    The National Environmental Policy Act (NEPA) of 1969 was established to prevent or eliminate damage to the environmental and biosphere from federal actions and stimulate the public health and welfare. An intertwined focus of NEPA has been to create and maintain conditions under which people and nature can exist in productive harmony. Meanwhile, the Clean Air Act (CAA) and amendments are the basis for regulating emission of air pollutants and otherwise maintaining or enhancing air quality to protect public health and welfare throughout the United States. Because the CAA is to comprehensive, a frequently asked question concerns the usefulness of NEPA from an air quality perspective: What can NEPA accomplish for federal actions that is not already accomplished by the CAA This paper contends that NEPA plays an important role in identifying and informing federal decision-makers of potential air quality impacts of federal actions. NEPA encompasses a broader scope and provides an independent analysis of CAA requirements for federal actions. NEPA ensures that spectrum of potential environmental effects is examined, rather than air quality alone.     This quality assurance project plan (QAPjP) describes the measures that shall be taken to ensure that the environmental data collected during characterization and closure activities of Resource Conservation and Recovery Act (RCRA) Industrial Sites at the Nevada Test Site (NTS) are meaningful, valid, defensible, and can be used to achieve project objectives. These activities are conducted by the US Department of Energy Nevada Operations Office (DOE/NV) under the Nevada Environmental Restoration (ER) Project. The Nevada ER Project consists of environmental restoration activities on the NTS, Tonopah Test Range, Nellis Air Force Range, and eight sites in five other states. The RCRA Industrial Sites subproject constitutes a component of the Nevada ER Project. Currently, this QAPjP is limited to the seven RCRA Industrial Sites identified within this document that are to be closed under an interim status and pertains to all field-investigation, analytical-laboratory, and data-review activities in support of these closures. The information presented here supplements the RCRA Industrial Sites Project Management Plan and is to be used in conjunction with the site-specific subproject sampling and analysis plans.

    Quality achievement for the National Ignition Facility (NIF) and the National Ignition Campaign (NIC) is the responsibility of the NIF Projects line organization as described in the NIF and Photon Science Directorate Quality Assurance Plan (NIF QA Plan). This Software Quality Assurance Plan (SQAP) is subordinate to the NIF QA Plan and establishes quality assurance (QA) activities for the software subsystems within Controls and Information Systems (CIS). This SQAP implements an activity level software quality assurance plan for NIF Projects as required by the LLNL Institutional Software Quality Assurance Program (ISQAP). Planned QA activities help achieve, assess, and maintain appropriate quality of software developed and/or acquired for control systems, shot data systems, laser performance modeling systems, business applications, industrial control and safety systems, and information technology systems.     The environmental impact assessment (EIA) has been a tool for decision makers since the enactment of the National Environmental Policy Act (NEPA). Since that time, few analyses have been performed to verify the quality of information and content within EIAs. High quality information within assessments is vital in order for decision makers, stake holders, and the public to understand the potential impact of proposed actions on the ecosystem and wildlife species. Low quality information has been a major cause for litigation and economic loss. Since 1999, wind energy development has seen an exponential growth with unknown levels of impact on wildlife species, in particular bird and bat species. The purpose of this article is to: (1) develop, validate, and apply a quantitative index to review avian/bat assessment quality for wind energy EIAs; and (2) assess the trends and status of avian/bat assessment quality in a sample of wind energy EIAs. This research presents the development and testing of the Avian and Bat Assessment Quality Index (ABAQI), a new approach to quantify information quality of ecological assessments within wind energy development EIAs in relation to avian and bat species based on review areas and factors derived from 23 state wind/wildlife siting guidance documents. The ABAQI was tested through a review of 49 publicly available EIA documents and validated by identifying high variation in avian and bat assessments quality for wind energy developments. Of all the reviewed EIAs, 66% failed to provide high levels of preconstruction avian and bat survey information, compared to recommended factors from state guidelines. This suggests the need for greater consistency from recommended guidelines by state, and mandatory compliance by EIA preparers to avoid possible habitat and species loss, wind energy development shut down, and future lawsuits. - Highlights: Black-Right-Pointing-Pointer We developed, validated, and applied a quantitative index to review avian/bat assessment quality for wind energy EIAs.     Purpose: The Internet is widely used by patients to source health care-related information. We sought to analyse the quality of information available on the Internet about uterine artery embolization (UAE). Materials and Methods: We searched three major search engines for the phrase 'uterine artery embolization' and compiled the top 50 results from each engine. After excluding repeated sites, scientific articles, and links to documents, the remaining 50 sites were assessed using the LIDA instrument, which scores sites across the domains of accessibility, usability, and reliability. The Fleisch reading ease score (FRES) was calculated for each of the sites. Finally, we checked the country of origin and the presence of certification by the Health On the Net Foundation (HONcode) as well as their effect on LIDA and FRES scores.ResultsThe following mean scores were obtained: accessibility 48/60 (80%), usability 42/54 (77%), reliability 20/51 (39%), total LIDA 110/165 (67%), and FRES 42/100 (42%). Nine sites had HONcode certification, and this was associated with significantly greater (p < 0.05) reliability and total LIDA and FRES scores. When comparing sites between United Kingdom and United States, there was marked variation in the quality of results obtained when searching for information on UAE (p < 0.05). Conclusion: In general, sites were well designed and easy to use. However, many scored poorly on the reliability of their information either because they were produced in a non-evidence-based way or because they lacking currency. It is important that patients are guided to reputable, location-specific sources of information online, especially because prominent search engine rank does not guarantee reliability of information.

  14. INFORMATION: Special Report on "Selected Department of Energy Program Efforts to Implement the American Recovery and Reinvestment Act"

    The American Recovery and Reinvestment Act of 2009 (Recovery Act) was enacted on February 17, 2009, to jumpstart the economy by creating or saving millions of jobs, spurring technological advances in health and science, and investing in the Nation's energy future. The Department of Energy received over $32.7 billion in Recovery Act funding for various science, energy, and environmental programs and initiatives. As of November 2009, the Department had obligated $18.3 billion of the Recovery Act funding, but only $1.4 billion had been spent. The Department's Offices of Energy Efficiency and Renewable Energy, Fossil Energy, Environmental Management, Science, and Electricity Delivery and Energy Reliability received the majority of funding allocated to the Department, about $32.3 billion. Obligating these funds by the end of Fiscal Year 2010, as required by the Recovery Act, and overseeing their effective use in succeeding years, represents a massive workload increase for the Department's programs. The effort to date has strained existing resources. As has been widely acknowledged, any effort to disburse massive additional funding and to expeditiously initiate and complete projects increases the risk of fraud, waste and abuse. It is, therefore, important for the Department's program offices to assess and mitigate these risks to the maximum extent practicable. In this light, we initiated this review as an initial step in the Office of Inspector General's charge to determine whether the Department's major program offices had developed an effective approach for identifying and mitigating risks related to achieving the goals and objectives of the Recovery Act. The Department's program offices included in our review identified risks and planned mitigation strategies that, if successfully implemented and executed, should help achieve the goals and objectives of the Recovery Act. While each office identified risks unique to its respective areas of responsibility, there were a number of risks shared in common. These included the mechanical and substantive requirements related to the award and distribution of funds; program and project performance monitoring; and, program and project execution activities. In particular, the offices self-identified common risks such as: (1) The inability to award and distribute funds in a timely manner to achieve the goals of the Recovery Act; (2) The sufficiency of monitoring procedures and resources to, among other things, prevent and detect fraud, waste and abuse throughout the performance period of financial assistance awards and contracts; and (3) The inherent cost, schedule and performance risks associated with first-of-a-kind, innovative research and demonstration projects. Our review confirmed that the Department had begun to implement a number of strategies designed to mitigate these and other program-specific risks. Our testing, however, identified challenges to the effective implementation of these mitigation strategies that need to be addressed if the Department is to meet the goals and objectives established by the Recovery Act. At the time of our review: (1) Program staffing resources, critical to the success of all other mitigation strategies, remained inadequate both in numbers and qualifications (certifications and training) for positions in procurement and acquisition, project management, and monitoring and oversight functions; (2) Performance measures for achieving Recovery Act goals such as distributing funds in an expeditious manner had not always been established and included in performance plans, and, in financial assistance and contract documents; and (3) Programs had not consistently demonstrated that previously reported deficiencies, identified through audits, inspections, investigations and other oversight activities, had been considered in designing mitigation strategies for the Recovery Act related risks.     The utility of three operational satellite remote sensing systems, namely, the Landsat Thematic Mapper (TM), the SPOT High Resolution Visible (HRV) sensors and the NOAA Advanced Very High Resolution Radiometer (AVHRR), were evaluated as a means of estimating water quality and surface temperature. Empirical calibration through linear regression techniques was used to relate near-simultaneously acquired satellite radiance/reflectance data and water quality observations obtained in Green Bay and the nearshore waters of Lake Michigan. Four dates of TM and one date each of SPOT and AVHRR imagery/surface reference data were acquired and analyzed. Highly significant relationships were identified between the TM and SPOT data and secchi disk depth, nephelometric turbidity, chlorophyll a, total suspended solids (TSS), absorbance, and surface temperature (TM only). The AVHRR data were not analyzed independently but were used for comparison with the TM data. Calibrated water quality image maps were input to a PC-based raster GIS package, EPPL7. Pattern interpretation and spatial analysis techniques were used to document the circulation dynamics and model mixing processes in Green Bay. A GIS facilitates the retrieval, query and spatial analysis of mapped information and provides the framework for an integrated operational monitoring system for the Great Lakes.

    The National Geothermal Data System (NGDS) is a Department of Energy funded effort to create a single cataloged source for a variety of geothermal information through a distributed network of databases made available via web services. The NGDS will help identify regions suitable for potential development and further scientific data collection and analysis of geothermal resources as a source for clean, renewable energy. A key NGDS repository or node is located at Southern Methodist University developed by a consortium made up of: SMU Geothermal Laboratory Siemens Corporate Technology, a division of Siemens Corporation Bureau of Economic Geology at the University of Texas at Austin Cornell Energy Institute, Cornell University Geothermal Resources Council MLKay Technologies Texas Tech University University of North Dakota. The focus of resources and research encompass the United States with particular emphasis on the Gulf Coast (on and off shore), the Great Plains, and the Eastern U.S. The data collection includes the thermal, geological and geophysical characteristics of these area resources. Types of data include, but are not limited to, temperature, heat flow, thermal conductivity, radiogenic heat production, porosity, permeability, geological structure, core geophysical logs, well tests, estimated reservoir volume, in situ stress, oil and gas well fluid chemistry, oil and gas well information, and conventional and enhanced geothermal system related resources. Libraries of publications and reports are combined into a unified, accessible, catalog with links for downloading non-copyrighted items. Field notes, individual temperature logs, site maps and related resources are included to increase data collection knowledge. Additional research based on legacy data to improve quality increases our understanding of the local and regional geology and geothermal characteristics. The software to enable the integration, analysis, and dissemination of this teams NGDS contributions was developed by Siemens Corporate Technology.     The U.S. Environmental Protection Agency (EPA) and state air quality control agencies are in the midst of developing regulations and programs to meet the ambitious goals of the Clean Air Act Amendment (CAAA) of 1990. The CAAA--which call for stricter air quality standards, a greater number of pollutants and sources to be regulated, new operating permits, and more stringent enforcement of air quality violations--are expected to have a significant impact on virtually every facility in the country. An important deadline in the implementation of the CAAA is November 1993. That is when individual states must submit their proposed operating permit programs to the EPA, as mandated by Title 5 of the Amendments. The EPA then has one year after receiving a state program to accept or reject it. Once a state's program is accepted, all major sources of air pollution in that state have one year to apply for an operating air permit. Although the initial deadlines for business and industry are up to two years away, sufficient information is now available to take the first steps toward compliance with the new air quality regulations. Even while the details of the new rules are being hammered out, plant engineering can and should begin laying the groundwork for their own permit applications. Time and effort spent preparing now for the provisions of the CAAA will pay off in the long run.

Legislative Acts and reference documents from Congress, US Department of Energy, and Lockheed Idaho Technologies Company provide the bases for conducting NEPA at the Idaho National Engineering Laboratory (INEL). Lockheed Idaho Technologies Company (LITCO) NEPA / Permitting Department, the Contractor Environmental Organization (CEO) is responsible for developing and maintaining LITCO NEPA and permitting policies, guidance, and procedures. The CEO develops procedures to conduct environmental evaluations based on NEPA, Council on Environmental Quality (CEQ) regulations, and DOE guidance. This procedure includes preparation or support of environmental checklists, categorical exclusion determinations, environmental assessment determinations, environmental assessments, and environmental impact statements. In addition, the CEO uses this information to train personnel conducting environmental evaluations at the INEL. Streamlining these procedures fosters efficient use of resources, quality documents, and better decisions on proposed actions.

    The Genetic Privacy Act is a proposal for federal legislation. The Act is based on the premise that genetic information is different from other types of personal information in ways that require special protection. The DNA molecule holds an extensive amount of currently indecipherable information. The major goal of the Human Genome Project is to decipher this code so that the information it contains is accessible. The privacy question is, accessible to whom? The highly personal nature of the information contained in DNA can be illustrated by thinking of DNA as containing an individual`s {open_quotes}future diary.{close_quotes} A diary is perhaps the most personal and private document a person can create. It contains a person`s innermost thoughts and perceptions, and is usually hidden and locked to assure its secrecy. Diaries describe the past. The information in one`s genetic code can be thought of as a coded probabilistic future diary because it describes an important part of a unique and personal future. This document presents an introduction to the proposal for federal legislation `the Genetic Privacy Act`; a copy of the proposed act; and comment.

    The Georgia General Assembly passed the Shore Assistance Act in 1979 in order to fill a regulatory gap in the state's management of its coastal resources. A review of its legislative history, purposes, applications, and effects in terms of the sand sharing system of sand dunes, beaches, sandbars, and shoals concludes that the Act is poorly drafted. In its application on the oceanfront, it betrays its intent and protects the oceanfront owner. It has failed to satisfy the requirements of the public trust in the tidal foreshore. Amendments to clarify its understanding of the functions and values of the sand-sharing system should also conform with the state's duties under the public trust. 139 references.

    This document describes the U.S. Department of Energys (DOE) Hanford Site environment. It is intended to provide a consistent description of the Hanford Site for the many environmental documents being prepared by DOE contractors concerning the National Environmental Policy Act (NEPA). No statements regarding significance or environmental consequences are provided. This years report is the eighteen revision of the original document published in 1988 and is (until replaced by the nineteenth revision) the only version that is relevant for use in the preparation of Hanford NEPA, State Environmental Policy Act (SEPA), and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) documents. Two chapters are included in this document (Chapters 4 and 6), numbered to correspond to chapters typically presented in environmental impact statements (EISs) and other Hanford Site NEPA or CERCLA documentation. Chapter 4.0 (Affected Environment) describes Hanford Site climate and meteorology; air quality; geology; hydrology; ecology; cultural, archaeological, and historical resources; socioeconomics; noise; and occupational health and safety. Sources for extensive tabular data related to these topics are provided in the chapter. When possible, subjects are divided into a general description of the characteristics of the Hanford Site, followed by site-specific information, where available, for the 100, 200, 300 and other areas. This division allows the reader to go directly to those sections of particular interest. When specific information on each of these separate areas is not complete or available, the general Hanford Site description should be used. Chapter 6.0 (Statutory and Regulatory Requirements) describes federal and state laws and regulations, DOE directives and permits, and presidential executive orders that are applicable to NEPA documents prepared for Hanford Site activities. Information in Chapter 6 can be adapted and supplemented with specific information covering statutory and regulatory requirements for use in an environmental assessment or environmental impact statement. When preparing environmental assessments and EISs, authors should consult Recommendations for the Preparation of Environmental Assessments and Environmental Impact Statements published by the DOE Office of NEPA Oversight (DOE 2004). Additional direction and guidance on the preparation of DOE NEPA documents can be found at http://tis.eh.doe.gov/nepa/guidance.html. Individuals seeking baseline data on the Hanford Site and its past activities may also use the information contained in this document to evaluate projected activities and their impacts. Pacific Northwest National Laboratory (PNNL) staff prepared individual sections of this document, with input from other Hanford Site contractors with the best available information through May 2007. More detailed data are available from reference sources cited or from the authors.     A double acting bit holder that permits bits held in it to be resharpened during cutting action to increase energy efficiency by reducing the amount of small chips produced. The holder consist of: a stationary base portion capable of being fixed to a cutter head of an excavation machine and having an integral extension therefrom with a bore hole therethrough to accommodate a pin shaft; a movable portion coextensive with the base having a pin shaft integrally extending therefrom that is insertable in the bore hole of the base member to permit the moveable portion to rotate about the axis of the pin shaft; a recess in the movable portion of the holder to accommodate a shank of a bit; and a biased spring disposed in adjoining openings in the base and moveable portions of the holder to permit the moveable portion to pivot around the pin shaft during cutting action of a bit fixed in a turret to allow front, mid and back positions of the bit during cutting to lessen creation of small chip amounts and resharpen the bit during excavation use.

    On July 30, 2003, Senator James M. Inhofe requested the Energy Information Administration to undertake analyses of S.843, The Clean Air Planning Act of 2003, introduced by Senator Thomas Carper, and S.485, Clear Skies Act of 2003. Senator Inhofe also asked the Energy Information Administration (EIA) to analyze S. 485 without the mercury provisions and S. 843 without the mercury and carbon dioxide provisions. This service report responds to both requests.

This report is in response to section 805(b) of EISA which calls on EIA to submit to Congress the plan established under subsection (a), including a description of any improvements needed to enhance the ability of the Administrator to collect and process energy information in a manner consistent with the needs of energy markets.

There was no new significant air quality legislation, but a number of lawsuits raised questions about State Implementation Plans, prevention of significant deterioration, the Clean Air Act Amendments, new source performance standards, and motor vehicle emissions. Efforts to increase coal utilization emphasized implementation of the Power Plant and Industrial Fuel Use Act of 1978 and the Surface Mining Program. New legislation protects certain forest products from exploitation and exportation. Forest-related lawsuits focused on the RARE II process. Land-use legislation modified credit assistance to coastal zones and the language of interstate land sales, established a new agency to consolidate flood-insurance programs, and added protection to archaeological resources. Land-use-related lawsuits covered coastal zone management, interstate land sales, Indian reservations, and land-use planning in the context of civil rights, antitrust action, exclusionary zoning, comprehensive planning, and regional general welfare. Other suits addressed grants, leasing, claims, grazing rights, surveys, and other matters of public lands concern. Administrative actions centered on implementing the Coastal Zone Management Act, establishing the Council of Energy Resource Tribes, and developing guidelines for energy development. 147 references.     Coal in Kentucky has been, and continues to be, a valuable energy source, especially for the electric utility industry. However, Federal mandates in Titles III and IV of the Clean Air Act Amendments of 1990, and more recently proposed ``greenhouse gas'' emission reductions, have placed increasingly stringent demands on the type and grade of coal that can be burned in an environmentally-accepted manner. Therefore, a greater understanding of the spatial and temporal distribution of thickness and quality parameters, and the geological factors that control their distribution, is critical if Kentucky will continue to be a major producer of high quality coal. Information from the Kentucky Geological Survey's Coal Resource Information System data base (KCRIS) is used in this paper to document the geological and stratigraphic distribution of important factors such as bed thickness, calorific value, ash yield, and total sulfur content. The distribution of major and minor elements that naturally occur in Kentucky coal is also discussed as some of these elements contribute to slagging and fouling in coal-fired furnaces; others may require monitoring with passage of Title III of the Clean Air Act Amendments of 1990.

    This document describes the U.S. Department of Energys (DOE) Hanford Site environment. It is updated each year and is intended to provide a consistent description of the Hanford Site environment for the many environmental documents being prepared by DOE contractors concerning the National Environmental Policy Act (NEPA). No statements about significance or environmental consequences are provided. This years report is the seventeenth revision of the original document published in 1988 and is (until replaced by the eighteenth revision) the only version that is relevant for use in the preparation of Hanford NEPA, State Environmental Policy Act (SEPA), and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) documents. The two chapters included in this document (Chapters 4 and 6) are numbered to correspond to the chapters where such information is typically presented in environmental impact statements (EISs) and other Hanford Site NEPA or CERCLA documentation. Chapter 4.0 (Affected Environment) describes Hanford Site climate and meteorology; air quality; geology; hydrology; ecology; cultural, archaeological, and historical resources; socioeconomics; noise; and occupational health and safety. Sources for extensive tabular data related to these topics are provided in the chapter. Most subjects are divided into a general description of the characteristics of the Hanford Site, followed by site-specific information, where available, of the 100, 200, 300, and other areas. This division allows the reader to go directly to those sections of particular interest. When specific information on each of these separate areas is not complete or available, the general Hanford Site description should be used. Chapter 6.0 (Statutory and Regulatory Requirements) describes federal and state laws and regulations, DOE directives and permits, and presidential executive orders that are applicable to the NEPA documents prepared for Hanford Site activities. Information in Chapter 6 of this document can be adapted and supplemented with specific information for a chapter covering statutory and regulatory requirements in an environmental assessment or environmental impact statement. When preparing environmental assessments and EISs, authors should also be cognizant of the document titled Recommendations for the Preparation of Environmental Assessments and Environmental Impact Statements published by the DOE Office of NEPA Oversight (DOE 2004). Additional guidance on preparing DOE NEPA documents can be found at http://tis.eh.doe.gov/nepa/guidance.html. Any interested individual seeking baseline data on the Hanford Site and its past activities may also use the information contained in this document to evaluate projected activities and their impacts.     A fast-acting valve actuator utilizes a spring driven pneumatically loaded piston to drive a valve gate. Rapid exhaust of pressurized gas from the pneumatically loaded side of the piston facilitates an extremely rapid piston stroke. A flexible selector diaphragm opens and closes an exhaust port in response to pressure differentials created by energizing and de-energizing a solenoid which controls the pneumatic input to the actuator as well as selectively providing a venting action to one side of the selector diaphragm.
