  1. USING RISK-BASED CORRECTIVE ACTION (RBCA) TO ASSESS (THEORETICAL) CANCER DEATHS AVERTED COMPARED TO THE (REAL) COST OF ENVIRONMENTAL REMEDIATION

    In 1978, on the basis of existing health studies at the time, the Uranium Mill Tailings Remedial Action (UMTRA) Project legislation was proposed that would authorize remedial action at inactive uranium processing sites and vicinity properties. The cost of the program to the Federal Government was expected to be $180 million. With the completion of this project, approximately 1300 theoretical cancer deaths were prevented in the next 100 years at a cost of $1.45 billion, based on the Fiscal Year 1998 Federal UMTRA budget. The individual site costs ranged from $0.2 million up to $18 billion spent per theoretical cancer death averted over the next 100 years. Resources required to sustain remediation activities such as this are subject to reduction over time, and are originally based on conservative assumptions that tend to overestimate risks to the general public. This evaluation used a process incorporating risk-based corrective action (RBCA); a three-tiered, decision-making process tailoring corrective action activities according to site-specific conditions and risks. If RBCA had been applied at the start of the UMTRA Project, and using a criterion of >1 excess cancer death prevented as justification to remediate the site, only 50% of the existing sites would have been remediated, yielding a cost savings of $303.6 million to the Federal Government and affected States, which share 10% of the cost. This cost savings equates to 21% of the overall project budget. In addition, only 22% of the vicinity properties had structural contamination contributing to elevated interior gamma exposure and radon levels. Focusing only on these particular properties could have saved an additional $269.3 million, yielding a total savings of $573 million; 40% of the overall project budget. As operational experience is acquired, including greater understanding of the radiological and nonradiological risks, decisions should be based on the RBCA process, rather than relying on conservative

    This document formally defines and clarifies the NDEP-approved process the NNSA/NSO Soils Activity uses to fulfill the requirements of the FFACO and state regulations. This process is used to establish FALs in accordance with the risk-based corrective action (RBCA) process stipulated in Chapter 445 of the Nevada Administrative Code (NAC) as described in the ASTM International (ASTM) Method E1739-95 (NAC, 2008; ASTM, 1995). It is designed to provide a set of consistent standards for chemical and radiological corrective actions.

    The U.S. Department of Energy, National Nuclear Security Administration Nevada Site Office (NNSA/NSO) oversees numerous sites on the Nevada Test Site (NTS) and other locations in the State of Nevada that have been impacted by activities related to the development and testing of nuclear devices and by other activities. NNSA/NSO is responsible for protecting members of the public, including site workers, from harmful exposure to both chemical and radiological contaminants at these sites as they remediate these sites. The Nevada Division of Environmental Protection (NDEP) is the primary state agency responsible for protection of human health and the environment with respect to chemical and radiological wastes. In 1996 the DOE, U.S. Department of Defense, and the State of Nevada entered into an agreement known as the ''Federal Facility Agreement and Consent Order'' (FFACO) (1996). Appendix VI to the FFACO describes the strategy employed to plan, implement, and complete environmental corrective action activities at NTS and other locations in the state of Nevada. One of the categories of corrective action units (CAUs) is Industrial Sites, which consists of approximately 1,150 locations that may require some level of investigation and corrective action. To evaluate the need for the extent of corrective action at a particular site, NNSA/NSO assesses the potential impacts to receptors by comparing measurements of contaminant concentrations to risk-based (chemical) and dose-based (radionuclide) standards (action levels). Preliminary action levels (PALs) are established as part of the data quality objective (DQO) process, and are presented in one or more FFACO documents generated as part of the corrective action process.     AR 200-2 is the Army`s implementing regulation to the National Environmental Policy Act (NEPA) and DoD`s NEPA Directive DoDD 6050.1. AR 200-2 was last revised in the late 1980s and since then the scope of Army NEPA compliance activities have significantly increased, and NEPA practice and case law are continually changing. The purpose of revising AR 200-2 is to provide Army personel with clear and Concise guidance on how to meet their NEPA compliance requirements. The revision process included reviewing the current AR 200-2 to identify areas and topics needing clarification or modification; conferring with Army NEPA personnel to obtain views on NEPA compliance practices and procedures; conducting a review and analysis of significant, recent developments in NEPA case law; reviewing other federal NEPA implementing regulations to identify useful, transferrable concepts; preparing a {open_quotes}strawman{close_quotes} version of AR 200-2 to use as a starting point in the revision process; coordinating and consolidating input from the AR 200-2 Revisions Steering Committee; and responding to review comments. A draft version of AR 200-2 has been completed and informal Army-wide comments have been addressed. Some of the issues that the AR 200-2 Revisions Steering Committee considered during the revision effort included expanding the list of categorical exclusions, determining the appropriate length for the public comment period for environmental assessments prior to approval of the finding of no significant impact, determining the appropriate level of analysis for Army actions abroad, and determining whether Comprehensive Environmental Response Compensation Liability Act (CERCLA) or Resource Conservation and Recovery Act (RCRA) actions should be addressed under NEPA. Corrective Action Unit 367 comprises the four corrective action sites (CASs) listed below: • 10-45-01, U-10h Crater (Sedan) • 10-45-02, Ess Crater Site • 10-09-03, Mud Pit • 10-45-03, Uncle Crater Site The CASs in CAU 367 are being investigated because hazardous and/or radioactive contaminants may be present in concentrations that exceed risk-based corrective action (RBCA) levels. Existing information on the nature and extent of potential contamination is insufficient to evaluate and recommend CAAs for the CASs. Additional information will be generated by conducting a CAI before evaluating and selecting CAAs. The scope of the corrective action investigation for CAU 367 includes the following activities: • Move surface debris and/or materials, as needed, to facilitate sampling. • Conduct radiological surveys. • Collect and submit environmental samples for laboratory analysis to determine the area where TED at the site exceeds FALs (i.e., corrective action boundary). • Evaluate TED to potential receptors in areas along Mercury Highway that have been impacted by a release of radionuclides from the Sedan test. • Collect and submit environmental samples for laboratory analysis related to the drilling mud within CAS 10-09-03, Mud Pit, and any encountered stains or waste as necessary to determine whether COCs are present. • If COCs are present, collect additional step-out samples to define the extent of the contamination. • Collect samples of investigation-derived waste, as needed, for waste management purposes.

    This Mitigation Action Plan (MAP) focuses on mitigation commitments stated in the Supplemental Environmental Impact Statement (SEIS) and the Record of Decision (ROD) for the Naval Petroleum Reserve No. 1 (NPR-1). Specific commitments and mitigation implementation actions are listed in Appendix A-Mitigation Actions, and form the central focus of this MAP. They will be updated as needed to allow for organizational, regulatory, or policy changes. It is the intent of DOE to comply with all applicable federal, state, and local environmental, safety, and health laws and regulations.     Environmental professionals today must address many issues that might not have been foreseen by developers of the National Environmental Policy Act of 1969 (NEPA) or the President`s Council on Environmental Quality (CEQ) regulations for implementing NEPA. One issue is the definition of the no action alternative for NEPA documentation of continuing actions. The CEQ regulations do not define the no action alternative, but merely state that NEPA analyses shall {open_quotes}include the alternative of no action{close_quotes}. For NEPA analyses of newly proposed actions, the practical definition of the no action alternative is clear (i.e., the agency will not implement the proposed action or alternative actions). However, the practical definition for NEPA analyses of continuing actions is not so clear. To clarify the definition of the no action alternative for continuing actions, particularly those that involve agency decisions about relicensing existing projects or continuing to operate existing programs or facilities. In trying to clarify the definition of the no action alternative for continuing actions, this paper examines the function of the no action alternative for NEPA analyses in general. Pertinent issues include how the definition of the no action alternative affects the selection of the baseline for environmental analysis and whether inclusion of the no action alternative really forces agencies to consider no action as a realistic alternative. To address these issues, this paper begins with a discussion of relevant legal decisions involving the no action alternative in NEPA analyses. The paper then examines some agency NEPA regulations and recent NEPA documents to provide examples of how some agencies address the no action alternative for continuing actions. Finally, the paper suggests definitions of the no action alternative for continuing actions and methods for addressing no action as a realistic alternative.

The definition of the no-action alternative for newly proposed actions seems clear. However, for continuing actions, the meaning of the no-action alternative is ambiguous. This article examines the overall function of the no-action alternative for NEPA analyses of continuing actions. It begins with a discussion of the conflicting definitions of the no-action alternative for continuing activities, including CEQ regulations and guidelines related to the no-action alternative and legal decisions that have helped establish precedence for defining no action. A review of NEPA regulations and guidelines of 10 federal agencies shows how different agencies define no-action for continuing actions. Review of six recent NEPA documents on continuing actions reveals how their definition of the no-action alternative promote or impede informed decision-making.

    On July 27, 1990, the U.S. Environmental Protection Agency (EPA) proposed a regulatory framework (55 FR 30798) for responding to releases of hazardous waste and hazardous constituents from solid waste management units (SWMUs) at facilities seeking permits or permitted under the Resource Conservation and Recovery Act (RCRA). The proposed rule, `Corrective Action for Solid Waste Management Units at Hazardous Waste Facilities`, would create a new Subpart S under the 40 CFR 264 regulations, and outlines requirements for conducting RCRA Facility Investigations, evaluating potential remedies, and selecting and implementing remedies (i.e., corrective measures) at RCRA facilities. EPA anticipates instances where releases or suspected releases of hazardous wastes or constituents from SWMUs identified in a RCRA Facility Assessment, and subsequently addressed as part of required RCRA Facility Investigations, will be found to be non-existent or non-threatening to human health or the environment. Such releases may require no further action. For such situations, EPA proposed a mechanism for making a determination that no further corrective action is needed.     The US Department of Energy (DOE) is responsible for compliance with an increasingly complex spectrum of environmental regulations. One of the most complex programs is the corrective action program proposed by the US Environmental Protection Agency (EPA) under the authority of the Resource Conservation and Recovery Act (RCRA) as amended by the Hazardous and Solid Waste Amendments (HSWA). The proposed regulations were published on July 27, 1990. The proposed Subpart S rule creates a comprehensive program for investigating and remediating releases of hazardous wastes and hazardous waste constituents from solid waste management units (SWMUs) at facilities permitted to treat, store, or dispose of hazardous wastes. This proposed rule directly impacts many DOE facilities which conduct such activities. This guidance document explains the entire RCRA Corrective Action process as outlined by the proposed Subpart S rule, and provides guidance intended to assist those persons responsible for implementing RCRA Corrective Action at DOE facilities.

    The newly promulgated Subtitle-D landfill regulations (40 CFR 258) require that landfill owners and operators adhere to certain design or performance standards for the location, design, operation and closure of municipal solid waste landfill facilities. This paper addresses the groundwater monitoring requirements and corrective action requirements of those regulations. The section of the regulations addressing groundwater monitoring and corrective action, Subpart-E, is the most comprehensive section of the regulations. As with other parts of the regulation, Subpart-E also contains inherent flexibility. This paper addresses the compliance schedules, exemptions to Subpart-E, and groundwater monitoring systems which include: background determination, multi-unit systems, hydrogeologic investigations, and monitoring well installation. The paper further addresses sampling and analysis requirements for detection and assessment monitoring, and the requirements for corrective action such as remedy assessment, selection, and implementation.

A diode in the positive line provides a constant voltage drop from the input to a regulating transistor emitter. An amplifier is coupled to the positive line through a resistor and is connected between a difference circuit and the regulating transistor base which is negative due to the difference in voltage drop across thc diode and the resistor so that a change in the regulator output causes the amplifier to increase or decrease the base voltage and current and incrcase or decrease the transistor impedance to return the regulator output to normal.     This document contains planned actions to correct the deficiencies identified in the Pre-Tiger Team Self-Assessment (PTTSA), January 1991, of Sandia National Laboratories (SNL -- Albuquerque, New Mexico; Tonopah, Nevada; and Kauai, Hawaii). The Self-Assessment was conducted by a Self-Assessment Working Group consisting of 19 department managers, with support from Environment, Safety, and Health (ES H) professionals, from October through December 1990. Findings from other past audits, dating back to 1985, were reviewed and compared with the PTTSA findings to determine if additional findings, key findings, or root causes were warranted. The resulting ES H Action Plan and individual planned actions were prepared by the ES H Action Plan Project Group with assistance from the Program owners/authors during February and March 1991. The plan was reviewed by SNL Management in April 1991. This document serves as a planning instrument for the Laboratories to aid in the scoping and sizing of activities related to ES H compliance for the coming five years. It will be modified as required to ensure a workload/funding balance and to address the findings resulting from the Tiger Team assessment at SNL, Albuquerque. The process of producing this document has served well to prepare SNL, Albuquerque, for the coming task of producing the required post-Tiger Team action plan document. 8 tabs.

    The Department of Energy`s Federal Energy Management Program (FEMP) is charged with carrying out key sections of EPACT and Executive Order 12903, to make the Federal government operate more efficiently. A congressionally mandated energy and water conservation audit program is one component of this growing DOE program. This paper traces the SAVEnergy Action Plan program throughout its development from (1) identifying projects and Agency champions, (2) establishing a protocol and fitting auditors into the program, (3) developing a data base to track the audits and measure their success, and (4) evaluating the process, learning from mistakes, and charting and transferring successes. A major tenet of the SAVEnergy program is to proactively prescreen all audit activities to ensure that -- where audits are done and Action Plans completed -- projects will be done.

    We present a computational approach to radical rhetoric that leverages the co-expression of rhetoric and action features in discourse to identify violent intent. The approach combines text mining and machine learning techniques with insights from Frame Analysis and theories that explain the emergence of violence in terms of moral disengagement, the violation of sacred values and social isolation in order to build computational models that identify messages from terrorist sources and estimate their proximity to an attack. We discuss a specific application of this approach to a body of documents from and about radical and terrorist groups in the Middle East and present the results achieved.

The corrective actions implemented at CAU 567 were developed based on an evaluation of analytical data from the CAI, the assumed presence of COCs at specific locations, and the detailed and comparative analysis of the CAAs. The CAAs were selected on technical merit focusing on performance, reliability, feasibility, safety, and cost. The implemented corrective actions meet all requirements for the technical components evaluated. The CAAs meet all applicable federal and state regulations for closure of the site.     This Idaho CERCLA Disposal Facility (ICDF) Remedial Action Report has been prepared in accordance with the requirements of Section 6.2 of the INEEL CERCLA Disposal Facility Remedial Action Work Plan. The agency prefinal inspection of the ICDF Staging, Storage, Sizing, and Treatment Facility (SSSTF) was completed in June of 2005. Accordingly, this report has been developed to describe the construction activities completed at the ICDF along with a description of any modifications to the design originally approved for the facility. In addition, this report provides a summary of the major documents prepared for the design and construction of the ICDF, a discussion of relevant requirements and remedial action objectives, the total costs associated with the development and operation of the facility to date, and identification of necessary changes to the Agency-approved INEEL CERCLA Disposal Facility Remedial Action Work Plan and the ICDF Complex Operations and Maintenance Plan.

The latency is determined between a control device and the at least one downhole device. The latency adjusted signal for triggering an action is sent to the downhole device. The action is performed downhole synchronized to the event. A preferred method for determining latency comprises the steps: a control device sends a first signal to the downhole device; after receiving the signal, the downhole device sends a response signal to the control device; and the control device analyzes the time from sending the signal to receiving the response signal.

We provide calculations for the results quoted in that paper, explain how it fits into a broader (tensor) network of ideas, and elaborate on the hypothesis that black holes are the fastest computers in nature.

    Einstein-Hilbert (EH) action can be separated into a bulk and a surface term, with a specific ('holographic') relationship between the two, so that either can be used to extract information about the other. The surface term can also be interpreted as the entropy of the horizon in a wide class of spacetimes. Since EH action is likely to just the first term in the derivative expansion of an effective theory, it is interesting to ask whether these features continue to hold for more general gravitational actions. We provide a comprehensive analysis of Lagrangians of the form {radical}(-g)L={radical}(-g)Q{sub a}{sup bcd}R{sup a}{sub bcd}, in which Q{sub a}{sup bcd} is a tensor with the symmetries of the curvature tensor, made from metric and curvature tensor and satisfies the condition {nabla}{sub c}Q{sub a}{sup bcd}=0, and show that they share these features. The Lanczos-Lovelock Lagrangians are a subset of these in which Q{sub a}{sup bcd} is a homogeneous function of the curvature tensor. They are all holographic, in a specific sense of the term, and--in all these cases--the surface term can be interpreted as the horizon entropy. The thermodynamics route to gravity, in which the field equations are interpreted as TdS=dE+pdV, seems to have a greater degree of validity than the field equations of Einstein gravity itself. The results suggest that the holographic feature of EH action could also serve as a new symmetry principle in constraining the semiclassical corrections to Einstein gravity. The implications are discussed.

    States should participate in coordinated transmission planning through regional transmission groups, while reserving their right to pass upon transmission planning. This would smooth an otherwise difficult transition, as FERC and state regulators seek to facilitate a competitive bulk power market that ignores arbitrary jurisdiction lines. Since the Federal Energy Regulatory Commission issued its Policy Statement on Regional Transmission Groups, two RTG`s, the Western Regional Transmission Association and the Southwest Regional Transmission Association, have gained conditional approval from FERC. A third, the Northwest Regional Transmission Association, files its governing agreement with the Commission, seeking FERC`s approval. Price setting within RTGs and information exchanges involved in planning the grid raise questions of the legality of these collective actions under the antitrust laws. All three agreements allow for exchanges of commercial and planning information, but, conspicuously, do not set transmission prices. For the moment, therefore, antitrust liability for RTGs would arise out of the information exchanges involved in planning the grid. In addition, with FERC pushing for `restructuring` at the wholesale level through open access and the states becoming aggressive in trying to institute competition at the consumer level through retail wheeling, issues of federal-state jurisdiction in transmission have come to the fore.

    This paper presents an unifying graph-based model for representing the infrastructure, behavior and missions of an enterprise. We describe how the model can be used to achieve resiliency against a wide class of failures and attacks. We introduce an algorithm for recommending resilience establishing actions based on dynamic updates to the models. Without loss of generality, we show the effectiveness of the algorithm for preserving latency based quality of service (QoS). Our models and the recommendation algorithms are implemented in a software framework that we seek to release as an open source framework for simulating resilient cyber systems.

    Exposure to silver, and hence its possible environmental effects, has been regulated since the 1960s. Rules were first developed in the United States to protect against potential negative effects to humans due to ingestion of drinking water containing silver. As regulations for other environmental media were developed, silver was generally included because of its designation as a drinking water chemical of concern. Ambient water quality criteria were developed based on the toxic action of ionic silver. In the early 1990s the US Environmental Protection Agency`s Office of Drinking Water downgraded silver from a primary to a secondary maximum contaminant level because the effects of exposure to silver were judged to be cosmetic. Regulations pertaining to solid waste, surface waters, and occupational exposure have not been changed, but may be changed in the near future as the fate and toxic mechanisms of silver become better understood.

    This Corrective Action Decision Document identifies and rationalizes the U.S. Department of Energy, Nevada Operations Office's selection of a recommended Corrective Action Alternative (CAA) appropriate to facilitate the closure of Corrective Action Unit (CAU) 490, Station 44 Burn Area, Tonopah Test Range (TTR), Nevada, under the Federal Facility Agreement and Consent Order. Corrective Action Unit 490 is located on the Nellis Air Force Range and the Tonopah Test Range and is approximately 140 miles northwest of Las Vegas, Nevada. This CAU is comprised of four Corrective Action Sites (CASs): 03-56-001-03BA, Fire Training Area (located southwest of Area 3); RG-56-001-RGBA, Station 44 Burn Area (located west of Main Lake); 03-58-001-03FN, Sandia Service Yard (located north of the northwest corner of Area 3); and 09-54-001-09L2, Gun Propellant Burn Area (located south of the Area 9 Compound on the TTR). A Corrective Action Investigation was performed in July and August 2000, and analytes detected during the corrective action investigation were evaluated against preliminary action levels to determine contaminants of concern (COCs). There were no COCs identified in soil at the Gun Propellant Burn Area or the Station 44 Burn Area; therefore, there is no need for corrective actions at these two sites. Five soil samples at the Fire Training Area and seven at the Sandia Service Yard exceeded PALs for total petroleum hydrocarbons-diesel. Upon the identification of COCs specific to CAU 490, Corrective Action Objectives were developed based on a review of existing data, future use, and current operations at the TTR, with the following three CAAs under consideration: Alternative 1 - No Further Action, Alternative 2 - Closure In Place - No Further Action With Administrative Controls, and Alternative 3 - Clean Closure by Excavation and Disposal.     Project Rulison was a joint US Atomic Energy Commission (AEC) and Austral Oil Company (Austral) experiment, conducted under the AEC`s Plowshare Program, to evaluate the feasibility of using a nuclear device to stimulate natural gas production in low-permeability gas-producing geologic formations. The experiment was conducted on September 10, 1969, and consisted of detonating a 40-kiloton nuclear device at a depth of 2,568 m below ground surface (BGS). This Corrective Action Report describes the cleanup of petroleum hydrocarbon- and heavy-metal-contaminated sediments from an old drilling effluent pond and characterization of the mud pits used during drilling of the R-EX well at the Rulison Site. The Rulison Site is located approximately 65 kilometers (40 miles) northeast of Grand Junction, Colorado. The effluent pond was used for the storage of drilling mud during drilling of the emplacement hole for the 1969 gas stimulation test conducted by the AEC. This report also describes the activities performed to determine whether contamination is present in mud pits used during the drilling of well R-EX, the gas production well drilled at the site to evaluate the effectiveness of the detonation in stimulating gas production. The investigation activities described in this report were conducted during the autumn of 1995, concurrent with the cleanup of the drilling effluent pond. This report describes the activities performed during the soil investigation and provides the analytical results for the samples collected during that investigation.

The device will regulate to a predetermined load for solid state bonding when heated to a bonding temperature.     This remedial action work plan presents the project organization and construction procedures developed for the performance of the remedial actions at U.S. Department of Energy (DOE's) sites on Amchitka Island, Alaska. During the late1960s and early 1970s, the U.S. Department of Defense and the U.S. Atomic Energy Commission (the predecessor agency to DOE) used Amchitka Island as a site for underground nuclear tests. A total of nine sites on the Island were considered for nuclear testing; however, tests were only conducted at three sites (i.e., Long Shot in 1965, Milrow in 1969, and Cannikin in 1971). In addition to these three sites, large diameter emplacement holes were drilled in two other locations (Sites D and F) and an exploratory hole was in a third location (Site E). It was estimated that approximately 195 acres were disturbed by drilling or preparation for drilling in conjunction with these activities. The disturbed areas include access roads, spoil-disposal areas, mud pits which have impacted the environment, and an underground storage tank at the hot mix plant which was used to support asphalt-paving operations on the island. The remedial action objective for Amchitka Island is to eliminate human and ecological exposure to contaminants by capping drilling mud pits, removing the tank contents, and closing the tank in place. The remedial actions will meet State of Alaska regulations, U.S. Fish and Wildlife Service refuge management goals, address stakeholder concerns, and address the cultural beliefs and practices of the native people. The U.S. Department of Energy, Nevada Operations Office will conduct work on Amchitka Island under the authority of the Comprehensive Emergency Response, Compensation, and Liability Act. Field activities are scheduled to take place May through September 2001. The results of these activities will be presented in a subsequent Closure Report.

    This revised Removal Action Work Plan describes the actions to be taken under the non-time-critical removal action recommended in the Action Memorandum for the Non-Time Critical Removal Action at the CPP-603A Basins, Idaho Nuclear Technology and Engineering Center, as evaluated in the Engineering Evaluation/Cost Analysis for the CPP-603A Basin Non-Time Critical Removal Action, Idaho Nuclear Technology and Engineering Center. The regulatory framework outlined in this Removal Action Work Plan has been modified from the description provided in the Engineering Evaluation/Cost Analysis (DOE/NE-ID-11140, Rev. 1, August 2004). The modification affects regulation of sludge removal, treatment, and disposal, but the end state and technical approaches have not changed. Revision of this document had been delayed until the basin sludge was successfully managed. This revision (Rev. 1) has been prepared to provide information that was not previously identified in Rev. 0 to describe the removal, treatment, and disposal of the basin water at the Idaho National Laboratory (INL) CERCLA Disposal Facility evaporation ponds and fill the basins with grout/controlled low strength material (CLSM) was developed. The Engineering Evaluation/Cost Analysis for the CPP-603A Basin Non-Time Critical Removal Action, Idaho Nuclear Technology and Engineering Center - conducted pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act - evaluated risks associated with deactivation of the basins and alternatives for addressing those risks. The decision to remove and dispose of the basin water debris not containing uranium grouted in place after the sludge has been removed and managed under the Hazardous Waste Management Act/Resource Conservation and Recovery Act has been documented in the Act Memorandum for the Non-Time Critical Removal Action at the CPP-603A Basins, Idaho Nuclear Technology and Engineering Center.

    This Corrective Action Decision Document identifies and rationalizes the U.S. Department of Energy, National Nuclear Security Administration Nevada Site Office's selection of a recommended corrective action alternative appropriate to facilitate the closure of Corrective Action Unit (CAU) 140: Waste Dumps, Burn Pits, and Storage Area, Nevada Test Site (NTS), Nevada, under the Federal Facility Agreement and Consent Order. Located in Areas 5, 22, and 23 of the NTS, CAU 140 consists of nine corrective action sites (CASs). Investigation activities were performed from November 13 through December 11, 2002, with additional sampling to delineate the extent of contaminants of concern (COCs) conducted on February 4 and March 18 and 19, 2003. Results obtained from the investigation activities and sampling indicated that only 3 of the 9 CASs at CAU 140 had COCs identified. Following a review of existing data, future land use, and current operations at the NTS, the following preferred alternatives were developed for consideration: (1) No Further Action - six CASs (05-08-02, 05-17-01, 05-19-01, 05-35-01, 05-99-04, and 22-99-04); (2) Clean Closure - one CAS (05-08-01), and (3) Closure-in-Place - two CASs (05-23-01 and 23-17-01). These alternatives were judged to meet all requirements for the technical components evaluated. Additionally, the alternatives meet all applicable state and federal regulations for closure of the site and will eliminate potential future exposure pathways to the contaminated media at CAU 140.

    This Corrective Action Decision Document identifies and rationalizes the U.S. Department of Energy, National Nuclear Security Administration Nevada Site Office's selection of a recommended corrective action alternative (CAA) appropriate to facilitate the closure of Corrective Action (CAU) 5: Landfills, Nevada Test Site (NTS), Nevada, under the Federal Facility Agreement and Consent Order. The corrective action investigation (CAI) of CAU 5 was conducted from October 7, 2002 through January 30, 2003, with geophysical surveys completed from March 6 through May 8, 2002, and topographic surveys conducted from March 11 through April 29, 2003. Contaminants of concern (COCs) were identified only at CAS 12-15-01. Those COCs included total petroleum hydrocarbons and volatile organic compounds. Based on the evaluation of analytical data from the CAI, review of future and current operations in Areas 5, 6, 12, 20, and 23 of the Nevada Test Site, and the detailed and comparative analysis of the potential CAAs, the following single alternative was developed for consideration. Close in Place with Administrative Controls is the recommended alternative for all of the CASs in CAU 5. This alternative was judged to meet all requirements for the technical components evaluated. Additionally, the alternative meets all applicable state and federal regulations for closure of the sites and will eliminate inadvertent intrusion into landfills at CAU 5.

    Many Federal Facility Agreement and Consent Order (FFACO) Use Restrictions (URs) have been established at various corrective action sites (CASs) as part of FFACO corrective actions (FFACO, 1996; as amended January 2007). Since the signing of the FFACO in 1996, practices and procedures relating to the implementation of risk-based corrective action (RBCA) have evolved. This document is part of an effort to re-evaluate all FFACO URs against the current RBCA criteria (referred to in this document as the Industrial Sites [IS] RBCA process) as defined in the Industrial Sites Project Establishment of Final Action Levels (NNSA/NSO, 2006c). Based on this evaluation, the URs were sorted into the following categories: 1. Where sufficient information exists to determine that the current UR is consistent with the RCBA criteria 2. Where sufficient information exists to determine that the current UR may be removed or downgraded based on RCBA criteria. 3. Where sufficient information does not exist to evaluate the current UR against the RCBA criteria. After reviewing all the existing FFACO URs, the 49 URs addressed in this document have sufficient information to determine that these current URs may be removed or downgraded based on RCBA criteria. This document presents recommendations on modifications to existing URs that will be consistent with the RCBA criteria.

    The Atomic Energy Act of 1954 established, and later Congressional amendments have confirmed, that except in areas which have been explicitly granted to the states, the federal government possesses preemptive authority to regulate radiation hazards associated with the development and use of atomic energy. Since the passage of the original Act, numerous decisions by the courts have reaffirmed the legitimacy of federal preemption, and have defined and redefined its scope. In this study, the aim is to explore the underlying issues involved in federal preemption of radiation-hazard regulation, and to recommend actions that the Department of Energy and other agencies and groups should consider undertaking in the near term to protect the preemption principle. Appropriate roles of the states are discussed, as well as recent state-level activities and their rationale, and several current arenas in which state-federal conflicts about regulation of hazards are being played out. The emphasis here is on four particular arenas that are now important arenas of conflict, but the issues discussed are far broader in scope. These four arenas are: state-level moratorium activity; emergency planning for reactors; conflicts arising from state financial regulation; and inroads in federal preemption through litigation under state law.

    This Technical Annex documents the assumptions and parameters used in developing the supporting analysis for the Climate Change Action Plan (the Plan) issued by President Clinton on October 19, 1993. The Annex is intended to meet the needs of independent energy and environmental analysts who wish to better understand the Plan, its analytical underpinnings, and the events that need to transpire for the emissions reductions called for in the Plan to be realized. The Plan documented in this Annex reflects the outcome of a wide-ranging effort by Government agencies and interested members of the public to develop and implement actions that can reduce net greenhouse gas emissions in the year 2000 to their aggregate 1990 level. Based on agency and public input, the Climate Change Mitigation Group, chaired by the White House Office on Environmental Policy, developed the Plan`s content. Many of the actions called for in the Plan are now underway, while others are in advanced planning pending congressional action on the fiscal year 1995 budget. The analysis supporting the Plan represents the results of an interagency effort. The US Department of Energy (DOE) was responsible for the integrated analysis of energy-related options, based on the analysis of individual energy-related options by DOE, the US Environmental Protection Agency (EPA), and the US Department of Transportation (DOT). EPA led in providing analysis for actions related to methane, hydrofluorocarbons, and perfluorocarbons. The US Department of Agriculture (USDA) led the analysis of carbon sequestration actions and cooperated with EPA in the analysis of actions to reduce nitrous oxide emissions.

    A gas regulator operating on the piston and feedback principle is described. The device is particularly suitable for the delicate regulation of high pressure, i.e., 10,000 psi and above, gas sources, as well as being perfectly adaptable for use on gas supplies as low as 50 psi. The piston is adjustably connected to a needle valve and the movement of the piston regulates the flow of gas from the needle valve. The gas output is obtained from the needle valve. Output pressure is sampled by a piston feedback means which, in turn, regulates the movement of the main piston. When the output is other than the desired value, the feedback system initiates movement of the main piston to allow the output pressure to be corrected or to remain constant. (AEC)
