    In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    The US Environmental Protection Agency`s (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standards since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP`s compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy`s (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA`s proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. Also discussed are assurance requirements, groundwater protection, individual protection, and an evaluation of EPA`s responses to EEG`s comments.

    What the EPA, working jointly with the states, hopes to accomplish over the next ten years in order to integrate and coordinate all the groundwater programs within the agency is discussed. Although many other EPA programs such as Superfund, Clean Air Act, and Wetlands Management are often highlighted in the media, EPA does not down rate the importance of groundwater protection. Indeed as a resource, it is one of the most important commodities. Groundwater is the basis for life in this country. Recharge rates are no where near what the withdrawal rates are in many areas of the country. Twenty-five percent of all the potable water comes from groundwater. Groundwater supplies 50 percent of the needs for all the US population. If you include strictly rural areas, it supplies 95 percent of all the use. Something that most people who are not groundwater hydrologists would not think about is the fact that groundwater is a recharge mechanism that provides over 30 percent of the flow in streams and major rivers.

    The client, a government agency, requires its contractor to obtain an Earned Value Management System (EVMS) certification that meets the intent of ANSI/EIA-748-B, Earned Value Management Systems. The contractor has extensive experience with certification preparation, having completed two certifications within two years. Information from a previous EVMS certification and internal system surveillances are used to prepare for client-based EVMS certifications and bi-annual surveillances. The contractor also sent members of its group to assist other companies preparing for surveillances and certifications to perform 'Black Hat Reviews.' This paper is a lessons learned on preparing a team for EVMS certification. The information is also applicable for surveillances, since the contractor prepares its team for the surveillance in the same manner as the initial certification. Some of the areas covered include required documents, tracing the data through the systems, Control Account Manager (CAM) preparation, and system verification.

    Today's rapidly developing and changing technologies and industrial practices frequently carry with them the increased generation of wastes and materials which, if improperly managed, may threaten public health and the environment. The US Environmental Protection Agency is charged with the mission of protecting public health and the environment from the hazards posed by these wastes and materials. As part of its effort to achieve this mandate, it has recently adopted a Pollution Prevention Program. Among other things, the program encourages the development and adoption of processing technologies and products that will lead to reducing the aggregate generation rates for pollutants entering the environment. This paper will address EPA's efforts under its Pollution Prevention Program. The paper will address regulatory and non-regulatory action EPA has taken pursuant to the Resource Conservation and Recovery Act (RCRA), the Emergency Planning and Community Right-to-Know Act, the Pollution Prevention Act of 1990, and other Federal statutes. In addition, the paper will present case studies in pollution prevention.

    In December 1993, the US Environmental Protection Agency (EPA) released its final rule that sets for the details for requirements to sell reformulated gasoline (RFG) in certain ozone non-attainment areas. At the same time, EPA also issued a proposed rule to require that 30% of the oxygen required in RFG be based on a renewable oxygenate. Renewables include ethanol and its ether derivatives such as ethyl tertiary butyl ether (ETBE). The RFG rule is a final rule, while the Renewable Oxygenate Requirement (ROR) rule is a proposed rule yet to be finalized and subject to revision. Included in this paper are brief reviews of Ashland petroleum Company`s ethanol usage, oxygenated fuel and reformulated gasoline blending economics, and some comments on the EPA proposed renewable oxygenate requirement.

    The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work together to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on actions that NRC should consider that address the site-specific matter that triggered consultation. Over the course of consultations on the eight sites, there have been some reoccurring themes to EPA's views. Primarily, these are EPA: 1. Recommending that NRC consider selecting institutional controls to ensure that NRC's assumptions about future human exposure at the site are not exceeded. 2. Recommending that NRC consider using more site-specific information when conducting dose assessment modeling. 3. Recommending that NRC consider a flexible approach to groundwater protection that still ensures the public is not exposed to contamination levels over drinking water limits. 4. Recommending that NRC consider an approach similar to how EPA implements supplemental standards under 40 CFR 192 as an ARAR when the UMTRCA soil standard of 5 pCi/g is not being met.

    In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs).     The Waste Isolation Pilot Plant (WIPP) Compliance Certification Application (CCA) Performance Assessment (PA) Parameter Database and its ties to supporting information evolved over the course of two years. When the CCA was submitted to the Environmental Protection Agency (EPA) in October 1996, information such as identification of parameter value or distribution source was documented using processes established by Sandia National Laboratories WIPP Quality Assurance Procedures. Reviewers later requested additional supporting documentation, links to supporting information, and/or clarification for many parameters. This guidebook is designed to document a pathway through the complex parameter process and help delineate flow paths to supporting information for all WIPP CCA parameters. In addition, this report is an aid for understanding how model parameters used in the WIPP CCA were developed and qualified. To trace the source information for a particular parameter, a dual-route system was established. The first route uses information from the Parameter Records package as it existed when the CCA calculations were run. The second route leads from the EPA Parameter Database to additional supporting information.

    Criminal investigators from the Environmental Protection Agency (EPA) and its field offices testified at a hearing on whether EPA has sufficient authority to investigate criminal violations, particularly in the area of illegal disposal of hazardous materials. They reported on the agency's progress in staffing a unit with authority comparable to that of Customs and the FBI. The Justice Department opposed deputizing EPA investigators, but the committee found that investigators in the 22 states surveyed operate with law-enforcement powers.     On October 20, 1993, the US Environmental Protection Agency (EPA) published in the Federal Register the proposed rule entitled Risk Management Programs for Chemical Accidental Release Prevention (40 CFR 68). Subsequently, on January 31, 1994, EPA published in the Federal Register the finalized list of 77 regulated toxic substances and 63 regulated flammable substances that are to be covered under the rule along with the associated threshold quantities for each substance. This list of substances will dictate which stationary sources will have to comply with the requirements of the proposed risk management program rule. The risk management program rule will most likely be finalized sometime after mid-1995. Covered facilities will then have a total of three years to achieve complete compliance with the requirements of the rule. This paper presents an approach for corporations with multiple sites to develop action plans for implementation of the risk management program rule. The process starts with a determination of which facilities are potentially covered, development of a matrix of requirements that each facility must comply with, and finally, common strategies that may be used in achieving compliance. Thus, a multi-facility corporation can develop a baseline compliance guideline document that individual plants can use in developing and implementing their risk management programs.

The Department of Energy (DOE) Carlsbad Field Office (CBFO) is seeking approval from the Environmental Protection Agency (EPA) and the New Mexico Environment Department (NMED) of the remote-handled (RH) TRU characterization plan to allow disposal of RH TRU waste in the WIPP repository. Each regulatory agency (i.e., EPA, NMED, and NRC) has different requirements that will have to be met through the use of information collected by characterizing the RH TRU waste. Therefore, the DOE-CBFO has developed a proposed characterization program for obtaining the RH TRU waste information necessary to demonstrate that the waste meets the applicable regulatory requirements. This process involved the development of a comprehensive set of Data Quality Objectives (DQOs) comprising the various regulatory requirements. The DOE-CBFO has identified seven DQOs for use in the RH TRU waste characterization program. These DQOs are defense waste determination, TRU waste determination, RH TRU determination, activity determination, RCRA physical and chemical properties, prohibited item determination, and EPA physical and chemical properties. The selection of the DQOs were based on technical, legal and regulatory drivers that assure the health and safety of the workers, the public, to protect the environment, and to comply with the requirements of the regulatory agencies. The DOE-CBFO also has the responsibility for the certification of generator/storage sites to ship RH TRU mixed waste to the WIPP for disposal. Currently, thirteen sites across the DOE complex are generators of RH TRU waste or store the waste at their location for other generators. Generator/storage site certification involves review and approval of site-specific programmatic documents that demonstrate compliance with the WIPP waste characterization and transportation requirements. Additionally, procedures must be developed to implement programmatic requirements and adequacy of those procedures determined. Finally, on-site audits evaluate the technical and administrative implementation and effectiveness of the operating procedures.

    The US Environmental Protection Agency (EPA) Conservation Verification Protocols (CVPs) are a set of step-by-step procedures for impact monitoring and evaluation of electric utility demand-side management (DSM) programs. The EPA developed these protocols as part of its mission to implement the Acid Rain Program authorized by Title IV of the Clean Air Amendments of 1990. This report provides an overview of the CVPs and how they can be used by electric utilities in DSM program monitoring and evaluation.     This report presents the results of a review of the US Environmental Protection Agency (EPA) Record of Decision System (RODS) database search conducted to identify Superfund landfill sites where a Record of Decision (ROD) has been prepared by EPA, the States or the US Army Corps of Engineers describing the selected remedy at the site. ROD abstracts from the database were reviewed to identify site information including site type, contaminants of concern, components of the selected remedy, and cleanup goals. It explains state-level cash incentives available, the importance of solar renewable energy certificate revenues (in certain markets), existing financing structures, as well as innovative financing structures being used by federal agencies to deploy on-site PV.     On April 1, 2010, the Environmental Protection Agency (EPA) issued a set of new guidelines to several of its Regional offices regarding the compliance of surface coal mining operations in Appalachia with the provisions of the Clean Water Act (CWA), the National Environmental Policy Act, and the environmental justice Executive Order (E.O. 12898). The stated purpose of the guidance was to explain more fully the approach that the EPA will be following in permit reviews, and to provide additional assurance that its Regional offices use clear, consistent, and science-based standards in reviewing the permits. Although the new guidelines go into effect immediately, they will be subjected to review both by the public and by the EPA's Science Advisory Board, with a set of final guidelines to be issued no later than April 1, 2011.

    The U.S. Environmental Protection Agency (EPA) Superfund program's six Preliminary Remediation Goal (PRG) and Dose Compliance Concentration (DCC) internet based calculators for risk and dose assessment at Superfund sites are being revised to reflect better science, revisions to existing exposure scenarios and new scenarios, and changes to match up more closely with the EPA chemical regional screening level calculator. A revised version of the 1999 guidance document that provides an overview for the Superfund risk assessment process at radioactively contaminated sites, 'Radiation Risk Assessment At CERCLA Sites: Q and A', is being completed that will reflect Superfund recommended guidance and other technical documents issued over the past 13 years. EPA is also issuing a series of fact sheets in the document 'Superfund Radiation Risk Assessment: A Community Tool-kit'. This presentation would go over those changes that are expected to be finished by this spring. (authors)

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE`s position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.

Curriculum development was by teams of Saint Francis University Faculty in the Business Administration and Science Departments and industry experts. Students seeking undergraduate and graduate degrees are able to enroll in courses offered within these departments which will combine theory and hands-on training in the various elements of wind power development.     The U.S. Environmental Protection Agency's (EPA) Integrated Risk Information System (IRIS) Program develops assessments of health effects that may result from chronic exposure to chemicals in the environment. The IRIS database contains more than 540 assessments. When supported by available data, IRIS assessments provide quantitative analyses of carcinogenic effects. Since publication of EPA's 2005 Guidelines for Carcinogen Risk Assessment, IRIS cancer assessments have implemented new approaches recommended in these guidelines and expanded the use of complex scientific methods to perform quantitative dose-response assessments. Two case studies of the application of the mode of action framework from the 2005 Cancer Guidelines are presented in this paper. The first is a case study of 1,2,3-trichloropropane, as an example of a chemical with a mutagenic mode of carcinogenic action thus warranting the application of age-dependent adjustment factors for early-life exposure; the second is a case study of ethylene glycol monobutyl ether, as an example of a chemical with a carcinogenic action consistent with a nonlinear extrapolation approach. The use of physiologically based pharmacokinetic (PBPK) modeling to quantify interindividual variability and account for human parameter uncertainty as part of a quantitative cancer assessment is illustrated using a case study involving probabilistic PBPK modeling for dichloromethane. We also discuss statistical issues in assessing trends and model fit for tumor dose-response data, analysis of the combined risk from multiple types of tumors, and application of life-table methods for using human data to derive cancer risk estimates. These issues reflect the complexity and challenges faced in assessing the carcinogenic risks from exposure to environmental chemicals, and provide a view of the current trends in IRIS carcinogenicity risk assessment.

    The Environmental Protection Agency of the State of Illinois (Illinois EPA) has programs in water, air, and land pollution and water supplies paralleling those of the US Environmental Protection Agency (EPA). The organization is part of a tripartite arrangement in which the Pollution Control Board is the judicial arm, the Department of Energy and Natural Resources is the research arm, and the Illinois EPA is the enforcement arm.     The Waste Isolation Pilot Plant (WIPP) is a US Department of Energy (DOE) facility for the permanent disposal of transuranic waste from defense activities. In 1996, the DOE submitted the Title 40 CFR Part 191 Compliance Certification Application for the Waste Isolation Pilot Plant (CCA) to the US Environmental Protection Agency (EPA). The CCA included a probabilistic performance assessment (PA) conducted by Sandia National Laboratories to establish compliance with the quantitative release limits defined in 40 CFR 191.13. An experimental program to collect data relevant to the actinide source term began around 1989, which eventually supported the 1996 CCA PA actinide source term model. The actinide source term provided an estimate of mobile dissolved and colloidal Pu, Am, U, Th, and Np concentrations in their stable oxidation states, and accounted for effects of uncertainty in the chemistry of brines in waste disposal areas. The experimental program and the actinide source term included in the CCA PA underwent EPA review lasting more than 1 year. Experiments were initially conducted to develop data relevant to the wide range of potential future conditions in waste disposal areas. Interim, preliminary performance assessments and actinide source term models provided insight allowing refinement of experiments and models. Expert peer review provided additional feedback and confidence in the evolving experimental program. By 1995, the chemical database and PA predictions of WIPP performance were considered reliable enough to support the decision to add an MgO backfill to waste rooms to control chemical conditions and reduce uncertainty in actinide concentrations, especially for Pu and Am. Important lessons learned through the characterization, PA modeling, and regulatory review of the actinide source term are (1) experimental characterization and PA should evolve together, with neither activity completely dominating the other, (2) the understanding of physical processes required to develop conceptual models is greater than can be represented in PA models, (3) experimentalists should be directly involved in model and parameter abstraction and simplification for PA, and (4) external expert review should be incorporated early in a project to increase confidence long before regulatory reviews begin.

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE's position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.

    The EPA Draft Document on EMF and Cancers grew out of an earlier effort by EPA to track biological effects literature relative to radio-frequency (RF) exposure. Scope of the document was broadened to include extremely low frequency electric and magnetic fields prior to an announcement in 1986 that EPA would formally review the whole area of non-ionizing radiation. An extensive survey of the relevant bioeffects and epidemiologic literature was carried out, and writing on the document began in earnest on the document sometime in 1989. In its draft form, the document reviewed the literature on mechanisms of Interaction between electromagnetic fields and biological tissue, EMF epidemiologic studies, supporting evidence for carcinogenicity and research needs. In the early summer of 1990, a draft of the document was reviewed by some 22 individuals within the EPA and other government agencies. It was also sent out for external review to an additional 9 qualified scientists who had worked in the area and were familiar with EMF-related literature in epidemiology, biology, and physics. Many of the comments sent to EPA from this first review, prior to release of the draft for public comment, were strikingly similar to those resulting from the second (public) review process. Thus, it appears that much of the controversy that was later associated with the document could have been avoided had the authors been diligent in following the recommendations of the initial set of reviewers.

    This report describes the work performed by TRI/Environmental, Inc. (TRI) to determine the chemical compatibility of one geomembrane and one seamed geomembrane with four synthetically generated leachates. The objective was to determine the resistance of the geomembrane to changes caused by exposure to the leachates. Changes in physical and mechanical properties were measured after exposure to the leachates at 23 C and 50 C for 30, 60, 90 and 120 days. Exposures were performed in accordance with the exposure regimen specified in US Environmental Protection Agency (EPA) Method 9090A. Methods, results and discussion are provided. Test results are also provided in the Tables of Results which accompany this report.

    ENERGY STAR is a voluntary energy efficiency-labeling program operated jointly by the United States Department of Energy and the United States Environmental Protection Agency (US EPA). Since the program inception in 1992, ENERGY STAR has become a leading international brand for energy efficient products. ENERGY STAR's central role in the development of regional, national, and international energy programs necessitates an open process whereby its program achievements to date as well as projected future savings are shared with committed stakeholders. Through 2006, US EPA?S ENERGY STAR labeled products saved 4.8 EJ of primary energy and avoided 82 Tg C equivalent. We project that US EPA?S ENERGY STAR labeled products will save 12.8 EJ and avoid 203 Tg C equivalent over the period 2007-2015. A sensitivity analysis examining two key inputs (carbon factor and ENERGY STAR unit sales) bounds the best estimate of carbon avoided between 54 Tg C and 107 Tg C (1993 to 2006) and between 132 Tg C and 278 Tg C (2007 to 2015).

    The purpose of this project was to evaluate integrated packages of advanced measures in individual test homes to assess their performance with respect to Building America Program goals, specifically compliance with the DOE Challenge Home Program. BSC consulted on the construction of five test houses by three Cold Climate production builders in three separate US cities. BSC worked with the builders to develop a design package tailored to the cost-related impacts for each builder. Therefore, the resulting design packages do vary from builder to builder. BSC provided support through this research project on the design, construction and performance testing of the five test homes. Overall, the builders have concluded that the energy related upgrades (either through the prescriptive or performance path) represent reasonable upgrades. The builders commented that while not every improvement in specification was cost effective (as in a reasonable payback period), many were improvements that could improve the marketability of the homes and serve to attract more energy efficiency discerning prospective homeowners. However, the builders did express reservations on the associated checklists and added certifications. An increase in administrative time was observed with all builders. The checklists and certifications also inherently increase cost due to: 1. Adding services to the scope of work for various trades, such as HERS Rater, HVAC contractor; 2. Increased material costs related to the checklists, especially the EPA Indoor airPLUS and EPA WaterSense(R) Efficient Hot Water Distribution requirement.

    With the advent and encouragement of recent initiatives by EPA and state environmental regulators for the development and use by business entities of voluntary environmental compliance and audit programs has come an increased concern over the potential for criminal prosecution of individuals charged with the responsibility for ensuring environmental compliance. With the EPA avoiding the issue of whether audit findings will be used as evidence in a joint civil and criminal investigation (i.e., multi-media inspection), a sense of heightened concern has been prevalent in the regulated community. This paper will address the use of audit methodologies that incorporate law enforcement/criminal investigatory techniques as well as suggested attorney-client reporting structure that should be applied in auditing in order to prevent/mitigate the potential for criminal enforcement actions. The goals of the paper are to enable both corporate compliance managers and environmental auditors to be aware of the potential pitfalls and/or liabilities associated with compliance audit findings. Additionally, to educate auditors on when and how to take further steps, through the use of investigatory interviewing techniques, in order to develop answers to questionable data and/or confirm findings of the environmental audit to avoid civil and criminal penalties. The goals of an environment audit should be to avoid both civil and criminal prosecution through the advanced identification of liabilities and the subsequent development of protocols to achieve compliance.     The National Radon Database has been developed by the U.S. Environmental Protection Agency (EPA) to distribute information collected in two recently completed radon surveys: the EPA/State Residential Radon Surveys, Years 1 to 6; and The National Residential Radon Survey. The goals of the state radon surveys were twofold. Some measure of the distribution of radon levels among residences was desired for major geographic areas within each state and for each state as a whole. In addition, it was desired that each state survey would be able to identify areas of potentially high residential radon concentrations (hot spots) in the state, enabling the state to focus its attention on areas where indoor radon concentrations might pose a greater health threat. The document discusses year 4, 1989-90. The areas surveyed are: California; Hawaii; Idaho; Louisiana; Nebraska; Billings, MT IHS Area; Nevada; North Carolina; Oklahoma; South Carolina; and Navajo Nation.

    U.S. EPA`s Wood Products Initiative has resulted in the settlement with Louisiana-Pacific (L-P) for over eleven million dollars in fines and much more in expenditures for corporate environmental improvements. EPA claimed that L-P`s corporate environmental structure inadequately addressed the environmental requirements of the Clean Air Act. L-P failed to obtain the necessary permits and provide the permitting authorities with accurate and complete information on air emissions. The author concentrates on the steps companies must follow to ensure that adequate permitting is obtained. The paper states clearly the expectations EPA has of permitting authorities and permit applicants. A checklist of criteria necessary to avoid permitting dilemmas is presented, along with practical advice for environmental managers responsible for permitting and interactions with regulatory authorities. The steps of source identification, emissions quantification, control technology selection, and permit completion are detailed.

    Vehicle manufacturers among others are putting great emphasis on improving fuel economy (FE) of light-duty vehicles in the U.S. market, with significant FE gains being realized in recent years. The U.S. Environmental Protection Agency (EPA) data indicates that the aggregate FE of vehicles produced for the U.S. market has improved by over 20% from model year (MY) 2005 to 2013. This steep climb in FE includes changes in vehicle choice, improvements in engine and transmission technology, and reducing aerodynamic drag, rolling resistance, and parasitic losses. The powertrain related improvements focus on optimizing in-use efficiency of the transmission and engine as a system, and may make use of what is termed downsizing and/or downspeeding. This study explores quantifying recent improvements in powertrain efficiency, viewed separately from other vehicle alterations and attributes (noting that most vehicle changes are not completely independent). A methodology is outlined to estimate powertrain efficiency for the U.S city and highway cycle tests using data from the EPA vehicle database. Comparisons of common conventional gasoline powertrains for similar MY 2005 and 2013 vehicles are presented, along with results for late-model hybrid electric vehicles, the Nissan Leaf, Chevy Volt and other selected vehicles.

    The U.S. Environmental Protection Agency (EPA) requested an external, independent verification study of their updated Preliminary Remediation Goals for Radionuclides (PRG) electronic calculator. The calculator provides PRGs for radionuclides that are used as a screening tool at Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and Resource Conservation and Recovery Act (RCRA) sites. These risk-based PRGs establish concentration limits under specific exposure scenarios. The purpose of this verification study is to determine that the calculator has no inherit numerical problems with obtaining solutions as well as to ensure that the equations are programmed correctly. There are 167 equations used in the calculator. To verify the calculator, all equations for each of seven receptor types (resident, construction worker, outdoor and indoor worker, recreator, farmer, and composite worker) were hand calculated using the default parameters. The same four radionuclides (Am-241, Co-60, H-3, and Pu-238) were used for each calculation for consistency throughout.

Data from the sensor is compared to threshold values provided by an extrinsic standard setting organizations using a certification engine. This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances.     The purpose of this project was to evaluate integrated packages of advanced measures in individual test homes to assess their performance with respect to Building America Program goals, specifically compliance with the DOE Challenge Home Program. BSC consulted on the construction of five test houses by three Cold Climate production builders in three separate US cities. BSC worked with the builders to develop a design package tailored to the cost-related impacts for each builder. Therefore, the resulting design packages do vary from builder to builder. BSC provided support through this research project on the design, construction and performance testing of the five test homes. Overall, the builders have concluded that the energy related upgrades (either through the prescriptive or performance path) represent reasonable upgrades. The builders commented that while not every improvement in specification was cost effective (as in a reasonable payback period), many were improvements that could improve the marketability of the homes and serve to attract more energy efficiency discerning prospective homeowners. However, the builders did express reservations on the associated checklists and added certifications. An increase in administrative time was observed with all builders. The checklists and certifications also inherently increase cost due to: 1. Adding services to the scope of work for various trades, such as HERS Rater, HVAC contractor. 2. Increased material costs related to the checklists, especially the EPA Indoor airPLUS and EPA WaterSense Efficient Hot Water Distribution requirement.

    In June 1996, the Renewable Aviation Fuels Development Center (RAFDC) at Baylor University in Waco, Texas, received a Supplemental Type Certificate (STC) for the use of 100% ethanol as a fuel for the Cessna 152, the most popular training aircraft in the world. This is the first certification granted by the Federal Aviation Administration (FAA) for a non-petroleum fuel. Certification of an aircraft on a new fuel requires a certification of the engine followed by a certification of the airframe/engine combination. This paper will describe the FAA airframe certification procedure, the tests required and their outcome using ethanol as an aviation fuel in a Cessna 152.

    The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

    Both the UK and US Municipal Waste Combuster (MWC) markets have undergone upgraded regulatory control. In the UK, the government`s Integrated Pollution Control (IPC) regime, enforced by the 1990 Environmental Protection Act (EPA) Standard IPR5/3 moved control of emissions of MWCs from local councils to the government Environmental Authority (EA). Existing MWCs had until December 1, 1996 to complete environmental upgrades. Simultaneously, the European Community (EC) was finalizing more stringent legislation to take place in the year 2001. In the US, the 1990 Clean Air Act amendments required the Environmental Protection Agency (EPA) to issue emission guidelines for new and existing facilities. Existing facilities are likely to have only until the end of 1999 to complete upgrades. In North America, Procedair Industries Corp had received contracts from Kvaerner EnviroPower AB, for APC systems of four new Refuse Derived Fuel (RDF) fluid bed boilers that incorporated low outlet temperature economizers as part of the original boiler equipment. The Fayetteville, North Carolina facility was designed for 200,000 tpy. What all these facilities have in common is low economizer outlet temperatures of 285{degrees}F coupled with a Total Dry Scrubbing System. MWC or RDF facilities using conventional spray dryer/fabric filter combinations have to have economizer gas outlet temperatures about 430{degrees}F to allow for evaporation of the lime slurry in the spray dryer without the likelihood of wall build up or moisture carry over. Since the Totally Dry Scrubbing System can operate with economizer gas outlet temperatures about 285{degrees}F, the added energy available for sale from adding low outlet temperature economizer heat recovery can be considerable. This paper focuses on Procedair`s new plant and retrofit experience using `Dry Venturi Reactor/Fabric Filter` combinations with the lower inlet temperature operating conditions.
