Project risk and appeals in U.S. Forest Service planning

The National Environmental Policy Act (NEPA) requires U.S. Forest Service planning processes to be conducted by interdisciplinary teams of resource specialists to analyze and disclose the likely environmental impacts of proposed natural resource management actions on Forest Service lands. Multiple challenges associated with these processes have been a source of frustration for the agency. One of these challenges involves administrative appeals through which public entities can challenge a Forest Service decision following a NEPA process. These appeals instigate an internal review process and can result in an affirmation of the Forest Service decision, a reversal of that decision, or additional work that re-initiates all or part of the NEPA process. We examine the best predictors of appeals and their outcomes on a representative sample of 489 Forest Service NEPA processes that were decided between 2007 and 2009. While certain factors associated with pre-existing social contexts (such as a history of controversy) or pre-determined elements of a proposed action (such as the extraction of forest products) predispose certain processes to a higher risk of appeals, other practices and process-related strategies within the control of the agency also appear to bear meaningful influence on the occurrence of appeals and their outcomes. Appeals and their outcomes were most strongly related to programmatic, structural (turnover of personnel in particular), and relationship risks (both internal and external) within the processes, suggesting the need for greater focus within the agency on cultivating positive internal and external relationships to manage the risk of appeals. -- Highlights: ? We examined appeals and their outcomes on 489 U.S. Forest Service NEPA processes. ? Project type, context, team turnover, and personal relationships predicted appeals. ? External relationship management and staff turnover best predicted appeal outcomes. ? Positive internal and external relationships appear to reduce appeal risks.

Tycho Brahe, the most prominent and accomplished astronomer of his era, made measurements of the apparent sizes of the Sun, Moon, stars, and planets. From these he showed that within a geocentric cosmos these bodies were of comparable sizes, with the Sun being the largest body and the Moon the smallest. He further showed that within a heliocentric cosmos, the stars had to be absurdly large - with the smallest star dwarfing even the Sun. (The results of Tycho's calculations are illustrated in this paper.) Various Copernicans responded to this issue of observation and geometry by appealing to the power of God: They argued that giant stars were not absurd because even such giant objects were nothing compared to an infinite God, and that in fact the Copernican stars pointed out the power of God to humankind. Tycho rejected this argument.

Low emission development strategies (LEDS) articulate policies and implementation plans that enable countries to advance sustainable, climate-resilient development and private sector growth while significantly reducing the greenhouse gas (GHG) emissions traditionally associated with economic growth. In creating a LEDS, policy makers often have access to information on abatement potential and costs for clean energy technologies, but there is a scarcity of economy-wide approaches for evaluating and presenting information on other dimensions of importance to development, such as human welfare, poverty alleviation, and energy security. To address this shortcoming, this paper proposes a new tool for communicating development benefits to policy makers as part of a LEDS process. The purpose of this tool is two-fold: 1. Communicate development benefits associated with each clean energy-related intervention; 2. Facilitate decision-making on which combination of interventions best contributes to development goals. To pilot this tool, the authors created a visual using data on developmental impacts identified through the Technology Needs Assessment (TNA) project in Montenegro. The visual will then be revised to reflect new data established through the TNA that provides information on cost, GHG mitigation, as well as the range and magnitude of developmental impacts.

The Office of Hearings and Appeals (OHA) issued a decision granting in part an appeal from a Freedom of Information Act (FOIA) determination issued by the Office of Information Resources (OIR). The National Security Archive (NSA) filed a FOIA request for documents relating to the Bonn Climate Change talks in August 2010. OIR conducted a search and located one responsive document. NSA challenged the adequacy of the search and the OIR agreed to search the retired records at the Washington National Records Center. Consequently, we remanded this matter to OIR so that a search of those records could be performed.
