional procurements. While claims of excessive prices are largely unsubstantiated and based on anecdotal evidence, the perception that there is a problem is shared by many in the ESPC community and has been noted by auditors and oversight organizations. The Price Reasonableness Working Group determined that a more formal emphasis on FAR 15.404-1 in the ESPC process could remove much of the doubt about price reasonableness determinations. The working group's recommended consensus policy on price reasonableness stresses the price analysis techniques described in the FAR that are applicable to ESPCs and includes guidance for agencies use of these techniques in determining price reasonableness for their ESPC delivery orders. The recommended policy and guidance, if communicated to federal ESPC stakeholders, can ensure that agencies will comply with the FAR in awarding ESPCs, obtain fair and reasonable prices and best value for the government, and follow procedures that provide auditable documentation of due diligence in price reasonableness determinations.

    On December 19, 2007, the Energy Independence and Security Act of 2007 (EISA) was signed into law as Public Law 110-140. Section 246(a) of EISA directs Federal agencies to install at least one renewable fuel pump at each Federal fleet fueling center under their jurisdiction by January 1, 2010. Section 246(b) requires the President to submit an annual report to Congress on Federal agency progress in meeting this renewable fuel pump installation mandate. This guidance document provides guidelines to help agencies understand these requirements and how to comply with EISA Section 246.

    This document was prepared at the request of the U.S. Department of Energy's (DOE's) Federal Energy Management Program (FEMP) under its Technical Guidance and Assistance and Project Financing Programs. The purpose was to provide an estimate of the national potential for combined heat and power (also known as CHP; cogeneration; or cooling, heating, and power) applications at federal facilities and the associated costs and benefits including energy and emission savings. The report provides a broad overview for the U.S. Department of Energy (DOE) and other agencies on when and where CHP systems are most likely to serve the government's best interest. FEMP's mission is to reduce the cost to and environmental impact of the federal government by advancing energy efficiency and water conservation, promoting the use of renewable energy, and improving utility management decisions at federal sites. FEMP programs are driven by its customers: federal agency sites. FEMP monitors energy efficiency and renewable energy technology developments and mounts ''technology-specific'' programs to make technologies that are in strong demand by agencies more accessible. FEMP's role is often one of helping the federal government ''lead by example'' through the use of advanced energy efficiency/renewable energy (EERE) technologies in its own buildings and facilities. CHP was highlighted in the Bush Administration's National Energy Policy Report as a commercially available technology offering extraordinary benefits in terms of energy efficiencies and emission reductions. FEMP's criteria for emphasizing a technology are that it must be commercially available; be proven but underutilized; have a strong constituency and momentum; offer large energy savings and other benefits of interest to federal sites and FEMP mission; be in demand; and carry sufficient federal market potential. As discussed in the report, CHP meets all of these criteria. Executive Order 13123 directs federal facilities to use CHP when life-cycle costs indicate energy reduction goals will be met. FEMP can assist facilities to conduct this analysis. The model developed for this report estimates the magnitude of CHP that could be implemented under various performance and economic assumptions associated with different applications. This model may be useful for other energy technologies. It can be adapted to estimate the market potential in federal buildings for any energy system based on the cost and performance parameters that a user desires to assess. The model already incorporates a standard set of parameters based on available data for federal buildings including total building space, building type, energy use intensity, fuel costs, and the performance of many prime movers commonly used in CHP applications. These and other variables can be adjusted to meet user needs or updated in the future as new data become available.

    This report is organized in a fashion that is intended to explain the legal duties imposed on officials responsible for hazardous waste at each stage of its existence. Section 2 describes federal hazardous waste laws, explaining the legal meaning of hazardous waste and the protective measures that are required to be taken by its generators, transporters, and storers. In addition, penalties for violation of the standards are summarized, and a special discussion is presented of so-called imminent hazard provisions for handling hazardous waste that immediately threatens public health and safety. Although the focus of Sec. 2 is on RCRA, which is the principal federal law regulating hazardous waste, other federal statutes are discussed as appropriate. Section 3 covers state regulation of hazardous waste. First, Sec. 3 explains the system of state enforcement of the federal RCRA requirements on hazardous waste within their borders. Second, Sec. 3 discusses two peculiar provisions of RCRA that appear to permit states to regulate federal facilities more strictly than RCRA otherwise would require.

    In a world with water resources severely impacted bytechnology, science must actively contribute to water law. To this end,this paper is an earth scientist s attempt to comprehend essentialelements of water law, and to examine their connections to science.Science and law share a common logical framework of starting with apriori prescribed tenets, and drawing consistent inferences. In science,observationally established physical laws constitute the tenets, while inlaw, they stem from social values. The foundations of modern water law inEurope and the New World were formulated nearly two thousand years ago byRoman jurists who were inspired by Greek philosophy of reason.Recognizing that vital natural elements such as water, air, and the seawere governed by immutable natural laws, they reasoned that theseelements belonged to all humans, and therefore cannot be owned as privateproperty. Legally, such public property was to be governed by jusgentium, the law of all people or the law of all nations. In contrast,jus civile or civil law governed private property. Remarkably, jusgentium continues to be relevant in our contemporary society in whichscience plays a pivotal role in exploiting vital resources common to all.This paper examines the historical roots of modern water law, followstheir evolution through the centuries, and examines how the spirit ofscience inherent in jus gentium is profoundly influencing evolving waterand environmental laws in Europe, the United States and elsewhere. In atechnological world, scientific knowledge has to lie at the core of waterlaw. Yet, science cannot formulate law. It is hoped that a philosophicalunderstanding of the relationships between science and law willcontribute to their constructively coming together in the service ofsociety.

    Zipf's law is just one out of many universal laws proposed to describe statistical regularities in language. Here we review and critically discuss how these laws can be statistically interpreted, fitted, and tested (falsified). The modern availability of large databases of written text allows for tests with an unprecedent statistical accuracy and also a characterization of the fluctuations around the typical behavior. We find that fluctuations are usually much larger than expected based on simplifying statistical assumptions (e.g., independence and lack of correlations between observations).These simplifications appear also in usual statistical tests so that the large fluctuations can be erroneously interpreted as a falsification of the law. Instead, here we argue that linguistic laws are only meaningful (falsifiable) if accompanied by a model for which the fluctuations can be computed (e.g., a generative model of the text).     The goal of the U.S. Department of Energy's (DOE) Loaner Program is to increase the awareness, deployment, and use of electric vehicles (EVs) in Federal fleets. The Loaner Program accomplishes this by providing free EVs to Federal fleets on a loaner basis, generally for 1 or 2 months. The Program partners DOE with six electric utilities, with DOE providing financial support and some leads on Federal fleets interested in obtaining EVs. The utilities obtain the vehicles, identify candidate loaner fleets, loan the vehicles, provide temporary charging infrastructure, provide overall support to participating Federal fleets, and support fleets with their leasing decisions. While the utilities have not had the success initially envisioned by themselves, DOE, the Edison Electric Institute, and the Electric Vehicle Association of the Americas, the utilities can not be faulted for their efforts, as they are not the entity that makes the ultimate lease or no-lease decision. Some external groups have suggested to DOE that they direct other federal agencies to change their processes to make loaning vehicles easier; this is simply not within the power of DOE. By law, a certain percentage of all new vehicle acquisitions are supposed to be alternative fuel vehicles (AFV); however, with no enforcement, the federal agencies are not compelled to lease AFVs such as electric vehicles.

    On August 8, 2005, the President signed the Energy Policy Act of 2005 (EPAct) into law. In Subtitle F of EPAct, Congress set forth various provisions that would change the way certain federal agencies (Agencies) coordinate to authorize the use of land for a variety of energy-related purposes. As part of Subtitle F of EPAct, Section 368 addresses the issue of energy transportation corridors on federal land for oil, gas, and hydrogen pipelines, as well as electricity transmission and distribution facilities. Because of the critical importance of improving the nation's electrical transmission grid, Congress recognized that electricity transmission issues should receive added attention when the Agencies address corridor location and analysis issues. In Section 368, Congress specifically directed the Agencies to consider the need for upgraded and new facilities to deliver electricity: In carrying out [Section 368], the Secretaries shall take into account the need for upgraded and new electricity transmission and distribution facilities to (1) improve reliability; (2) relieve congestion; and (3) enhance capability of the national grid to deliver electricity. Section 368 does not require the Agencies to consider or approve specific projects, applications for rights-of-way (ROWs), or other permits within designated energy corridors. Importantly, Section 368 does not direct, license, or otherwise permit any on-the-ground activity of any sort. If an applicant is interested in obtaining an authorization to develop a project within any corridor designated under Section 368, the applicant would have to apply for a ROW authorization and applicable permits. The Agencies would consider each application by applying appropriate project-specific reviews under requirements of laws and related regulations, including, but not limited to, the National Environmental Policy Act (NEPA), the Clean Water Act, the Clean Air Act, Section 7 of the Endangered Species Act (ESA), and Section 106 of the National Historic Preservation Act (NHPA). Under Section 368, Congress divided the United States into two groups of states: the 11 contiguous western states and the remaining states. Direction for energy transportation corridor analysis and selection in the 11 western states was addressed in Section 368(a) of EPAct, while direction for energy transportation corridor analysis and selection in all other states was addressed under Section 368(b) of EPAct. It was clearly the priority of Congress to conduct corridor location studies and designation first on federal lands in the western states. Under Section 368(a), the Agencies produced a programmatic environmental impact statement (EIS), Designation of Energy Corridors on Federal Land in the 11 Western States (DOE and DOI 2008), that was used in part as the basis for designating more than 6,000 mi (9,656 km) of energy transportation corridors on federal land in 11 western states. Under Section 368(a) of EPAct, Congress clearly stated the Agencies needed to (1) designate energy transportation corridors on federal land, (2) conduct the necessary environmental review of the designated corridors, and (3) incorporate the designated corridors into the appropriate land use plans. Congressional direction under Section 368(b) of EPAct differs from that provided under Section 368(a). Specifically, Section 368(b) requires the secretaries of the Agencies, in consultation with the Federal Energy Regulatory Commission (FERC), affected utility industries, and other interested persons, to jointly: (1) Identify corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on federal land in states other than the 11 western states identified under Section 368(a) of EPAct, and (2) Schedule prompt action to identify, designate, and incorporate the corridors into the applicable land use plans. While Section 368(a) clearly directs designation as a necessary first step for energy transportation corridors in the 11 western states, Section 368(b) directs the Agencies to first identify corridor

    This book presents the findings of a four-year study of the impact of federal court decisions on the policies and administration of the US Environmental Protection Agency (EPA) in all seven of its major statutory areas: clean air, clean water, hazardous waste cleanup, controlled pesticide use, resource conservation and recovery, safe drinking water, and control of toxic substances. The author use the Lexis and Westlaw legal data bases to generate a list of all cases in which the EPA was either a plaintiff or a defendant in each of the agency's seven major statutory areas. The author verified these data and at times supplemented them with EPA records and with environmental reporters published by the Bureau of National Affairs and the Environmental Law Institute. She derived settlement agreements from the EPA, the Department of Justice, and the courts.

    The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.

    The Federal Fleet Conversion Task Force was created by Executive Order 12844, signed by President Clinton on April 21, 1993. In the Order, the President directed that purchases of alternative fueled vehicles by the Federal Government be substantially increased beyond the levels required by current law. The President charged the Task Force with developing recommendations for carrying out the Executive Order, with special emphasis on setting a course that will lead to the widespread use of alternative fueled vehicles by Federal, State, and local government fleets, by private fleets and, ultimately, by individuals. The chief recommendation of the Task Force is the establishment of a Presidential Clean Cities Initiative. To support creation of the Presidential Initiative, the Task Force identified 38 cities and regions, prioritized into three tiers, for concentrating the Initiative`s efforts in Fiscal Years 1994 through 1996. This concentration of effort is key to the effectiveness of the Initiative. The 38 cities and regions would receive priority funding for Federal vehicle purchases and for infrastructure development. In addition, the Task Force has made specific recommendations for overcoming numerous regulatory, economic, and technical barriers that have slowed the introduction of alternative fueled vehicles into general use.

    Waste handling and disposal from hydrocarbon exploration, drilling, and production are regulated by the US Environmental Protection Agency (EPA) through federal and state regulations and/or through implementation of federal regulations. Some wastes generated in these operations are exempt under the Resource Conservation and Recovery Act (RCRA) but are not exempt under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), Superfund Amendments and Reauthorization Act (SARA), and other federal environmental laws. Exempt wastes remain exempt only if they are not mixed with hazardous wastes or hazardous substances. Once mixture occurs, the waste must be disposed as a hazardous material in an approved hazardous waste disposal facility. Before the Clean Air Act as amended in 1990, air emissions from production, storage, steam generation, and compression facilities associated with hydrocarbon exploration, drilling, and production industry were not regulated. A critical proposed regulatory change which will significantly effect Class II injection wells for disposal of produced brine and injection for enhanced oil recovery is imminent. Federal regulations affecting hydrocarbon exploration, drilling and production, proposed EPA regulatory changes, and a recent significant US Court of Appeals decision are covered in this report. It appears that this industry will, in the future, fall under more stringent environmental regulations leading to increased costs for operators.

    Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    In a ''green roof,'' a layer of vegetation (e.g., a roof garden) covers the surface of a roof to provide shade, cooler indoor and outdoor temperatures, and effective storm-water management to reduce runoff. The main components are waterproofing, soil, and plants. There are two basic kinds: intensive and extensive. An intensive green roof often features large shrubs and trees, and it can be expensive to install and maintain. An extensive green roof features shallow soil and low-growing, horizontally spreading plants that can thrive in the alpine conditions of many rooftops. These plants do not require a lot of water or soil, and they can tolerate a significant amount of exposure to the sun and wind. This Federal Technology Alert focuses on the benefits, design, and implementation of extensive green roofs and includes criteria for their use on federal facilities.

    Network-centric systems that depend on mobile wireless ad hoc networks for their information exchange require detailed analysis to support their development. In many cases, this critical analysis is best provided with high-fidelity system simulations that include the effects of network architectures and protocols. In this research, we developed a high-fidelity system simulation capability using an HLA federation. The HLA federation, consisting of the Umbra system simulator and OPNET Modeler network simulator, provides a means for the system simulator to both affect, and be affected by, events in the network simulator. Advances are also made in increasing the fidelity of the wireless communication channel and reducing simulation run-time with a dead reckoning capability. A simulation experiment is included to demonstrate the developed modeling and simulation capability.

    The impact of DOE's Current Federal Program on the commercialization of hydrothermal resources between 1980 and 2000 is analyzed. The hydrothermal resources of the United States and the types of DOE activities used to stimulate the development of these resources for both electric power and direct heat use are described briefly. The No Federal Program and the Current Federal Program are then described in terms of funding levels and the resultant market penetration estimates through 2000. These market penetration estimates are also compared to other geothermal utilization forecasts. The direct benefits of the Current Federal Program are next presented for electric power and direct heat use applications. An analysis of the external impacts associated with the additional hydrothermal resource development resulting from the Current Federal Program is also provided. Included are environmental effects, national security/balance-of-payments improvements, socioeconomic impacts and materials requirements. A summary of the analysis integrating the direct benefits, external impacts and DOE program costs concludes the report.

    In response to the growing number of environmental laws and regulations worldwide, the Federal Aviation Administration (FAA) has adopted an environmental compliance program that identifies compliance problems before they are cited as violations by the U.S. Environmental Protection Agency (USEPA). In 1992, the FAA developed a program to maintain compliance with all Federal, state, and local environmental regulations. The goal is to protect human health/safety and the environment. The Southern Region of the FAA, which includes eight states and the Caribbean, developed and implemented a specific environmental assessment and management program tailored to the type and size of their facilities and operations. The resulting system combines Federal environmental regulations, along with good management practices and risk management information, into a series of checklists that show (1) legal requirements and (2) which specific items or operations to review. In 1994, the program was implemented nationwide. The Environmental Compliance Assessment Protocol - Federal Aviation Administration (ECAP-FAA) incorporates existing checklists from USEPA and private industry. The system has been tested at several FAA facilities. The manual is updated continually to address new environmental compliance laws and regulations.

These activities are reported semiannually under the auspices of the Federal Energy Resource Modernization (FERM) Coordinating Committee, and as such include activities undertaken from April 1, 1992, through September 30, 1992. The activities reported are classified into four major categories: (1) technology-base support, which includes development of processes, software, metering and monitoring equipment and strategies, and other tools for federal energy managers to better understand and characterize their energy resources; (2) federal energy systems testing and monitoring; (3) federal energy systems revitalization projects at federal installations in cooperation with the utilities serving the sites; and (4) energy supply, distribution and end-use conservation assessment for federal agencies and/or facilities.     Measuring the Economic Impacts of Federal Investments in Research evaluates approaches to measuring the returns on federal research investments. This report identifies new methodologies and metrics that can be developed and used for assessing returns on research across a wide range of fields (biomedical, information technology, energy, agriculture, environment, and other biological and physical sciences, etc.), while using one or more background papers that review current methodologies as a starting point for the discussion. It focuses on tools that are able to exploit available data in the relatively near term rather than on methodologies that may require substantial new data collection. Over the last several years, there has been a growing interest in policy circles in identifying the payoffs from federal agency research investments, especially in terms of economic growth, competitiveness, and jobs. The extraordinary increase in research expenditures under the American Recovery and Reinvestment Act (ARRA) of 2009 and the President�������¢����������������s commitment to science and technology (S&T) funding increases going forward have heightened the need for measuring the impacts of research investments. Without a credible analysis of their outcomes, the recent and proposed increases in S&T funding may not be sustained, especially given competing claims for federal funding and pressures to reduce projected federal budget deficits. Motivated by these needs and requirements, Measuring the Economic Impacts of Federal Investments in Research reviews and discusses the use of quantitative and qualitative data to evaluate the returns on federal research and development (R&D) investments. Despite the job-focused mandate of the current ARRA reporting requirements, the impact of S&T funding extend well beyond employment. For instance, federal funding in energy research may lead to innovations that would reduce energy costs at the household level, energy imports at the national level, and greenhouse gas emissions at the global level. In principle, these benefits can be measured as a return on research investments, with appropriate consideration of time lags to research outcomes and attribution to private as well as public expenditure. With appropriate metrics, the same could be true for benefits to public health, environmental quality, and food productivity and security. Federal funding of research leads to the development of human capital that is deployed in a variety of occupations with economic and social impacts. Research also produces information that is used in formal (e.g., regulatory and judicial) and informal (e.g., firm and consumer) decision making processes. In addition to reviewing the range of work (by academics, consultants, and research agencies themselves) that has been done in measuring research outcomes and providing a forum to discuss their methods, this report also considers the different methodologies used across fields of research (e.g., agriculture and energy research) to identifies which are applicable to a range of federal S&T funding.

    More than 56 million gallons of radioactive and hazardous waste are stored in 177 underground storage tanks at the U.S. Department of Energy’s (DOE’s) Hanford Site in southeastern Washington State. The Hanford Tank Waste Treatment and Immobilization Plant (WTP) is being constructed to treat the wastes and immobilize them in a glass waste form. The WTP includes a pretreatment facility to separate the wastes into a small volume of high-level waste (HLW) containing most of the radioactivity and a larger volume of low-activity waste (LAW) containing most of the nonradioactive chemicals. The HLW will be converted to glass in the HLW vitrification facility for ultimate disposal at an offsite federal repository. At least a portion (~35%) of the LAW will be converted to glass in the LAW vitrification facility and will be disposed of onsite at the Integrated Disposal Facility (IDF). The pretreatment and HLW vitrification facilities will have the capacity to treat and immobilize the wastes destined for each facility. However, a second facility will be needed for the expected volume of additional LAW requiring immobilization. A cementitious waste form known as Cast Stone is being considered to provide the required additional LAW immobilization capacity. The Cast Stone waste form must be acceptable for disposal in the IDF. The Cast Stone waste form and immobilization process must be tested to demonstrate that the final Cast Stone waste form can comply with waste acceptance criteria for the IDF disposal facility and that the immobilization processes can be controlled to consistently provide an acceptable waste form product. Further, the waste form must be tested to provide the technical basis for understanding the long term performance of the waste form in the IDF disposal environment. These waste form performance data are needed to support risk assessment and performance assessment (PA) analyses of the long-term environmental impact of the waste disposal in the IDF. A testing program was developed in fiscal year (FY) 2012 describing in some detail the work needed to develop and qualify Cast Stone as a waste form for the solidification of Hanford LAW (Westsik et al. 2012). Included within Westsik et al. (2012) is a section on the near-term needs to address Tri-Party Agreement Milestone M-062-40ZZ. The objectives of the testing program to be conducted in FY 2013 and FY 2014 are to: • Determine an acceptable formulation for the LAW Cast Stone waste form. • Evaluate sources of dry materials for preparing the LAW Cast Stone. • Demonstrate the robustness of the Cast Stone waste form for a range of LAW compositions. • Demonstrate the robustness of the formulation for variability in the Cast Stone process. • Provide Cast Stone contaminant release data for PA and risk assessment evaluations. The first step in determining an acceptable formulation for the LAW Cast Stone waste form is to conduct screening tests to examine expected ranges in pretreated LAW composition, waste stream concentrations, dry-materials sources, and mix ratios of waste feed to dry blend. A statistically designed test matrix will be used to evaluate the effects of these key parameters on the properties of the Cast Stone as it is initially prepared and after curing. The second phase of testing will focus on selection of a baseline Cast Stone formulation for LAW and demonstrating that Cast Stone can meet expected waste form requirements for disposal in the IDF. It is expected that this testing will use the results of the screening tests to define a smaller suite of tests to refine the composition of the baseline Cast Stone formulation (e.g. waste concentration, water to dry mix ratio, waste loading).

    The Federal government is the largest user of energy in the United States today. The Department of Defense (DOD) uses more than 80{percent} of that energy; the Department of Energy is the second largest user. In the 15 years from 1975 to 1989, {dollar_sign}128 billion was spent for Federal energy activities. In 1989 alone, the Federal government spent a total of {dollar_sign}8.7 billion on energy, of which {dollar_sign}3.5 billion was for buildings and {dollar_sign}2.4 billion was for electricity. The Federal government, which owns or leases 500,000 buildings, provided an additional {dollar_sign}3.9 billion on energy assistance for low-income housing in 1989 (1). Executive Order 12902 (Energy Efficiency and Water Conservation at Federal Facilities) of March 8, 1994 implements and expands the Federal energy management provisions stated in the Energy Policy Act (EPAct) of 1992. The goal is to reduce energy use in Federal buildings to 30{percent} of the 1985 levels by the year 2005. The Federal Energy Management Program (FEMP) has been assigned the responsibility of implementing Executive Order 12902. Subsequently, DOE, FEMP, other Federal agencies and private industry have formed a unique partnership to develop a process and set of actions that will stimulate new opportunities for renewable energy technologies.     The goal of environmental management is to reduce environmental pollution and minimize risks associated with a facility's production, operations and maintenance. An environmental management program oversees the environmental functions within an agency, generally providing guidance and technical support throughout the entire organization. An environmental audit program is a critical component of an agency's ongoing environmental management program. Auditing increasingly is being used as a systematic method for verifying compliance with applicable statutes and regulations, evaluating the effectiveness of environmental management systems already in place, and identifying unregulated risks present at a facility. In essence, environmental auditing provides the data for a facility or agency to prepare a report card to ensure that the goals and objectives of their ongoing environmental program are achieved. The Environmental Protection Agency (EPA) defines environmental auditing as a systematic, documented, periodic and objective review of facility operations and practices related to meeting environmental requirements. In addition, EPA policy encourages all Federal agencies to develop auditing programs and offers technical assistance to help Federal agencies design audit programs. The guidance document is one means by which EPA is following through on its commitment to provide such assistance to other Federal agencies.

    Short-time human travel behaviour can be well described by a power law with respect to distance. We incorporate this information in space-time models for infectious disease surveillance data to better capture the dynamics of disease spread. Two previously established model classes are extended, which both decompose disease risk additively into endemic and epidemic components: a space-time point process model for individual point-referenced data, and a multivariate time series model for aggregated count data. In both frameworks, the power-law spread is embedded into the epidemic component and its decay parameter is estimated simultaneously with all other unknown parameters using (penalised) likelihood inference. The performance of the new approach is investigated by a re-analysis of individual cases of invasive meningococcal disease in Germany (2002-2008), and count data on influenza in 140 administrative districts of Southern Germany (2001-2008).     The Federal Demonstration Project is a cooperative effort between a number of universities, a private research institute, and several federal agencies to increase research productivity by eliminating unnecessary administrative procedures and by streamlining and standardizing needed controls. The Project aims to locate responsibility for decision-making as close as possible to principal investigators while maintaining necessary institutional and agency oversight to ensure accountability. By freeing researchers from some of their paperwork burden, more efficient research administration systems will enable investigators to spend more of their time doing science and engineering. The Federal Demonstration Project is an outgrowth of an earlier activity sponsored by five major federal R D agencies at the Florida State University System and the University of Miami. In Florida, the focus was on standardizing and streamlining procedures for administering research grants after the grants had been awarded to the universities. (See Attachment 1 for descriptions of the demonstrations carried out under the Florida Demonstration Project). In May 1988, the most successful of the demonstrated procedures were approved by the US Office of Management and Budget for use in grants awarded by any federal agency to any research organization. The new procedures give agencies authority to waive requirements that grantees obtain federal approval prior to taking a number of administrative actions with respect to grant management. The FDP institutions together with the participating federal agencies are designing and demonstrating innovative research administration procedures and are assessing the impact of those new procedures.

    In an unprecedented acknowledgement that federal facility cleanup activities face a money crunch, a federal-state advisory panel is preparing a new strategy to avert enforcement showdowns when funding cuts prevent federal agencies from meeting legally required cleanup schedules set by states. In a draft report the panel said states must recognize that some cleanup [open quotes]milestones[close quotes] will have to be delayed due to budget pressures - a concession that will be politically difficult in some states. At the same time, the panel said federal agencies must be more forthcoming in working with states and local groups to determine how increasingly scarce resources will be distributed. As a general rule, the report recommended that federal agencies and state environmental officials agree on a [open quotes]fair share[close quotes] allocation method under which the pain of a budget cutback would be spread equally among all cleanup sites within an affected federal agency. That fair share approach would be altered only if the federal agency reached agreement with states that a funding cutback could be absorbed at selected sites without affecting any cleanup milestone.

    Parabolic-trough solar water heating is a well-proven renewable energy technology with considerable potential for application at Federal facilities. For the US, parabolic-trough water-heating systems are most cost effective in the Southwest where direct solar radiation is high. Jails, hospitals, barracks, and other facilities that consistently use large volumes of hot water are particularly good candidates, as are facilities with central plants for district heating. As with any renewable energy or energy efficiency technology requiring significant initial capital investment, the primary condition that will make a parabolic-trough system economically viable is if it is replacing expensive conventional water heating. In combination with absorption cooling systems, parabolic-trough collectors can also be used for air-conditioning. Industrial Solar Technology (IST) of Golden, Colorado, is the sole current manufacturer of parabolic-trough solar water heating systems. IST has an Indefinite Delivery/Indefinite Quantity (IDIQ) contract with the Federal Energy Management Program (FEMP) of the US Department of Energy (DOE) to finance and install parabolic-trough solar water heating on an Energy Savings Performance Contract (ESPC) basis for any Federal facility that requests it and for which it proves viable. For an ESPC project, the facility does not pay for design, capital equipment, or installation. Instead, it pays only for guaranteed energy savings. Preparing and implementing delivery or task orders against the IDIQ is much simpler than the standard procurement process. This Federal Technology Alert (FTA) of the New Technology Demonstration Program is one of a series of guides to renewable energy and new energy-efficient technologies.

    In all 2d theories of gravity a conservation law connects the (space-time dependent) mass aspect function at all times and all radii with an integral of the matter fields. It depends on an arbitrary constant which may be interpreted as determining the initial value together with the initial values for the matter field. We discuss this for spherically reduced Einstein-gravity in a diagonal metric and in a Bondi-Sachs metric using the first order formulation of spherically reduced gravity, which allows easy and direct fixations of any type of gauge. The relation of our conserved quantity to the ADM and Bondi mass is investigated. Further possible applications (ideal fluid, black holes in higher dimensions or AdS spacetimes etc.) are straightforward generalizations.

    A detailed description is given of the laws and programs of the State of Louisiana governing the regulation of public energy utilities, the siting of energy generating and transmission facilities, the municipal franchising of public energy utilities including attendant problems of cost allocations, rate base and operating expense determinations, and rate of return allowances. These laws and programs are analyzed to identify impediments which they may present to the implementation of Integrated Community Energy Systems (ICES). This report is one of fifty-one separate volumes which describe such regulatory programs at the Federal level and in each state as background to the report entitled Community Energy Systems and the Law of Public Utilities--Volume One: An overview. This report also contains a summary of a strategy described in Volume One--An Overview for overcoming these impediments by working within the existing regulatory framework and by making changes in the regulatory programs to enchance the likelihood of ICES implementation.

    This research focuses on the regulatory politics of mountaintop removal mining for coal within the Appalachian states of West Virginia and Kentucky. Based on Administrative Presidency concepts suggesting that chief executives seek more control and influence over agency program decisions, this article analyzes President George W. Bush's efforts to promote the development of coal resources within these states despite statutory constraints posed by federal environmental laws. The analysis demonstrates that President Bush effectively achieved his energy production goals by combining the use of discretionary authority with staff controls, executive orders, and regulatory initiatives to lessen industry compliance costs with environmental regulatory requirements.

    The enactment of legislation and promulgation of implementing regulations generally involves the resolution of conflicting goals. Defining ``How Clean is Clean?`` in federal and state cleanup laws, regulations, and policies is no exception. Answering the ``How Clean is Clean?`` question has resulted in the identification of some important and sometimes conflicting goals. Continuing resolution of the following conflicting goals is the key to effect cleanup of hazardous waste sites: Expediency vs. Fairness; Flexibility vs. Consistency; Risk Reduction vs. Risk Causation; and Permanence vs. Cost Effectiveness.

    It seems well understood that supercomputer simulation is an enabler for scientific discoveries, weapons, and other activities of value to society. It also seems widely believed that Moore's Law will make progressively more powerful supercomputers over time and thus enable more of these contributions. This paper seeks to add detail to these arguments, revealing them to be generally correct but not a smooth and effortless progression. This paper will review some key problems that can be solved with supercomputer simulation, showing that more powerful supercomputers will be useful up to a very high yet finite limit of around 1021 FLOPS (1 Zettaflops) . The review will also show the basic nature of these extreme problems. This paper will review work by others showing that the theoretical maximum supercomputer power is very high indeed, but will explain how a straightforward extrapolation of Moore's Law will lead to technological maturity in a few decades. The power of a supercomputer at the maturity of Moore's Law will be very high by today's standards at 1016-1019 FLOPS (100 Petaflops to 10 Exaflops), depending on architecture, but distinctly below the level required for the most ambitious applications. Having established that Moore's Law will not be that last word in supercomputing, this paper will explore the nearer term issue of what a supercomputer will look like at maturity of Moore's Law. Our approach will quantify the maximum performance as permitted by the laws of physics for extension of current technology and then find a design that approaches this limit closely. We study a 'multi-architecture' for supercomputers that combines a microprocessor with other 'advanced' concepts and find it can reach the limits as well. This approach should be quite viable in the future because the microprocessor would provide compatibility with existing codes and programming styles while the 'advanced' features would provide a boost to the limits of performance.

    Executive Order 13123 calls for the Federal government to conserve water as well as energy in its 500,000 facilities. To help set priorities among water-saving measures, the Federal Energy Management Program conducted a study of Federal water use in 1997. The study indicated that the government consumes more than 50% of its water in just three types of Federal facilities: housing, hospitals, and office buildings. These facilities have enough kitchens, rest rooms, and laundry areas to provide facility managers with many opportunities to begin reducing their water use (and utility costs) with appropriate water-saving fixtures and products. Therefore, this Federal Technology Alert focuses on domestic technologies, products, and appliances such as water-efficient faucets, showerheads, toilets, urinals, washing machines, and dishwashers. Conserving water also saves the energy needed to treat, pump, and heat that water in homes, businesses, and other buildings.

    The major objective of the baseline glass formulation work was to develop and select glass formulations that are compliant with contractual and processing requirements for each of the LAW waste streams. Other objectives of the work included preparation and characterization of glasses with respect to the properties of interest, optimization of sulfate loading in the glasses, evaluation of ability to achieve waste loading limits, testing to demonstrate compatibility of glass melts with melter materials of construction, development of glass formulations to support ILAW qualification activities, and identification of glass formulation issues with respect to contract specifications and processing requirements.

    Federal legislation allows federal agencies to retain up to 50% of the savings associated with implementing energy efficiency and water conservation measures and practices. Given budget pressures to reduce expenditures, the use of retained savings to fund additional projects represents a source of funds outside of the traditional budget cycle. The Southwest Region Federal Aviation Administration (FAA) has tasked Pacific Northwest National Laboratory (PNNL) to develop a model retained savings program for Southwest Region FAA use and as a prototype for consideration by the FAA. PNNL recommends the following steps be taken in developing a Southwest Region FAA retained savings program: Establish a retained savings mechanism. Determine the level at which the retained savings should be consolidated into a fund. The preliminary recommendation is to establish a revolving efficiency loan fund at the regional level. Such a mechanism allows some consolidation of savings to fund larger projects, while maintaining a sense of facility ownership in that the funds will remain within the region.

    This report documents the recommendations of a working group commissioned by the Federal Energy Management Program (FEMP) in 2002 to identify ways to reduce financing costs in federal energy savings performance contract (ESPC) projects. The working group is part of continuing efforts launched by FEMP since the award of the Department of Energy's (DOE's) Super ESPCs in 1998 and 1999 to ensure that practical, flexible, and cost-effective alternative financing for energy-efficiency improvements is available to all federal agencies. During FY 2002-2004, the working group pursued extensive fact finding, consulted with government and private-sector finance experts, and analyzed data from federal and local government ESPC programs. The working group observed that both competition and transparency were lacking in federal ESPCs. The working group also found that the government often falls short of full compliance with certain provisions of the final rule that codifies the federal ESPC authority into regulation (10 CFR 436), which speak to due diligence in determining fair and reasonable pricing. Based on these findings, the working group formulated their short-term recommendations of actions that agencies can take immediately to reduce ESPC financing costs. The working group recommended requiring competitive solicitation of offers from prospective financiers of ESPC projects, standardization of processes to keep the playing field level and reduce energy service companies (ESCOs) project development costs, and assuring transparency by specifying that the government will see and review all bids. The reforms are intended to enable the government to determine quickly and reliably whether the portion of price related to financing is fair and reasonable and to provide auditable records of the transaction. The working group's recommendations were incorporated into modifications to the Super ESPCs and requirements to be included in the Super ESPC delivery order request for proposal (DO RFP), which is used to tailor delivery orders to the particular needs of the ordering agency and becomes a part of the contract. The financing reforms are summarized.

    The primary objective of this study was to estimate the current life-cycle cost-effective (i.e., economic) energy savings potential in Federal buildings and the corresponding capital investment required to achieve these savings, with Federal financing. Estimates were developed for major categories of energy efficiency measures such as building envelope, heating system, cooling system, and lighting. The analysis was based on conditions (building stock and characteristics, retrofit technologies, interest rates, energy prices, etc.) existing in the late 1990s. The potential impact of changes to any of these factors in the future was not considered.
