Disclosure requirements: Disclosures, notifications and release reporting requirements
Federal and state statutes and their implementing regulations impose seemingly innumerable disclosure and notification upon persons who conduct ``industrial activities``. These statutes and regulations impose requirements ranging from notifying agencies before conducting an industrial activity, to disclosure of disposal activities which occurred decades ago. The requirements are confusing, complex and scattered such that even the most experienced environmental professional can be bewildered. This paper sets forth the more significant disclosure, notification and release reporting requirements under federal and Texas statutes and regulations. This is written from the perspective of an owner or operator of property on which an industrial activity is being or has been conducted. This paper does not include requirements for those engaged in the commercial treatment, storage, or disposal of wastes, nor does it contain requirements for transporters.
