Title: To elect or not to early elect - one utility`s answer

On March 22, 1994, the U.S. Environmental Protection Agency published final rules establishing nitrogen oxides (NO{sub x}) emission limitations for two categories of Phase I coal-fired utility boilers: dry bottom, wall-fired boilers and tangentially-fired boilers. These two types of boilers are called Group 1 boilers. On November 29, 1994, the United States Court of Appeals for the District of Columbia Circuit vacated these rules. The vacated rules contained provisions allowing Phase II sources with Group 1 boilers to elect to comply with the Phase I limitations by calendar year 1997. Utilities choosing this option would be exempt from compliance with any revisions in NO{sub x} limits until January 1, 2008. This includes the Phase II limitations scheduled for promulgation by January 1, 1997. These limitations may be more stringent than the recently published Phase I standards. Based on provisions of the March rules, Arizona Electric Power Cooperative, Inc., (AEPCO) as a Phase II, Group 1, utility, initiated analysis of the early election option. Targeted for review during analysis of the early election option. Targeted for review during analysis are: (1) applicability to unit boilers; (2) historic emission data; (3) compliance with Phase II standards; and (5) expected fuel sources and operating scenarios during the affected period. Assigned to review of these items is an in-house task force comprised of key decision-makers in the company. Each task force member is assigned to a portion of the review based on their area of expertise and responsibility. To date, items 1, 2, and 4 have received attention by the task force. Due to vacatur of the Phase I rules in November, 1994, AEPCO has extended the analysis period for items 3 and 5.
