    In support of the Weldon Spring Site Remedial Action Project Federal Facilities Agreement, a copy of the Quarterly Environmental Data Summary (QEDS) for the third quarter of 1998 is enclosed. The data presented in this letter and attachment constitute the QEDS. The data, except for air monitoring data and site KPA generated data (uranium analyses), were received from the contract laboratories, verified by the Weldon Spring Site verification group, and merged into the database during the third quarter of 1998. Air monitoring data presented are the most recent complete sets of quarterly data. Significant data, defined as data values that have exceeded defined above normal Level 2 values, are discussed in this letter for Environmental Monitoring Plan (EMP) generated data only. Above normal Level 2 values are based, in ES and H procedures, on historical high values, DOE Derived Concentration Guides (DCGs), NPDES limits, and other guidelines. The procedures also establish actions to be taken in the event that above normal data occur.

    This document summarizes the progress that has been made to date in implementing the plans and schedules for meeting the Federal Facility Agreement (FFA) commitments for the Liquid Low-Level Waste (LLLW) System at Oak Ridge National Laboratory (ORNL). These commitments were initially submitted in ES/ER-17&Dl, Federal Facility Agreement Plans and Schedules for Liquid Low-Level Radioactive Waste Tank Systems at Oak Ridge National Laboratory, Oak Ridge, Tennessee. Information presented in this document provides a comprehensive summary to facilitate understanding of the FFA compliance program for LLLW tank systems and to present plans and schedules associated with remediation, through the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) process, of LLLW tank systems that have been removed from service. ORNL has a comprehensive program underway to upgrade the LLLW system as necessary to meet the FFA requirements. The tank systems that are removed from service are being investigated and remediated through the CERCLA process. Waste and risk characterizations have been submitted. Additional data will be prepared and submitted to EPA/TDEC as tanks are taken out of service and as required by the remedial investigation/feasibility study (RI/FS) process. The plans and schedules for implementing the FFA compliance program that were submitted in ES/ER-17&Dl, Federal Facility Agreement Plans and Schedules for Liquid Low-Level Radioactive Waste tanks Systems at Oak Ridge National Laboratory, Oak Ridge, Tennessee, are updated in this document. Chapter 1 provides general background information and philosophies that lead to the plans and schedules that appear in Chaps. 2 through 5.

    Many Federal Facility Agreement and Consent Order (FFACO) Use Restrictions (URs) have been established at various corrective action sites (CASs) as part of FFACO corrective actions (FFACO, 1996; as amended January 2007). Since the signing of the FFACO in 1996, practices and procedures relating to the implementation of risk-based corrective action (RBCA) have evolved. This document is part of an effort to re-evaluate all FFACO URs against the current RBCA criteria (referred to in this document as the Industrial Sites [IS] RBCA process) as defined in the Industrial Sites Project Establishment of Final Action Levels (NNSA/NSO, 2006c). Based on this evaluation, the URs were sorted into the following categories: 1. Where sufficient information exists to determine that the current UR is consistent with the RCBA criteria 2. Where sufficient information exists to determine that the current UR may be removed or downgraded based on RCBA criteria. 3. Where sufficient information does not exist to evaluate the current UR against the RCBA criteria. After reviewing all the existing FFACO URs, the 49 URs addressed in this document have sufficient information to determine that these current URs may be removed or downgraded based on RCBA criteria. This document presents recommendations on modifications to existing URs that will be consistent with the RCBA criteria.

    This paper discusses compliance agreements that affect the Department of Energy's (DOE) cleanup program. Compliance agreements are legally enforceable documents between DOE and its regulators, specifying cleanup activities and milestones that DOE has agreed to achieve. Over the years, these compliance agreements have been used to implement much of the cleanup activity at DOE sites, which is carried our primarily under two federal laws - the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (CERCLA) and the Resource Conservation and Recovery Act of 0f 1976, as amended (RCRA). Our objectives were to determine the types of compliance agreements in effect at DOE cleanup sites, DOE's progress in achieving the milestones contained in the agreements, whether the agreements allowed DOE to prioritize work across sites according to relative risk, and possible implications the agreements have on DOE's efforts to improve the cleanup program.

    This is a progress report of work carried out under the terms of a research agreement entitled the Canadian Seismic Agreement'' between the US Nuclear Regulatory Commission (USNRC), the Canadian Commercial Corporation and the Geophysics Division of the Geological Survey of Canada (GD/GSC) during the period from July 01, 1989 to June 30, 1990. The Canadian Seismic Agreement'' supports generally the operation of various seismograph stations in eastern Canada and the collection and analysis of earthquake data for the purpose of mitigating seismic hazards in eastern Canada and the northeastern US. The specific activities carried out in this one-year period are summarized below under four headings; Eastern Canada Telemetred Network and local network developments, Datalab developments, strong-motion network developments and earthquake activity. During this period the first surface fault unequivocably determined to have accompanied a historic earthquake in eastern North America, occurred in northern Quebec.

    This is the twenty-first progress report under the agreement entitled Canadian Seismic Agreement between the US Nuclear Regulatory Commission (NRC) and the Canadian Commercial Corporation. Activities undertaken by the Geophysics Division of the Geological Survey of Canada (GD/GSC) during the period from July 01, 1988 to June 30, 1989 and supported in part by the NRC agreement are described below under four headings; Eastern Canada Telemetred Network and local network developments, Datalab developments, strong motion network developments and earthquake activity. In this time period eastern Canada experienced its largest earthquake in over 50 years. This earthquake, which has been christened the Saguenay earthquake, has provided a wealth of new data pertinent to earthquake engineering studies in eastern North America and is the subject of many continuing studies, which are presently being carried out at GD and elsewhere. 41 refs., 21 figs., 7 tabs.

    The Federal Facilities Compliance Act (FFCA, the Act) was signed into law on October 6, 1992, primarily as a means of waiving sovereign immunity for federal facilities with respect to requirements under the Resource Conservation and Recovery Act. DOE`s implementation of the FFCA will have significant effects on current and future DOE waste management operations. DOE will need to rethink its strategy in the area of future compliance agreements to ensure commitments and deliverables are made consistent throughout the different DOE facilities. Several types of agreements that address mixed waste land disposal restriction (LDR) compliance have already been signed by both DOE and the regulators. These agreements are in place at the Hanford Reservation, the Savannah River Site, the Oak Ridge Reservation (Oak Ridge National Laboratory, K-25, Y-12), and the Paducah Gaseous Diffusion Plant. The Rocky Flats Agreement is now being renegotiated. Los Alamos National Laboratory, Sandia/Albuquerque National Laboratory, Lawrence Livermore National Laboratory, and Idaho National Engineering Laboratory agreements are in progress. Major components of the FFCA include provisions on: sovereign immunity waiver; cost reimbursements; mixed waste requirements, including inventory reports on mixed waste and treatment capacity and technologies; and plans for the development of treatment capacities and technologies. Each of these components is discussed within this paper.

    In an unprecedented acknowledgement that federal facility cleanup activities face a money crunch, a federal-state advisory panel is preparing a new strategy to avert enforcement showdowns when funding cuts prevent federal agencies from meeting legally required cleanup schedules set by states. In a draft report the panel said states must recognize that some cleanup [open quotes]milestones[close quotes] will have to be delayed due to budget pressures - a concession that will be politically difficult in some states. At the same time, the panel said federal agencies must be more forthcoming in working with states and local groups to determine how increasingly scarce resources will be distributed. As a general rule, the report recommended that federal agencies and state environmental officials agree on a [open quotes]fair share[close quotes] allocation method under which the pain of a budget cutback would be spread equally among all cleanup sites within an affected federal agency. That fair share approach would be altered only if the federal agency reached agreement with states that a funding cutback could be absorbed at selected sites without affecting any cleanup milestone.

    Executive Order 13123 calls for the Federal government to conserve water as well as energy in its 500,000 facilities. To help set priorities among water-saving measures, the Federal Energy Management Program conducted a study of Federal water use in 1997. The study indicated that the government consumes more than 50% of its water in just three types of Federal facilities: housing, hospitals, and office buildings. These facilities have enough kitchens, rest rooms, and laundry areas to provide facility managers with many opportunities to begin reducing their water use (and utility costs) with appropriate water-saving fixtures and products. Therefore, this Federal Technology Alert focuses on domestic technologies, products, and appliances such as water-efficient faucets, showerheads, toilets, urinals, washing machines, and dishwashers. Conserving water also saves the energy needed to treat, pump, and heat that water in homes, businesses, and other buildings.

    This document was prepared at the request of the U.S. Department of Energy's (DOE's) Federal Energy Management Program (FEMP) under its Technical Guidance and Assistance and Project Financing Programs. The purpose was to provide an estimate of the national potential for combined heat and power (also known as CHP; cogeneration; or cooling, heating, and power) applications at federal facilities and the associated costs and benefits including energy and emission savings. The report provides a broad overview for the U.S. Department of Energy (DOE) and other agencies on when and where CHP systems are most likely to serve the government's best interest. FEMP's mission is to reduce the cost to and environmental impact of the federal government by advancing energy efficiency and water conservation, promoting the use of renewable energy, and improving utility management decisions at federal sites. FEMP programs are driven by its customers: federal agency sites. FEMP monitors energy efficiency and renewable energy technology developments and mounts ''technology-specific'' programs to make technologies that are in strong demand by agencies more accessible. FEMP's role is often one of helping the federal government ''lead by example'' through the use of advanced energy efficiency/renewable energy (EERE) technologies in its own buildings and facilities. CHP was highlighted in the Bush Administration's National Energy Policy Report as a commercially available technology offering extraordinary benefits in terms of energy efficiencies and emission reductions. FEMP's criteria for emphasizing a technology are that it must be commercially available; be proven but underutilized; have a strong constituency and momentum; offer large energy savings and other benefits of interest to federal sites and FEMP mission; be in demand; and carry sufficient federal market potential. As discussed in the report, CHP meets all of these criteria. Executive Order 13123 directs federal facilities to use CHP when life-cycle costs indicate energy reduction goals will be met. FEMP can assist facilities to conduct this analysis. The model developed for this report estimates the magnitude of CHP that could be implemented under various performance and economic assumptions associated with different applications. This model may be useful for other energy technologies. It can be adapted to estimate the market potential in federal buildings for any energy system based on the cost and performance parameters that a user desires to assess. The model already incorporates a standard set of parameters based on available data for federal buildings including total building space, building type, energy use intensity, fuel costs, and the performance of many prime movers commonly used in CHP applications. These and other variables can be adjusted to meet user needs or updated in the future as new data become available.

    Typically, the Federal building stock is referred to as a group of about one-half million buildings throughout the United States. Additional information beyond this level is generally limited to distribution of that total by agency and maybe distribution of the total by state. However, additional characterization of the Federal building stock is required as the Federal sector seeks ways to implement efficiency projects to reduce energy and water use intensity as mandated by legislation and Executive Order. Using a Federal facility database that was assembled for use in a geographic information system tool, additional characterization of the Federal building stock is provided including information regarding the geographical distribution of sites, building counts and percentage of total by agency, distribution of sites and building totals by agency, distribution of building count and floor space by Federal building type classification by agency, and rank ordering of sites, buildings, and floor space by state.     The Pacific Northwest National Laboratory has researched how participating countries divide funding obligations under International Energy Agency (IEA) Implementing Agreements (IAs). This is part of a broader assessment evaluating the buildings-area IAs. This particular part of the analysis looked at 12 IAs funded by the U.S. Department of Energy. By selecting a range of agreements, we hoped to understand the types of arrangements and the range of funding formulas. PNNL asked the U.S. Executive Committee (ExCo) members how the total contribution for their IA and its Annexes were determined, and how the total was then divided between participating countries.

    Since early 1984, FEMP has examined a number of innovative techniques for financing energy efficiency improvements in Federal facilities. Having identified a number of legal and procurement barriers to shared savings contracting by Federal agencies, FEMP set out to identify and explore possible solutions. Currently, it has narrowed in on three specific options which represent potentially viable approaches to Federal energy financing: (1) removing regulatory and institutional barriers to energy services contracts with the private sector; (2) implementing energy services agreements at Government Owned Contractor Operated (GOCO) facilities; and (3) establishing a government financial corporation to fund agency energy conservation investments. These possible solutions are discussed in the report. The third possibility is regarded as unlikely.

    The U.S. Department of Energy-Oak Ridge Operations (DOE-ORO) EM Program adopted a watershed approach for performing Remedial Investigations (RIs) and characterizations for ORR because it is an effective system for determining the best methods for protecting and restoring aquatic ecosystems and protecting human health. The basic concept is that water quality and ecosystem problems are best solved at the watershed level rather than at the individual water-body or discharger level. The watershed approach requires consideration of all environmental concerns, including needs to protect public health, critical habitats such as wetlands, biological integrity, and surface and ground waters. The watershed approach provides an improved basis for management decisions concerning contaminant sources and containment. It allows more direct focus by stakeholders on achieving ecological goals and water quality standards rather than a measurement of program activities based on numbers of permits or samples. The watershed approach allows better management strategies for investigations, therefore maximizing the utilization of scarce resources. Feasibility studies (FSs) evaluate various alternatives in terms of environmental standards, the protection of human health and the environment, and the costs of implementation to find the optimum solution among them. Society has to decide how much it is willing to spend to meet the standards and to be protective. Conducting FSs is the process of trading off those criteria to pick that optimum point that society wants to achieve. Performing this analysis at the watershed scale allows those trade-offs to be made meaningfully. In addition, a Land Use Control Assurance Plan for the ORR was prepared to identify the strategy for assuring the long-term effectiveness of land use controls. These land use controls will be relied upon to protect human health and the environment at areas of the ORR undergoing remediation pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act and/or the Resource Conservation and Recovery Act. This plan will be implemented by means of a Memorandum of Understanding (MOU) incorporating its terms with the United States EPA and TDEC. The majority of projects described in this report are grouped into five watersheds. They are the East Tennessee Technical Park (ETTP) Watershed (formerly the K-25 Site), the Melton Valley (MV) and Bethel Valley (BV) Watersheds at the Oak Ridge National Laboratory (ORNL), and the Bear Creek Valley (BCV) and Upper East Fork Poplar Creek (UEFPC) Watersheds at the Y-12 Plant.

    The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.

    This book presents the findings of a four-year study of the impact of federal court decisions on the policies and administration of the US Environmental Protection Agency (EPA) in all seven of its major statutory areas: clean air, clean water, hazardous waste cleanup, controlled pesticide use, resource conservation and recovery, safe drinking water, and control of toxic substances. The author use the Lexis and Westlaw legal data bases to generate a list of all cases in which the EPA was either a plaintiff or a defendant in each of the agency's seven major statutory areas. The author verified these data and at times supplemented them with EPA records and with environmental reporters published by the Bureau of National Affairs and the Environmental Law Institute. She derived settlement agreements from the EPA, the Department of Justice, and the courts.

    This paper argues that cooperative monitoring plays a critical role in the implementation of regional security agreements and confidence building measures. A framework for developing cooperative monitoring options is proposed and several possibilities for relating bilateral and regional monitoring systems to international monitoring systems are discussed. Three bilateral or regional agreements are analyzed briefly to illustrate different possibilities. These examples illustrate that the relationship of regional or bilateral arms control or security agreements to international agreements depends on a number of factors: the overlap of provisions between regional and international agreements; the degree of interest in a regional agreement among the international community; efficiency in implementing the agreement; and numerous political considerations. Given the importance of regional security to the international community, regions should be encouraged to develop their own infrastructure for implementing regional arms control and other security agreements. A regional infrastructure need not preclude participation in an international regime. On the contrary, establishing regional institutions for arms control and nonproliferation could result in more proactive participation of regional parties in developing solutions for regional and international problems, thereby strengthening existing and future international regimes. Possible first steps for strengthening regional infrastructures are identified and potential technical requirements are discussed.

    Currently, the Federal government coordinates the planning and operation of the Federal Columbia River Power System (FCRPS) with projects owned and operated by the region`s non-Federal hydrogenerating utilities pursuant to the Pacific North-west Coordination Agreement (PNCA). The Bureau of Reclamation (Reclamation), the Corps of Engineers (Corps), and the Bonneville Power Administration (BPA) are parties to the PNCA on behalf of the government of the United States. The PNCA is a complex agreement that provides an opportunity for the region`s power producers to maximize the power system`s reliability and economy while meeting their multiple-use objectives. The PNCA does not dictate the operation of the resources it coordinates. It is essentially an accounting mechanism that exchanges the power produced among the parties in order to improve the reliability of the system and reduce regional power costs. Project owners retain complete autonomy to operate as needed to meet their multiple-use requirements. The PNCA was executed in 1964 as an important component of regional plans to maximize the Northwest`s hydro resource capability. Maximization also included the development of storage projects on the Columbia River in Canada pursuant to the terms of the 1964 Columbia River Treaty. Because of the link between power coordination and Treaty issues, the current parties to the PNCA, currently are contemplating entering into a replacement or renewed power coordination agreement. Because the power coordination agreement is a consensual arrangement, its ultimate provisions must be acceptable to all of its signatories. This Appendix R to the Final Environmental Impact Statement of the Columbia River System is a presentation of the Pacific North-west Coordination Agreement.

    In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources.     Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    In a ''green roof,'' a layer of vegetation (e.g., a roof garden) covers the surface of a roof to provide shade, cooler indoor and outdoor temperatures, and effective storm-water management to reduce runoff. The main components are waterproofing, soil, and plants. There are two basic kinds: intensive and extensive. An intensive green roof often features large shrubs and trees, and it can be expensive to install and maintain. An extensive green roof features shallow soil and low-growing, horizontally spreading plants that can thrive in the alpine conditions of many rooftops. These plants do not require a lot of water or soil, and they can tolerate a significant amount of exposure to the sun and wind. This Federal Technology Alert focuses on the benefits, design, and implementation of extensive green roofs and includes criteria for their use on federal facilities.

    Network-centric systems that depend on mobile wireless ad hoc networks for their information exchange require detailed analysis to support their development. In many cases, this critical analysis is best provided with high-fidelity system simulations that include the effects of network architectures and protocols. In this research, we developed a high-fidelity system simulation capability using an HLA federation. The HLA federation, consisting of the Umbra system simulator and OPNET Modeler network simulator, provides a means for the system simulator to both affect, and be affected by, events in the network simulator. Advances are also made in increasing the fidelity of the wireless communication channel and reducing simulation run-time with a dead reckoning capability. A simulation experiment is included to demonstrate the developed modeling and simulation capability.

    The impact of DOE's Current Federal Program on the commercialization of hydrothermal resources between 1980 and 2000 is analyzed. The hydrothermal resources of the United States and the types of DOE activities used to stimulate the development of these resources for both electric power and direct heat use are described briefly. The No Federal Program and the Current Federal Program are then described in terms of funding levels and the resultant market penetration estimates through 2000. These market penetration estimates are also compared to other geothermal utilization forecasts. The direct benefits of the Current Federal Program are next presented for electric power and direct heat use applications. An analysis of the external impacts associated with the additional hydrothermal resource development resulting from the Current Federal Program is also provided. Included are environmental effects, national security/balance-of-payments improvements, socioeconomic impacts and materials requirements. A summary of the analysis integrating the direct benefits, external impacts and DOE program costs concludes the report.

    This paper proposes that strengthening regional capabilities for formulating and implementing arms control and confidence-building measures is a tangible method of enhancing regional security. It discusses the importance of developing a regional infrastructure for arms control and confidence building and elucidates the role of technology in facilitating regional arms control and confidence-building agreements. In addition, it identifies numerous applications for regional cooperative monitoring in the areas of arms control, resource management, international commerce and disaster response. The Cooperative Monitoring Center at Sandia National Laboratories, whose aim is to help individual countries and regions acquire the tools they need to develop their own solutions to regional problems, is discussed briefly. The paper ends with recommendations for establishing regional cooperative monitoring centers.

    During April 1 st , 1998 to June 31 st , 1998, significant work was done in preparation for a series of test involving cofiring at power plants. A biomass material handling system was designed for the Seward testing, a gasification system was designed for the Allen Fossil Plant, and a test program plan was developed for testing at NIPSCO?s Bailly Station. Also completed this quarter was a cyclone combustion model that provides a color visual representation of estimated temperatures within a plant. This report summarizes the activities during the second quarter in 1998 of the FETC/EPRI Biomass Cofiring Cooperative Agreement. It focuses upon reporting the results of testing in order to highlight the progress at utilities.

    This report summarizes the broad range of activities that are focused on meeting the President's Executive Order on Federal Energy Management promulgated to meet energy savings goals and encourage more efficient management of all federal energy resources. These activities are reported semiannually under the auspices of the Federal Energy Resource Modernization (FERM) Coordinating Committee, and as such include activities undertaken from April 1, 1992, through September 30, 1992. The activities reported are classified into four major categories: (1) technology-base support, which includes development of processes, software, metering and monitoring equipment and strategies, and other tools for federal energy managers to better understand and characterize their energy resources; (2) federal energy systems testing and monitoring; (3) federal energy systems revitalization projects at federal installations in cooperation with the utilities serving the sites; and (4) energy supply, distribution and end-use conservation assessment for federal agencies and/or facilities. Lighting systems and air conditioning projects at federal facilities, especially military bases are updated.

    The Morgantown Energy Technology Center (METC) is always interested in discussing partnering opportunities with those in the private sector. One way METC can work with the private sector and academia is through Cooperative Research and Development Agreements (CRADAs). From METC`s perspective, a good CRADA consists of two elements: a good project and a good CRADA partner. Good CRADA projects address goals that are beneficial to both the private sector participant and METC. Of primary interest to METC is the development and deployment of clean, efficient power generation technologies and environmental remediation technologies. For power generation, METC`s primary focus is on Integrated Gasification Combined Cycle (IGCC)systems, Pressurized Fluidized-Bed Combustion (PFBC) systems, Advanced Turbine Systems (ATS), Externally Fired Combined-Cycle (EFCC) power systems, fuel cell systems, and fuels technology systems. METC`s environmental remediation interests focus on the development of high-payoff technologies to clean up the inventory of DOE nuclear component manufacturing sites, and to manage DOE-generated waste faster, safer, and cheaper than environmental cleanup technologies that are currently available. Regarding CRADA partners, preference is given to small businesses and to business units located in the United States which agree that products resulting from the CRADA will be manufactured substantially in the United States.

    This final report summarizes the accomplishments of the 6-year Environmental Management Cooperative Agreement (EMCA) between the Energy and Environmental Research Center (EERC), a nonprofit, contract-supported unit of the University of North Dakota, and the U.S. Department of Energy (DOE) National Energy Technology Laboratory (NETL). The first portion of the report summarizes EMCA's structure, activities, and accomplishments. The appendix contains profiles of the individual EMCA tasks. Detailed descriptions and results of the tasks can be found separately in published Final Topical Reports. EMCA (DOE Contract No. DE-FC21-94MC31388) was in place from the fall of 1994 to the summer of 2001. Under EMCA, approximately $5.4 million was applied in three program areas to expedite the commercialization of 15 innovative technologies for application in DOE's EM Program ($3.8 million, or 69% of funds), provide technical support to the Deactivation and Decommissioning Focus Area (DDFA; $1.04 million, or 19% of funds), and provide for the coordination of the EMCA activities ($0.62 million, or 11% of funds). The following sections profile the overall accomplishments of the EMCA program followed by a summary of the accomplishments under each of the EMCA areas: commercialization, DDFA technical support, and management. Table 1 provides an overview of EMCA, including program areas, program activities, the duration and funding of each activity, and the associated industry partner, if appropriate.

    The Federal government is the largest user of energy in the United States today. The Department of Defense (DOD) uses more than 80{percent} of that energy; the Department of Energy is the second largest user. In the 15 years from 1975 to 1989, {dollar_sign}128 billion was spent for Federal energy activities. In 1989 alone, the Federal government spent a total of {dollar_sign}8.7 billion on energy, of which {dollar_sign}3.5 billion was for buildings and {dollar_sign}2.4 billion was for electricity. The Federal government, which owns or leases 500,000 buildings, provided an additional {dollar_sign}3.9 billion on energy assistance for low-income housing in 1989 (1). Executive Order 12902 (Energy Efficiency and Water Conservation at Federal Facilities) of March 8, 1994 implements and expands the Federal energy management provisions stated in the Energy Policy Act (EPAct) of 1992. The goal is to reduce energy use in Federal buildings to 30{percent} of the 1985 levels by the year 2005. The Federal Energy Management Program (FEMP) has been assigned the responsibility of implementing Executive Order 12902. Subsequently, DOE, FEMP, other Federal agencies and private industry have formed a unique partnership to develop a process and set of actions that will stimulate new opportunities for renewable energy technologies. If these Federal initiatives are successful, substantial investment in renewable and energy efficiency technologies will be stimulated, an important portion of the nation{close_quote}s energy needs will be supplied, and a significant reduction in greenhouse gas emissions will be achieved. {copyright} {ital 1996 American Institute of Physics.}

    The Federal Demonstration Project is a cooperative effort between a number of universities, a private research institute, and several federal agencies to increase research productivity by eliminating unnecessary administrative procedures and by streamlining and standardizing needed controls. The Project aims to locate responsibility for decision-making as close as possible to principal investigators while maintaining necessary institutional and agency oversight to ensure accountability. By freeing researchers from some of their paperwork burden, more efficient research administration systems will enable investigators to spend more of their time doing science and engineering. The Federal Demonstration Project is an outgrowth of an earlier activity sponsored by five major federal R D agencies at the Florida State University System and the University of Miami. In Florida, the focus was on standardizing and streamlining procedures for administering research grants after the grants had been awarded to the universities. (See Attachment 1 for descriptions of the demonstrations carried out under the Florida Demonstration Project). In May 1988, the most successful of the demonstrated procedures were approved by the US Office of Management and Budget for use in grants awarded by any federal agency to any research organization. The new procedures give agencies authority to waive requirements that grantees obtain federal approval prior to taking a number of administrative actions with respect to grant management. The FDP institutions together with the participating federal agencies are designing and demonstrating innovative research administration procedures and are assessing the impact of those new procedures.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services obtained through conventional procurements. While claims of excessive prices are largely unsubstantiated and based on anecdotal evidence, the perception that there is a problem is shared by many in the ESPC community and has been noted by auditors and oversight organizations. The Price Reasonableness Working Group determined that a more formal emphasis on FAR 15.404-1 in the ESPC process could remove much of the doubt about price reasonableness determinations. The working group's recommended consensus policy on price reasonableness stresses the price analysis techniques described in the FAR that are applicable to ESPCs and includes guidance for agencies use of these techniques in determining price reasonableness for their ESPC delivery orders. The recommended policy and guidance, if communicated to federal ESPC stakeholders, can ensure that agencies will comply with the FAR in awarding ESPCs, obtain fair and reasonable prices and best value for the government, and follow procedures that provide auditable documentation of due diligence in price reasonableness determinations.

Over the four years covered in this document, the Alliance To Save Energy conducted liaison with the private sector through our Federal Energy Productivity Task Force. In this time, the Alliance held several successful workshops on the uses of metering in Federal facilities and other meetings. We also conducted significant research on energy efficiency, financing, facilitated studies of potential energy savings in energy intensive agencies, and undertook other tasks outlined in this report.

    The purpose of the analysis is to identify and quantify Federal incentives that have increased the consumption of coal, oil, natural gas, and electricity. The introductory chapter is intended as a device for presenting the policy questions about the incentives that can be used to stimulate desired levels of energy development. In the theoretical chapter federal incentives were identified for the consumption of energy as Federal government actions whose major intent or result is to stimulate energy consumption. The stimulus comes through changing values of variables included in energy demand functions, thereby inducing energy consumers to move along the function in the direction of greater quantity of energy demanded, or through inducing a shift of the function to a position where more energy will be demanded at a given price. The demand variables fall into one of six categories: price of the energy form, price of complements, price of substitutes, preferences, income, and technology. The government can provide such incentives using six different policy instruments: taxation, disbursements, requirements, nontraditional services, traditional services, and market activity. The four major energy forms were examined. Six energy-consuming sectors were examined: residential, commercial, industrial, agricultural, transportation, and public. Two types of analyses of incentive actions are presented in this volume. The generic chapter focused on actions taken in 1978 across all energy forms. The subsequent chapters traced the patterns of incentive actions, energy form by energy form, from the beginning of the 20th century, to the present. The summary chapter includes the results of the previous chapters presented by energy form, incentive type, and user group. Finally, the implications of these results for solar policy are presented in the last chapter. (MCW)
