    In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    To achieve a more stringent ambient-air ozone standard promulgated in 1997, the U.S. EPA has established summer NOx emissions limits for fossil-fired electric power generating units in the Ozone Transport Rulemaking region, consisting of 22 eastern and midwestern states and the District of Columbia. These jurisdictions are required to submit State Implementation Plans by September 1999 in response to EPA's rule, with compliance required by 2007. There are 1757 affected units in this region. In the present study, projected state-by-state growth rates for power production are used to estimate power production and NOx emissions by unit in the year 2007. NOx emissions reductions expected by January 1, 2000 due to Title IV compliance are estimated, leaving a substantial balance of emissions reductions to be achieved by post-combustion NOx control. Cost estimates are developed for achieving these remaining reductions.

    This Record of Decision (ROD) Amendment documents the U.S. Environmental Protection Agency`s (EPA`s) selection of a modified remedy for the Renora, Inc. site. The initial ROD for the Renora site included the excavation and off-site disposal of soils contaminated with polychlorinated biphenyls, (PCBs) and biodegradation of PAH-contaminated soils. The first phase of the remedy, involving the PCB-contaminated soils, has been completed. Therefore, the remedy will be modified to include the removal of surface soils contaminated with PAHs.

    The Weldon Spring Quarry is one of two noncontiguous areas that constitute the US Department of Energy`s (DOE) Weldon Spring site. The main area of the site is the chemical plant. Both areas are located in St. Charles County, Missouri, about 48 km (30 mi) west of St. Louis. The US Environmental Protection Agency (EPA) listed the quarry on the National Priorities List (NPL) in 1987, and the chemical plant area was added to the list in 1989. The quarry is about 6.4 km (4 mi) south-southwest of the chemical plant area; it is accessible from State Route 94 and is currently fenced and closed to the public. The quarry is approximately 300 m (1,000 ft) long by 140 m (450 ft) wide and covers an area of approximately 3.6 ha (9 acres). The quarry was used by the Army for disposal of chemically contaminated (explosive) materials in the 1940s and was later used for the disposal of radioactively contaminated material by the Atomic Energy Commission (AEC) in the 1960s. Approximately 110,000 m{sup 3} (144,000 yd{sup 3}) of soil and waste material was removed from the quarry and transported to the chemical plant area as part of completing the remedial action stipulated in the Record of Decision (ROD) for the Quarry Bulk Waste Operable Unit (DOE 1990). Bulk waste removal was completed in October 1995. These wastes have been placed in the disposal cell at the chemical plant. Prior to bulk waste removal, contaminated water contained in the quarry pond was also removed; approximately 170 million liters (44 million gal) have been treated as of March 1998.

    The Forest Glen Subdivision site consists of 21 acres of developed residential properties and undeveloped land in Niagara Fall, Niagara County, New York. Land in the area surrounding the Forest Glen subdivision is used for residential and industrial purposes, including a mobile home park, small shopping mall, and the CECOS Landfill. Chemical companies reportedly disposed of wastes onsite from the early 1950s to the early 1970s. Sampling by EPA's Field Investigation Team revealed the presence of high concentrations of unknown and tentatively identified compounds (TICs) in August 1987, and further soil sampling was conducted to identify the TICs. EPA has executed interim measures to stabilize site conditions including collecting, staging, and securing drums in areas north and east of the subdivision and temporarily covering visibily contaminated soil with concrete. The remedial activity is the first of two planned operable units and addresses resident relocation only. A subsequent operable unit will address the remediation of site contamination once the relocation is complete.

The major goal of these cleanup activities is to address the most serious threats at the Wrigley Charcoal Site by removing contaminated media from the Primary Site flood plain, remediating wastes at the Storage Basin, and through limited access restrictions at the Primary Site and the Storage Basin.     What the EPA, working jointly with the states, hopes to accomplish over the next ten years in order to integrate and coordinate all the groundwater programs within the agency is discussed. Although many other EPA programs such as Superfund, Clean Air Act, and Wetlands Management are often highlighted in the media, EPA does not down rate the importance of groundwater protection. Indeed as a resource, it is one of the most important commodities. Groundwater is the basis for life in this country. Recharge rates are no where near what the withdrawal rates are in many areas of the country. Twenty-five percent of all the potable water comes from groundwater. Groundwater supplies 50 percent of the needs for all the US population. If you include strictly rural areas, it supplies 95 percent of all the use. Something that most people who are not groundwater hydrologists would not think about is the fact that groundwater is a recharge mechanism that provides over 30 percent of the flow in streams and major rivers.

    The 82.6-acre Naval Industrial Reserve Ordnance Plant (NIROP) site is a weapons system manufacturing facility in Fridley, Minnesota, which began operations in 1940. The site is a government-owned, contractor-operated, plant located just north of the FMC Corp. During the 1970s, paint sludge and chlorinated solvents were disposed of onsite in pits and trenches. In 1981, State investigations identified TCE in onsite water supply wells drawing from the Prairie DuChien/Jordan aquifer, and the wells were shut down. In 1983, EPA found drummed waste in the trenches or pits at the northern portion of the site, and as a result, during 1983 and 1984, the Navy authorized an installation restoration program, during which approximately 1,200 cubic yards of contaminated soil and 42 drums were excavated and landfilled offsite. The Record of Decision (ROD) addresses the remediation of a shallow ground water operable unit. The primary contaminants of concern affecting the ground water are VOCs including PCE, TCE, toluene, and xylene.

    The Seymour Recycling Corporation (SRC) site, encompassing a fourteen-acre area, is approximately two miles southwest of Seymour, Indiana. SRC and its corporate predecessor, Seymour Manufacturing Company, processed, stored, and incinerated chemical wastes at the site from about 1970 to early 1980. The facility was closed when SRC failed to comply with a 1978 agreement with the State of Indiana to cease receiving wastes and to institute better waste-management practices. In 1980, several thousand drums were removed from the site by two potentially responsible parties (PRPs). In 1981, the U.S. EPA removed chemicals from tanks at the site and disposed of those wastes offsite. A 1982 Consent Decree with potential PRPs resulted in the removal, between December 1982 and January 1984, of approximately 50,000 drums, 100 storage tanks and the first foot of contaminated soil from about 75 percent of the site's surface.     The Environmental Protection Agency's (EPA) Region 5 Chicago Regional Laboratory (CRL) developed a method titled Analysis of Diisopropyl Methylphosphonate, Ethyl Hydrogen Dimethylamidophosphate, Isopropyl Methylphosphonic Acid, Methylphosphonic Acid, and Pinacolyl Methylphosphonic Acid in Water by Multiple Reaction Monitoring Liquid Chromatography/Tandem Mass Spectrometry: EPA Version MS999. This draft standard operating procedure (SOP) was distributed to multiple EPA laboratories and to Lawrence Livermore National Laboratory, which was tasked to serve as a reference laboratory for EPA's Environmental Reference Laboratory Network (ERLN) and to develop and validate analytical procedures. The primary objective of this study was to validate and verify the analytical procedures described in EPA Method MS999 for analysis of the listed phosphonic acids and surrogates in aqueous samples. The gathered data from this validation study will be used to: (1) demonstrate analytical method performance; (2) generate quality control acceptance criteria; and (3) revise the SOP to provide a validated method that would be available for use during a homeland security event. The data contained in this report will be compiled, by EPA CRL, with data generated by other EPA Regional laboratories so that performance metrics of EPA Method MS999 can be determined.

    The Ozone Transport Commission`s (OTC) Nitrogen Oxides (NO{sub x}) Budget Program will implement the emissions reduction goal of the 1994 Memorandum of Understanding between its twelve member states and the District of Columbia. The program will achieve its significant NO{sub x} reductions from electric utilities and industrial boilers using a {open_quotes}cap-and-trade{close_quotes} approach modeled after the US Environmental Protection Agency`s sulfur dioxide emissions trading under the Acid Rain Program. The similarity of the two programs has led to the development of an important partnership between the OTC states and EPA`s Acid Rain Division, Over the past two years, Acid Rain Program staff have shared their technical expertise and assisted extensively in the development of the program`s rules. Leveraging the investment EPA made in the systems used to run the Acid Rain Program, the OTC states have asked the Acid Rain Division to administer the data systems for them, and together are working to expand its existing Emissions Tracking System and to modify a clone of the sulfur dioxide Allowance Tracking System, to fulfill the unique requirements of the NO{sub x} Budget Program. This partnership is an important example of the new type of cooperation and sharing of expertise and resources that should develop between EPA and states as they launch multi-state programs to address regional pollution problems that defy a single-state solution.

    The 40-acre Chemsol site is a former solvent recovery and waste reprocessing facility in Piscataway Township, Middlesex County, New Jersey. Land use in the area is predominantly commercial and residential, with an onsite marshy area that may be considered a wetlands. The site overlies a bedrock aquifer that is used as a regional drinking water source. Between 1980 and 1990, sampling of residential wells indicated the presence of organic contaminants and PCBs. The Record of Decision (ROD) provides an interim remedy to restrict the offsite migration of highly contaminated ground water. The primary contaminants of concern affecting the ground water are VOCs including benzene, toluene, and xylenes; other organics including pesticides and phenols; and metals including arsenic, chromium, and lead. The selected remedial action for this interim remedy includes installing a ground water collection trench; installing three ground water extraction wells to a depth of 130 feet; constructing an onsite treatment plant and treating contaminated ground water using air stripping, biological filtration, and activated carbon adsorption.

    The Native American multimedia program was developed to facilitate the U.S. Environmental Protection Agency`s (EPA`s) partnership with tribes in the delivery of environmental programs on reservation lands and to enhance the EPA`s ability to carry out its trust responsibility to the tribes. By providing the means for each tribe to employ its own environmental specialist, the multimedia program helps provide the foundation necessary to build environmental infrastructure for the protection of Native American lands and people and for the development of more rigorous medium-specific programs. The multimedia program began in 1991 with two pilot projects on the Bad River Chippewa Reservation, Wisconsin, and the Wind River Reservation, Wyoming. Expanded in 1992, Region 5 awarded ten multimedia cooperative agreements. At the time, Region 5 made the commitment to fund all reservations within the region, and by end of fiscal year 1993, 24 agreements brought the program to all 29 tribes. This has been a monumental effort, possible only by coupling fiscal year 1993`s funding from the Office of Federal Activities ($599050) with the region`s own reprogramming efforts ($510000).

    The 6,000-acre Anaconda Smelter site is a former copper and ore processing facility in Deer Lodge County, Montana. Land use in the area is predominantly residential. The site is bounded on the north and east, respectively, by the Warm Springs Creek and Mill Creek, both of which are potential sources of drinking water. From 1884 until 1980 when activities ceased, the site was used for ore processing and smelting operations. In 1988, EPA conducted an investigation to determine the nature and extent of the flue dust contamination. A 1988 ROD addressed the Mill Creek Operable Unit (OU15) and documented the relocation of residents from the community surrounding the smelter site as the selected remedial action. The Record of Decision (ROD) addresses the Flue Dust Operable Unit (OU11). The primary contaminants of concern affecting this site from the flue dust materials are metals including arsenic, cadmium, and lead. The selected remedial action for the site is included.

    Today's rapidly developing and changing technologies and industrial practices frequently carry with them the increased generation of wastes and materials which, if improperly managed, may threaten public health and the environment. The US Environmental Protection Agency is charged with the mission of protecting public health and the environment from the hazards posed by these wastes and materials. As part of its effort to achieve this mandate, it has recently adopted a Pollution Prevention Program. Among other things, the program encourages the development and adoption of processing technologies and products that will lead to reducing the aggregate generation rates for pollutants entering the environment. This paper will address EPA's efforts under its Pollution Prevention Program. The paper will address regulatory and non-regulatory action EPA has taken pursuant to the Resource Conservation and Recovery Act (RCRA), the Emergency Planning and Community Right-to-Know Act, the Pollution Prevention Act of 1990, and other Federal statutes. In addition, the paper will present case studies in pollution prevention.

    The 11-acre Coleman-Evans Wood Preserving site is a former wood treatment facility, which was operated from 1954 to the late 1980s, in the community of Whitehouse, Duval County, Florida. Prior to 1970, wastewater from the facility was precipated and discharged to the onsite drainage ditch. The precipitated sludge was deposited into two unlined pits until 1970, when the sludge was stored in tanks. The wastewater treatment process was also enhanced in 1970 with lime precipitation and chlorination. In 1980, onsite ground water contamination was detected and activated charcoal filters were added to the treatment process to remove organics. The primary contaminant in onsite soil and ground water has been identified as pentachlorophenol (PCP). The highest areas of PCP concentration were in the vicinity of onsite chemical tanks and the unlined pit areas. In 1985, EPA conducted an emergency response, which included excavating and disposing of pit material offsite and filling excavated areas with clean fill. The Record of Decision (ROD) amends a 1986 ROD, which documented the selection of incineration for an estimated 9,000 cubic yards of contaminated soil. Since that time, additional studies during the remedial design phase indicated that there are approximately 27,000 cubic yards of contaminated soil. Based on the excessive volume of soil and the high cost of incineration, treatability studies were conducted and an alternative source control treatment was selected. The primary contaminants of concern affecting the soil, sediment, and ground water are organics including PCP and metals.

    The 7-acre Whitehouse Waste Oil Pits site was used by Allied Petroleum Products (Allied) to dispose of acidic waste oil sludges from its oil reclamation process in Whitehouse, Duval County, Florida. A cypress swamp system and residential area are immediately adjacent to the site. The acid sludge produced in the first step and clay used to decolorize the oil were dumped into the unlined pits at the site. A 1985 ROD addressed source control as a containment remedy consisting of a slurry wall construction, soil cap, and a ground water recovery and treatment system; however, EPA has re-evaluated the 1985 ROD selection and determined that the containment remedy failed to meet the requirements of SARA. As a result, the ROD Amendment focuses on an alternative for treating Whitehouse wastes by eliminating direct contact risk associated with pit soil/sludge wastes and preventing contaminated ground water in the surficial aquifer from migrating laterally. The primary contaminants of concern that affect the soil, sediment, surface water, and ground water are VOCs, including benzene, toluene, and xylenes; organics, including PCBs and phenols; and metals, including arsenic, chromium, and lead. The amended remedial action for the site are included.

    The 200-acre Kin-Buc Landfill consists of several inactive disposal areas and is located in Edison Township, Middlesex County, New Jersey. Land use in the area is predominantly industrial and commercial, with some residences within 2 miles north of the site. No drinking water supply wells are located within a 2-mile radius of the site. As a result of an oil spill in 1976, EPA conducted an investigation of the property. In 1980, clean-up activities were initiated under the Clean Water Act and included removal, treatment, and disposal of leachate and drummed waste. The ROD addresses a final remedy for OU2 consisting of the sediment and groundwater in the Edmonds Creek wetlands area, Mill Brook/Martins Creek, Mound B, and the low-lying area. The primary contaminants of concern affecting the sediment and ground water are VOCs, including benzene and xylenes; other organics, including PAHs, PCBs, and pesticides; and metals, including arsenic and lead. The selected remedy for the site are included.

It has also has been proposed that gasoline refiners lower the volatility of commercial fuels in summer to reduce vehicle evaporative emissions. EPA said nationwide emissions of volatile organic compounds (VOC), a major contributor to the formation of urban ozone, could be reduced as much as 10% under the proposed pollution-control measures.

    The decision document presents the selected remedial action for the Muscoy Plume Operable Unit, Newmark Groundwater Contamination Superfund site. The Muscoy Plume OU is an interim action focusing on contamination in the underground water supply in the Bunker Hill Basin of San Bernardino, west of the Shandin Hills. The remedy involves groundwater extraction (pumping) and treatment of 6,200 gallons per minute (gpm) in San Bernardino at the leading edge of the contaminant plume. All the extracted contaminated groundwater shall be treated to remove Volatile Organic Compounds (VOCs) by either of two proven treatment technologies: granular activated carbon (GAC) filtration or air stripping. The treated water will be transferred to a public water supply agency for distribution. Groundwater monitoring wells will be installed and sampled regularly to help evaluate the effectiveness of the remedy.

    In December 1993, the US Environmental Protection Agency (EPA) released its final rule that sets for the details for requirements to sell reformulated gasoline (RFG) in certain ozone non-attainment areas. At the same time, EPA also issued a proposed rule to require that 30% of the oxygen required in RFG be based on a renewable oxygenate. Renewables include ethanol and its ether derivatives such as ethyl tertiary butyl ether (ETBE). The RFG rule is a final rule, while the Renewable Oxygenate Requirement (ROR) rule is a proposed rule yet to be finalized and subject to revision. Included in this paper are brief reviews of Ashland petroleum Company`s ethanol usage, oxygenated fuel and reformulated gasoline blending economics, and some comments on the EPA proposed renewable oxygenate requirement.

    EPA on Nov. 16, 1990, issued stormwater discharge regulations associated with industrial activity'' under the authority of CWA's National Pollutant Discharge Elimination System (NPDES). Those regulations established NPDES permit application requirements for industrial and certain municipal separate stormwater discharge systems. Three permit application options were made available for industrial stormwater discharges -- filing an individual application, becoming a participant in a group application or filing a notice of intent to be covered under a general permit and its requirements. The Agency of Nov. 19 proposed a draft general permit for group applications. Industrial dischargers choosing the group option previously were required to file in two parts. Part 1 was due by Sept. 30, 1991, and Part 2 was due by Oct. 1, 1992. The proposed permit would apply to industrial facilities, including certain Indian lands, in selected areas of EPA Regions I, II, III, IV, VI, VIII, IX and X. The permit would cover industrial stormwater discharges to US waters, and would include discharges transmitted through large, medium-sized and other municipal separate storm sewer systems.

    ENERGY STAR is a voluntary energy efficiency-labeling program operated jointly by the United States Department of Energy and the United States Environmental Protection Agency (US EPA). Since the program inception in 1992, ENERGY STAR has become a leading international brand for energy efficient products. ENERGY STAR's central role in the development of regional, national, and international energy programs necessitates an open process whereby its program achievements to date as well as projected future savings are shared with committed stakeholders. Through 2006, US EPA?S ENERGY STAR labeled products saved 4.8 EJ of primary energy and avoided 82 Tg C equivalent. We project that US EPA?S ENERGY STAR labeled products will save 12.8 EJ and avoid 203 Tg C equivalent over the period 2007-2015. A sensitivity analysis examining two key inputs (carbon factor and ENERGY STAR unit sales) bounds the best estimate of carbon avoided between 54 Tg C and 107 Tg C (1993 to 2006) and between 132 Tg C and 278 Tg C (2007 to 2015).

    As part of the 1990 Clean Air Act Amendments, major facilities are required to obtain federally enforceable operating permits (Title V). In a separate permitting action, the electric utilities with units generating more then 25 megawatts are required to obtain permits for NO{sub x} and SO{sub x}, the emissions which contribute to acid rain (Title IV). The Title IV permit is included as part of the Title V permit. This paper will use an actual audit experience at a coal fired generation facility as a case study for the preparation for and outcome of an EPA Title IV Level 3 audit. The paper will document the procedures for preparation, the audit process, and the outcome. The audit is part of the EPA's process for review of the record keeping and instrument calibration methods outlined in Title IV. Both types of permits have many different record keeping and monitoring requirements as well as separate reporting requirements which are submitted to both federal; state and local regulatory agencies for review and evaluation. Title IV units include very specific instrument calibration/audit requirements, and Title V has compliance testing and monitoring requirements. Alliant Power was notified in August 1998 of the intent of EPA Region VII to conduct a Level 3 audit at the Lansing Generation Station. The US EPA and the State of Iowa intended to review all Title IV record keeping (Level 1), continuous emission monitoring calibrations and linearity testing (Level 2) and observe the annual Relative Accuracy Testing Audit performed by an outside contractor. In addition, during this facility site visit, the compliance with Title V permit requirements was also audited.

  4. Memorandum of Understanding Between U.S. EPA Superfund and U.S. NRC

    The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work together to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on actions

    In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs). Forty-two CRADAs and five licensing agreements have been initiated with EPA under this program. This paper provides an overview of this new and innovative program within the EPA. 1 fig., 2 tabs.

    On October 20, 1993, the US Environmental Protection Agency (EPA) published in the Federal Register the proposed rule entitled Risk Management Programs for Chemical Accidental Release Prevention (40 CFR 68). Subsequently, on January 31, 1994, EPA published in the Federal Register the finalized list of 77 regulated toxic substances and 63 regulated flammable substances that are to be covered under the rule along with the associated threshold quantities for each substance. This list of substances will dictate which stationary sources will have to comply with the requirements of the proposed risk management program rule. The risk management program rule will most likely be finalized sometime after mid-1995. Covered facilities will then have a total of three years to achieve complete compliance with the requirements of the rule. This paper presents an approach for corporations with multiple sites to develop action plans for implementation of the risk management program rule. The process starts with a determination of which facilities are potentially covered, development of a matrix of requirements that each facility must comply with, and finally, common strategies that may be used in achieving compliance. Thus, a multi-facility corporation can develop a baseline compliance guideline document that individual plants can use in developing and implementing their risk management programs.

    The quantitative procedures associated with noncancer risk assessment include reference dose (RfD), benchmark dose, and severity modeling. The RfD, which is part of the EPA risk assessment guidelines, is an estimation of a level that is likely to be without any health risk to sensitive individuals. The RfD requires two major judgments: the first is choice of a critical effect(s) and its No Observed Adverse Effect Level (NOAEL); the second judgment is choice of an uncertainty factor. This paper discusses major assumptions and limitations of the RfD model.

    The US Environmental Protection Agency (EPA) Conservation Verification Protocols (CVPs) are a set of step-by-step procedures for impact monitoring and evaluation of electric utility demand-side management (DSM) programs. The EPA developed these protocols as part of its mission to implement the Acid Rain Program authorized by Title IV of the Clean Air Amendments of 1990. This report provides an overview of the CVPs and how they can be used by electric utilities in DSM program monitoring and evaluation. Both the CVPs Monitoring Path and Stipulated Path procedures are summarized and reviewed. Several examples are provided to illustrate how to calculate DSM program energy savings using the CVPSs.

    This report presents the results of a review of the US Environmental Protection Agency (EPA) Record of Decision System (RODS) database search conducted to identify Superfund landfill sites where a Record of Decision (ROD) has been prepared by EPA, the States or the US Army Corps of Engineers describing the selected remedy at the site. ROD abstracts from the database were reviewed to identify site information including site type, contaminants of concern, components of the selected remedy, and cleanup goals. Only RODs from landfill sites were evaluated so that the results of the analysis can be used to support the remedy selection process for the Sanitary Landfill at the Savannah River Site (SRS).

    The US Environmental Protection Agency`s (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standards since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP`s compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy`s (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA`s proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. Also discussed are assurance requirements, groundwater protection, individual protection, and an evaluation of EPA`s responses to EEG`s comments.

    The U.S. Environmental Protection Agency (EPA) built a successful water conservation program and reduced potable water use through a series of initiatives at EPA laboratories. The projects highlighted in this case study demonstrate EPA’s ability to reduce water use in laboratory and medical equipment by implementing vacuum pump and steam sterilizer replacements and retrofits. Due to the success of the initial vacuum pump and steam sterilizer projects described here, EPA is implementing similar projects at several laboratories throughout the nation.

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE`s position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.
