    What the EPA, working jointly with the states, hopes to accomplish over the next ten years in order to integrate and coordinate all the groundwater programs within the agency is discussed. Although many other EPA programs such as Superfund, Clean Air Act, and Wetlands Management are often highlighted in the media, EPA does not down rate the importance of groundwater protection. Indeed as a resource, it is one of the most important commodities. Groundwater is the basis for life in this country. Recharge rates are no where near what the withdrawal rates are in many areas of the country. Twenty-five percent of all the potable water comes from groundwater. Groundwater supplies 50 percent of the needs for all the US population. If you include strictly rural areas, it supplies 95 percent of all the use. Something that most people who are not groundwater hydrologists would not think about is the fact that groundwater is a recharge mechanism that provides over 30 percent of the flow in streams and major rivers.

    The quantitative procedures associated with noncancer risk assessment include reference dose (RfD), benchmark dose, and severity modeling. The RfD, which is part of the EPA risk assessment guidelines, is an estimation of a level that is likely to be without any health risk to sensitive individuals. The RfD requires two major judgments: the first is choice of a critical effect(s) and its No Observed Adverse Effect Level (NOAEL); the second judgment is choice of an uncertainty factor. This paper discusses major assumptions and limitations of the RfD model.

    Today's rapidly developing and changing technologies and industrial practices frequently carry with them the increased generation of wastes and materials which, if improperly managed, may threaten public health and the environment. The US Environmental Protection Agency is charged with the mission of protecting public health and the environment from the hazards posed by these wastes and materials. As part of its effort to achieve this mandate, it has recently adopted a Pollution Prevention Program. Among other things, the program encourages the development and adoption of processing technologies and products that will lead to reducing the aggregate generation rates for pollutants entering the environment. This paper will address EPA's efforts under its Pollution Prevention Program. The paper will address regulatory and non-regulatory action EPA has taken pursuant to the Resource Conservation and Recovery Act (RCRA), the Emergency Planning and Community Right-to-Know Act, the Pollution Prevention Act of 1990, and other Federal statutes. In addition, the paper will present case studies in pollution prevention.

  3. Statutory complexity disguises agency capture in Citizens Coal Council v. EPA

    In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    In December 1993, the US Environmental Protection Agency (EPA) released its final rule that sets for the details for requirements to sell reformulated gasoline (RFG) in certain ozone non-attainment areas. At the same time, EPA also issued a proposed rule to require that 30% of the oxygen required in RFG be based on a renewable oxygenate. Renewables include ethanol and its ether derivatives such as ethyl tertiary butyl ether (ETBE). The RFG rule is a final rule, while the Renewable Oxygenate Requirement (ROR) rule is a proposed rule yet to be finalized and subject to revision. Included in this paper are brief reviews of Ashland petroleum Company`s ethanol usage, oxygenated fuel and reformulated gasoline blending economics, and some comments on the EPA proposed renewable oxygenate requirement.

    On October 20, 1993, the US Environmental Protection Agency (EPA) published in the Federal Register the proposed rule entitled Risk Management Programs for Chemical Accidental Release Prevention (40 CFR 68). Subsequently, on January 31, 1994, EPA published in the Federal Register the finalized list of 77 regulated toxic substances and 63 regulated flammable substances that are to be covered under the rule along with the associated threshold quantities for each substance. This list of substances will dictate which stationary sources will have to comply with the requirements of the proposed risk management program rule. The risk management program rule will most likely be finalized sometime after mid-1995. Covered facilities will then have a total of three years to achieve complete compliance with the requirements of the rule. This paper presents an approach for corporations with multiple sites to develop action plans for implementation of the risk management program rule. The process starts with a determination of which facilities are potentially covered, development of a matrix of requirements that each facility must comply with, and finally, common strategies that may be used in achieving compliance. Thus, a multi-facility corporation can develop a baseline compliance guideline document that individual plants can use in developing and implementing their risk management programs.

    With the advent and encouragement of recent initiatives by EPA and state environmental regulators for the development and use by business entities of voluntary environmental compliance and audit programs has come an increased concern over the potential for criminal prosecution of individuals charged with the responsibility for ensuring environmental compliance. With the EPA avoiding the issue of whether audit findings will be used as evidence in a joint civil and criminal investigation (i.e., multi-media inspection), a sense of heightened concern has been prevalent in the regulated community. This paper will address the use of audit methodologies that incorporate law enforcement/criminal investigatory techniques as well as suggested attorney-client reporting structure that should be applied in auditing in order to prevent/mitigate the potential for criminal enforcement actions. The goals of the paper are to enable both corporate compliance managers and environmental auditors to be aware of the potential pitfalls and/or liabilities associated with compliance audit findings. Additionally, to educate auditors on when and how to take further steps, through the use of investigatory interviewing techniques, in order to develop answers to questionable data and/or confirm findings of the environmental audit to avoid civil and criminal penalties. The goals of an environment audit should be to avoid both civil and criminal prosecution through the advanced identification of liabilities and the subsequent development of protocols to achieve compliance. However, oftentimes the use of a pre-established {open_quotes}checklist.

    U.S. EPA`s Wood Products Initiative has resulted in the settlement with Louisiana-Pacific (L-P) for over eleven million dollars in fines and much more in expenditures for corporate environmental improvements. EPA claimed that L-P`s corporate environmental structure inadequately addressed the environmental requirements of the Clean Air Act. L-P failed to obtain the necessary permits and provide the permitting authorities with accurate and complete information on air emissions. The author concentrates on the steps companies must follow to ensure that adequate permitting is obtained. The paper states clearly the expectations EPA has of permitting authorities and permit applicants. A checklist of criteria necessary to avoid permitting dilemmas is presented, along with practical advice for environmental managers responsible for permitting and interactions with regulatory authorities. The steps of source identification, emissions quantification, control technology selection, and permit completion are detailed.

    In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs). Forty-two CRADAs and five licensing agreements have been initiated with EPA under this program. This paper provides an overview of this new and innovative program within the EPA. 1 fig., 2 tabs.

    Adam Sieminski Administrator Biography Adam Sieminski was sworn in on June 4, 2012, as the eighth administrator of the U.S. Energy Information Administration (EIA).     The survey reported here was conducted with the intent of identifying categories of low-level radioactive wastes which would be classified under EPA regulations 40 CFR Part 261 as hazardous due to the chemical properties of the waste. Three waste types are identified under these criteria as potential radioactive mixed wastes: wastes containing organic liquids; wastes containing lead metal; and wastes containing chromium. The survey also indicated that certain wastes, specific to particular generators, may also be radioactive mixed wastes. Ultimately, the responsibility for determining whether a facility's wastes are mixed wastes rest with the generator. However, the uncertainties as to which regulations are applicable, and the fact that no legal definition of mixed wastes exists, make such a determination difficult. In addition to identifying mixed wastes, appropriate methods for the management of mixed wastes must be defined. In an ongoing study, BNL is evaluating options for the management of mixed wastes. These options will include segregation, substitution, and treatments to reduce or eliminate chemical hazards associated with the wastes listed above. The impacts of the EPA regulations governing hazardous wastes on radioactive mixed waste cannot be assessed in detail until the applicability of these regulations is agreed upon. This issue is still being discussed by EPA and NRC and should be resolved in the near future.     Traditionally, the No-Observed-Adverse-Effect-Level (NOAEL) approach has been used to determine the point of departure (POD) from animal toxicology data for use in human health risk assessments. However, this approach is subject to substantial limitations that have been well defined, such as strict dependence on the dose selection, dose spacing, and sample size of the study from which the critical effect has been identified. Also, the NOAEL approach fails to take into consideration the shape of the dose-response curve and other related information. The benchmark dose (BMD) method, originally proposed as an alternative to the NOAEL methodology in the 1980s, addresses many of the limitations of the NOAEL method. It is less dependent on dose selection and spacing, and it takes into account the shape of the dose-response curve. In addition, the estimation of a BMD 95% lower bound confidence limit (BMDL) results in a POD that appropriately accounts for study quality (i.e., sample size). With the recent advent of user-friendly BMD software programs, including the U.S. Environmental Protection Agency's (U.S. EPA) Benchmark Dose Software (BMDS), BMD has become the method of choice for many health organizations world-wide. This paper discusses the BMD methods and corresponding software (i.e., BMDS version 2.1.1) that have been developed by the U.S. EPA, and includes a comparison with recently released European Food Safety Authority (EFSA) BMD guidance.

    The U.S. Environmental Protection Agency's (EPA) Integrated Risk Information System (IRIS) Program develops assessments of health effects that may result from chronic exposure to chemicals in the environment. The IRIS database contains more than 540 assessments. When supported by available data, IRIS assessments provide quantitative analyses of carcinogenic effects. Since publication of EPA's 2005 Guidelines for Carcinogen Risk Assessment, IRIS cancer assessments have implemented new approaches recommended in these guidelines and expanded the use of complex scientific methods to perform quantitative dose-response assessments. Two case studies of the application of the mode of action framework from the 2005 Cancer Guidelines are presented in this paper. The first is a case study of 1,2,3-trichloropropane, as an example of a chemical with a mutagenic mode of carcinogenic action thus warranting the application of age-dependent adjustment factors for early-life exposure; the second is a case study of ethylene glycol monobutyl ether, as an example of a chemical with a carcinogenic action consistent with a nonlinear extrapolation approach. The use of physiologically based pharmacokinetic (PBPK) modeling to quantify interindividual variability and account for human parameter uncertainty as part of a quantitative cancer assessment is illustrated using a case study involving probabilistic PBPK modeling for dichloromethane. We also discuss statistical issues in assessing trends and model fit for tumor dose-response data, analysis of the combined risk from multiple types of tumors, and application of life-table methods for using human data to derive cancer risk estimates. These issues reflect the complexity and challenges faced in assessing the carcinogenic risks from exposure to environmental chemicals, and provide a view of the current trends in IRIS carcinogenicity risk assessment.

    The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work together to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on actions that NRC should consider that address the site-specific matter that triggered consultation. Over the course of consultations on the eight sites, there have been some reoccurring themes to EPA's views. Primarily, these are EPA: 1. Recommending that NRC consider selecting institutional controls to ensure that NRC's assumptions about future human exposure at the site are not exceeded. 2. Recommending that NRC consider using more site-specific information when conducting dose assessment modeling. 3. Recommending that NRC consider a flexible approach to groundwater protection that still ensures the public is not exposed to contamination levels over drinking water limits. 4. Recommending that NRC consider an approach similar to how EPA implements supplemental standards under 40 CFR 192 as an ARAR when the UMTRCA soil standard of 5 pCi/g is not being met.

    Failures of the complex infrastructures society depends on having enormous human and economic cost that poses the question: Are there ways to optimize these systems to reduce the risks of failure? A dynamic model of one such system, the power transmission grid, is used to investigate the risk from failure as a function of the system size. It is found that there appears to be optimal sizes for such networks where the risk of failure is balanced by the benefit given by the size.

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE`s position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.

    On April 1, 2010, the Environmental Protection Agency (EPA) issued a set of new guidelines to several of its Regional offices regarding the compliance of surface coal mining operations in Appalachia with the provisions of the Clean Water Act (CWA), the National Environmental Policy Act, and the environmental justice Executive Order (E.O. 12898). The stated purpose of the guidance was to explain more fully the approach that the EPA will be following in permit reviews, and to provide additional assurance that its Regional offices use clear, consistent, and science-based standards in reviewing the permits. Although the new guidelines go into effect immediately, they will be subjected to review both by the public and by the EPA's Science Advisory Board, with a set of final guidelines to be issued no later than April 1, 2011.

    The U.S. Environmental Protection Agency (EPA) Superfund program's six Preliminary Remediation Goal (PRG) and Dose Compliance Concentration (DCC) internet based calculators for risk and dose assessment at Superfund sites are being revised to reflect better science, revisions to existing exposure scenarios and new scenarios, and changes to match up more closely with the EPA chemical regional screening level calculator. A revised version of the 1999 guidance document that provides an overview for the Superfund risk assessment process at radioactively contaminated sites, 'Radiation Risk Assessment At CERCLA Sites: Q and A', is being completed that will reflect Superfund recommended guidance and other technical documents issued over the past 13 years. EPA is also issuing a series of fact sheets in the document 'Superfund Radiation Risk Assessment: A Community Tool-kit'. This presentation would go over those changes that are expected to be finished by this spring. (authors)

    The US Environmental Protection Agency (EPA) Conservation Verification Protocols (CVPs) are a set of step-by-step procedures for impact monitoring and evaluation of electric utility demand-side management (DSM) programs. The EPA developed these protocols as part of its mission to implement the Acid Rain Program authorized by Title IV of the Clean Air Amendments of 1990. This report provides an overview of the CVPs and how they can be used by electric utilities in DSM program monitoring and evaluation. Both the CVPs Monitoring Path and Stipulated Path procedures are summarized and reviewed. Several examples are provided to illustrate how to calculate DSM program energy savings using the CVPSs.

    This report presents the results of a review of the US Environmental Protection Agency (EPA) Record of Decision System (RODS) database search conducted to identify Superfund landfill sites where a Record of Decision (ROD) has been prepared by EPA, the States or the US Army Corps of Engineers describing the selected remedy at the site. ROD abstracts from the database were reviewed to identify site information including site type, contaminants of concern, components of the selected remedy, and cleanup goals. Only RODs from landfill sites were evaluated so that the results of the analysis can be used to support the remedy selection process for the Sanitary Landfill at the Savannah River Site (SRS).

EPA-induced [Ca{sup 2+}]{sub c} elevation was depended on production of ROS. EPA-induced ROS generation, [Ca{sup 2+}]{sub c} increase, and JNK activated caused MPTP opening. The apoptosis induced by EPA was related to release of cytochrome C through the MPTP. EPA induced HepG2 cells apoptosis through ROSCa{sup 2+}JNK mitochondrial pathways. - Abstract: Eicosapentaenoic acid (EPA), a well-known dietary n?3 PUFAS, has been considered to inhibit proliferation of tumor cells. However, the molecular mechanism related to EPA-induced liver cancer cells apoptosis has not been reported. In this study, we investigated the effect of EPA on HepG2 cells proliferation and apoptosis mechanism through mitochondrial pathways. EPA inhibited proliferation of HepG2 cells in a dose-dependent manner and had no significant effect on the cell viability of humor normal liver L-02 cells. It was found that EPA initially evoked ROS formation, leading to [Ca{sup 2+}]{sub c} accumulation and the mitochondrial permeability transition pore (MPTP) opening; EPA-induced HepG2 cells apoptosis was inhibited by N-acetylcysteine (NAC, an inhibitor of ROS), 1,2-bis (2-aminophenoxy) ethane-N,N,N?,N?-tetraacetic acid (BAPTA-AM, a chelator of calcium) and CsA (inhibitor of MPTP). The relationship between ROS production, the increase of cytoplasmic Ca and MPTP opening was detected. It seems that ROS may act as an upstream regulator of EPA-induced [Ca{sup 2+}]{sub c} generation, moreover, generation of ROS, overload of mitochondrial [Ca{sup 2+}]{sub c}, and JNK activated cause the opening of MPTP. Western blotting results showed that EPA elevated the phosphorylation status of JNK, processes associated with the ROS generation. Simultaneously, the apoptosis induced by EPA was related to release of cytochrome C from mitochondria to cytoplasm through the MPTP and activation of caspase-9 and caspase-3. These results suggest that EPA induces apoptosis through ROSCa{sup 2+}JNK mitochondrial pathways.
