National Pollutant Discharge Elimination System. a proposed rule
A proposed rule is issued by the U.S. Environmental Protection Agency which would revise final regulations just issued. The final regulations facilitate compliance with the treatment deadlines for toxic pollutants under the Clean Water Act by requiring permit modification or reissuance when new effluent guidelines covering those pollutants are promulgated or approved by the EPA. However, these regulations raise the question of how compliance will be ensured when: permits are issued which do not expressly require achievement of future treatment deadlines; and permit modification or revocation to incorporate such requirements is not triggered (e.g., where new guidelines covering toxic pollutants are not or do not become available). The EPA proposes to answer this question by indicating that permits may reflect a continuation of 1977 treatment requirements under the Act, only if set to expire no later than 18 months from the scheduled date of effluent guideline promulgation (i.e., 1980-81). Permits set to expire after that time must provide for compliance with 1984 treatment requirements. Comments must be received by the EPA on or before 6/22/78.
