Criminal investigators from the Environmental Protection Agency (EPA) and its field offices testified at a hearing on whether EPA has sufficient authority to investigate criminal violations, particularly in the area of illegal disposal of hazardous materials. They reported on the agency's progress in staffing a unit with authority comparable to that of Customs and the FBI. The Justice Department opposed deputizing EPA investigators, but the committee found that investigators in the 22 states surveyed operate with law-enforcement powers. Material submitted for the record by EPA, the Justice Department, and others follows the testimony of 10 witnesses.

S. 2415 (which started out as a bill to encourage solar and geothermal power generation) now would amend the Atomic Energy Act of 1954 to redirect uranium enrichment enterprises to further the national interest, respond to competitive market forces, and to ensure the nation's common defense and security. It would establish a United States Enrichment Corporation for the following purposes: to acquire feed materials, enriched uranium, and enrichment facilities; to operate these facilities; to market enriched uranium for governmental purposes and qualified domestic and foreign persons; to conduct research into uranium enrichment; and to operate as a profitable, self-financing, reliable corporation and in a manner consistent with the health and safety of the public. The bill describes powers and duties of the corporation; the organization, finance, and management; decontamination and decommissioning. The second part of the bill would ensure an adequate supply of domestic uranium for defense and power production; provide assistance to the domestic uranium industry; and establish, facilitate, and expedite a comprehensive system for financing reclamation and remedial action at active uranium and thorium processing sites. The third part of the bill would remove the size limitations on power production facilities now part of the Public Utility Regulatory Policies Act of 1978. Solar, wind, waste, or geothermal power facilities would no longer have to be less than 80 MW to qualify as a small power production facility.

The hearing was called to examine two bills which address the processing of oil shale mining claims and patents by the Department of the Interior under the General Mining Law of 1872. S.2089 would provide for certain requirements relating to the conversion of oil shale mining claims located under the Mining Law of 1872 to leases and H.R.1039 would amend section 37 of the Mineral Lands Leasing Act of 1920 relating to oil shale claims. Under the new bills the owners of oil shale mining claims must make an election within 180 days after enactment as to whether to convert their claims to leases or to maintain their claims by performing 1000 dollars of annual assessment work on the claim, filing annually an affidavit of assessment work performed, and producing oil shale in significant marketable amounts within 10 years from the date of enactment of the legislation.

This session of the EPA Workshop 2, Technical Basis for EPA HLW Disposal Criteria, focused on the significance of gaseous transport of radionuclide releases. The basis of the cumulative curie release limit set for carbon-14, the principle nuclide of concern with respect to gaseous transport, is not inconsistent with the limits set for the nuclides. It was pointed out that radionuclides released through gaseous wastes affect the world-wide population while radionuclides released to the water supply affect only localized populations. This argument was used to justify a modification to the carbon-14 release limit.

This four-hour overview course is designed to briefly describe the environmental law system. The course provides an overview that managers and technical people will find useful as a beginning course or a course that puts formerly taken detailed courses in perspective. The course begins by defining environmental law and describing the legal system that establishes compliance obligations. Then, all the major Environmental Acts such as The Water Pollution Control Act, The National Environmental Policy Act, Resource Conservation and Recovery Act (RCRA), and Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) are briefly described and interrelated. All the environmental DOE Orders, selected books, and other source material are referenced. Radioactive pollutants are not discussed; however, reference material is provided.

This final session at the Wind Energy and Birds/Bats workshop was lead by a facilitator who asked participants for their overall reaction to the research that had been presented during the workshop. Questions addressed by workshop participants included: how do you develop trust and confidence in the research, what are some of the specific gaps in our understanding of wind energy's impact on birds and bats; how do we prioritize and proceed with closing the data/research gaps; how do we connect the dots and bring various research and mapping efforts together; given gaps in the data, what are the critical questions we need to answer to make project decisions now; and, how do we track/influence the policies that will shape wind energy development. Conclusions reached regarding these questions are included in summary form.

This session at the Wind Energy and Birds/Bats workshop consisted of a panel discussion followed by a discussion/question and answer period. The panelists were Paul Kerlinger, Curry and Kerlinger, LLC, Al Manville, U.S. Fish and Wildlife Service, and Bill Kendall, US Geological Service. The panel addressed the potential cumulative impacts of wind turbines on bird and bat populations over time. Panel members gave brief presentations that touched on what is currently known, what laws apply, and the usefulness of population modeling. Topics addressed included which sources of modeling should be included in cumulative impacts, comparison of impacts from different modes of energy generation, as well as what research is still needed regarding cumulative impacts of wind energy development on bird and bat populations.

In a world with water resources severely impacted bytechnology, science must actively contribute to water law. To this end,this paper is an earth scientist s attempt to comprehend essentialelements of water law, and to examine their connections to science.Science and law share a common logical framework of starting with apriori prescribed tenets, and drawing consistent inferences. In science,observationally established physical laws constitute the tenets, while inlaw, they stem from social values. The foundations of modern water law inEurope and the New World were formulated nearly two thousand years ago byRoman jurists who were inspired by Greek philosophy of reason.Recognizing that vital natural elements such as water, air, and the seawere governed by immutable natural laws, they reasoned that theseelements belonged to all humans, and therefore cannot be owned as privateproperty. Legally, such public property was to be governed by jusgentium, the law of all people or the law of all nations. In contrast,jus civile or civil law governed private property. Remarkably, jusgentium continues to be relevant in our contemporary society in whichscience plays a pivotal role in exploiting vital resources common to all.This paper examines the historical roots of modern water law, followstheir evolution through the centuries, and examines how the spirit ofscience inherent in jus gentium is profoundly influencing evolving waterand environmental laws in Europe, the United States and elsewhere. In atechnological world, scientific knowledge has to lie at the core of waterlaw. Yet, science cannot formulate law. It is hoped that a philosophicalunderstanding of the relationships between science and law willcontribute to their constructively coming together in the service ofsociety.

Potential Conservation Laws

We prove that potential conservation laws have characteristics depending only on local variables if and only if they are induced by local conservation laws. Therefore, characteristics of pure potential conservation laws have to essentially depend on potential variables. This statement provides a significant generalization of results of the recent paper by Bluman, Cheviakov and Ivanova [J. Math. Phys., 2006, V.47, 113505]. Moreover, we present extensions to gauged potential systems, Abelian and general coverings and general foliated systems of differential equations. An example illustrating possible applications of proved statements is considered. A special version of the Hadamard lemma for fiber bundles and the notions of weighted jet spaces are proposed as new tools for the investigation of potential conservation laws.

The Aspen Global Change Institute (AGCI) successfully organized and convened six interdisciplinary meetings over the course of award NNG04GA21G. The topics of the meetings were consistent with a range of issues, goals and objectives as described within the NASA Earth Science Enterprise Strategic Plan and more broadly by the US Global Change Research Program/Our Changing Planet, the more recent Climate Change Program Strategic Plan and the NSF Pathways report. The meetings were chaired by two or more leaders from within the disciplinary focus of each session. 222 scholars for a total of 1097 participants-days were convened under the auspices of this award. The overall goal of each AGCI session is to further the understanding of Earth system science and global environmental change through interdisciplinary dialog. The format and structure of the meetings allows for presentation by each participant, in-depth discussion by the whole group, and smaller working group and synthesis activities. The size of the group is important in terms of the group dynamics and interaction, and the ability for each participant's work to be adequately presented and discussed within the duration of the meeting, while still allowing time for synthesis

Two laws governing activities in the marine environment are considered in this Reference Book. The Marine Protection, Research, and Sanctuaries Act (MPRSA, P.L. 92-532) regulates ocean dumping of waste, provides for a research program on ocean dumping, and provides for the designation and regulation of marine sanctuaries. The Marine Mammal Protection Act (MMPA, P.L. 92-522) establishes a federal program to protect and manage marine mammals. The Fishery Conservation and Management Act (FCMA, P.L. 94-265) establishes a program to regulate marine fisheries resources and commercial marine fishermen. Because the Department of Energy (DOE) is not engaged in any activities that could be classified as fishing under FCMA, this Act and its regulations have no implications for the DOE; therefore, no further consideration of this Act is given within this Reference Book. The requirements of the MPRSA and the MMPA are discussed in terms of their implications for the DOE.

Public Law 105-119 (Law) was enacted in November 1997 as part of the Defense Authorization Act of 1998 (Act). The Law specifically requires the US Department of Energy (DOE) to identify lands that are suitable for conveyance or transfer at Los Alamos National Laboratory (LANL) within 90 days after enactment of the Act. In general, suitable lands include those parcels that are not required to meet the national security missions assigned to DOE at LANL within a ten year period beginning on the date of enactment of the Act. Additional suitability criteria are addressed below and include the need to establish clear title to the land and to restore areas contaminated with hazardous wastes. This proposed change in future land ownership is intended to serve as the final settlement of DOE community assistance obligations with respect to LANL and Los Alamos County and to stimulate economic development.

Integrable viscous conservation laws

We propose an extension of the Dubrovin-Zhang perturbative approach to the study of normal forms for non-Hamiltonian integrable scalar conservation laws. The explicit computation of the first few corrections leads to the conjecture that such normal forms are parameterized by one single functional parameter, named viscous central invariant. A constant valued viscous central invariant corresponds to the well-known Burgers hierarchy. The case of a linear viscous central invariant provides a viscous analog of the Camassa-Holm equation, that formerly appeared as a reduction of a two-component Hamiltonian integrable systems. We write explicitly the negative and positive hierarchy associated with this equation and prove the integrability showing that they can be mapped respectively into the heat hierarchy and its negative counterpart, named the Klein-Gordon hierarchy. A local well-posedness theorem for periodic initial data is also proven. We show how transport equations can be used to effectively construct asymptotic solutions via an extension of the quasi-Miura map that preserves the initial datum. The method is alternative to the method of the string equation for Hamiltonian conservation laws and naturally extends to the viscous case. Using these tools we derive the viscous analog of the Painlev\\'e I2 equation that describes the universal behaviour of the solution at the critical point of gradient catastrophe.

The holder consist of: a stationary base portion capable of being fixed to a cutter head of an excavation machine and having an integral extension therefrom with a bore hole therethrough to accommodate a pin shaft; a movable portion coextensive with the base having a pin shaft integrally extending therefrom that is insertable in the bore hole of the base member to permit the moveable portion to rotate about the axis of the pin shaft; a recess in the movable portion of the holder to accommodate a shank of a bit; and a biased spring disposed in adjoining openings in the base and moveable portions of the holder to permit the moveable portion to pivot around the pin shaft during cutting action of a bit fixed in a turret to allow front, mid and back positions of the bit during cutting to lessen creation of small chip amounts and resharpen the bit during excavation use.

Single-Session Radiofrequency Ablation of Bilateral Lung Metastases  

SciTech Connect (OSTI)

Purpose: This retrospective study examined the feasibility and efficacy of bilateral lung radiofrequency ablation (RFA) performed in a single session. Methods: From 2002-2009, patients with bilateral lung metastases were treated by RFA, where possible in a single session under general anesthesia with CT guidance. The second lung was punctured only if no complications occurred after treatment of the first lung. Five lung metastases maximum per patient were treated by RFA and prospectively followed. The primary endpoint was the evaluation of acute and delayed complications. Secondary endpoints were calculation of hospitalization duration, local efficacy, median survival, and median time to tumor progression. Local efficacy was evaluated on CT or positron emission tomography (PET) CT. Results: Sixty-seven patients were treated for bilateral lung metastases with RFA (mean age, 62 years). Single-session treatment was not possible in 40 due to severe pneumothoraces (n = 24), bilateral pleural contact (n = 14), and operational exclusions (n = 2). Twenty-seven (41%) received single-session RFA of lesions in both lungs for 66 metastases overall. Fourteen unilateral and four bilateral pneumothoraces occurred (18 overall, 66.7%). Unilateral (n = 13) and bilateral (n = 2) chest tube drainage was required. Median hospitalization was 3 (range, 2-8) days. Median survival was 26 months (95% confidence interval (CI), 19-33). Four recurrences on RFA sites were observed (4 patients). Median time to tumor progression was 9.5 months (95% CI, 4.2-23.5). This session at the Wind Energy and Birds/Bats workshop consisted of two presentations followed by a discussion/question answer period. The session addressed a variety of questions related to avoiding, minimizing, and mitigating the avian and bat impacts of wind power development including: what has been learned from operating turbines and mitigating impacts where they are unavoidable, such as at Altamont Pass WRA, and should there be mitigation measures such as habitat creation or land conservation where impacts occur. Other impact minimization and mitigation approaches discussed included: location and siting evaluations; options for construction and operation of wind facilities; turbine lighting; and the physical alignment/orientation. The conservation laws of electromagnetism, and implicitly all theories built from quadratic Lagrangians, are extended to a continuum of nonlocal versions. These are associated with symmetries of a class of equal time field correlation functions and give results for both connected and disconnected branches of the general linear group of the space. It is generally assumed that manifestly covariant Lagrangians are the necessary starting point for physical theories. Here we show that the EOM derived from any of these can also follow from a broad class of nonlocal ones and each generally gives a different nonlocal Noether current. When the equations are put into a linear form and evaluated on a flat spacetime, a simple ansatz exists to give a class of conservation laws corresponding to all affine transformations of the underlying space. A general procedure is given to generate a class of nonlocal conservation laws for solutions to a very large class of nonlinear PDEs.

Session: What can we learn from developed wind resource areas

This session at the Wind Energy and Birds/Bats workshop was composed of two parts intended to examine what existing science tells us about wind turbine impacts at existing wind project sites. Part one dealt with the Altamont Wind Resource area, one of the older wind projects in the US, with a paper presented by Carl Thelander titled ''Bird Fatalities in the Altamont Pass Wind Resource Area: A Case Study, Part 1''. Questions addressed by the presenter included: how is avian habitat affected at Altamont and do birds avoid turbine sites; are birds being attracted to turbine strings; what factors contribute to direct impacts on birds by wind turbines at Altamont; how do use, behavior, avoidance and other factors affect risk to avian species, and particularly impacts those species listed as threatened, endangered, or of conservation concern, and other state listed species. The second part dealt with direct impacts to birds at new generation wind plants outside of California, examining such is sues as mortality, avoidance, direct habitat impacts from terrestrial wind projects, species and numbers killed per turbine rates/MW generated, impacts to listed threatened and endangered species, to USFWS Birds of Conservation Concern, and to state listed species. This session focused on newer wind project sites with a paper titled ''Bird Fatality and Risk at New Generation Wind Projects'' by Wally Erickson. Each paper was followed by a discussion/question and answer period.

A fast-acting valve actuator utilizes a spring driven pneumatically loaded piston to drive a valve gate. Rapid exhaust of pressurized gas from the pneumatically loaded side of the piston facilitates an extremely rapid piston stroke. A flexible selector diaphragm opens and closes an exhaust port in response to pressure differentials created by energizing and de-energizing a solenoid which controls the pneumatic input to the actuator as well as selectively providing a venting action to one side of the selector diaphragm.

This is the third chapter of The Hanford Story. This chapter is a tribute to the thousands of workers and representatives of regulatory agencies, neighboring states, Tribes, stakeholders, and surrounding communities who came together to put stimulus funding to work at Hanford. The video describes how the Department of Energy and its contractors turned a nearly $2 billion investment of American Recovery and Reinvestment Act funding in 2009 into nearly $4 billion worth of environmental cleanup work over the past two years. At the same time, Hanford workers have reduced the cleanup footprint of the Hanford Site by more than half (586 square miles to 241 sq. mi. through August -- 59 percent).

Baseline LAW Glass Formulation Testing

The major objective of the baseline glass formulation work was to develop and select glass formulations that are compliant with contractual and processing requirements for each of the LAW waste streams. Other objectives of the work included preparation and characterization of glasses with respect to the properties of interest, optimization of sulfate loading in the glasses, evaluation of ability to achieve waste loading limits, testing to demonstrate compatibility of glass melts with melter materials of construction, development of glass formulations to support ILAW qualification activities, and identification of glass formulation issues with respect to contract specifications and processing requirements.

The 14th Workshop discussion sessions addressed funding needs for Si research and for R&D to enhance U.S. PV manufacturing. The wrap-up session specifically addressed topics for the new university silicon program. The theme of the workshop, Crystalline Silicon Solar Cells: Leapfrogging the Barriers, was selected to reflect the astounding progress in Si PV technology during last three decades, despite a host of barriers and bottlenecks. A combination of oral, poster, and discussion sessions addressed recent advances in crystal growth technology, new cell structures and doping methods, silicon feedstock issues, hydrogen passivation and fire through metallization, and module issues/reliability. The following oral/discussion sessions were conducted: (1) Technology Update; (2) Defects and Impurities in Si/Discussion; (3) Rump Session; (4) Module Issues and Reliability/Discussion; (5) Silicon Feedstock/Discussion; (6) Novel Doping, Cells, and Hetero-Structure Designs/Discussion; (7) Metallization/Silicon Nitride Processing/Discussion; (8) Hydrogen Passivation/Discussion; (9) Characterization/Discussion; and (10) Wrap-Up. This year's workshop lasted three and a half days and, for the first time, included a session on Si modules. A rump session was held on the evening of August 8, which addressed efficiency expectations and challenges of c Si solar cells/modules. Richard King of DOE and Daren Dance of Wright Williams& Kelly (formerly of Sematech) spoke at two of the luncheon sessions. Eleven students received Graduate Student Awards from funds contributed by the PV industry.

This ended a four-year debate over legislation designed to plan and coordinate the region's energy future. This legislative history is an abbreviated version taken from the larger historical file maintained by the BPA Law Library. It is intended to assist BPA personnel and others who are studying the Northwest Power Act and working on its implementation. The documents included were selected for their value in determining what Congress meant in enacting the statute and to provide the researcher with a starting point for further investigation. These documents include: a history of the Act, a chronology of the legislative action leading to passage of the law; a section-by-section analysis of the Act; the Congressional Records of Senate and House debates on the bill and its amendments, and a list of Congressional committee hearings.

Wind energy and the Migratory Bird Treaty Act

The Fish and Wildlife Service (Service) is charged to balance its support for clean, renewable energy such as windpower with its trust responsibilities under the Migratory Bird Treaty Act (MBTA). There are four international treaties implemented by the MBTA protecting 850 species of migratory birds. The Service is focused on managing healthy populations but must protect individuals by law. An activity cannot legally {open_quotes}take{close_quotes} one migratory bird except as provided by a hunting season or a permit. The Service does not have the authority to issue a permit to {open_quotes}take{close_quotes} a bird incidental to an otherwise legal activity. Scientific permits or special purpose permits may be appropriate. Development of incidental take regulations are being considered. More research is needed, but this should prevent some management actions. The Service will continue to work with the industry to develop broad guidelines to minimize avian mortality.

The generalized second law of thermodynamics in Ho?ava-Lifshitz cosmology

We investigate the validity of the generalized second law of thermodynamics in a universe governed by Ho?ava-Lifshitz gravity. Under the equilibrium assumption, that is in the late-time cosmological regime, we calculate separately the entropy time-variation for the matter fluid and, using the modified entropy relation, that of the apparent horizon itself. We find that under detailed balance the generalized second law is generally valid for flat and closed geometry and it is conditionally valid for an open universe, while beyond detailed balance it is only conditionally valid for all curvatures. Furthermore, we also follow the effective approach showing that it can lead to misleading results. The non-complete validity of the generalized second law could either provide a suggestion for its different application, or act as an additional problematic feature of Ho?ava-Lifshitz gravity.

We describe recent progress towards deriving the Fundamental Laws of thermodynamics (the 0th, 1st and 2nd Law) from nonequilibrium quantum statistical mechanics in simple, yet physically relevant models. Along the way, we clarify some basic thermodynamic notions and discuss various reversible and irreversible thermodynamic processes from the point of view of quantum statistical mechanics.
