  7. Statutory complexity disguises agency capture in Citizens Coal Council v. EPA

    SciTech Connect (OSTI)

    Mullen, R.

    2007-07-01

In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

The Uranium Mill Tailings Remedial Action (UMTRA) Project involves stabilizing 24 inactive uranium mill tailings piles in 10 states. Remedial work must meet standards established by the US Environmental Protection Agency (EPA). Remedial action must be designed and constructed to prevent dispersion of the tailings and other contaminated materials, and must prevent the inadvertent use of the tailings by man. This report is prepared primarily for distribution to parties involved in the UMTRA Project, including the US Nuclear Regulatory Commission (NRC), and states and tribes. It is intended to record the work done by the DOE since publication of the proposed EPA groundwater protection standards, and to show how the DOE has attempted to respond and react in a positive way to the new requirements that result from the proposed standards. This report discusses the groundwater compliance strategies now being defined and implemented by the DOE, and details the changes in disposal cell designs that result from studies to evaluate ways to facilitate compliance with the proposed EPA groundwater protection standards. This report also serves to record the technical advances, planning, and progress made on the UMTRA Project since the appearance of the proposed EPA groundwater protection standards. The report serves to establish, document, and disseminate technical approaches and engineering and groundwater information to people who may be interested or involved in similar or related projects. 24 refs., 27 figs., 8 tabs.

This paper discusses program objectives, approaches, current status and results, future activities, and schedules for EPA's program for research and development, field evaluation, and demonstration of Limestone Injection Multistage Burner (LIMB) technology. Primary emphasis is on: (1) the full-scale demonstration being conducted on Ohio Edison's 104-MW wall-fired Edgewater Station Unit 4; (2) evaluation on a 50 million Btu/hr tangentially fired prototype nearing completion; (3) on-going field evaluation on Richmond Power and Light's 61-MW tangentially fired Whitewater Valley Generating Station Unit 2. The new program for demonstration on Virginia Electric Power's 180-MW tangentially fired Yorktown II Plant is also described. The LIMB process is based on injecting dry sorbents into the boiler for direct capture of SO/sub 2/ from the combustion gases. LIMB combines sorbent injection for SO/sub 2/ control with the use of low-NOx burners, in which staged combustion is utilized for NOx control.

The US Environmental Protection Agency`s (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standards since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP`s compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy`s (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA`s proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. Also discussed are assurance requirements, groundwater protection, individual protection, and an evaluation of EPA`s responses to EEG`s comments.

This book presents the findings of a four-year study of the impact of federal court decisions on the policies and administration of the US Environmental Protection Agency (EPA) in all seven of its major statutory areas: clean air, clean water, hazardous waste cleanup, controlled pesticide use, resource conservation and recovery, safe drinking water, and control of toxic substances. The author use the Lexis and Westlaw legal data bases to generate a list of all cases in which the EPA was either a plaintiff or a defendant in each of the agency's seven major statutory areas. The author verified these data and at times supplemented them with EPA records and with environmental reporters published by the Bureau of National Affairs and the Environmental Law Institute. She derived settlement agreements from the EPA, the Department of Justice, and the courts.

Protests from the Council of Industrial Boiler Owners that this is an unfair burden on non-utility boilers note that scrubbing is more costly for smaller boilers, and that it could impede air quality improvement by discouraging the replacement of old boilers. EPA contests these claims.

    2008-01-15

The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work together to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on actions that NRC should consider that address the site-specific matter that triggered consultation. Over the course of consultations on the eight sites, there have been some reoccurring themes to EPA's views. Primarily, these are EPA: 1. Recommending that NRC consider selecting institutional controls to ensure that NRC's assumptions about future human exposure at the site are not exceeded. 2. Recommending that NRC consider using more site-specific information when conducting dose assessment modeling. 3. Recommending that NRC consider a flexible approach to groundwater protection that still ensures the public is not exposed to contamination levels over drinking water limits. 4. Recommending that NRC consider an approach similar to how EPA implements supplemental standards under 40 CFR 192 as an ARAR when the UMTRCA soil standard of 5 pCi/g is not being met.

    1990-12-31

In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs). Forty-two CRADAs and five licensing agreements have been initiated with EPA under this program. This paper provides an overview of this new and innovative program within the EPA. 1 fig., 2 tabs.

Criminal investigators from the Environmental Protection Agency (EPA) and its field offices testified at a hearing on whether EPA has sufficient authority to investigate criminal violations, particularly in the area of illegal disposal of hazardous materials. They reported on the agency's progress in staffing a unit with authority comparable to that of Customs and the FBI. The Justice Department opposed deputizing EPA investigators, but the committee found that investigators in the 22 states surveyed operate with law-enforcement powers. Material submitted for the record by EPA, the Justice Department, and others follows the testimony of 10 witnesses.

    Howarth, S.M.; Martell, M.A.; Weiner, R.; Lattier, C.

    1998-06-01

The Waste Isolation Pilot Plant (WIPP) Compliance Certification Application (CCA) Performance Assessment (PA) Parameter Database and its ties to supporting information evolved over the course of two years. When the CCA was submitted to the Environmental Protection Agency (EPA) in October 1996, information such as identification of parameter value or distribution source was documented using processes established by Sandia National Laboratories WIPP Quality Assurance Procedures. Reviewers later requested additional supporting documentation, links to supporting information, and/or clarification for many parameters. This guidebook is designed to document a pathway through the complex parameter process and help delineate flow paths to supporting information for all WIPP CCA parameters. In addition, this report is an aid for understanding how model parameters used in the WIPP CCA were developed and qualified. To trace the source information for a particular parameter, a dual-route system was established. The first route uses information from the Parameter Records package as it existed when the CCA calculations were run. The second route leads from the EPA Parameter Database to additional supporting information.

    2003-02-27

The Waste Isolation Pilot Plant (WIPP) is operating to receive and dispose of contact-handled (CH) transuranic (TRU) waste. The Department of Energy (DOE) Carlsbad Field Office (CBFO) is seeking approval from the Environmental Protection Agency (EPA) and the New Mexico Environment Department (NMED) of the remote-handled (RH) TRU characterization plan to allow disposal of RH TRU waste in the WIPP repository. In addition, the DOE-CBFO has received approval from the Nuclear Regulatory Commission (NRC) to use two shipping casks for transporting RH TRU waste. Each regulatory agency (i.e., EPA, NMED, and NRC) has different requirements that will have to be met through the use of information collected by characterizing the RH TRU waste. Therefore, the DOE-CBFO has developed a proposed characterization program for obtaining the RH TRU waste information necessary to demonstrate that the waste meets the applicable regulatory requirements. This process involved the development of a comprehensive set of Data Quality Objectives (DQOs) comprising the various regulatory requirements. The DOE-CBFO has identified seven DQOs for use in the RH TRU waste characterization program. These DQOs are defense waste determination, TRU waste determination, RH TRU determination, activity determination, RCRA physical and chemical properties, prohibited item determination, and EPA physical and chemical properties. The selection of the DQOs were based on technical, legal and regulatory drivers that assure the health and safety of the workers, the public, to protect the environment, and to comply with the requirements of the regulatory agencies. The DOE-CBFO also has the responsibility for the certification of generator/storage sites to ship RH TRU mixed waste to the WIPP for disposal. Currently, thirteen sites across the DOE complex are generators of RH TRU waste or store the waste at their location for other generators. Generator/storage site certification involves review and approval of site-specific programmatic documents that demonstrate compliance with the WIPP waste characterization and transportation requirements. Additionally, procedures must be developed to implement programmatic requirements and adequacy of those procedures determined. Finally, on-site audits evaluate the technical and administrative implementation and effectiveness of the operating procedures.

    1990-12-31

The quantitative procedures associated with noncancer risk assessment include reference dose (RfD), benchmark dose, and severity modeling. The RfD, which is part of the EPA risk assessment guidelines, is an estimation of a level that is likely to be without any health risk to sensitive individuals. The RfD requires two major judgments: the first is choice of a critical effect(s) and its No Observed Adverse Effect Level (NOAEL); the second judgment is choice of an uncertainty factor. This paper discusses major assumptions and limitations of the RfD model.

    SciTech Connect (OSTI)

Ling, A.D. [Dept. of the Navy, Washington, DC (United States)

    1997-12-31

In August 1996, the Environmental Protection Agency (EPA) issued the first ever Clean Air Act (CAA) guidance directed specifically at military facilities. The Guidance, titled Major Source Determinations for Military Installations under the Air Toxics, New Source Review and Title V Operating Permit Programs of the Clean Air Act, was negotiated by an EPA/DoD workgroup that included field and headquarters EPA and DoD representatives, and was led by the Navy. This paper describes the development and contents of the guidance and the significant legal and policy issues raised. By statute and rule, all sources under common control on contiguous or adjacent property and belonging to the same two digit Standard Industrial Classification (SIC) Code must be aggregated when determining if the source is a major source. DoD requested that EPA develop the guidance because of a move by EPA to impose a fenceline-to-fenceline interpretation of what constitutes a major source for purposes of the three programs identified above. Such an interpretation could and did result in more stringent regulation of industrial sources on military installations than of similar industrial plants. The guidance establishes EPA`s allowable interpretation of two of the three key elements of the major source definition. First, the guidance specifies that common control occurs at the military service level; therefore, sources belonging to the Army, Navy, Marine Corps, Air Force, the National Guard or a Defense Agency that are located on the same installation could each be treated separately. Second, the guidance allows the military to assign SIC codes to functional industrial groupings in a manner similar to the private sector. Past practice grouped all national defense activities under the same SIC code.

  6. New EPA Guidelines for Review of Surface Coal Mining Operations in Appalachia (released in AEO2010)

    Reports and Publications (EIA)

    2010-01-01

On April 1, 2010, the Environmental Protection Agency (EPA) issued a set of new guidelines to several of its Regional offices regarding the compliance of surface coal mining operations in Appalachia with the provisions of the Clean Water Act (CWA), the National Environmental Policy Act, and the environmental justice Executive Order (E.O. 12898). The stated purpose of the guidance was to explain more fully the approach that the EPA will be following in permit reviews, and to provide additional assurance that its Regional offices use clear, consistent, and science-based standards in reviewing the permits. Although the new guidelines go into effect immediately, they will be subjected to review both by the public and by the EPA's Science Advisory Board, with a set of final guidelines to be issued no later than April 1, 2011.

The U.S. Environmental Protection Agency (EPA) Superfund program's six Preliminary Remediation Goal (PRG) and Dose Compliance Concentration (DCC) internet based calculators for risk and dose assessment at Superfund sites are being revised to reflect better science, revisions to existing exposure scenarios and new scenarios, and changes to match up more closely with the EPA chemical regional screening level calculator. A revised version of the 1999 guidance document that provides an overview for the Superfund risk assessment process at radioactively contaminated sites, 'Radiation Risk Assessment At CERCLA Sites: Q and A', is being completed that will reflect Superfund recommended guidance and other technical documents issued over the past 13 years. EPA is also issuing a series of fact sheets in the document 'Superfund Radiation Risk Assessment: A Community Tool-kit'. This presentation would go over those changes that are expected to be finished by this spring. (authors)

  8. Defining the scope of lender liability after Kelley v. EPA: Who will have safe harbor?

    SciTech Connect (OSTI)

    NONE

    1995-08-01

In 1980, Congress enacted CERCLA in order to clean up toxic waste sites and identify broad classes of people who would be financially responsible for the clean-up efforts. One of these broad classes of responsible parties includes owners or operators of hazardous waste sites. This category created enormous potential for liability risk for lenders who hold title to contaminated property as collateral. Congress created a {open_quotes}safe harbor{close_quotes} exemption from liability within the definition of owners and operators in order to protect lenders who held title merely as protection of a security interest. Conflicting interpretations have caused a great deal of confusion for lending institutions. In response to fears of unlimited liability expressed by lending institutions and in consideration of the federal government`s increasing role as a secured creditor, the Environmental Protection Agency (EPA) issued a regulation in 1992 that attempted to define clearly the scope of a lender`s liability under CERCLA. This rule provided the lending community with a precise standard by which to guide their actions in order to avoid incurring liability. In Kelley v. EPA, the EPA`s regulation that attempted to clarify issues of lender liability under CERCLA was struck down by the United States Court of Appeals for the D.C. Circuit. The court held that Congress had not granted the EPA authority to promulgate regulations that would define the scope of lender liability in private party litigation. It further determined that federal courts should evaluate claims in private cost recovery actions independent of the EPA`s {open_quotes}institutional view{close_quotes}. This note postulates that the Kelley decision to invalidate the rule once again exposes lenders to unlimited liability under CERCLA by leaving them to make decisions based on an ambiguous statutory provision that has been interpreted both broadly and narrowly in the past.

The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE`s position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.

    O'Leary, R.

    1988-01-01

This work is the first comprehensive analysis of the impact of federal court decisions on the United States Environmental Protection Agency (EPA) in all seven of its major statutory areas. The work found first, that judicial intervention into disputes concerning the EPA fall into five groups: (1) cases in which the mere filing of a lawsuit, without judicial action, has evoked a changed in the EPA; (2) cases in which courts have upheld the agency's position completely without yielding changes in the agency; (3) cases in which judges, who have been passive and unwilling to intervene in the affairs of the EPA have issued decisions that nonetheless have affected the agency's policies and administration; (4) cases in which judges have legitimately used their discretionary powers to affect agency actions; and (5) cases in which judges have gone beyond the normal limits of judicial activism to evoke change in the agency. Second, the dissertation analyzed the ten ways that the EPA has responded to federal court decisions. Third, the dissertation found that the major impact of federal court decisions on the EPA has been policy related. Compliance with court orders has become the agency's top priority. Finally, the dissertation found that federal court decisions have affected the administration of the EPA in five ways.

The U.S. Environmental Protection Agency's (EPA) Integrated Risk Information System (IRIS) Program develops assessments of health effects that may result from chronic exposure to chemicals in the environment. The IRIS database contains more than 540 assessments. When supported by available data, IRIS assessments provide quantitative analyses of carcinogenic effects. Since publication of EPA's 2005 Guidelines for Carcinogen Risk Assessment, IRIS cancer assessments have implemented new approaches recommended in these guidelines and expanded the use of complex scientific methods to perform quantitative dose-response assessments. Two case studies of the application of the mode of action framework from the 2005 Cancer Guidelines are presented in this paper. The first is a case study of 1,2,3-trichloropropane, as an example of a chemical with a mutagenic mode of carcinogenic action thus warranting the application of age-dependent adjustment factors for early-life exposure; the second is a case study of ethylene glycol monobutyl ether, as an example of a chemical with a carcinogenic action consistent with a nonlinear extrapolation approach. The use of physiologically based pharmacokinetic (PBPK) modeling to quantify interindividual variability and account for human parameter uncertainty as part of a quantitative cancer assessment is illustrated using a case study involving probabilistic PBPK modeling for dichloromethane. We also discuss statistical issues in assessing trends and model fit for tumor dose-response data, analysis of the combined risk from multiple types of tumors, and application of life-table methods for using human data to derive cancer risk estimates. These issues reflect the complexity and challenges faced in assessing the carcinogenic risks from exposure to environmental chemicals, and provide a view of the current trends in IRIS carcinogenicity risk assessment.

The Environmental Protection Agency of the State of Illinois (Illinois EPA) has programs in water, air, and land pollution and water supplies paralleling those of the US Environmental Protection Agency (EPA). The organization is part of a tripartite arrangement in which the Pollution Control Board is the judicial arm, the Department of Energy and Natural Resources is the research arm, and the Illinois EPA is the enforcement arm. Other state agencies are also concerned with various aspects of the environment and may do risk assessments for chemicals. Although there are various risk assessment activities, both formal and informal, in our agency and in others, this paper will discuss only recent initiatives in water quality criteria.

The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE's position on the proposed standards.

  10. The process of consensus on EMF: SAB review of the EPA draft document on EMF and cancer

    SciTech Connect (OSTI)

    Wilson, B.W.

    1992-06-01

The EPA Draft Document on EMF and Cancers grew out of an earlier effort by EPA to track biological effects literature relative to radio-frequency (RF) exposure. Scope of the document was broadened to include extremely low frequency electric and magnetic fields prior to an announcement in 1986 that EPA would formally review the whole area of non-ionizing radiation. An extensive survey of the relevant bioeffects and epidemiologic literature was carried out, and writing on the document began in earnest on the document sometime in 1989. In its draft form, the document reviewed the literature on mechanisms of Interaction between electromagnetic fields and biological tissue, EMF epidemiologic studies, supporting evidence for carcinogenicity and research needs. In the early summer of 1990, a draft of the document was reviewed by some 22 individuals within the EPA and other government agencies. It was also sent out for external review to an additional 9 qualified scientists who had worked in the area and were familiar with EMF-related literature in epidemiology, biology, and physics. Many of the comments sent to EPA from this first review, prior to release of the draft for public comment, were strikingly similar to those resulting from the second (public) review process. Thus, it appears that much of the controversy that was later associated with the document could have been avoided had the authors been diligent in following the recommendations of the initial set of reviewers.

    SciTech Connect (OSTI)

    Smock, R.

    1982-07-01

The overall message of the recent Symposium on Flue Gas Desulfurization was that the technology for sulfur dioxide scrubbing has matured enough for discussions to focus on future improvements rather than whether scrubbers work at all. The Environmental Protection Agency (EPA) regulations will not change in the near future, however, unless there are changes in the Clean air Act to deal with acid rain, despite the improvements in performance data. The symposium covered reports on dual-alkali scrubbing, organic buffer additives, the probability that scrubber wastes will not be classified as hazardous, simultaneous removal of nitrogen oxides and sulfur dioxide, and continuous monitoring programs. 3 figures, 4 tables. SciTech Connect (OSTI)

    Facca, G.L.; Faler, M.

    1999-07-01

As part of the 1990 Clean Air Act Amendments, major facilities are required to obtain federally enforceable operating permits (Title V). In a separate permitting action, the electric utilities with units generating more then 25 megawatts are required to obtain permits for NO{sub x} and SO{sub x}, the emissions which contribute to acid rain (Title IV). The Title IV permit is included as part of the Title V permit. This paper will use an actual audit experience at a coal fired generation facility as a case study for the preparation for and outcome of an EPA Title IV Level 3 audit. The paper will document the procedures for preparation, the audit process, and the outcome. The audit is part of the EPA's process for review of the record keeping and instrument calibration methods outlined in Title IV. Both types of permits have many different record keeping and monitoring requirements as well as separate reporting requirements which are submitted to both federal; state and local regulatory agencies for review and evaluation. Title IV units include very specific instrument calibration/audit requirements, and Title V has compliance testing and monitoring requirements. Alliant Power was notified in August 1998 of the intent of EPA Region VII to conduct a Level 3 audit at the Lansing Generation Station. The US EPA and the State of Iowa intended to review all Title IV record keeping (Level 1), continuous emission monitoring calibrations and linearity testing (Level 2) and observe the annual Relative Accuracy Testing Audit performed by an outside contractor. In addition, during this facility site visit, the compliance with Title V permit requirements was also audited.

    2008-06-03

ENERGY STAR is a voluntary energy efficiency-labeling program operated jointly by the United States Department of Energy and the United States Environmental Protection Agency (US EPA). Since the program inception in 1992, ENERGY STAR has become a leading international brand for energy efficient products. ENERGY STAR's central role in the development of regional, national, and international energy programs necessitates an open process whereby its program achievements to date as well as projected future savings are shared with committed stakeholders. Through 2006, US EPA?S ENERGY STAR labeled products saved 4.8 EJ of primary energy and avoided 82 Tg C equivalent. We project that US EPA?S ENERGY STAR labeled products will save 12.8 EJ and avoid 203 Tg C equivalent over the period 2007-2015. A sensitivity analysis examining two key inputs (carbon factor and ENERGY STAR unit sales) bounds the best estimate of carbon avoided between 54 Tg C and 107 Tg C (1993 to 2006) and between 132 Tg C and 278 Tg C (2007 to 2015).

    2014-09-01

The purpose of this project was to evaluate integrated packages of advanced measures in individual test homes to assess their performance with respect to Building America Program goals, specifically compliance with the DOE Challenge Home Program. BSC consulted on the construction of five test houses by three Cold Climate production builders in three separate US cities. BSC worked with the builders to develop a design package tailored to the cost-related impacts for each builder. Therefore, the resulting design packages do vary from builder to builder. BSC provided support through this research project on the design, construction and performance testing of the five test homes. Overall, the builders have concluded that the energy related upgrades (either through the prescriptive or performance path) represent reasonable upgrades. The builders commented that while not every improvement in specification was cost effective (as in a reasonable payback period), many were improvements that could improve the marketability of the homes and serve to attract more energy efficiency discerning prospective homeowners. However, the builders did express reservations on the associated checklists and added certifications. An increase in administrative time was observed with all builders. The checklists and certifications also inherently increase cost due to: 1. Adding services to the scope of work for various trades, such as HERS Rater, HVAC contractor; 2. Increased material costs related to the checklists, especially the EPA Indoor airPLUS and EPA WaterSense(R) Efficient Hot Water Distribution requirement.

Vehicle manufacturers among others are putting great emphasis on improving fuel economy (FE) of light-duty vehicles in the U.S. market, with significant FE gains being realized in recent years. The U.S. Environmental Protection Agency (EPA) data indicates that the aggregate FE of vehicles produced for the U.S. market has improved by over 20% from model year (MY) 2005 to 2013. This steep climb in FE includes changes in vehicle choice, improvements in engine and transmission technology, and reducing aerodynamic drag, rolling resistance, and parasitic losses. The powertrain related improvements focus on optimizing in-use efficiency of the transmission and engine as a system, and may make use of what is termed downsizing and/or downspeeding. This study explores quantifying recent improvements in powertrain efficiency, viewed separately from other vehicle alterations and attributes (noting that most vehicle changes are not completely independent). A methodology is outlined to estimate powertrain efficiency for the U.S city and highway cycle tests using data from the EPA vehicle database. Comparisons of common conventional gasoline powertrains for similar MY 2005 and 2013 vehicles are presented, along with results for late-model hybrid electric vehicles, the Nissan Leaf, Chevy Volt and other selected vehicles.

    2015-08-28

The U.S. Environmental Protection Agency (EPA) requested an external, independent verification study of their updated “Preliminary Remediation Goals for Radionuclides” (PRG) electronic calculator. The calculator provides PRGs for radionuclides that are used as a screening tool at Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and Resource Conservation and Recovery Act (RCRA) sites. These risk-based PRGs establish concentration limits under specific exposure scenarios. The purpose of this verification study is to determine that the calculator has no inherit numerical problems with obtaining solutions as well as to ensure that the equations are programmed correctly. There are 167 equations used in the calculator. To verify the calculator, all equations for each of seven receptor types (resident, construction worker, outdoor and indoor worker, recreator, farmer, and composite worker) were hand calculated using the default parameters. The same four radionuclides (Am-241, Co-60, H-3, and Pu-238) were used for each calculation for consistency throughout.

    1994-01-30

With the realignment and closure of Federal facilities, especially Department of Defense installations, Federal agencies have been presented with a unique opportunity: the chance to create and dispose of air emission reduction credits (ERCs). This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances. This paper will discuss ERCs, why the disposal of ERCs by Federal agencies is a pressing issue, and how Federal agencies can dispose of ERCs under existing Federal property laws and regulations.

These studies can be viewed in several ways, including as viable paths to compliance with the EPA rule, alternative “bookend cases” to compare to compliance based largely on natural gas, or something in between. The studies in this paper represent a body of work that can help inform the public discussion surrounding the cost and reliability impacts of complying with the proposed EPA CPP.

The purpose of this report is two-fold. First, the risk assessment methodology for both RESRAD and the EPA’s tools is reviewed. This includes a review of the EPA’s justification for 2 using a dose-to-risk conversion factor to reduce the dose-based protective ARAR from 15 to 12 mrem/yr. Second, the models and parameters used in RESRAD and the EPA PRG and DCC Calculators are compared in detail, and the results are summarized and discussed. Although there are suites of software tools in the RESRAD family of codes and the EPA Calculators, the scope of this report is limited to the RESRAD (onsite) code for soil contamination and the EPA’s PRG and DCC Calculators also for soil contamination.

  6. Environmental enforcement of federal agencies: A struggle for power under the New Federalism. Master's thesis

    SciTech Connect (OSTI)

    Surver, R.E.

    1990-01-01

The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

  7. Combined heat recovery and dry scrubbing for MWCs to meet the new EPA guidelines

    SciTech Connect (OSTI)

    Finnis, P.J.; Heap, B.M.

    1997-12-01

Both the UK and US Municipal Waste Combuster (MWC) markets have undergone upgraded regulatory control. In the UK, the government`s Integrated Pollution Control (IPC) regime, enforced by the 1990 Environmental Protection Act (EPA) Standard IPR5/3 moved control of emissions of MWCs from local councils to the government Environmental Authority (EA). Existing MWCs had until December 1, 1996 to complete environmental upgrades. Simultaneously, the European Community (EC) was finalizing more stringent legislation to take place in the year 2001. In the US, the 1990 Clean Air Act amendments required the Environmental Protection Agency (EPA) to issue emission guidelines for new and existing facilities. Existing facilities are likely to have only until the end of 1999 to complete upgrades. In North America, Procedair Industries Corp had received contracts from Kvaerner EnviroPower AB, for APC systems of four new Refuse Derived Fuel (RDF) fluid bed boilers that incorporated low outlet temperature economizers as part of the original boiler equipment. The Fayetteville, North Carolina facility was designed for 200,000 tpy. What all these facilities have in common is low economizer outlet temperatures of 285{degrees}F coupled with a Total Dry Scrubbing System. MWC or RDF facilities using conventional spray dryer/fabric filter combinations have to have economizer gas outlet temperatures about 430{degrees}F to allow for evaporation of the lime slurry in the spray dryer without the likelihood of wall build up or moisture carry over. Since the Totally Dry Scrubbing System can operate with economizer gas outlet temperatures about 285{degrees}F, the added energy available for sale from adding low outlet temperature economizer heat recovery can be considerable. This paper focuses on Procedair`s new plant and retrofit experience using `Dry Venturi Reactor/Fabric Filter` combinations with the lower inlet temperature operating conditions.

Adding services to the scope of work for various trades, such as HERS Rater, HVAC contractor. 2. Increased material costs related to the checklists, especially the EPA Indoor airPLUS and EPA WaterSense Efficient Hot Water Distribution requirement.

    1997-12-31

In June 1996, the Renewable Aviation Fuels Development Center (RAFDC) at Baylor University in Waco, Texas, received a Supplemental Type Certificate (STC) for the use of 100% ethanol as a fuel for the Cessna 152, the most popular training aircraft in the world. This is the first certification granted by the Federal Aviation Administration (FAA) for a non-petroleum fuel. Certification of an aircraft on a new fuel requires a certification of the engine followed by a certification of the airframe/engine combination. This paper will describe the FAA airframe certification procedure, the tests required and their outcome using ethanol as an aviation fuel in a Cessna 152.

    1998-12-01

This Record of Decision (ROD) presents the final remedial action decisions selected for soils and sediments in each of the solid waste management units (SWMUs) of Waste Area Groups (WAGs) 1 and 7 at the Paducah Gaseous Diffusion Plant (PGDP) near Paducah, Kentucky. Waste Area Group 1 consists of SWMUs 100 and 136. Waste Area Group 7 consists of SWMUs 8 and 130 through 134. By mutual consent among the United States Environmental Protection Agency (EPA), the Kentucky Department for Environmental Protection (KDEP), the United States Department of Defense (DOD), the United States Army Corps of Engineers (COE), and the DOE, it was agreed that the evaluation and implementation of any remedial actions required for the Kentucky Ordnance Works (KOW) SWMUs (SWMU 94 (KOW Sewage Treatment Plant), SWMU 95 (KOW Burn Area), and SWMU 157 (KOW Toluene Spill Site)), formerly included in WAGs 1 and 7, would be the responsibility of the DOD and conducted on behalf of the DOD by the COE. Due to the agreements reached among these entities, remedial technologies for the KOW SWMUs are not discussed further in this ROD and will be evaluated as part of the WAG 10 investigation by the COE. Additionally, by written mutual consent, the EPA, the DKEP, and the DOE agreed that an evaluation of remedial alternatives for SWMU 38, the C-615 Sewage Treatment Plant, would be deferred until the unit ceases operation. Consequently, no remedial actions are discussed for these SWMUs in this ROD.

    1995-03-01

The remedial action at the Northwest Transformer Mission/Pole site in Whatcom County, Washington, is nearly complete. The purpose of this document is to inform the public that the final two piles of excavated soil containing 53 and 70 parts per million Polychlorinated Biphenyls (PCBs), respectively, will be disposed of at a hazardous waste landfill rather than by incineration. This document also discusses the results of the Environmental Protection Agency (EPA) reassessment of the selected remedy for groundwater (which was and remains no further action) in light of sampling results and the apparent removal of the source of groundwater contamination during remediation.

Carbon capture and sequestration (CCS) is an option to mitigate impacts of atmospheric carbon emission. Numerous factors are important in determining the overall effectiveness of long-term geologic storage of carbon, including leakage rates, volume of storage available, and system costs. Recent efforts have been made to apply an existing probabilistic performance assessment (PA) methodology developed for deep nuclear waste geologic repositories to evaluate the effectiveness of subsurface carbon storage (Viswanathan et al., 2008; Stauffer et al., 2009). However, to address the most pressing management, regulatory, and scientific concerns with subsurface carbon storage (CS), the existing PA methodology and tools must be enhanced and upgraded. For example, in the evaluation of a nuclear waste repository, a PA model is essentially a forward model that samples input parameters and runs multiple realizations to estimate future consequences and determine important parameters driving the system performance. In the CS evaluation, however, a PA model must be able to run both forward and inverse calculations to support optimization of CO{sub 2} injection and real-time site monitoring as an integral part of the system design and operation. The monitoring data must be continually fused into the PA model through model inversion and parameter estimation. Model calculations will in turn guide the design of optimal monitoring and carbon-injection strategies (e.g., in terms of monitoring techniques, locations, and time intervals). Under the support of Laboratory-Directed Research & Development (LDRD), a late-start LDRD project was initiated in June of Fiscal Year 2010 to explore the concept of an enhanced performance assessment system (EPAS) for carbon sequestration and storage. In spite of the tight time constraints, significant progress has been made on the project: (1) Following the general PA methodology, a preliminary Feature, Event, and Process (FEP) analysis was performed for a hypothetical CS system. Through this FEP analysis, relevant scenarios for CO{sub 2} release were defined. (2) A prototype of EPAS was developed by wrapping an existing multi-phase, multi-component reservoir simulator (TOUGH2) with an uncertainty quantification and optimization code (DAKOTA). (3) For demonstration, a probabilistic PA analysis was successfully performed for a hypothetical CS system based on an existing project in a brine-bearing sandstone. The work lays the foundation for the development of a new generation of PA tools for effective management of CS activities. At a top-level, the work supports energy security and climate change/adaptation by furthering the capability to effectively manage proposed carbon capture and sequestration activities (both research and development as well as operational), and it greatly enhances the technical capability to address this national problem. The next phase of the work will include (1) full capability demonstration of the EPAS, especially for data fusion, carbon storage system optimization, and process optimization of CO{sub 2} injection, and (2) application of the EPAS to actual carbon storage systems.

At the request of the Chairman, Subcommittee on Oversight and Investigations, House Committee on Energy and Commerce, GAO reviewed EPA's procedures for ensuring grantee compliance with Section 105 provisions and EPA regulations and determined whether grantees are, in fact, meeting these requirements. GAO reviewed all 235 grants awarded from fiscal years 1979 through 1982 at 3 of EPA's 10 regional offices to determine whether consultation, supplementing, and level-of-effort requirements were being met. Those grants represented about 35% of the $340 million in grant funds awarded nationwide during that 4-year period. GAO also reviewed fiscal year 1982 expenditures (the latest data available at the time of GAO's review) for six grantees - two in each of the three regions - to determine whether the grant funds were properly spent and reported. GAO also visited three other grantees for further review after determining that EPA records did not contain a justification as to why those grantees' levels of effort had not been maintained. GAO found that the three EPA regions reviewed were consulting with state officials and were satisfied that supplanting did not occur, as required by the Clean Air Act. On the other hand, GAO found that two of the three EPA regions had not ensured that all grantees complied with the level-of-effort requirement of the act or EPA's reporting requirements. EPA officials believed the problems GAO found could exist in other regions not included in this review.

The MARSSIM is a multi-agency consensus document that was developed collaboratively by four Federal agencies having authority and control over radioactive materials: Department of Defense (DOD), Department of Energy (DOE), Environmental Protection Agency (EPA), and Nuclear Regulatory Commission (NRC). The MARSSIM`s objective is to describe a consistent approach for planning, performing, and assessing building surface and surface soil final status surveys to meet established dose or risk-based release criteria, while at the same time encouraging an effective use of resources.

    SciTech Connect (OSTI)

    2013-07-01

Following the decision to withdraw the Yucca Mountain license application, the Department of Energy created a Blue Ribbon Commission (BRC) on America's Nuclear Future, tasked with recommending a national strategy to manage the back end of the nuclear fuel cycle. The BRC issued its final report in January 2012, with recommendations covering transportation, storage and disposal of spent nuclear fuel (SNF); potential reprocessing; and supporting institutional measures. The BRC recommendations on disposal of SNF and high-level waste (HLW) are relevant to the U.S. Environmental Protection Agency (EPA), which shares regulatory responsibility with the Nuclear Regulatory Commission (NRC): EPA issues 'generally applicable' performance standards for disposal repositories, which are then implemented in licensing. For disposal, the BRC endorses developing one or more geological repositories, with siting based on an approach that is adaptive, staged and consent-based. The BRC recommends that EPA and NRC work cooperatively to issue generic disposal standards-applying equally to all sites-early in any siting process. EPA previously issued generic disposal standards that apply to all sites other than Yucca Mountain. However, the BRC concluded that the existing regulations should be revisited and revised. The BRC proposes a number of general principles to guide the development of future regulations. EPA continues to review the BRC report and to assess the implications for Agency action, including potential regulatory issues and considerations if EPA develops new or revised generic disposal standards. This review also involves preparatory activities to define potential process and public engagement approaches. (authors)

    SciTech Connect (OSTI)

    1995-03-31

The Waste Isolation Pilot Plant (WIPP) is a research and development facility for the demonstration of the permanent isolation of transuranic radioactive wastes in a geologic formation. The facility was constructed in southeastern New Mexico in a manner intended to meet criteria established by the scientific and regulatory community for the safe, long-term disposal of transuranic wastes. The US Department of Energy (DOE) is preparing an application to demonstrate compliance with the requirements outlined in Title 40, Part 191 of the Code of Federal Regulations (CFR) for the permanent disposal of transuranic wastes. As mandated by the Waste Isolation Pilot Plant (WIPP) Land Withdrawal Act of 1992, the US Environmental Protection Agency (EPA) must evaluate this compliance application and provide a determination regarding compliance with the requirements within one year of receiving a complete application. Because the WIPP is a very complex program, the DOE has planned to submit the application as a draft in two parts. This strategy will allow for the DOE and the EPA to begin technical discussions on critical WIPP issues before the one-year compliance determination period begins. This report is the first of these two draft submittals.

    Brown, D.F.

    1994-10-17

The Waste Acceptance Criteria (WAC) procedures define the rules concerning packages of solid Low Level Waste (LLW) that are sent to the E-area vaults (EAV). The WACs tabulate the quantities of 22 radionuclides that require manifesting in waste packages destined for each type of vault. These quantities are called the Package Administrative Criteria (PAC). If a waste package exceeds the PAC for any radionuclide in a given vault, then specific permission is needed to send to that vault. To avoid reporting insignificant quantities of the 22 listed radionuclides, the WAC defines the Minimum Reportable Quantity (MRQ) of each radionuclide as 1/1000th of the PAC. If a waste package contains less than the MRQ of a particular radionuclide, then the package`s manifest will list that radionuclide as zero. At least one radionuclide has to be reported, even if all are below the MRQ. The WAC requires that the waste no be ``hazardous`` as defined by SCDHEC/EPA regulations and also lists several miscellaneous physical/chemical requirements for the packages. This report evaluates the solid wastes generated within the F/H Effluent Treatment Facility (ETF) for potential impacts on waste certification.

    GREAGER, T.M.

    2000-12-06

As a generator of transuranic (TRU) and TRU mixed waste destined for disposal at the Waste Isolation Pilot Plant (WIPP), the Hanford Site must ensure that its TRU waste meets the requirements of US. Department of Energy (DOE) 0 435.1, ''Radioactive Waste Management,'' and the Contact-Handled (CH) Transuranic Waste Acceptance Criteria for the Waste Isolation Pilot Plant (WIPP-WAC). WIPP-WAC requirements are derived from the WIPP Technical Safety Requirements, WIPP Safety Analysis Report, TRUPACT-II SARP, WIPP Land Withdrawal Act, WIPP Hazardous Waste Facility Permit, and Title 40 Code of Federal Regulations (CFR) 191/194 Compliance Certification Decision. The WIPP-WAC establishes the specific physical, chemical, radiological, and packaging criteria for acceptance of defense TRU waste shipments at WIPP. The WPP-WAC also requires that participating DOE TRU waste generator/treatment/storage sites produce site-specific documents, including a certification plan, that describe their program for managing TRU waste and TRU waste shipments before transferring waste to WIPP. Waste characterization activities provide much of the data upon which certification decisions are based. Waste characterization requirements for TRU waste and TRU mixed waste that contains constituents regulated under the Resource Conservation and Recovery Act (RCRA) are established in the WIPP Hazardous Waste Facility Permit Waste Analysis Plan (WAP). The Hanford Site Quality Assurance Project Plan (QAPjP) (HNF-2599) implements the applicable requirements in the WAP and includes the qualitative and quantitative criteria for making hazardous waste determinations. The Hanford Site must also ensure that its TRU waste destined for disposal at WPP meets requirements for transport in the Transuranic Package Transporter-11 (TRUPACT-11). The US. Nuclear Regulatory Commission (NRC) establishes the TRUPACT-11 requirements in the Safety Analysis Report for the TRUPACT-II Shipping Package (TRUPACT-11 SARP). In addition, a TRU waste is eligible for disposal at WIPP only if it has been generated in whole or in part by one or more of the activities listed in Section 10101(3) of the Nuclear Waste Policy Act. DOE sites must determine that each waste stream to be disposed of at WIPP is ''defense'' TRU waste. (See also the definition of ''defense'' TRU waste.). Only CH TRU wastes meeting the requirements of the QAPjP, WIPP-WAP, WPP-WAC, and other requirements documents described above will be accepted for transportation and disposal at WIPP.
