Marketing cooperatives allow small independent gas producers to capitalize better on spot direct or special marketing arrangements. By pooling their production and reserves a co-op would come to the bargaining table with more clout and some tax advantages. Co-ops would be organized as a corporation under state law, but would not be subject to the federal double taxation provided the earnings are distributed through the owners or patrons as a patronage dividend. Legal opinions differ on whether forming cooperatives would violate anti-trust laws.
